>> out of time. thanks to andrew doyle. i love you america. >> thank you. good evening. thanks you to fox news at night. i'm trace gallagher in los angeles. an breaking ftx founder sam bankman-fried denied bond because he's a flight risk.
9:01 pm
study finds booster mandates for college students not based in science but don't tell that you to the ivy leaguers and lone lines huge crowds risings costs sad faces at the happiest place on earth. join us for a nightcap but we begin with why it might be days even weeks before sam bankman-fried comes back to the u.s. to face charges that could land him in prison for life. the chief correspondent jonathan hunt is live with more. >> good evening trace. one of the biggest frauds in american history, a house of cards built on a foundation of deception, a scheme an artifice to defraud some of the charges against samuel bankman-fried takeover collapse of his cryptocurrency exchange. fbx left court late days in the
9:02 pm
bahamas after being arrested after a request from u.s. authorities. he's facing extradition on charges that include wire fraud and money laundering. the 30-year-old could face decades in principal for essentially profiting off billions of dollars of investors money. >> this case is about fraud. it does not matter the complexity of the investment scheme. >> a house committee hearing into the collapse of ftx was given a written statement from sbf which said in part, quote. the company new ceo said the company led ftx did more just messing up.
9:03 pm
prosecutors pointed out they funneled 10s of millions of dollars to political candidates mainly democrats but some republicans too in an effort to buy influence. >> all of this dirty money was used in service of bankman-fried's desire to buy bipartisan influence and impact the direction of public policy in washington. >> having been denied bail at today's court hearing sbf is tonight being held in the only prison in the bahamas, fox hell, a far cry from the luxury island apartment he was enjoying until his arrest and apparently conditions at fox hill pretty bad might encourage him to agree to extradition. >> strike a deal. we will see you later. legal insight former action of fbi corruption unit an criminal defense attorney brian. welcome you both. thank you wren.
9:04 pm
it's a big crime for one person, right? you have to think there might be other people involved here. i want to put this up on the screen talking about sbf's girlfriend here quoting. what are your thoughts on this wren? >> yeah, trace if you look at the indictments there were speier sigs all over the place and bluflgs we see wire fraud and money laundering securities fraud but conspiracies throughout and even if you look closely at the complaints you see other names of people. in this game anybody that has been the federal criminal justice system knows it's a little bit of a race who is going to cooperate who is going to become state witness here and i would argue that even possibly people may have been cooperating
9:05 pm
with the government even before his arrest and so there's no surprise. if any of these people want to get a deal because they're all going to be facingsi jail time an it sounds like there's a lot of evidence here as well. >> i think you're spot onto something there. brian i look at this and think back to bernie madoff. madoff did lie to his investors. sbf is just going to say i didn't lie. i was the benefactor of bad luck. >> conspiracy requires two people to form an agreement to commit the fraud. why is that important? because the u.s. prosecutors know who the other person is on the four of these counts so i expect further indictments.
9:06 pm
in fact the prosecutor came out an said if you know you were involved in this come to us before we come to you. that's critical. and look. in terms of any defense he's got in this case and he's got to argue that i may have misled investors but i didn't intentionally lie about it because that's require. he has to lie to deceive them and he's going to argue these were 90 mostly private equity groups. these are more intelligent investors and they had their own due diligence to look into the integrity of this investment. that's going to be his defense. >> what do you make of the timing of this defense? we thought he's going to testify before congress an last night there he is in handcuffs not testifying in front of anybody. lee zeldin said this today. >> i don't find it a coincidence he was arrested last night. it did deprive the opportunity of these questions to be asked over the course of these hours
9:07 pm
and if you're trying to put together a case against sam bankman-fried why not let him take the oath today answer the questions for hours and then arrest him? >> and as prosecutors would say look you give him the rope he hangs himself. these guys in there an indict themselves. why not let him? >> i don't draw those conclusions with the timing as much as others might. these cases are very complex. if you listen to the press conference today in the southern district of new york you hear about all the moving pieces an even mention the dea aviation group. i believe this case has been going on for a while. i don't think the timing is really suggestive of anything. they have to get so and things in place to get in front of the grand jury it's not just the snap of a finger. these fact these relationships are going to come out anyway. >> they're going to fight extradition the lawyers for sbf. should they work to fight or sneak a deal in there somewhere? >> trace i think the bigger
9:08 pm
issue is extradition is moved to february 8 because baum is going to investigate whether crime was committed on their turf so they may want to charge him as well. >> you got all that money coming from the ups an bahamas the regulations down there are not that secure brian wren gentlemen thank you both. >> you bet. thanks trace. >> ominous sign for crisis on southern border illegal immigrants loitering in el paso texas because jails are overwhelmed an before title 42 expires in days. kevin is live with this. >> to say things along the southern board err beyond crisis stage is frankly an understatement but so many illegal aliens on u.s. soil and thousands more crossing our border in violation of our laws every day that the border patrol

the witt doesn't seem to have a problem posted by ending title 42. >> we are working to combat misinformation from smugglers and as was the case before title 42 and remained the case after it individuals who attempt to cross the border unlawfully and don't have a legal base toys remain will be subject to removal. >> and of course you recall what the president himself said about the crisis on his latest trip to arizona when asked about visiting the border, why go to a border state an not visit the border? he said because there are more important things going on. more important things and of course asking for money, more money to address the address the issue. that's what critics say the white house continues to do calling it a feckless talking point especially for those fighting on the front lines. >> can you line me an my fellow border patrol agents across the entire southwest border and if we are continuing to let people
9:11 pm
go rewarding them for violating laws they're going to continue to come. >> white house says it's working on the problem but at least so far shown no inclination to leave title 42 in place. >> you look at those people coming across you got to believe something down there is not right. back to you later. thank you kevin. president biden was quick to celebrate an early christmas gift as he touted economic numbers that showed inflation easing more than expected in november although it's still three times higher than pre-pandemic average an consumer prices are sky high. jackie is in just about the most expensive city in the country new york, new york. jackie good evening. >> the white house taking a victory lap as the november consumer price index a key measure of inflation rose 1/10 a percentage point from october. while president biden is celebrating that inflation

9:17 pm
>> absolutely not. >> why does anybody in the united states not do something with our current asylum law? if you just stay don't come to the united states -- >> the truth is you apply for asylum legally like they've been doing it for 200 some odd years. i want to move on to "wall street journal" and inflation "wall street journal" said this because the biden administration is taking a victory lap, yet a 7.1 percent increase in prices still a long way from victory an inflation continues to be sticky across much of the economy. food rose .5 percent, much of the decrease came in energy prices which are volatile an fell by 1.5 percent. jason stuff is just so expensive, you look at these numbers like it's all better and you walk in a store and thinking man we are getting killed. go ahead.
9:18 pm
>> energy prices, look. the administration has no plan to deal with inflation. it's just the hope that maybe next year things will get better but when their energy policy remains the same energy costs will be rain high. that is goods and services in this country will stay high. when they want to spend more money that's the pure definition of inflation, too much money chasing too few goods. the democrats don'ts have a single thing to do to tackle this an it doesn't have to be this way. >> leslie wrap us up. >> it will continue in january when your party takes over. screen shot, i want to see the miracles your party is going to put together in the first quarter of 2023. look. is it the journey or the destination? it is the destination but we have to celebrate with good news more the economy. when there's good news to the
