way to put it. it is temporary. we will see what happens. maybe as soon as today. good morning to you, steve, rachel, and brian. in his one-page order, the supreme court's chief justice john roberts granted, as you point out, a stay to keep title 42 in place pending further orders. and he asked the government to respond by 5:00 today. that is, of course, just hours before the restrictions are slated to expire at some point tomorrow. you probably know by now that 19 states had asked the high court for an emergency stay that would keep title 42 in place. under then president donald trump. back in march of 2020. and they prevented hundreds of thousands from claiming asylum here in the u.s. in the midst of a raging pandemic; however, despite halting construction on the border wall, fighting the enforcement of title 42 in court, and ending the trump era remain in mexico program, the

biden administration says it needs about $3.5 billion to fight the problem. this is from dhs. they are urging congress to provide the funds that they have requested for border security and management. they add at the end of their statement that president biden proposed this on his first day in office. meanwhile, texas governor greg abbott responding to what we saw from the high court yesterday. he said the halt helps prevent illegal immigration. the white house meanwhile for its part remains on vow. they vow to continue to fight to end those restrictions under title 42. despite the obvious consequences along the border. >> will try spread misinformation to take advantage of these vulnerable migrants. i want to be very clear here, the fact is that the removal of title 42 does not mean the border is open. anyone who suggests otherwise is

simply doing the work of these smugglers, who again, are spreading misinformation and which are -- which is very dangerous. it would be wrong to think that the border is open. it is not open. >> they say if you say the border is open, you are doing the bidding of the smugglers. but critics argue that the numbers tell an obviously different story, which is why we now know that the texas national guard will be deploying to the border in greater numbers. steve, rachel, and b.k. back to you. >> steve: hey, kevin, so the white house is asking congress for $3.5 billion to help with the southern border. if they said we need 3.5 billion to finish the wall or border security, the republicans would be on board with that, right? >> precaiaphasly. in particular, when you consider there was a great deal of material left right there on the ground along the border right when the biden administration assumed power. they feel like, a lot of republicans have said and i have

talked to a couple on capitol hill if you simply do the basics, secure the wall, make sure that's constructed, put more people down along the border and make them wait in mexico and enter through ports of intreerks basic stuff which we have done in the past in our country, they feel like the problem would be a lot less severe right now. >> steve: chaotic. >> indeed. >> steve: thank you for a great report. >> brian: love to get the construction conditions we had the contracts with to pay to have this done what are you doing? i know you got the money already, what is it going to take for you to pick up those bollardens ifs and put them up. >> rachel: we're literally paying them not to build the wall. when i took the ride in the helicopter and saw the rusting wall lei leiing on the floor. right here is a process center that had a wall around it. it was crazy. they had a big, tall fence and the -- but the border wall rusting on the ground. >> brian: in a way i think title

42 is a false sense of security. >> >> rachel: agreed. >> brian: only evidently abiding with title 42 with 7% of the would be apprehensions or people that surrender themselves or dare i say encounters. for the most part going off title 8 to begin with. people come over and say i'm oppressed. we get to stay. don't have the facilities for you get to go. that's how it has been going. keep in mind, barack obama had a crisis. he walls 2,000 a day. trump, for one month, had 4,000 a day. he quickly got that under control. this president has 7,000 a day working towards 8. looking to top off at 15,000 a day, and his answer is going to delaware, not going to the border. and blaming republicans for saying the border is open. hey, pal, jack, the border is wide open thanks to you. >> steve: the mayor of el paso says that there are 20,000 people on the other side of the u.s.-mexican border just massing, waiting for the word.

and they are going to come across. and apparently el paso is setting up what they're referring to as mass sheltering centers with the red cross. they have got at least 10,000 cots. they might use the convention center. they might use the schools. every public building is being considered as a shelter because so many people, i mean, look. that's a facility that is five times over capacity. and the only reason we got this is because congressman gonzalez down in texas actually whipped out his phone and took these pictures because nobody else -- the press is not allowed in there. just one other thing. and that is so the supreme court has given them a temporary reprieve from, you know, this title 42 ending. karine jean-pierre said something interesting yesterday. she said that we'll have more to share tomorrow, meaning today, about what the administration is going to do at the end of title 42. will they come up with something else? >> rachel: they claim they have a plan, steve. we haven't heard that plan yet.

she was also asked if now with all of this happening with title 42, if the president plans to now come to the border to finally see what he has never seen. and she said no. he is focused on getting the resources, you know, the over $3 billion that he wants. but the point is -- it's actually a very honest answer from karine jean-pierre she said no he is not interested in seeing he has opened the border. i'm reading between the lines here. all he wants to do get more tax dollars from all of to you process them more quickly. >> brian: get more soft sided facilities. >> rachel: this is bawl processing them more quickly. can i just note this? when i went to the border on my way back i was in el paso. i went to the airport. seeing images of people laying around, sleeping. >> steve: warm place. >> rachel: but when i went i was in line and noticed all these hispanics carrying folders ahead of me in line when i was about

to get on my jetblue. just like yours. similar to yours. >> steve: travel itinerary. >> rachel: where are you from? most of them in line with me from the dominican republic. how long have you been in the country? they said 24 hours. so i said you crossed and you are on a plane within 24 hours? i speak spanish. i can talk to them they said absolutely. that is the problem they are facing. they want to be able, the biden administration to get them through and on a plane within 24 hours. they don't care how well or poorly vetted they are. but, this influx that you are seeing right now, even before title 42, is causing a bottleneck in that processing -- process, i guess a and that is what biden is concerned about. we need more money in order not to secure the border. in order to process them. >> brian: the other thing is remember all the i.d. we have to go through. background to get a plane ticket. tsa and take your shoes off. these guys flow right through.

we have no idea who they are go. right through and land in a city near you. one of the things the administration is considering is you have to apply to come to our country from the country you are in or the country, the first country you step into. meaning and if you come to the border, illegally, you are -- you immediately are eliminated from coming through. that's very similar to donald trump's policies which he was talking about. we expand the consulates, we bring more workers in. but we do it in an organized way. and i believe the leader of ecuador was with the president yesterday says this guy knows how to do it. really? you finally have a central american leader in, and you don't use that opportunity to talk about if he is being responsible, use him as an example of how to do it and talk about the countries that are not doing it right. and the ones that are. and stop digging in because ev president trump did in your mind was bad. when it turns out you would kill to have his numbers at the

this is a big winter storm we are tracking and all being driven by absolutely frigid artic air that is already beginning to settle across the middle of the country. folks waking up to a feels like temperature in bismarck negative 25 degrees. the start of a real air mass settle across the country next four or five days. this is a future forecast. see overnight temperatures from wednesday night. thursday night. and early friday morning. and, boy, does it get cold. spots down to negative 30, 40. and negative 50 degrees. stretching as far as south as waking up answered feeling like negative 1 degree in dallas. artic cold air is going to be sweeping across a huge portion of the country. dropping down to as low as negative 46 degrees there in billing. one of the spots is going to see some of the coldest air. that is how long it is going to take to get frost bite. see pink colors. five minutes is all the time you have to spend outside. this is a big winter system. one we are going to i paying very close attention to as we get closer to the weekend.

that whatever was on that laptop, was russian disinformation. i want to know who in the intel community said hey, okay. this is going to be -- whatever it is russian intel. >> we don't know yet. it was a necessary narrative to create. we know that the fbi had the hunter biden hard drive. at least as early as 2019 when john paul mac isaac the delaware repairman gave it to them. we also knew that they were independently spying on rudy giuliani for a different investigation and would have had access to his internet cloud. and they would have also been able to get it there because rudy had access to the hard drive. they knew this was a real thing and they must have known that the russia disinformation angle was bogus. they put it out anyway. >> steve: what's interesting, when you read all of them, and that's your job, actually. it's very clear that early on -- it sound like in 2017, the federal government started the foreign influence task force. so they would -- it would be the fbi, the department of homeland security, the office of director

of national intelligence and a bunch of other trump administration officials all would brief the social media company. they were warning, we don't know what it is but something is coming. ultimately started pushing this thing that it was russian disinformation. >> right. what you see is in the months before the post's reporting this effort by the fbi to kind of prime the pump. meeting with twitter every single week and saying you know there is going to be a hack and leak operation. foreign influence operation. got to be on the look for it. going to be about hunter biden. we know hunter biden kept coming up in meetings and we see sort of the story itself published on october 1st is book ended by activity between twitter and the fbi right before the story is published and right after the story is published. >> and in the tranche of documents that were released last night. yesterday, rather, there were 10 documents that were sent to twitter but we don't know what they were. >> we don't know what they were.
