washington. hey aishah. aishah: hey, griff. and in addition in arlington, they're laying wreaths at 3400 additional locations in all 50 states at sea and abroad. it's an incredibly important day and what i love about these images that we're looking at, griff, right now are all the children that are part of this. parents, mothers and fathers bringing their kids out to really experience this in person and to teach them the value of freedom and how important these fallen heroes are to our country, our future. griff: and those wreaths didn't just show up, they came from maine, the tradition started back in 1992 when the worcester family, decided they had addi additional wreaths where mr. worcester visited. and it went on for years and then an image went viral

showing the wreaths as we're seeing today, laid at the tombstones of so many heroes and everybody is involved and now it's tradition that's very sacred this holiday season, and no better way to honor our fallen heroes. >> absolutely. and we'll continue to talk about this very important moment throughout our newscast. but for now, we've got other big stories to get to, griff. >> you're watching live images of our southern border. title 42 set to expire this wednesday as officials brace for a possible surge in border crossings, in the biden administration, staying tight lipped on their plans to respond. we have fox team coverage with lucas tomlinson, and let's kick things off with bill melugin at border pass. >> good afternoon to you, this

unprecedented crisis has shattered records across the board. here we are now days away from things potentially getting much, much worse when title 42 drops next week. we're already seeing a surge in activity. take a look at the video our drone team shot before sunrise, or just after sunrise of a group that crossed illegally here in eagle pass. we're getting multiple groups every morning here, single adults from cuba, colombia. and most of them not subject to title 42. we're barely seeing any haitians out here like we were last year and that's not the only group. take a look at the second piece of video, this is coming before sunrise and this is a group of 280 that crossed here in eagle pass this morning. this del rio sector has been getting thousands recent weeks more than 115,000 illegal crossings since october 1st. those up 56% over last year. last year set the all-time record for illegal crossings

here in the del rio sector. then we'll take you out to the el paso sector. take a look, two convicted sex offenders arrested by border patrol there, both from guatemala, and both previously charged and convicted of sex crimes in the state of california and both now charged with illegal reentry into the united states. and then lastly, take a look at this photo here. believe it or not, this is from vermont, our northern border, where border agents stopped five mexican nationals who crossed illegally into vermont from canada. and one previously deported two times in 2016, the northern border seeing a surge as well. that vector in vermont are seeing nine times as many illegal crossings in fiscal year 2023 so far as they were the same time last year. and back here live. if and when title 42 does drop on wednesday, dhs is predicting upwards of 15,000 illegal crossings every single day,

just to put that number in perspective for our viewers. remember all the haitians under the bridge in del rio last summer. that was about 15,000 people. imagine that crossing the border every single day. that's a possibility if fight 42 drops. griff: who can forget that image, bim bill. you and i were working together this week putting together the numbers, they have now more than half a million and counting. my question to you, do you see in eagle pass, in the del rio sector anywhere, bill, there is an amping up of resources, a stockpiling of resources or any infrastructure being put in place in advance of wednesday? >> from the state of texas, yes, absolutely. to my right shoulder and to my left shoulder, you can't see it on camera, but they've been bringing in more shipping containers and stacking them in the illegal crossing area and razor wire and flood lights

pointing toward the river. the state of texas, yes, in certain areas where there are illegal crossings, bringing more troopers, more shipping containers to try to do a makeshift border wall, but the kind of numbers that dhs is projecting, the stuff like that is probably not going to slow a surge like that down and that's not addressing other parts of the border when you talk about yuma and el paso, el paso is completely overrun right now. griff: the numbers out of el paso are stunning, quickly, let's go back to our drone shot and i'm not sure if you can tell exactly where that is in the eagle pass area, but you know, it is clock work, every day, nearly every hour, you're seeing the border patrol officials being overwhelmed. >> yeah, they are. and we've talked to several agents who have come up to us since we got out here and they kind of come up to us, you guys ready, buckle up. they know what's happening on

wednesday when title 42 drops, this is something that agents have been talking about for months. it was supposed to drop back in may and pushed back, there are thousands of people in mexico waiting since that day, they're camped out all over the place and they're waiting for tuesday night midnight for that time to come to cross, is border patrol ready? we'll have to find out. >> our appreciation goes to the men and women of the border patrol and the national guard and texas dps trying to deep with this unprecedented problem. great reporting as always, bell melugin live for us in eagle pass. thanks. aishah. aishah: griff, as you said, more and more people are taking notice and talking about it. high profile democrats in fact from california and new york now, joining the g.o.p. in raising the alarm over the crisis at the border. this, as the countdown to the end of title 42 use today turn away migrants by both the trump and biden administrations enters its final days. lucas tomlinson is there with

the latest on the administration's response or preparedness for this. lucas, what are you hearing? >> aishah, last night, a federal appeals court in washington ruled that title 42 will not be extended which not only is supposed to limit the number of migrants intended to cross in the middle of the united states and that's expected wednesday. now, the white house reacting to this statement saying quote, to be clear, the lifting. title 42 public health order does not mean the border is open. anyone who suggests otherwise is doing the work of smugglers, spreading misinformation to make a quick buck off of vulnerable migrants. despite the white house pointing the finger, they're warning of what they say will be a tidal wave of illegal my grants expected to ckcome. >> the border is open and once title 42 goes away i'm told there's more than 50,000 people

counting, waiting for title 42 to go away so they can come in, into the united states. i will tell you next week is going to be very challenging and very chaotic. >> here is texas' attorney general, the following warning about wednesday. >> we've never been given information about a plan and i don't suspect we're going to get one this time and i'm very suspicious of any so-called plan that they have not shared with the border states, obviously, it affects us on a daily basis with 5, 6, 7,000 people a day crossing the border. >> there you have it, the white house says the border is closed. some democrats say the border is open. aishah. aishah: i know that senate democrats were trying to get some answers from dhs secretary alejandro mayorkas, wanted to know what the plan was. the administration, i think, kept telling the press all last week they were going to release more information. are we getting a sense in these final days that we will hear

anything about what replaces title 42 before it ends? >> well, aishah, with president biden in wilmington and no plans to go to the border and nancy pelosi says she's not bringing this up in congress before the end of the session, the administration does not want to deal with the border crisis, so it appears, so it looks like might not hear much before title 42 is not extended. who knows, things can change quickly in this town as you know, aishah. aishah: absolutely, we'll keep watching what happens on pennsylvania avenue and down at the border, thank you, lucas tomlinson at the white house, griff. griff: well, the fbi is responding to the latest dump of twitter files after matt taibbi revealed the agency's constant ties with the giant. and alex, you've done a great job covering this, this is now the sixth drop? >> yeah, it might be the last,

griff. elon musk actually implied this could perhaps be the conclusion at least for now. at one point in the sixth installment, taibbi described the relationship between fbi and twitter giving off one big happy family vibe. early in the thread last night he summed it up like this, twitter's contact with the phish was consistent and pervasive as if it were a subsidiary. and taibbi goes on to describe how in the wake of the election, the fbi created a social media task for known as ftif and at time swelled to 80 agencies who regularly corresponded with twitter executives. he writes between january of 2020, and 2022, there were over 150 e-mails between the fbi and former twitter trust and safety chief roth. and provides examples of lists passed over to the fbi about accounts that should be monitored and twitter replied with actions taken to most of

those accounts and actor billy baldwin was on the original list and it was spared there. and quote, the fbi regularly engages with private sector entities to provide information specific to identified foreign malign influence actors, subversive undeclared or overt activities, and they r-private entities decide what actions they take and before or after the fbi has notified them. and they said they didn't have to take action on those flagged. and just how closely they've monitored the accounts of everyday americans. many of the accounts that were flagged, belong belonged to people who didn't have many followers, and satire and making jokes. you can see the little jokes made, but for some reason the fbi didn't like them and twitter wiped them.

griff: basically, they're saying that twitter is a subsidiary of the fbi, the fbi says even if we tell them what to do, after we tell them, what they do is on them, not. >> they're saying they didn't have to take the actions, but this is constant correspondence, relationships that became casual, friendly at times. twitter wouldn't have a reason to say no, we're not going to follow your lead here. griff: alex hoff, great coverage. aishah: for more on this we're joined by democratic congressman from massachusetts, and member of house transportation and infrastructure committee, jake auchincloss. let's start with these twitter files. we know that the house republicans are going to come in the next session here and hold a bunch of investigations and look into content suppression and say, look, we told you so. we were talking about suppression all along and it was happening. so, where are democrats, like

yourself, going to stand when it comes to this? >> good to be with you. big tech shouldn't have their fingers on the scales of american political discourse, nor should law enforcement agencies and if we bring sunlight into previously confidential conversations, that helps advance that shared value, that's a good thing. if we're going to spend two years with tawdry and irrelevant investigations into people's laptops, then republicans are going to have to explain to the american people how that helps lower costs. aishah: big tech, obviously, going to be big in the next session. congressman, i have to ask you about ftx and the money that you received from ftx owner, founder sam bankman-fried and you've kept that money and haven't returned it. can you tell us why? >> well, i'm not going to

return money to a criminal sitting in jail right now. i'm holding that money to make creditors of ftx whole and awaiting guidance from the department of justice. >> you're not going to donate it like some of your other colleagues, ro khanna has decided to give it back and others to donate it, you're not doing that? >> i'm listening to the department of justice how to best use the money for creditors whole. those who got scammed deserve their money back and i'll do that at the earliest opportunity. aishah: what do you think of the timing of the arrest, raised a lot of eyebrows, before an important hearing you would have been part of as at vice chair. disappointed by that? >> yes, i think the american people deserve to hear sam

bankman-fried testify under oath about his malicious and illegal actions and he needs to be brought to justice for what he did. and it just is another exclamation point that we need strong, clear regulations that crypto industry needs to come into compliance and we need crypto that ensures market integrity and advances the u.s. dollar as the world's reserve currency. aishah: the last quick question and i promise we'll move on. how do you and other lawmakers on the hill prevent this from happening again. people are watching this and thinking, how was this allowed to happen? and then, also, learning that, you know, politicians benefitted from taking donations from this man who is now alleged of serious crimes. how do you look americans in the face and say, look, we're going to hold people like this accountable and we're going to do the job that we were sent to washington to do? how do you make sure that you still have that trust? >> well, because i have pea been saying the same thing

about crypto for two plus years now. which is that people in washington d.c. shouldn't be crypto bulls or crypto bears, they should be referees. and that we should be passing legislation that prevents fraud and abuse, that ensures that markets work efficiently and effectively and make sure that the u.s. dollar remains the world reserve currency. if the ftc needs more funds to do this, if they need clearer laws for digital assets, we should as well. and the next step is stable coin legislation which i've been working to advance because stable coins are being used the world over and we need to ensure that they're audited and disclosed properly so that consumers have trust in what they're transacting with. aishah: do you think that lawmakers like yourself should continue to accept crypto as donations for campaigns? >> i've taken contributions

from thousands of supporters, some who hate crypto, love crypto and some have never heard of crypto, as i've said it needs to assure integrity and advance the u.s. dollar. we have legislation and we need to be working on that. aishah: and finally, your reaction to title 42, it's coming to an end very, very quickly here. look, the white house says they've got this under control. do you believe them? >> we've got 23,000 border patrol agents who are preparing for this, hhs is putting together a plan nobody thinks our immigration system is working right now. fixing it is the hardest problem in politics, and it's going to require three things, it's going to require that we have a secure border that cracks down on human and drug trafficking, it's going to require that we work with countries of origin to stem poverty and crime that's causing immigrants to flee and

require documents and for those living in the u.s. right now. title 42 doesn't do those things. what does those three things republicans and democrats coming together in the senate and with hard compromises. i'm willing to do that and make a tough vote, and haven't heard the g.o.p., certainly under kevin mccarthy, be willing to do that. aishah: i think they don't want to throw money at a problem if they feel like the dhs secretary isn't willing to say that the border is not open. i think there's a little bit of suspicion on that side as to where that money will eventually wind up, but i hear you and i appreciate it. thank you so much, congressman, auchincloss for joining us, for your time and willingness to share your thoughts, we appreciate it. happy holidays. >> good to be on. aishah: griff. griff: aishah, we'll hear from the other side of the aisle next. plus, students at one of the most expensive private schools in new york occupying a campus building and demanding that teachers give all students an

surge when title 42 is set to end on wednesday. and we have the house budgets and national resources committee and serves on the technology and science committee. congressman, thank you for joining us. you've seen the images we've brought to you. bill melugin, our reporter doing great work down there. we've never seen this, but you may have heard in his report, that these agents are worried bracing for what comes next. what do you think about this and what can republicans do in the new year about it? >> well, unfortunately, this just illustrates a problem that we have been passionately talking about for the last couple of years. the absolute lawlessness at our southern border. i've been down to the border several times the last few months, the situation you see on camera doesn't actually do justice to what is actually occurring there. it's a complete disregard for the rule of law. america has always been a

nation of immigrants and we support legal immigration we believe in the rule of law and we cannot permit the lawlessness there. griff: let's talk about what the republicans will do in the house and you heard auchincloss in the last segment that republicans will come to the team and something of immigration deal on the table. your reaction? >> i think that there's room for a comprehensive reform of immigration policy, but both sides have to be able to take those sacred cows that they've so far been unwilling to vote against and also negotiate on them and you know, one of those things for republicans, we absolutely have to reestablish control of our southern border. the last time i was at the texas border, we saw a storage yard in far texas, p-h-a-r-texas with millions and millions of unused border wall construction materials, quarter

mile long, stacks and stacks, 30 feet high. why on earth are we not willing to take physical control southern border. griff: we have high-tech methods that are also unused and that has to come first. griff: we got a statement to fox news about title 42 ending the spokesperson saying look, to be clear, their position lifting of title 42 does not mean the border is open. we've continued to hear from this administration that the border is secure. do you see it that way? >> well, certainly not. and anyone that looks at the aerial shots that you just posted could argue that the border is secure. but we've got actually one ray of hope that occurred yesterday, a judge in federal district court in texas has issued an injunction against

the ending of the remain in mexico policy anthes an opportunity to retake control of the situation as title 42 ends because it says, that's a policy established under president trump, that says that if you're seeking asylum in the united states, you have to remain on the mexican side of the border while your asylum application is processed. reestablishing that would be another way of controlling the situation at least temporarily. griff: i'm getting the administration, if remain in mexico came back, getting the administration to reinforce that, a whole other story. lets me change gears before i rn out of time. earlier this morning, minority leader kevin mccarthy was on fox and friends and had this to say about taking over in january. >> we won the majority, we'll be able to stop biden's authority, and we fired nancy pelosi and get the work going. griff: how can you get the work going, when you can't get the votes to elect him speaker.

what's going on behind the curtain? >> i think a lot of the work has begun. last two years, the republican conference under kevin's leadership has been working on different pillars are policy because what we didn't want to have happen is to take the majority and then be looking at each other wondering what policies we should be promoting. so we've been engaged with stake holders, writing legislation over the last two years and differentos silos and what came out of there. and we will be working with democratic controlled senate and executive branch and that's going to complicate the issue, but we have a clear idea what we want to do. >> it seems that what house g.o.p. members need to do is find unity. we'll see if that indeed happens. congressman, thank you, happy holidays. >> merry christmas. griff: all right. thank you. tomorrow, fox news sunday will air at 8 a.m. due to the world cup. shannon bream will have exclusive interviews with two

maybe i'd be in a whole different career here. the students are not backing down. they're protesting for days and handing over a demand for teachers. this is the private university at the center of this controversy, you can see it called the new school, it's expensive and exclusive and it's over in greenwich village. so the students handed over 16 demands to the staff after their teachers went on a month long strike which they say disrupted their learning. so, that strike was so the teachers could get better benefits and higher pay, but now the guys and students want something in return here. at the top of the list, students want a refund of their tuition, better cafeteria food and say they should all get a's due to the disruption from the teachers. the student body is focused on the grading policy and check it out here and listed out that every student should get a final course grade of "a", and their attendance should not impact the grading scale and they support peaceful free

of money laundering and more, and they're wondering if others in the circle could be next. hey, charles. >> good afternoon, griff. the heat is turning up on sam bankman-fried's inner circle, when you talk about his alleged former girlfriend caroline ellison and bankman-fried's parents. and his parents, both stanford law professors, were entangled ahead of the collapse, that joseph bankman would frequently accompany sam bankman-fried to capitol hill meetings. the parents have not been named in any criminal on civil cases they've brought against their son. the security and exchange commission does allege that bankman-fried used customers

dollars to buy property in the bah ma'am h-- bahamas, not only for himself, but for his parents. >> we're investigating tas well as any other players and we indicated that mr. bankman had been giving advice. >> had he been an employee? >> i don't know if he had an employee status, but certainly receive payments from-- the family did receive payments. >> bankman-fried's former girlfriend has become a centerpiece of that, a former ceo of alameda research, which federal prosecutors say misappropriated funds and had access to $8 billion belonging to ftx customers and money that's allegedly missing. there's a lot of thought or people wondering whether ellison will be charged along with sam bankman-fried or if

she'll cooperate with the feds to take him down. we know that ftx co-ceo tipped off bahamian officials two days before ftx filed bankruptcy saying, hey, there's essentially something funny with the money moved around here. >> we have charles watson following the money for us, charles, thank you very much. >> for more on this wild and whacky story, we're joined now by attorney andrew stoltmann, and let's start with where charles left off as the circle widens as the investigation goes on. he talked about his parents, obviously, that were there in the bahamas with him and then the former girl friend. we could see friends, former employees. how big can this circle go? >> the circle can get really, really big and i think the

noose is beginning to tighten. i think the girlfriend is the key part of the daisy change, she was the head of alameda refunds, they got the funds meaning the customer funds, if she flips and hasn't been charged yet, i think it's game, set and match for ftx. aishah: what about the celebrities we see the pictures up. the celebrity spokes people sued by invests because they were a part of pitching this idea that obviously fell apart very, very quickly. people like tom brady, steph curry there, shaquille o'neal and i've got to tell you, shaq made this comment like, look, i don't understand this. i was just a paid spokesperson for a commercial. and you've got to think of all the other americans watching this, thinking, you know, i don't understand how crypto works either, so, maybe shaq's right. maybe he didn't know what he was doing. could these people get in trouble? >> no, they can't. i think the plaintiffs lawyers who decided to sue them

primarily did it for publicity. these are paid spokes people. they don't have any legal liability unless they knew of the fraud and good luck establishing that steph curry, tom brady, gisele and shaq knew. they'll have to most likely give the money back, so they'll have to disgorge that. >> very good, i'm sure shaq will be happy about that. and the guy was about to testify in front of congress and came in 24 hours in advance and picked him up, at least the bahamian authorities did, but then they hit him with charges. what do you make of how fast the doj put together this case and hit him with these charges? >> don't you find it very suspicious that he was charged literally one day before he was set to testify in front of congress?

>> a lot of people do. >> that's ridiculous. look, if he goes in front of congress and he lies, that's obstruction of justice. that's always the way the fbi and the criminal authorities love getting defendants who they can't get on the underlying charges. let him testify, let him layout the parade of horribles who put what and when. i think the democrats put pressure on him to indict him before he could go out in front of congress, before he could lay it out. who gave what. we know that 37 million came from the democrats, right? you know, have these democrats given that money back yet? it doesn't appear so, very few have. aishah: not all of them-- we just heard from a congressman on this show who is still hanging onto his and watching how to plays out. and let me ask you to get the final thought on, you know, he has done so many interviews, right? and now he's put away for a little while, but what do you make of everything that he's already gone on the record and said about what he did.

>> welcome back. moscow, idaho police are denying that the investigation into the murders of four college students have gone cold. as we learned, new details now about the search for a white hyundai that could be linked to this case. matt finn is live for us on the ground there in idaho with the very latest on this case. matt. >> hi, aishah. this morning marks the end of a chapter in this ongoing investigation because finals ended yesterday. so the semester is now over and it was a semester in which one of the murder victims, kaylee goncalves was supposed to walk the stage and graduate and that did not happen. the campus is clearing out and the only tidbit that moscow police is giving us, to be on the lookout for the 2011-2013 white hyundai elantra they're
