texas is attempting to patch gaps in the border without help from the biden administration. new york city's flaky mayor, eric adams, which way is he going, you never know. just announced public services for citizens of new york city will likely be cut in order to pay for the influx of new illegals. this is a crisis that impacts every corner, every state of our country, every community. the president of the united states can't even be bothered to think about visiting the border. according to one white house advisor, is just too difficult for joe to make the trip. >> why doesn't he go to the border. he was just in arizona. why wasn't it worth his time? speak you have to remember when the president travels, it's not like you are i jumping on an aie only getting often going to our destination. everything comes to a halt. all of these things are in consideration for the president.

8,000, over 8,000 just here, people are waiting to come across the border. these are people that have been told by the smugglers that title 42 is going to end on wednesday. right now chief justice roberts did have a state to uphold title 42. they are to uphold it until tomorrow at 5:00 p.m. when they're going to give the department of justice an opportunity to respond. the biden administration is going to respond as to why we don't need title 42. i can tell you this. federal long enforcement officis are concerned. they are seeing migrant swells coming and not just in brownsville, in mcallen, texas, cross the border in arizona and california as well. they say with the removal of title 42 they expect up to 18,000 people a day.

that's only because of the removal of title 42. they are expecting those swells to come in. i spoke to vice president the national border patrol council here in the rio grande valley, chris cabrera. he said those people coming in right now aren't just people being held back from title 42. these are people who aren't being held back. people from venezuela, cuba, afghanistan, pakistan. i want you to take a listen to what he had to say. >> based on what you seen the last few years, how much of a difference is it going to be to remove title 42? if we are already seeing these numbers, is it just going to be more of the same or far worse? >> it's going to be far worse. we have certain people we can send back under title 42 but there are certain countries that can't be sent back under title 42, and that's what you're seeing now mostly gray venezuelans, nicaraguans, cubans.

mass? the process doesn't change. it's just a bigger mass release of people? >> that's absolutely correct. we are seeing a number of people. they talk about apprehensions of the border. the majority of those apprehensions are released within a day or two. we don't have the facilities here in texas, according to the governor, texas dps, border patrol, immigrations and customs enforcement to hold all the people coming across. what you're saying is correct, they are bringing them in. they are processing them, they can even do full background checks. they are just being released into the united states. before i got on with you, young family walked by me they had a baby and you can see they just come across the border. they were asking for directions to the bus station. they had a child with them. people are sleeping in the streets here in texas. they don't stay in texas. they end up all across the

united states. worst of all before i let you go, the fact that many times the cartels are moving a lot of people, big, large groups and while they are doing that, they are moving fentanyl and other narcotics into the united states and there's nobody there to stop them. this is a very dangerous crisis of our nation. we don't know who's coming in. it's affecting everyone, not just the people crossing the border but our children and the people in the united states as well. >> pete: we spent all those man-hours processing hordes of people, their agents that are not working the line is people with even more nefarious intentions are choosing different routes. hsara carter, thank you. you can't really vet people when you're processing through right away. get this next angle. it's no secret that america's resources are overwhelmed because of this influx where laying out tonight. according to new senate report the biden administration is handing over unaccompanied

minors. remember that phrase under the trump administration? the unaccompanied minors. they are being handed over to adults who have not undergone a background check. you heard that from sara carter. in other words, those kids are vulnerable to being placed in the legal custody, the custody of legal guardians who have a history of child neglect or even registered sex offenders. here with mark, wisconsin senator ron johnson who is on the committee that put out that report. senator, i can't help but remember the political hysteria that was how unaccompanied minors were humbled under the trump administration. now because of this crisis, you're saying it's possible that adults are not vetted enough to know what their criminal history might be yet they get unaccompanied minors? >> they are not being vetted. they've issued a couple executive orders that have relaxed the types of checks that you do on the people,

unaccompanied children are being really -- released two. 300,000 unaccompanied children since the biden administration took office. 225,000 been released to sponsors. we have no idea who they are. we don't track them. when president obama had his crisis, 2,000 people a day. trump had in one month over 4,000 today. under the biden administration it's over 7,000 people a day. they don't call it apprehension anymore. they call encounters. we are probably talking, as you are talking about, 4 million people so far have been encountered, processed, dispersed or come to this country is a known or unknown got-aways. 22 states have a population less than 4 million people. this is completely out of control with the biden administration apparently couldn't care less. they don't call it a problem.

always for mail and balloting as well without voter i.d. i think they've got a game plan and their -- they are carrying out that game plan. >> pete: is there anything republicans on capitol hill can do? the senate remains in the minority. the house will be in slim republican hands. if there's one thing you could do that would actually be effectual at this point, what would it be? >> we have to raise the issue. i was chairman of homeland security committee, we had close to three dozen hearings on some aspect of the border when the crisis was far smaller. we had written a letter to our chairman who completely is and interested. the majority has no interest whatsoever in this crisis on the border but we just need to ramp up pressure, tried to get them mainstream media paying attention. right now it's almost just fox covering it so most americans don't realize a full-blown crisis occurring at the southern border.

that smugglers listen to or is it the policies that the administration is pursuing? >> it's all about actions. smugglers look at the actions and the policies of an administration. they will react based upon what our government is doing. how many agents patrolling the border, the other night when i put on the uniform and patrolled the border, every agent was doing administrative duties including administrative duties. i was doing transport duties. you look, let's talk about facts. if we are only deploying between 40% to 50% of our resources to control the border at the beginning of a shift. by the end of the shift, those numbers drop down to either 30 or 20% that's actually patrolling the border. once title 42 goes away, we are going to have next to no agents patrolling the border. every single one of us are going to be doing administrative duties, processing these people through as quickly as we possibly can just to be released

professor, you heard chad pergram. he said never been done before. talk to me about the implications of what this sham committee has done. >> of course it's never been done before. it's unconstitutional. violates three provisions of the constitution. article once has the power of congress is limited to performing a legislative function. this is not a legislative function. making a referral to congress has nothing to do with legislation. the second is bill of obtained prohibition which has congress doesn't have the power to specify a name people for prosecution. in the spirit of that provision was also violated. the 14th amendment does say congress does have some power. when it comes to the kind of insurrection that led to the civil war but that's a very limited power. this is a very dangerous thing. it's not just irrelevant. the justice department will toss this into the wastebasket after writing apply letter to the

committee. they should rejected and denounced the committee for violating the separation of powers and our system of checks and balances. >> pete: gregg, is that what you think will happen? does it make it more or less likely that third apartment of justice and merrick garland would pursue it. >> this is symbolism at its worst. partisan act by a politically driven committee. i don't think anybody in the department of justice is even going to read it. politicians are not prosecutors. good prosecutors know that they have to prove every essential element of a crime beyond reasonable doubt. legally when you read through these referrals, as i have, they are anemic. for example, obstructing government process because trump worked with others to object to

biden's slate of electors? like democrats did in 2017. 2017, 2005, objecting to republican electors? one of the other referrals is incitement of insurrection. where's the evidence of that? the committee spent 16 months trying to find evidence of that. all they have is trump's beach which is just the opposite which he urges his supporters to protest peacefully, cheer on the allies, let your voices be heard. that's not the standards set by the supreme court for incitement of violence. this isn't just a week. it's farcical. >> pete: professor, do they know that it was unconstitutional from the beginning and it was all a p.r. exercise? it was never really about serious criminal charges.

fbi used your tax dollars to weaponize intelligence and squash the hunter biden laptop story despite the report being true and accurate. as michael shellenberger explains, an organized effort by representatives of the intelligence community aimed at senior execs at news and social media companies to discredit leaked information about hunter biden before and after it was published. translation: the fbi, the federal bureau of investigation, was hell-bent on defeating donald trump and covering for team biden no matter the cost. as shellenberger continues, writing during all of 2020 the fbi and other agencies reportedly primed someone to dismiss reports of hunter biden's laptop is a russian hack and leak confirmation. they did a tabletop exercise about how he should respond when the leak comes out. so-called leak.

inside the fbi, i don't think this is the whole fbi. how can anybody inside the fbi try to interfere an election like this by suppressing information? the fbi's job is to investigate crimes. it is not to put his finger on the scale of american elections for or against anybody. it's not to put its finger on the scale of whether somebody's engaging in quote-unquote disinformation. it's none of the fbi's business. this is extraordinarily worrisome to see that the tentacles, the fbi, elements have extended into twitter. even twitter is starting to resist the fbi in some ways. they were so worried about the fbi's overreaching. this is extraordinary. >> pete: senator, it's exactly right .1. put her execs are saying are we supposed to be doing this but they almost moved them and paid for it. there was a carrot and stick

approach. is this how washington works? is this an outlier? >> i hope it's an outlier. we've heard many times government agencies say we don't have any influence over the private sector at all. how many times have we heard that the testimony? we find that it's not true. i think we are finally seeing that conservatives had been kind of put on the front seat in terms of -- the mainstream media and other groups not getting a fair shake. but people want in this country is for the fbi and the doj and other government entities to call balls and strikes. don't play influencers. don't metal with things you don't have any purview over. there is a breach and a lack of trust that basically contributes to the turmoil we are seeing. we have to get those agencies to do the jobs, do them fairly, to them openly and transparently. i'm glad i praise elon musk for
