on cameras that are in and around that area. so there is obviously a reason they focused on this car and they say it is so importants, i believe them, this is something they are looking into. between hours of 3 a.m. and 5 a.m. in a college town on a sunday morning, it is going to be a virtual ghost town. if that vehicle is there and moved, it most likely got picked up on some kind of camera and that point they are now able to focus for the first time really, focus on something that could lead them forward. >> carley: are you reading into the statement from police about the car that it is the killer's car and does that mean this is a break in the case? >> well, i mean if police are saying that, then they must have a reason to be saying that and if they have a reason to be saying that, then the public

should be very aware. this is something not only moscow should be aware of, but surrounding areas, six, eight, 10 hours away should be aware and people who left school and didn't come back that may know other people, take into consideration what they drive, because if they left and drove 15 hours away and that car is there and somebody can remember that, that is something they should try to recollect. >> carley: the worry is this will be a cold case and never be solved, is it too early to say that? >> i think it is. i have to say that the amount of pressure put on this police department by some of the families and i know families are grieving at times like this, but it has become ridiculous to point they have unrealistic

expectations and to go on television and bash police to the point where the police are doing press conferences just to respond to that family has caused a lot of pain and angst in law enforcement to get done quicker and you don't want law enforcement doing things quicker than they need to have gotten them done, they need time to do these things. i've never seen this before, i think this is modern era type issue, where a family can go to media and force a police department to move faster, and i just think it is really the police have to have time to go through the evidence, to go through the people, clear the people who need to be cleared and keep working the case diligently. >> carley: the family and police, everybody involved, everybody on the sideline, the media, everybody wants the same

process, a very lengthy process, in the meantime, i was disciplined for not attending a meeting when i was told not to come and i was disciplined for stating i would not wear a mask while i was teaching and ultimately disciplined for trying to meet with my students in zoom when the university cancelled by classes when they could not find a substitute. i tried to put my students first and i was disciplined for it. >> carley: tell us about the lawsuit, what is your argument and where does the lawsuit stand right now? >> well, the trial court has said that we have dismissed it for lack of standing, so we are going to the appellate court and i'm glad to see the article that has come out, i think it refers to something rather obvious, people should compare the risk

a tremendous loss for our organization and our nation. our prayers are with his family and co-workers during this difficult time and, guys, the biden administration also filed an appeal against a ruling that blocks the title 42 protocol which allows the government to remove migrants because of health concerns. now, title 42 is lifted, as many as 2500 additional migrants could cross the southern border every day. carley, todd? >> todd: brooke, thank you, let's remember that border patrol agent was a dad, two kids also a husband. >> absolutely. >> todd: think about that. that guy didn't have to die but for the biden administration policies. thank you. >> carley: brooke, thank you so much. with that let's bring in brian hughes, chairman of the committee on state affairs. good morning, sir, thank you for joining us. what is your reaction to the death of this border patrol agent and he did die just a few hours after the president said that there are more important things than the southern border. he died defending the border and protecting it.

>> it's tragic. this should not be a republican or democratic issue. this is an american issue. this is about human suffering. and death, as you just described. it's just unspeakable how this administration is refusing to do anything about the crisis. our border patrol officers are brave. they are in danger. they are not getting support from the administration. they are getting help from texas. they are backed up now by texas law enforcement. our department of public safety. our state police, our game warns, the texas guard. billions of dollars and thousands of officers, boots on the ground, equipment we're deploying because the federal government will not do its job. if they won't, texas will. >> carley: things are so bad at the southern border that kevin mccarthy, he was recently just visiting the border. he told us several times about a woman that he saw brutally murdered by mexican cartel members. and he says that the situation down there is so bad that he thinks that special ops should come in. get the navy seals to defend the border. do you think that he is on to

something there? >> i absolutely believe he did. governor abbott with our texas guard, just deployed more military style vehicles that used to be controversial. this is such a drivers. you also know that we just had the largest seizure of liquid fentanyl in history. fentanyl, a drug that americans are just hearing about, enough fentanyl in this seizure to kill 5 million people. texas law enforcement, border patrol made that seizure. the drugs, the human trafficking, it's just beyond belief. and something has to be done. and, in texas, we are spending buildings of texas tax paying dollars and putting our law enforcement, our texas military forces on the border. defenderring the border for the rest of the country because the biden administration will not do it. >> todd: you mentioned fentanyl. they shouldn't just be hearing about it. we have been talking about fentanyl on this very show, on this very network for years now. are the fact that mainstream media is just catching on is an abomination.
