>> join me at 7:00 p.m. eastern for a coast to coast christmas cook along with the doocy family streaming live on fox nation. >> i will be on the do we call it -- on "outnumbered" in a few hours. watch that at noon. >> see you in st. louis tonight. i will look in the bible with the frosty story. >> dana: good morning. a flight to freedom today. brittney griner landing in san antonio, texas overnight after the prisoner swap with russia. she is back on u.s. soil. other americans, including paul whelan, still sit in russian jail cells. we'll discuss his status with national security council spokesman john kirby next hour. first this hour part two of the twitter files revealing how the social media giant censorship of conservative went far beyond the hunter biden laptop story.
6:01 am
i'm dana perino. bill has the day off. good morning, mike. >> thrilled to be working with you. i'm mike emanuel "america's newsroom." journalist bari weiss posted more last night. secret black listing that made conservative voices disappear across the platform. twitter executives denied the shadow banning. they engaged in visibility filtering. she explains, quote, think about visibility filtering as being a way for us to suppress what people see, the different levels. it is a very powerful tool one employee told us. republican senator tom cotton said his colleagues in the house will dig into it when they take the majority next year. >> progressive left in america no longer believes in the principles of free speech and free inquiry and open debate. they rely instead on censorship and shadow banning and black lists. it is very bad for our democracy. some of these twitter executives
6:02 am
have testified before that these practices didn't occur. the new house republican majority i think has another line of inquiry for oversight hearings in a few weeks. >> roe khanna is standing by and we have griff jenkins with the details. >> we knew another drop was coming. this one has us raising questions today whether twitter executives lied when they claimed under oath they did not shadow ban in the lead-up to the 2020 election which we now know those exelby called it visibility. we learned that conservatives were the targets. she also wrote this. take for exchange jay bhattacharya who said lock downs would hurt children. he was on a black list that prevented his tweets from
6:03 am
trending, or consider the popular talk show host dan bon jeanne who was put on a search black list. conservative activist charlie kirk was made a do not amp plea file status. a secret group of twitter officials called the shots. you see them here. one of those targeted dan bongino said he is grateful to elon musk for the transparency. >> this guy did an enormous service for freedom and free speech around the world and deserves a big pat on the back for that. >> musk says twitter will offer a solution to users being shadow banned and working on a software update that you can determine if you have been shadow banned and what to do about it.
6:04 am
she said matt taibbi will have the next installment of the twitter files. >> fascinating as daylight gets into the twitter files. griff jenkins starting us off this morning. thanks. >> dana: ro khanna was one of the only democrats to sound the alarm about suppressing the hunter biden laptop story. he joins us now. a little bit from what you said to them. you wrote on october 14, 2020, this seems a violation of the first amendment principles to restrict the distribution of that material especially regarding a presidential candidate seems not in keeping of the principles of nyt versus sullivan . i say it as a total biden partisan. it has become more about censorship and became a bigger deal than it would have been. you are a principled person and understand the constitution and tried to warn them. i think they ignored you and now you have the revelation that actually yes it was happening, congressman.
6:05 am
>> dana, it is problematic. look, technically they are private actors but they are a modern public square and should not be engaged in censorship. it is one thing for them to say don't put up sensational pictures of hunter biden. i understand that but to censor the "new york post." they haven't written a positive about me in my six years in congress but never dream of saying shut them down or don't allow them to publish articles. that's the essence of democracy and we need to stand up for the first amendment. >> dana: some out there saying -- before they would say that anybody who thought conservatives were being shadow banned on twitter was being paranoid. now they're saying of course they deamp -- do you think elon musk is doing a good thing by releasing this information? >> i do. i do think we have to have
6:06 am
transparency. there are two conflicting values. on the one hand we shouldn't be censoring people based on viewpoint. what concerns me with the second release of the twitter files it seems some people are being censored because of their beliefs. another thing is to have spiffed i don't think you want these sites to have anti-semitism or racism. my understanding it is going beyond that. not just that they are taking down speech that is hate and elon musk said he wants the take that down. they are censoring based on viewpoint and it is not what we do in this country. >> dana: musk was responding to adam schiff from california saying he was concerned about hate speech and he wrote back saying actually the hate speech is down by 1/3 now prior to his acquisition. i assume they're working at it. we want to get you on record and glad you came out.
6:07 am
you wrote an article about this if you want more information about what you think. quiet behind you in the capitol now. that won't be the case when the republicans take over the majority. they will do some investigations and oversight of the biden administration. how do you expect that to go? >> i think it depends what the republicans want to do. i understand that they will do investigations. we did investigations. we were in the majority. i hope at some point we can have legislation. how do we bring manufacturing back to america? how do we deal with china? and the fact that they are dominating on certain technologies? those are the issues where we can have bipartisan support and what i would like to focus on. >> dana: speaking of bipartisan support there was a bombshell dropped this morning by kyrsten sinema. the senator from arizona. she was a democrat until this morning. she has dropped that. she is going to be an
6:08 am
independent registering that way and caucus with the democrats. maybe not a lot of changes to be expected on that front. however, i did want to ask you traditionally the democrats that are incumbents in the senate support other democratic incumbents. she is up for re-election in 2024. do you expect chuck schumer and the rest of you to support her in her re-election or would you allow for her to be pry married and support a person against her more of a progressive left democrat. >> i think she will face a strong democrat. the place i have the most disagreement with her when she was opposed having wall street and private equity pay a tax on the carried interest. they weren't being taxed the same way as teachers and firefighters and i strongly disagreed with that. i would support a democrat there
6:09 am
but obviously it's a free country and she is an independent and glad she is still caucusing with the democrats. >> maybe she thinks is a representative of how she thinks and helps her in her re-election. we'll see. a long time to go between now and then. have a good weekend. >> thanks for having me. >> fox news giving a close-up look at the out of control migrant crisis on our southern border. our cameras catching troopers making multiple human smuggling busts while embedded with an elite texas dps tax force in the rio grande valley. bill melugin is live in la joya, texas. good morning. >> good morning. that's right. while we were embedded here in the la joya, texas area.

troopers got into a brief pursuit with a human smuggler who bails out in front of somebody's house and illegal immigrants are running all over the place. troopers tackle them and take them into custody and open up the back of the vehicle and find more illegal immigrants in the trunk. several wearing those cartel smuggling wrist bands indicating they have paid a cartel before they crossed illegally into the united states. then you will see the smuggler himself in the yellow jacket who was chased down and arrested by dps troopers, also a mexican national. told troopers he was paid $1 hundred per person to smuggle them. in the back we find two other illegal immigrants laying motionless thinking if they don't move nobody will see them. this happened essentially in somebody's front yard and what people living out here on the border have to deal with day in and day out. minutes later take a look at the second piece of video. another human smuggling bust in the exact same area. troopers arrested this group of illegal immigrants from mexico

smuggler as well. you can see how crammed that man was inside of that truck. horrible image right there. back live it goes to show these human smuggling incidents are happening multiple times a day all over the border. the reason it's happening is once illegal immigrants cross into the united states they don't just sit at the border. they want to get deeper into the country. as you can see from these images a lot of them are willing to take some pretty drastic measures in order to make that happen. the cartels and human smugglers are capitalizing off of that. >> more shocking images from la joya, texas. bill, many thanks. >> i'm glad an american is coming home. she was arrested for a trumped-up charged. to exchange the merchant of death for this? it's made us weaker, it has made putin stronger and americans more vulnerable. >> dana: the likely next speaker of the house raising questions about the prisoner exchange for

let's not forget that. >> dana: congressman let's get your thoughts today especially given that traditionally it has been that if you're in a situation like this you would take the one held the longest. that did not happen here. >> of course we're happy for her family. when you have an american come home it's a great thing for her family. but the concerns are at least two-fold. the first is just the terms of the trade itself. as you point out, we're talking about one of the most dangerous men in the world who is a convicted terrorist, the merchant of death, tried to kill americans. in return for a professional athlete on trumped up drug charges. the reality is putin took a hostage and used it to exert leverage over the united states in the middle of a conflict in europe and we're supporting the other side. the signal it sends more broadly. i'm concerned the signal it sends that it is open season to take american citizens hostage because this is not just an isolated incident. the biden administration also
6:23 am
let a sanctions violator, chinese sanctions violator and huawei official go to get two canadian citizen. it creates a pattern where we're willing to accept a bad deal and send a signal that it's a good idea if you're a rogue regime and want to get leverage over america to take americans hostage. >> dana: paul whelan did an interview that he said he is disappointed but glad that brittney is home. do you think that there is anything that -- else that putin wants that would help us have some leverage in order to get him home? >> of course the main thing putin wants right now is control over ukraine. we should not allow that to happen. we shouldn't give it to him. of course, he sees this as part of a broader chess game here. this is just an individual piece on a broader game. sometimes i worry we're playing geopolitical checkers. we don't have a company hereent strategy and don't understand
