2:00 am
>> todd: a fox news alert, we are awaiting the arrival of wnba star brittney griner brittney griner, who is set to land any moment now. president biden brokered a deal with russia to hand offer victor boothe in exchange for brittney griner. i'm todd piro. >> carley: i'm carley shimkus. victor boot arriving back in
2:01 am
russia, the merchant of death, convicted in 2011 and found guilty to kill americans and providing aid to terrorists, accused of supporting armed conflict, selling weapons to the killing of american citizens. >> todd: a lot of unknown and outrage as retired marine paul whelan remains in cap captivity. >> griff: celebration and seering criticism, especially here in washington following the u.s.-russia prisoner swauch to bring home a professional women's basketball player in exchange for one of the world's most incredibly dangerous arms dealers while leaving behind former marine, paul whelan, who has been in custody several years. brittney griner had been
2:02 am
imprisoned and tried on drug possession charges. the deal will send back viktor bout, he has provided weapons and drugs. he has been a sanctioned buster agreeing to sell weapons to kill u.s. troops and had been sentenced to 25 years in prison. the former marine paul whelan became a corporate security agent, arrested, accused of spying in 2018 and been in russian custody ever since. the white house claims the deal was the only deal they could manage, which was one prisoner for one prisoner swap, however they didn't explain how they arrived to swap basketball player for armed dealer while
2:03 am
leaving behind a marine. >> in this prisoner swap, why did russia get such a better deal? >> our choices was britney or no one at all, one american or no american at all. >> a professional athlete, we gave up a prolific arms dealer convicted of trying to kill americans, called the merchant of death. >> the american athlete is an american citizen. >> kevin: quite the exchange at the white house press briefing. as far as mr. wheel, the news of brittney griner's release came as a shock. >> i am greatly disappointed more has not been done to get my release. i was arrested for a crime that never occurred. i'm happy britney is going home, and trevor did, i don't understand why i'm sitting here, my bags are packed, i just need
2:04 am
an airplane to come get me. >> you can almost hear the desperation right there. the white house insists it was not a choice of which american to bring home, rather a choice of one or none, which critics wonder at what cost. >> carley: kevin corke live for us there. this swap was made yesterday, viktor bout for brittney griner. she will touchdown in san antonio and be taken to the brook army medical center, she lives in phoenix, she is going to the medical center to debrief her or who require sensitive medical care and the hospital that the u.s. government uses to treat people who have survived torture. i love this video of her on the plane. she looks so young and all
2:05 am
smiles. you can only imagine what she has gone through, she was sent to the worst kind of russian prison. she was taken captive 10 months ago for having hash /* hashis oil in her baggage. >> todd: we cannot ignore the geopolitical ramifications of this and the tweet storm in response coming from unlikely sources. micah parson tweeting, we are still not voting for you, we are not -- no shot at brittney griner, i'm happy she's back home, i just have family who have served and it crazy to me the president wouldn't bring him home, too. i'm furthest thing from a trump supporter, but i'm not a fan of
2:06 am
biden either. that comment from a star football player does highlight the geopolitical problem here. our standing in the world under the biden administration has foughten so far that joe biden does not have the leverage to get a marine home, and has to do this very one-sided swap, somebody who basically did nothing, like you pointed out for somebody called the merchant of death who all experts agree, when he's back out there in russia, he will do things that potentially could kill americans in the futures. >> carley: dan dan crenshaw wrote this is not a simple choose him or her situation, if it was, you choose the guy who serve our country, paul whelan, we need an explanation immediately. it is bittersweet. everybody is happy brittney griner is coming home. over the course of this past 10
2:07 am
monthses, i thought when she wasn't in the news, this poor girl still sitting in a russian prison. think about what paul whelan is going through, there are mark fogel and david barnes, who are in russian cap captivity. yesterday this revelation that viktor bout was the number one guy russia wanted, have we lost leverage in getting those three people home if we gave one for one, the guy putin wants most for brittney griner and there is question of why vladamir putin would want this guy so much when he is as cia director bill burnes said he is total loser, guy that nobody really even understands why putin would want so much unless he knows where all the weapons are and russia is in the war with ukraine right now and could he be able to
2:08 am
facilitate something. he has been in custody for so long, there are still a lot of questions, but it does feel like the world is less safe with him free. >> todd: especially for americans, incentivize kidnapping americans for exchanges. stunning twitter files released last night exposing steps to shadowban conservatives and catching top executives in a lie about it. >> carley: miami mayor anthony suarez wants elon musk to bring twitter headquarters to south florida and he is here next. waiting. sometimes it's just inevitable. but if you're over 50 or live with a chronic condition, untreated covid could be deadly. got covid symptoms? get tested and get treated right away.
2:10 am
2:11 am
2:12 am
>> fox news alert latest batch of twitter files being released overnight, the social media giant was blacklisting tweeting and users blocking them from sharing their views. twitter used shadowbanning to limit tweets from commentators, activists and doctors. bari weiss tweets, in an attempt to limit the plate form. >> todd: jay bhattacharya was placed on blacklist after claiming covid vaccines would
2:13 am
harm children. >> carley: do not flag. >> todd: lives of tiktok so-called ideology put on the trend blacklist making tweets appear less frequently on timelines. >> carley: and dan bongino getting placed on the list. >> all you media clowns and goons and nuts who told me i was the crazy conspiracy theorist tell me we live in a free country, three of the largest social media platforms when an opinion guy like me cannot speak or is restricted from doing so or banned and shadowbanned in theis caof twitter, tell me how this is a free country. you are supposed to protect this stuff, freedom of the press is literally written in the constitution and what do you do? ignore this story the entire
2:14 am
time. >> todd: it wasn't just media shutting it undo, twitter's founder denying it was happening. >> are you censoring people? >> no. twitter shadowbanning prominent republicans, bad, is that true? >> no. >> elon musk is promising to find a solution for shadowbanned users and remains adamant tweeting twitter is working on software update that will show your true account status so you know if you have been shadow banned, the reason why and how to appeal. with that, bring in miami mayor anthony suarez, good morning to you. what do you think about all of this? >> i don't think anybody is really surprised that these things are happening. obviously it is wonderful to see a proof and to know and i think it is important that someone like elon is at the helm, it is
2:15 am
incredibly valuable to have someone like him who is, has done so many amazing things in companies now taking over twitter and exposing things happening and hopefully fixing them, i have no doubt he will. >> carley: elon musk is causing quite the controversy and made himself a target because of this. you have democrats who want to investigate him, there is an investigation in san francisco over him adding sleeping quarters to twitter, as well. so clearly people are afraid of what he has to say and what he might be revealing in the future. where do you think all of this is going? >> well, i think that is true, what you said, i also think it is sort of unamerican. we have elon musk, who is one of the most prominent americans who purchased twitter and simply wants to continue to build this
2:16 am
company in a way that reflects american values. and so he tweeted out a couple days ago the fact that san francisco, the city that the headquarters is in was investigating, investigating headquarters and said, look, come to miami, we're a city that believes in the american experiment and american dream and we would love to have someone like him and have twitter headquarte miami and create high-paying jobs, number one in the nation in tech job growth and doing that at the same time, while converted miami dade from plus 30 democrat county in 2016 to plus 10 republican county in 2022. we have invited your people to miami and it hasn't changed politics for the worse, it changed politics for the better. >> carley: have you heard back from elon musk? i'm sure it would be 28er to run out of miami than san francisco
2:17 am
and get a different talent pool of people that might not be so political. >> it would absolutely be cheaper in terms of cost of living and taxes, changing 17% every employee, cheaper on both those and certainly have access to best talent in the world. certainly not as political as who he has access to in the valley. i agree with you, i'm working every angle possible, doing this interview early in the morning and trying to get the message that miami would welcome twitter with open arms and think it is on brand and think his transparent twitter and making sure people know their status and are not being shadowbanned or censored is on brand with miami, freest city in america. >> carley: great point and we know elon musk is a busy man
2:18 am
right now, doesn't get a lot of sleep, who knows, he may be watching and the appeal could be going from your mouth to his ears. mayor francis suarez, thank you for joining us. >> carley: in boston, they are handing out free crack pipes along with the city's infamous methadone mile. >> todd: a businessowner from the area cannot believe this is a solution to the drug and crime problem, he is here next. in my ozempic® tri-zone, i lowered my a1c, cv risk, and lost some weight. announcer: ozempic® provides powerful a1c reduction. in studies, the majority of people reached an a1c under 7 and maintained it. ozempic® lowers the risk of major cardiovascular events such as stroke, heart attack, or death in adults also with known heart disease. and you may lose weight. adults lost up to 14 pounds.

>> carley: a shocking new development behind the fedex driver accused of murdering a texas girl. the suspect telling authorities he strangled the girl after accidentally hitting her with his van as he was delivering her christmas gift. he claims he panicked before putting her in his van and killing her. the family spoke about the
2:23 am
family's devastating loss, standing with the barbie dolls her daughter will never get a chance to unwrap on christmas day. >> athena was robbed of the opportunity to grow up and this present is one she will never receive. athena's first holiday is christmas, as it is for many children everywhere, the joy athena gave her family and joy she felt on christmas is something we'll never feel with her again. >> carley: unimaginable tragedy, the suspect being held in county jail on capital murder and aggravated kidnapping charges. authorities along the u.s.-canadian border are monitoring for the hyundai elantra that was near the home. authorities believe the occupantses may have critical information about the november 13th killings.
2:24 am
unnamed idaho mayor says the victims' front door was wide open the morning of the murders, according to report. sunday marks one month since the killing. >> todd: boston standing behind decision to hand out meth and crack pipes to stop users from shooting up in the streets. methadone mile. jerry, as a taxpayer, trying to run a business in boston, what do you think when your city uses your money to enable users? >> good morning, good morning. i just hear -- crack pipes and if you look back at what has been going over the last few years with needle disbursements, it is attraction to methadone mile. everybody coming here to get crack pipes, the drugs, the
2:25 am
needles and we need to stop this. >> todd: methadone mile doesn't sound like better homes and gardens, how bad has vandalism gotten? >> last few weeks, between my trucks, the front of my building, i've had my glass broken three or four times, new market pizza been broken into, all of us are suffering. >> todd: doctors are warning fentanyl being consumed on the streets is becoming stronger, making dealing with overdoses more challenging, that begs the question, why do cities like boston choose to give addictses more drugs instead of giving them help? >> we are all shaking our heads and don't know why this is going on, they tried dealing with needles and it doesn't help, it is not helping, i think the city is going down the wrong road,
2:26 am
not taking a step back and actually getting to the root of the problem and i think this is just going to get worse. what is happening is everybody is coming here from all over just to get their crack pipes and drugs, the drug dealers are rampant here right now. >> todd: look how much worse it has gotten with synthetic opioid, deaths are up on the screen. to be clear, boston is making it one-stop shopping for drug addictses and they don't have to try to get drugs issue the city is i think bring the drugs to them. how are people like yourself, law-abiding, tax-paying citizen employing people in the city of boston supposed to view that. >> we're all shaking our heads, i just met with three or four businesses and basically you can see what is going on, over the
2:27 am
last year, the homeless are more disbursed, but the drug and drug dealers are more ramp nota, they break into businesses or steal to get money and can just come to new market to get their drugs. >> todd: think of the perverse incentive structure boston is putting in place, it makes no sense. it is not just boston, san francisco, new york, you name it, blue cities in blue states and it doesn't make a lick of sense. thank you for your time, hope the situation gets better, appreciate it. >> carley: fox news alert, looking live at kelly field in san antonio, texas, where brittney griner is expected to arrive back on u.s. soil any moment now. chad wolf will talk about the controversial exchange with russia's merchant of death to bring griner home.
2:28 am
an unthinkable genocide took the lives of six million jews. and thousands of jewish survivors are still suffering in poverty today. god calls on people who believe in him to act on his word. "comfort ye, comfort my people." especially during this holiday season of hanukkah. when i come here and i sit with lilia i realize what she needs right now is food. these elderly jews are weak and they're sick. they're living on $2 a day

2:31 am
>> carley: elon musk unveiling the blacklist for conservative voices, one silenced was dr. jay bhattacharya, whose tweets were banned after he spoke out against dangers of covid lockdowns. >> it is ridiculous and really hurt public health. if we had an open discussion, being lodowns would have been lifted earlier. twitter by suppressing
2:32 am
scientific discussion harmed science, harmed children and the american public. >> carley: former housing and urban development secretary dr. van carson joins me now. good morning. there are a lot of issues here, one involves dr. jay bhattacharya, he was silenced for speaking out against covid lockdowns saying they could harm children and wound up being right. >> be objective and see how media has been used to manipulate the population, this is a classic example of that happening and we should be alarmed about it and particularly when we look at something like the covid situation, there was so much misinformation passed along, even ramifications from that that are in effect today and affecting people's lives and americans can't just slumber through this and say okay, we're
2:33 am
talking about freedom of speech and freedom of expression, one of the founding pillars of our nation. >> carley: you are right. when it comes to one twitter account silenced, high profile, involving dorsey sign-off approval on limiting tiktok, there are internal documents that show that twitter recognized tiktok was not violating policy, decided it was for greater good because twitter account harms people overall, they made that decision about who to silence and when she complained, the person who runs the account complained, her personal information was put on twitter and they said it did not violate policies, where do you think this is going and how harmful do you think this is? >> i know the people who are
2:34 am
responsible for it are saying we're sorry, we didn't mean it, let's move on to the next topic, that is old news, this is not old news, this is very new news, very important there be consequences for this, this needs to be done, investigated and adjudicated in such a way no one wants to do it again. >> carley: do you think your twitter account was silenced in a lot of conservative voices were. >> we did notice our ability to make raw endroads changed and we don't know why that was, but we were suspicious. >> carley: interesting, there is the hunter biden laptop, dr. carson, when it comes to that, and censoring that story, you have twitter executives saying don't look at us, the fbi was having weekly meetings with twitter and warning of this data
2:35 am
dump coming down in october and had to do with hunter biden. where do you think this really ends and where do you place the blame? is it tiktok? is the fbi? is it both? >> i think there is obviously a lot of culpability to go around. i have to mention that i know people in the fbi who were very decent americans, so we shouldn't paint them with a broad brush, there are people in leadership roles who allowed this to happen and knew what was implications were. looking back historically when the state uses power to -- the people, usually bad things end up happening. >> carley: that is absolutely right. there is 50 senior inteleofficials who sign the all right saying hunter biden laptop was classic disinformation and
2:36 am
biden used that against donald trump calling out the story. bari weiss said we are just getting started, more to come. fda approved new bivalent covid vaccine for babies and are pushing parents to get their kids the latest jab. talking about young children, do you agree with this, how do you feel? should children be vaccinating young children and babies? >> i've been very much against this from the beginning, it doesn't many if it is bivalent, it is just two different parts of the virus, the old virus and the new entities so you give the immune system two chances to fight. why give to children at all when science tells us their chance of
2:37 am
death are 0.025 approach, that is approaching zero and we do not know the long-term implication and there have been recent revelation about complication, why take that chance, we don't need to do that. the virus is becoming -- >> carley: we are getting bringing news, we have to leave it there. >> todd: the associated press reporting the plane carrying brittney griner has just landed at kelly field in san antonio, texas right now. we believe we are looking at the plane that was carrying or is carrying brittney griner. again, not 100% confirmed, but you are looking at kelly field, a plane has just landed, ap reporting that is the plane carrying brittney griner as she
2:38 am
makes her way back to the u.s. after months in russian cap captivity. the breaking news yesterday was brittney griner was exchanged for reputed arms dealer viktor bout, the merchant of death, accused and convicted of plotting, conspiracy to conduct arms transactions that would lead to american deaths, a lot of controversy surrounding this exchange, we believe this is the plane carrying brittney griner, ap reporting she has landed in the u.s. >> carley: her 10-month nightmare is over, sentenced to nine years in prison after she was taken into custody in russia, she was playing basketball over there. taken into custody at a russian airport because she had hashish oil and she was sentenced to nine years for trumped up charges, they were using her and
2:39 am
it was a one-for-one trade biden administration made yesterday officially trading brittney griner for viktor bout, a notorious arms dealer who the former head of the d.e.a. said was one of the most dangerous men in the world. we're grateful to have brittney griner back on u.s. soil. >> todd: no doubt about that, with that, bring in chad wolf. chad, get your reaction to this, are you worried as someone who is in the security space like yourself, are you worried that biden got played here with this exchange in way that will incentivize our enemies in rogue nations to kidnap americans for their own prisoner swaps? >> i think that is certainly the concern here, right? it is wonderful news any time an american comes home, particularly from situations like this. but i think end of the day,
2:40 am
there is u.s. marine there in russia and i guess end of the day, this is high price to pay. you mentioned merchant of death, prolific arms dealer, led to american deaths at the end of the day and the question is, was president biden and this administration strong enough advocating for all u.s. citizens to return from russia? i don't think that is the case here and the rest of the world is looking at this and we have to ask yourself a question, does this embolden our enemies, there are 65 other americans around the worlgd world being held captive and hostage, what does that do to their fate? happy that a u.s. citizen is back on u.s. grounds, but we have to look at other folks that are still out there and what does that say to their fate? >> carley: brittney griner does live in phoenix, she is landing in san antonio to be taken to brooks army medical center,
2:41 am
place where people go to be debriefed and place that handles people who require sensitive medical treatment, people who have been tortured, as well, so with that, what do you think brittney griner has been through over the past 10 months and what does her future look like? >> had it is unimaginable for what she has been through for first 300 days, shea will try to gather and debrief and gather information that she has been through and be reunited with her family pretty quickly. this is a process. i keep going back to all the other americans that are out there. we celebrate brittney griner being here, but i think our
2:42 am
heart and certainly our thoughtses need to go with mr. wheeland others still out there and i think this administration and hopefully they are, are doing everything to bring those americans home, as well. >> todd: former acting secretary of the department of homeland securitying, focusing on viktor bout, how soon before viktor bout is back out there arming our enemyings and risking the homeland american lives? >> i think that is the most concerning thing. he will be free to operate, probably have restrictions in russia, we will lose some visibility and intelligence. his abilitieses have been severely diminished, what the russian government allows him to do is concerning. look at our enemies overseas and what we have to do from intelligent perspective and u w
2:43 am
don't need an individual like mr. bout back out there and doing what he was doing in the past. that is concerning. i'm hopeful, but we'll see that the administration got assurances from the russian government he would not go back to what he was doing before, but i don't know if that could be guaranteed. high price to pay for this type of exchange. >> carley: absolutely and the wheelfamily say they are glad the trade was made, they are sad it didn't include paul. paul's brother said after it was announced it would be one for one without paul, i can't fathom how paul would feel, paul worked hard to survive four years of injustice, his hopes had soared the government was taking concrete steps toward his
2:44 am
release. he had been worrying where he would live, he was thinking about his future when he gets back to the united states and this morning waking up still in a russian prison cell. paul's brother david says the u.s. should take more russians into u.s. custody, there are plenty out there, be more proactive about grabbing a guy putin wants to use that to get paul back. how do you feel about that suggestion? >> well, that goes to strategy of what this administration is trying to do to bring mr. paul whelan back, hope those discussions and negotiations have been underway over the past several months and hopefully over the past several years. i'm hopeful and understand the administration will not talk about the strategy to bring mr. paul whelan and others back to the u.s., all options should be
2:45 am
on the table, this individual has been there four years and i can only imagine the hope he has when he hears news about individuals and exchange being likely, it is past time to bring this american back to the u.s. and hopefully the administration has a very robust plan and action plan to make that happen. >> todd: chad, does our leverage in this negotiation improve if joe biden didn't handle the afghanistan withdrawal so poorly decreasing our standing in the world and decreasing the leverage with which joe biden had to work? >> the answer to that is yes, without a doubt. when you hear the administration talk about they had no choice, given ultimatum, brittney griner or no one, that goes to that question, we shouldn't be given that choice, u.s. should dictate terms and it is kind of unfathomable to americans we're
2:46 am
having putin tell us what the terms of a prisoner exchange are and should be demanding more. there is variety of different ways to go about negotiations and president biden is seen as not as strong as he should be around the world embolden putin, russian government as well as other opponents and adversaries around the world that are also holding americans and what does that say to their fate? others around the world were looking at this and for the most part, people saying, maybe the u.s. did not get the best deal they could. >> carley: if russia got their arms trader back, does this impact the war in ukraine? what do you think zelenskyy is thinking right now? >> well, absolutely, i think president zelenskyy is certainly looking at what this individual has done in ukraine over his
2:47 am
history. i'm not sure it has a measurable impact, that know coflikt is ongoing in a variety of different aspectses and something that the u.s. and this administration is trying to deal with and i don't think they have done that very well manner and so we're going to have to continue to see that unfold and not sure this has direct impact on that, though. >> todd: fascinating morning as we reset for you. a plane believing to be carrying brittney griner, landing at kelly field in san antonio, texas. reported she has arrived on u.s. soil and we believe that is the plane we're looking at right now. chad wolf joining us, chad, we had you hear on other topics. let's continue on talking about this major breaking news story. in the press conference earlier, karine jean-pierre, referenced a lot of woke bingo scorecard
2:48 am
stuff as to why we should be happy that brittney griner is back home. why did the white house choose to politicize that and go that direction when they should be focused on solely two things, celebrating the fact an american is back on u.s. soil and lamenting the fact that paul whelan is not? >> i think it was a major misstep and they will look back and say that was something we shouldn't have done, you have the press secretary talking about misbrittney griner and the lgbtq aspects of what she stands for or her messages, they shouldn't be talking about that from the white house podium. ms. brittney griner was an american and we needed to bring her home tomp say all the other woke aspects of that, leads you to believe that was their priority, on their mind why they needed to bring her back and i hope that is not the case, i
2:49 am
hope that was a misstep and misspeak from the press secretary. it is hard to imagine that was the case, my guess, that was planned remarks and i think the majority of americans shake their head and say that is not important here. what is important, she was a u.s. citizen, should not have been in russian prison for 300 days, good to have her back and we need to bring the other americans back. >> carley: reuters reporting brittney griner is off the plane and she is going to brooks medical center to be -- nightmare has officially ended. yesterday karine jean-pierre was talking to peter doocy about this prisoner exchange and president biden has made it clear he will not be in direct talks with putin any time soon and other ways where prisoner
2:50 am
swaps are negotiated. can you speak at all to the process and what goes into a prisoner swap of this level? >> well, i think there has been reporting about the uae and saudi arabia being involved in this prisoner exchange. what the u.s. will do is go through and other other countries and diplomats to negotiate these type of releases, not sure why the biden administration is not dealing with them directly, that is unusual, particularly for a country like russia. one thing if this is venezuela or cuba, we don't have diplomatic ties with. it is strange in my view to do that with the russian government. but there is a long strategy and diplomatic back and forth on the contour of this negotiation, this has been in the works for
2:51 am
quite sometime to bring her back and they lost leverage when trying not to get mr. paul whelan back, as well >> carley: historic moment when an american wrongfully imprisoned in enemy country and back on american soil. you are looking at the plane that was holding brittney griner at kelly field in san antonio, texas. brittney griner now at a hospital to be evaluated, this whole situation is bittersweet because paul whelan has been left behind, mark fogel, and david barnes. wheelhas spoken out and said his bags are packed and he's ready to come back home and disappointed the united states did not facilitate that for them. the biden administration says they are working and doing
2:52 am
everything to get every american back that deserves to be on u.s. soil. thank you for hopping in and joining us on this important moment and breaking news, we appreciate it. >> thank you. >> todd: also this, tunnel to tower offering a life-changing christmas gift to the family of a connecticut police officer killed in an ambush this year. >> carley: that's right. frank siller is here live on that, don't go anywhere. .
