welcome to fox news live. i'm mike emanuel. clock is ticking down to expiration of title 42. fox team coverage with lucas tomlinson standing outside the white house. let's begin with bill melgin in eagle pass, texas, good afternoon, bill. bill: mike, good afternoon to you, el paso democratic mayor indicated that in conversations he had with border patrol, border patrol told him they are unsure if they will be able to handle the incoming surge and federal projections showing city of el paso might be getting 5 and 6,000 illegal immigrants once title 42 pass. take a look at video we shot earlier this morning as the activity is constant. another group of more than 300 migrants who crossed illegally in the chilly early morning temperatures. that is why you can see border patrol having to hand out space blankets.

it doesn't matter how much money the congress will give to the white house. fund asking funding two more years of failed approach. unless significant policy changes are tied to that funding, i believe that fund asking not going to make any difference because they are not going to change their strategy and it's a failed strategy and that's why we see the numbers increasing every single month. >> el paso mayor is a democrat declaring state of emergency, can you blame him and does that get anybody's attention here in the democratic side of the aisle? chad: likely not to get a lot of attention but the mayor can't ignore reality anymore. this should have been done months ago. el paso has been a state of emergency. if you look at the apprehensions and that sector alone, what he is looking at title 42 on wednesday and i cannot declare the state of emergency any longer. i can't face what's in front of me and so i don't know that it's going to get a lot of attention back here in dc people are

pretty wed today their position here but it's telling you the folks that are on the front lines, down there on the border are now saying, i've had enough, we are overwhelmed and if these numbers and projections become true where it goes from 8,000 a day to upwards to 10 or 12 or even 14,000, then cities like el paso and mcallen and del rio are going to be overwhelmed beyond a capacity. mike: for the view from the white house, let's play the clip from karine jean-pierre and i will get you to react. >> what americans should know is that the president has done -- has done the work to deal with what we are seeing at the border since day one, to fix the gutted system that was -- that has been around for some time but certainly was gutted by the last administration. but what we are seeing is republicans continue to move forward with political stunts. so the president has done the work. mike: the president has done the work, do you buy that? chad, no i don't buy that and i don't think any reasonable american or anyone on capitol

hill or anyone else buys that. i would ask the question what, point to one thing that you have done over the last 23 months that has tried to end the crisis and make it better. i think what we do know they tore down a number of successful policies as they came into office 23 months ago. they put nothing in its place. we talk a lot about title 42 ending, yes, that's bad but only bad in the context of this administration had 23 months to plan for this, they had 23 months to put together a number of plans and policies that would take title 42's place. they've done none of that and so it's bad title 42 -- but it's only bad because the biden administration refuses to actually take an enforcement posture to send a signal to the cartel and the traffickers that, you know, this is going to be a new sheriff in town. we are not going to have the same-ole policies as the last 23 months. but i think what we all know is this is what they planned on since day one and we are seeing that unfortunately. we are probably going to see that into 2023. mike: the new york city mayor is sounding the alarm, let's play

that. >> this is a national problem and a national government has a responsibility. we should not be paying for this and we need help from washington, d.c. mike: if mayor eric adams is alarmed what about border state governors and border city mayor? chad: i think the mayor is right. this is a national problem, the national government and the federal government needs to do its job to bring the crisis to an end. if he's looking for additional resources to help new york, i would say get in line because the people along texas and new mexico, arizona and california have been on this for 23 months and, yes, you may see a couple hundred in new york city, they see thousands every single day, so, yes, the administration needs to step up but resources alone are not going to solve this. surging individuals to the border to process more and more migrants, building soft-sided facilities, none of this is solving the manage, it's just managing the problem. the administration needs to get serious and put together policies that are going to solve

mike: crypto king sam bankman fried reportedly to give up extradition fight tomorrow and return to the united states to face criminal charges. jonathan has the latest on this rapidly developing story. good afternoon, jonathan. >> hi, there, mike. bahamian official saying sam bankman fried is holding out hold he will have bail in bahamas. he likely will stop fighting extradition back to the u.s. according to routers, if this is the case, he would reverse his division to fight extradition in a hearing on monday. if he agrees to return to the u.s., he would appear in federal court to face wire fraud, money laundering and campaign finance charges. federal prosecutors have been contacting democratic and republican campaigns about donations they both received from the ftx crypto currency

exchange founder. the vast majority of contributions, though, went to democrats and in this last midterm cycle he was the second biggest individual donor to democratic campaigns surpassed only by billionaire george soros. some of the recipients of the donations have vowed to give the money to charity or set it aside until they receive further legal guidance. bankman fried arrest in the bahamas came just before he was schedule today testify in the u.s. under oath before a house committee. >> if he wants to wave extradition, he can do that. another where i think that will the government would not have to have gone through had they just let him come here to testify. we will eventually get him here. >> it's unclear why the apparent change of heart although we are told that the facility that he's being held in the bahamas, fox hill in recent months, it's been described as overcrowded, very primitive conditions although

bahamian officials have been trying to address those concerns. mike: jonathan reporting live, thanks so much. kristin, democratic strategist and former blue dog communications director, welcome to both of you. so on the ftx disaster, we've got celebrity endorsers, you tom brady and giselle, steph curry, shaquille o'neal, are they in jeopardy at all, kristin and your thoughts on ftx? >> i think they need to be careful about what they are doing. i know platforms like twitter had put some safeguards in place where you have to say who is paying you to endorse and all those types of things. i think on the donations, you know, he gave to both sides of the aisle and, you mow, most of the people if not all of them have said that they are waiting to see legally what they need to

do, whether they give the money back, however they need to deal wit. we have all worked on political campaigns and you get donations and sometimes this happens, that's why the investigation isn't on them. it's to the company. mike: congress want today hear from sam bankman fried. he was arrested the night before, your thoughts on that and what she said? >> this was not a proportionate response. it was 40 million to democrats and $200,000 to republicans and i think a big part of the reason that sam bankman fried has taken less seriously because of the breakdown. $5 million to the biden campaign in 2020. this is not a guy writing $200 in the basement. second largest donor in the entire cycle. he bought and paid for congressmen on the democratic said. he's overwhelmingly a democratic donor and from the beginning, from the wild media tour he did, everyone was kind of not taking him seriously because this guy who takes naps in hammocks and

doesn't put a suit on, huge player in politics and now that's why the walls are closing in hard and fast. mike: he gives up extradition, comes back to the u.s., good news? >> i mean, i would like to see him come back in the united states and be tried here. he's committed some egregious acts. mike: your thoughts? >> he defrauded investors of $8 million. this is not a minor thing. again, i remember at the beginning i'm ignoring my lawyers, this is a pretty serious thing and now the tenure needs to reflect that. mike: latest edition coming out dealing with interaction. let's play it. >> well, the fbi had under the cover of saying that they were pursuing foreign maligned influence had really exploded into activities that involve

engaging with mainstream media and social media and really impacting what is the normal debate of democracy. mike: is that interaction at all troubling, kristin? >> i think that the congress will have a really big part role to play in the oversight of twitter. you know, there -- it's been open forum for debate for a long time and there's been very big changes in the last couple of months with elon musk and everybody is trying to deal with it and i think the latest you see with him arbitrarily removing report freers the platform is a real problem. mike: are you surprised by fbi resources, the amount of fbi resources devote ted to social media. >> it's becoming proven that their content was based on political views and that's why you are seeing the uproar around it. look, twitter has gone through a lot of turmoil right now but elon musk didn't become the

richest guy in the planet by accident. he spent $44 million of this things for everyone to communicate as they see fit. mike: adam schiff, let's play it. >> i think we have a real problem right now with social media companies and failure to moderate content and explosion of hate on twitter. the banning of journalists on twitter. mike: kristin, does this lead to action in the new congress? >> i think that's -- that's up to republican oversight too because the republicans are going to be taking over. i think that twitter and a lot of social media companies have developed, you know, enemies on both sides and developed problems on both sides. maybe not for the same reasons but i do think they are going to have to answer for a lot of these things that have been, you know, police officer rating

proliferating. probably not. it's been a lame duk duck. mike: so we have a few seconds left. obviously kevin mccarthy is seeking 218 on the floor to become the next speaker, does he get there? >> i would ask you, it's interesting because you've seen how remarkable speaker pelosi whether you agree with her or not is counting the votes and making sure when she goes into that vote that she's got them. i don't see how you do, how he does, i don't see anybody else. i guess he will pull it out. mike: kevin mccarthy? >> he will get there. there's no paul ryan waiting in the wings like 2015 to come in the last minute. never say never but the amount of money that he raised for candidates over the course of the campaign, the work that went into that, that's going to pay dividends and you can't be beat somebody with nobody and right now there's no viable challenger

america, so while the argentineans are celebrating world cup victory americans are preparing for hosting theirs. mike: very exciting when it gets here trey yingst with the latest, trey, many thanks. federal reserve indicating more interest rate hikes to come in the new year after announcing the seventh consecutive increase earlier this week. it's the fed's latest attempt at cooling r ramped inflation witht tipping economy into a recession. joining me to weigh fox news contributor and capital managing member gary b smith. gary, welcome. >> hi, mike, how are you? mike: thrilled to have you. let's start with interest rates, highest they're been in more than 15 years. you are the chart man, how do you assess that and the impact on consumers, gary? >> well, i tell you, mike, it's interesting. first of all, i think the fed is going to raise one more time and the reason is ironically

probably at this point not because of inflation but because they made that whole statement about it being transitory, they got egg on their face and, look, t-- the people in the fed are humans and i wish it was done by a computer and they are going to try to correct that and saying oh, my gosh, we are taking inflation seriously. i think they will overreach on the raising rates. i think that's going to put a crimp in the economy but overall i think inflation has cooled. i'm not sure one more hit by the fed is really going to do any more severe damage than they've already done. mike: okay, to holiday inflation, hanukkah start tonight. what about added costs this holiday season, gary? look, they are definitely going to impact the consumer's pocket.

here is what is not talked about, i don't know if it's all-time high but certainly near all-time high is credit card debt. people are stretched during inflationary period to pay for things. i'm not sure people have a lot more buying power, if you will, but here is the good news. over the last ten years we've averaged inflation about .2% a month over the last 5 months it's right back at .2% per month. so what really hit everyone, the sticker shock, if you will, was the 18 months before that. and you know it, you walk into the supermarket and you see the price of eggs and say, oh, my gosh, this is incredible. i think it's cooled off. if people can get through next two or three months, i think we are, you know, going to actually be in good shape. mike: let's hear from the treasury secretary janet yellen and i will get you to respond. >> i think we will see substantial reduction in inflation in the year ahead.

it's going to take a year. >> i believe by the end of next year, you will see much lower inflation. mike: end of next year, what's your advice to consumers, gary? >> i think it would be my outlook also. advice to consumers as it always has been, this is the good news. i started my business career in 1980. i didn't even know there was a recession back then, you know, people are much more informed but on the flip side, they have a lot more choices. so they are going to do exactly beyond -- you say, oh, my gosh, that's outrageous, i'm going buy chicken. we normally shop at public, hey, you know what, let's government wal-mart. thankfully with amazon the choices in retail, people can adapt to inflation. i think yellen is right in this case that once it start to taper off, i mean, look at gas prices have come down, housing prices have come down, there's still

pockets obviously that are going up. i think if people like i said can get through the next six, nine months or so, you're going the say, yeah, prices are still a lot high, pretty high but they haven't gotten much higher and i think the economy is going perk up then. mike: are you expecting a bumpy 2023 in the markets? [laughter] >> you know, when you're a trader like me every day is bumpy. i actually -- i think it's going to be a little less bumpy next year as all these things, you know, the fed is going to kind of go away as a real force. that's what caused the bumpiness, the readlines of inflation, the war with ukraine has taken a backseat headline wise, so i expect -- i'm praying a little smoother 2023. mimike: gary b smith, good to he you, have a good day.

trying to combat that in terms of flexibility which encourages more charitable giving. mike: what can you tell folks at home of your campaign? >> we are the home for donors who cherish liberty, who believe in opportunity for every american and who know that personal responsibility is essential in helping people achieve success in life. so we have a campaign that shows how those values improve lives and we are trying to just highlight the ways that americans are giving to wonder organizations on the ground that embody those values and really changing the trajectory of their lives. we have something called the opportunity playbook on our website that highlights some of the great organizations working in education, working in workforce development through really moving the needle on issues that are -- are facing our country right now. mike: and is it your view that this holiday season is a perfect
