hundreds of millions of real estate and used company profits to finance political donations. i want to highlight one of the charges. violating campaign finance laws. what sbf and others are accused of is fraudulently donating under other names as a workaround to political contribution limits. that means that figure of $40 million is even larger. >> these contributions were disguised to look like they were coming from wealthy co-conspirators when the contributions were funded by alameda research with stolen customer money. all this dirty money was used in service of bankman-fried's desire to buy bipartisan influence and impact the direction of public policy. >> that sound bite is very, very impactful. tracing all that money will take months maybe even years. they had no records. it is like trying to put together a jigsaw puzzle.
6:04 am
>> bill: he was taking it in ole um b and passing it to column b. >> it was like a piggy bank he was using the money. >> bill: you are still stuck in new york. good during the holidays. jonathan turley is with us now, law professor, fox news contributor. good morning. you wrote a piece today saying it's the first time you recall when a prosecutor moved aggressively to prevent a defendant from testifying against his own self-incrimination. you call it curious. explain. >> well, it's particularly odd timing because he was hours away from doing something that could have effectively sealed the case for the prosecutors. he was going to allow himself to be cross-examined by hostile members of congress for hours on every detail of the case. why wouldn't a prosecutor want him to do that? all of that is admissible. he is allowed to do it. instead, they sort of threw a flag on the play and moved
6:05 am
quickly, charged him, stopped his appearance from occurring. so it was really baffling for a lot of us. but now we are going to have to see where this goes because, you know, the u.s. attorney referred to co-conspirators. when will we see those indictments particularly caroline ellison, the ceo of alameda. they just said alameda basically allowed him to shift money over from ftx to be used for all of these improper purposes. well, obviously ellison was the key figure there. the view is that she might be trying to cooperate. but the prosecutors may have other people in mind. one of the things that the prosecutors look for is a target's most vulnerable point. as a criminal defense attorney i would look at the parents. the father was reportedly paid
6:06 am
by his son, the mother reportedly helped with some of these donations to democratic causes. if they have any grounds for a charge, prosecutors will often press them as a way of getting the son to accept a plea. >> dana: interesting. heck of a family business. wanted the play some reaction from capitol hill because they didn't get to have him testify in front of them yesterday. >> unfortunately the timing of his arrest denies the public the opportunity to get the answers they deserve. >> if you're trying to put together a case against sam bankman-fried why not let him take the oath today, answer the questions for hours, and then arrest him? >> i think there is a lot of questions here about the timing of that arrest. >> all three may be right about that. the curious piece to use your word out of bloomberg today written by bill alison, bankman-fried accused. the first paragraph.
6:07 am
the second biggest democratic donor in the 2022 election cycle is charged with violating campaign finance laws in what could be the biggest infusion of illegal corporate money in u.s. politics in decades. how do you measure that up now, professor? >> well, that's i think the most interesting of these charges. pursuing that final charge on campaign financing could expose a sort of ugly face of the dark money accounts and other efforts to funnel money towards these campaigns. what is fascinating is that he seemed to rush to get millions out the door for the mid-term campaign as his company was collapsing. what was fascinating about the press conference, they were saying in november he was still trying to sort of leverage and wheel and deal as this company was coming crashing down around him. so all of the timing on these
6:08 am
things is really rather odd. that's another question of why the department of justice would work against its own interest to prevent him from giving under oath statements to congress on all of these details. it is going to fuel a lot of the concerns about what is being -- what forces are pushing this case and its timing. >> dana: curious is a good word for it. i could find other words later. >> bill: thank you, we'll talk to you soon. thank you. >> dana: at least three people confirmed dead in louisiana and dozens injured after tornadoes tear through the south. among the deaths sadly a young boy, severe storms causing major damage in oklahoma and texas. fox weather's robert wray is live in louisiana. >> good morning. a very sad situation here in

this parish in louisiana northwest part of the state just south of shreve port and unfortunately a young boy and his mother have died from this possible tornado that hit here yesterday. the boy found outside of his home in a debris field. the mother found at 2:30 a.m. a block away from their home unfortunately just two weeks before christmas. this family going through a lot, as is this community. you see behind me the cato parish sheriff with the roadblock not allowing people into the neighborhood that was destroyed yesterday by this severe weather. we're actually going to be escorted in by sheriff's department after this report and get a firsthand look at exactly the damage. but my goodness, extensive in this small town unfortunately and we know what happened in texas and oklahoma yesterday with six confirmed ef2 tornadoes, multiple injuries.

6:20 am
to do here? republicans are asking, you know, how will we secure the border? i've listed out the ways we've tried to work on that. but we're also wanting to do this on a bipartisan way. republicans know how to work with us. why don't they work with us on this particular issue that is important to americans across the country. >> dana: i'll let you answer her there. >> clear. they don't want to work at all. they destroyed the border. we don't have operational control anymore. 1.5 million fentanyl pills in a week. one crossing from 42 different countries. it didn't used to be this way. what is going to happen one week when title 42 is lifted. all your viewers understand what that means. title 42 simply says when someone enters our country illegally from another nation we send them back to their country. when you do that, it stops illegal immigration from coming. but this administration will not
6:21 am
uphold that. there are projections it would be 13 million more team crossing the border illegally in the next two years under the biden administration. he won't even go and tour the border. he has been in office formore than 40 years and never been it to. how does he understand what's going on? the difference in 20 days on january 3rd, i will move hearings to the border. so these committees in congress and washington won't hold these hearings here, it will be at the border so the democrats can no longer avoid the situation. they've got to learn firsthand what's going on and the american public has to understand what's happening. >> bill: they're looking for $4 billion. they said if you don't work with them you aren't serious about the issue. can you find maybe the word is compromise or some sort of resolution between the two? we understand where you are coming from. we don't quite understand why the white house has allowed it to reach the point that it has.
6:22 am
so hang on. you want to be house speaker. bring the two sides together. how would you do that as speaker? >> the first thing is house speaker i bring the republicans and dream demme congratulations to the border so they understand the problem. i would take the border agents out of being processing agents where they are not even able to be on the border to protect it. so bring processors in there. i would put the policies back in with republicans and democrats remain in mexico. i would work with republicans and democrats to bring back title 42 that you would put people back into their countries so they know not to come here. i would make sure to go directly from republicans and democrats to go directly to china to stop sending the chemicals to the cartels in mexico to kill americans. that can no longer happen. the next thing i would do is make sure border agents have enough help.
6:23 am
now the cartels control the borders. the best thing that could actually happen i would have bill melugin testify. i would help -- fox would give him a one-hour special to let him show the videos that he has where there were tracers, bullets being shot at our national guard from the cartels on our border. i would give the stories of what is happening. you know what? this isn't a republican or democrat issue. today 300 americans are going to die because of what is happening on that border with fentanyl. tomorrow 300 more. you are watching people from 160 different countries coming. you know what else is happening? they're catching people on the terrorist watch list. we all know as americans what happens with a very few that come here that want to have a different way about america. so no, i will work with anyone that wants to do this. but to sit back in the white house and say we're not working with you. they have ignored the problem. they have created the problem and they have played politics with the problem. come january 3rd no longer will we accept that.
6:24 am
we'll bring everyone together and we'll go after to make sure this border is secure and americans are stopped from being killed. >> bill: as you were talking we had a drive drone shot from the border. 200 or 300 people there at day break. >> dana: but you have a good point which is when -- if or when you become speaker. here is recent headlines on your quest. here is what i would say. if you get indicted by the southern district of new york, the u.s. attorney southern district. the chances of you getting convicted are 99.9%. this guy, as i've said on this show, is going to jail. he is going to jail for a long time. because even his sergeant schultz defense i didn't know this was happening. remember sergeant schultz from hogan's heroes, even with that there is negligence involved here. just by the fact he set up this big system without proper controls, thus it was bound to fail and bound to lead to fraud and theft. it was bound to do that. he set it up. he is going to jail. i will say this, i'm not totally surprised they brought the charges now. we've been reporting on fox business that they were looking to bring charges before the end of the year. got two weeks left, i guess, until the end of the year. they were under pressure to bring charges. when the u.s. attorney for the southern district brings a case, it is almost done. i know what he ising to say.
