5:00 p.m.enter >> bill: several states asked the court to intervene arguing the dire crisis at the border will escalate further if you lift the policy. tony gonzalez reacting to the order last night. >> it's almost a stay of execution. part of it that frustrates me you have the greatest country on earth that we have to rely on a covid-era policy to enforce our immigration system. it is completely broken. >> dana: fox team coverage, bill melugin is live along the border in eagle pass. let's go to peter doocy live at the white house. i assume they're putting together a reply by 5:00 p.m.? >> the lawyers are working on that, data. if title 42 doesn't have to end right away, the white house will take that. they say this in a statement. as required the title public 42 health order will remain in effect at this time and individuals who attempt to enter the united states unlawfully will continue to be expelled to mexico.

while this stage of our litigation proceeds, we'll continue our preparation to manage the border in a safe, orderly and humane way. joe manchin from west virginia says while i'm pleased by chief justice roberts' order that will divert a disaster temporarily it is not a permanent solution. james comer adds this. >> i give my hats off to the attorneys general doing the right thing doing everything in your ability to try to do what this administration has failed to do, the secure the border with the one tool, the one tool that we have in the tool box title 42 to send people back to where they came from. >> we know the white house says they'll respect the court's order but we don't know what they want the court to do. >> is the administration in some way hoping that the court will intervene and extend title 42 to

help you all out of this situation that is brewing at the border? >> i won't get into any legal determinations or speculations or, you know, get ahead of the process here. >> now they won't say whether or not they want title 42 to go away. different than april when they argued title 42 must go away. >> president biden: we had proposed to eliminate that policy by the end of may. the court has said we can't so far. and what the court says, we are going to do. they could come along and say we cannot do that. >> so at least to this point the president is not putting forward any new immigration policies. he is letting the courts rule on old ones. if there is a post title 42 contingency plan, we haven't heard about it yet. >> dana: no time like the present, right, peter? >> bill: there is new data revealing more than 10,000 migrants were released in el

paso, texas last week alone. large groups of them are camping out at the airport waiting for flights. bill melugin back on the story in eagle pass, texas. hello. >> good morning to you. some pretty astonishing numbers coming out of el paso. the city reporting that over the last two weeks alone, the federal government has released more than 18,000 migrants into their city. now the governor of texas is surging resources there. look at the video fox news shot late yesterday afternoon at el paso airport. several c-130s came in flying 400 texas national guard soldiers to surge texas resources to el paso. the state is doing this because they expect a mass migration event to possibly take place as soon as midnight tonight if title 42 does end up dropping. they've been here in eagle pass. now the national guard is showing up in el paso. we'll show you more of el paso airport yesterday.

a wild video showing large masses of hundreds of migrants camped out and sleeping inside of el paso airport as they are waiting for flights. the airport director says they are letting migrants sleep in the airport if they have a flight within 12 hours. every night there is between 30400 migrants sleeping inside that airport and they're gone in the morning when they fly out. he says they're flying all over the country as mass catch and release remains in effect with this administration. we'll take you out to west texas. look at the images. the extremely remote terrain of the big bend sector. troopers finding and arresting three illegal immigrants from honduras smuggling two pounds of fentanyl pills and 170 pounds of marijuana trying to sneak through the open desert. texas dps says through operation lone star their troopers seized over 354 million doses of

>> the issue here is president biden hasn't recognized it as a crisis and they haven't demonstrated an ability to enforce the law. the first thing that if president biden wants to see all this change, the first thing he needs to do is fire secretary mayokas and all the people advising him on border security. they have no credibility within the united states. no credibility outside the united states. i don't have a personal beef with the secretary but just like if you are running a sports team or business, if your sports team is doing poorly, what happens? you fire the head coach. this has to be a signal that things are going to change. ultimately the administration has to answer why aren't they using title ix to do more expedited removal. it is a fancy way of saying deportation. president obama deported 3 million more people than donald trump. president obama did not use title 42. he had title ix. so all these people coming into the border can be deported using

title ix if they don't have the right travel documents or lied or came into the country illegally, which they are all doing. that's a tool that's already on the shelf, can be used and why this administration is not using that is baffling to me. >> bill: good question there. they are considering the transit ban which i understand would target migrants who cross the border illegally subjecting them to quick deportation. a lot of stuff seems to come under a different name or title as we mentioned title 42. want to take you back three years. democratic primary, then candidate joe biden said this about the border and migrants. >> president biden: i would make sure that there is immediately surge to the border all those people seeing asylum. they deserve to be heard. that's who we are. if you want to flee and fleeing oppression you should come. >> bill: that sets the table in hindsight. >> absolutely. we need to make sure that our

state department has the resources and working and dealing in the local countries where this is being driven. one of the other things that's frustrating about this administration is they've made it harder to get stats on what's really happening. they have changed the way they report numbers. they have changed the terms and in that sense it looks like they are trying to hide what is really going on. the fact that they can't be clear about, you know, the apprehensions, the people that are being caught and released, how many people are being expedited removal. the fact that it's really hard to try to find that information is a sign that they don't recognize or that they understand how big of a problem it is and they don't want to make it easier for us to understand the size and scale of what the problem is right now, because it is a crisis. >> dana: i want to have you listen to karine jean-pierre talk about what republicans are doing. it's interesting to try to flip

it on its head and blame republicans. >> the fact is the removal of title 42 does not mean the border is open. anyone who suggests otherwise is simply doing the work of the smugglers who are spreading misinformation and which are very dangerous. >> dana: why not go after the smugglers instead of going after the republicans? >> absolutely. and again, the executive branch has all the tools they need to deal with this crisis. they are refusing to do that. to your point, dana, the fact that it's hard to get from mexico to el paso, texas. there is infrastructure. the drug cartels are making money because border patrol is tied up on dealing with families and kids and people coming across the border illegally that they can't stop people that are bringing in drugs. all of this is connected. we're not doing enough to dismantle these networks

throughout central and south america. our relationship with mexico, the bilateral relationship is the worst its ever been in recent years. they are a partner we need to use to deal with this. they are even buying equipment from china to put on our border. it is insane. there is a diplomatic piece that this administration is failing on as well, too. it starts at the top and you need to recognize it's a crisis, people need to believe it and your actions need to reflect that. unfortunately we're not seeing it. it is not the republicans' fault in congress, it is clearly the executive branch's responsibility. >> bill: thank you for your time there, will, in texas. some of that video we saw inside the border facility the other day was provided by congressman tony gonzalez who lives in the area. a long time since we've seen any pictures inside. there were women and children and they were stacked on top of one another.

more than five weeks and still not the one that solves this case. although police insist that they are still getting valuable information in and they are making progress in finding that white hyundai elantra, their best lead in this case. the heat is definitely being turned up on moscow police as we speak. the lawyer for one of the victims' families questioned their competence. shannon gray represents the gonzalez family told fox digital yesterday if they aren't capable of handling a quadruple murder and in over their heads acknowledge that and turn the investigation over to someone who is more versed in handling these matters. we know investigators are going to great lengths to find that elantra and who was in it near the house the night of the murders but fox news contributor and long-time criminal defense lawyers say police waited too long to ask for the public's help in locating that car.

the police are saying this case isn'ting cold. they are actually more f.b.i. agents on the case 60 now up from 46 and even though we're just five days away from christmas, the police chief says in a video yesterday finding the killer is their only focus. >> that does not change anything for us. we will continue to push through the holidays. we have a team that will continue to do the investigation and work on that as we move through the holidays. >> dane dana, it has been a long five weeks for him and his department and how much of this investigation he already has turned over to the f.b.i. or idaho state patrol. publicly his department is still the lead in this investigation and taking a lot of criticism right now, dana. >> dana: dan springer in idaho. thank you. >> bill: disgraced and defuncted ftx founder sam bankman-fried

has been ex extradited to the united states. he has been held in the bahamas for a week's time. fox news learned that once he is here on bail, he could be released. but that's a decision for the courts to decide. andy mccarthy, former assistant u.s. attorney fox news contributor, you know the southern district very well where the charges came from. i would assume that's where he goes to be held in a jail here in manhattan. what then, andy? >> well, he will be entitled to a bail hearing. the issue i'm sure will be the risk of flight here. so they will probably, if he gets conditions of bail, there will be very high numbers, i would think. a lot of assurance that he will make his future court appearances. then we're off to the races. these cases can take a long time to get to trial. >> dana: one of the things that i can imagine he was want -- why he was wanting to come to the united states. these are the conditions of a

bahamian jail saying maximum security cells for men measure six feet by ten feet and house up to six people. no mattresses or toilet facilities. they may develop bed sores, sanitation is a general problem and cells infested with rats, maggots and insects. he thought new york would be a better place to spend this. some people think why should he get bail? if he wasn't going to get bail in the bahamas why would we give that to him here? >> because he is an american defendant. regardless of how he would have been treated in the bahamas he is entitled to bail like everyone else. it doesn't mean he automatically gets bail. when he say he should get bail, you know, assuming they can satisfy the court he will make his court appearances. it doesn't mean he is innocent of the charges.

he is presumed innocent and people are entitled to bail. if you can satisfy the court you will make your appearances, people get bail. otherwise he will be in jail for a couple of years as a presumed innocent criminal defendant who hasn't been convicted of anything yet. >> bill: we'll see whether or not there is news on that or before the holiday. a referral by the january 6th committee to the department of justice, several charges against the former president, donald trump. you write this in the "new york post." criminal referral may have helped trump by politicizing the d.o.j.'s decision. here are the charges. obstruction of an official proceeding. conspiracy to defraud the u.s., incite, assist, aid and comfort an insurrection. you are writing the charges are weak and you are writing that the committee could not link trump to the violence of january 6th. explain. >> well, the justice department has prosecuted or charged upwards of 800 people. they have never named trump as

even an unindicted co-conspirator in cases where there was undoubtedly violence that took place at the capitol. the justice department's position, bill, has been that trump at most was a pre-text for violence that was committed by these militia groups inclined to commit that violence anyway. they have had a very different theory at the justice department than at the january 6th committee, which has made political presentations that feature trump as the center of everything. the person that basically directs everything, orders the riot, makes everything happen. that hasn't been the justice department's theory and yet it is basically the headline of what the committee referred to the justice department yesterday. >> dana: andy, what do you think merrick garland, the attorney general, will do? >> i they he has tried to get detachment from this by naming a special counsel.

i don't know if people will buy it at the end because the special counsel reports to the justice department and reports to garland. all prosecutorial authority comes from the executive. the special counsel exercises biden's power. i don't think they can get detachment from it. it is a fraught political decision whether you bring a case or not. i sense that they think, regardless of january 6th, which they would like to make a case on, they have a pretty strong case on the mar-a-lago documents they probably believe they can bring at any point. the issue comes down to not only do you think you have a sufficient amount of evidence but does it serve the public interest to bring a case like this? given the last, you know, two presidential election cycles that we've had where we've had, you know, law enforcement intruded into our politics, that hasn't gone well. interesting. thank you for explaining all

>> good morning, bill. tsa lines are moving pretty good behind me. make no mistake, the snow and bitterly cold temperatures are threatening to put the freeze on holiday travel. not only are forecasters expecting bitterly cold temperatures for most of the country but heavy snow in the midwest that could produce blizzard conditions in places like milwaukee and chicago, preparing for what could be a messy holiday week. united and american airlines are issuing customers' travel waivers, airports across the country get ready for more than 7 million travelers already facing delays. >> we were waiting in line for security check-in. that took about an hour and a half. by the time we got to the plane to the actual gate, they had told us that they closed the gate 15 minutes early. >> stand in this line and stand in that line. we're standing in the line and missed our flight to begin with. >> the holiday travel period

starting off rough for british airways. the airline says a global i.t. glitch affected its long-haul flights leading to long delays overnight. passengers were left waiting at airports for hours including jfk. people tried their best to pass the time at the crowded gates. british airlines says the issue is fixed and apologizes for the delays. meantime drivers buckle up for delays on the roadways, aaa estimates more than millions of holiday travelers will drive this year and many could run into snowy and icy conditions. folks can look forward to spending less at the gas pumps. take a listen. >> we're paying less for gas now than this time last year. they've come down rapidly the past month and a half and putting money back in your pocket. >> as a gift for everyone, spending less at the pump. >> bill: charles, good luck to all of them.

including us. charles watson in atlanta, thank you. dana. >> dana: let's bring in the chief communications officer for united airlines. josh, everybody is ready to travel, to go home to see their families and now the weather might not cooperate and tech. what are you doing at united to make sure people get where they need to go? >> good morning. nice to see you this morning. we're as ready as ever for all of the people who are ready to fly united airlines to get where they are going safe le. we expect we'll fly close to 450,000 people every day. they are counting on united to get them safely to where they want to go. we're as prepared as ever to deliver for them. now, as charles was just talking about it. looks like mother nature is ready to throw us a curveball. a couple of things i would recommend that people who are flying united should do in advance. the first thing people should do, download the united app.

the best way to communicate with us and to get realtime or close to realtime updates from our national operations center in chicago about what is happening on your flight. charles alluded to -- >> bill: i downloaded it over the weekend. it's a good app and keeps current for the flights. i recommend it. aa says this about the travel forecast. 112 million will journey 50 miles or more. i don't know how they know this. that's what we go through every year over the holidays. air travel see an increase 14% over last year and 7 million americans expected to fly. we were in omicron last year and 12 months later, what's the status of that a year later? maybe what does it say about the economic strength below it? >> well look, i think the biggest difference is we aren't seeing the same kind of covid spike we did over the holidays last year. that's going to contribute to a much smoother travel experience for a lot of people than they

had last holiday season. the second is the airlines are better prepared now, too. a broader eco system. tsa staffing better, faa is staffing better and airlines are better planning to have the kind of surplus staff that we need so if we do see an increase in sick calls, that we'll be prepared to handle it. so we are better prepared this year and one of the things i want people to do. go and see if you have a travel waiver. it means we'll give you the option to change your flight to try to avoid bad weather. you can change that flight to avoid bad weather if you're traveling to or from or throw bad weather we can try to help you avoid it. >> dana: is that all done on the app? >> you can do that on the app. it will give you the best options to change if you qualify for a change. the other thing you can do is use the app to chat with an agent to help you make changes. >> dana: if you are somebody who maybe you are an older person,

sometimes i just feel overwhelmed by the technology. can you talk to a person if you need to? >> in fact, we have a new tool that we've just been deploying over the last year and a half agent on demand. people in the airport mostly. we've all seen the long lines at the customer service center where if a flight is canceled and you see everybody on that flight stampede to go and obtain -- we have new technology now. a qr code throughout the airport where you can scan the qr code and it allows you to video chat with a united agent to help you consider your alternatives. >> dana: face time with your grandchildren but with an agent. >> exactly. what we're doing is taking agents who are working in airports that don't have bad weather. our airport agents in los angeles or san francisco, if they aren't helping customers there, threy are logging on and

>> dana: title 42 remains in place for now. city officials across the u.s. are scrambling to deal with the expected influx of migrants should it be allowed to expire. mayor eric adams said the city can't handle more. we're live in new york city with the details. hi, bryan. >> good morning. since spring new york city has received more than 31,000 migrants, many bused from texas. 3600 migrants, families with children, are living in the roe hotel behind me. the largest of four relief centers set up in the heart of manhattan. prime real estate just steps away from times square and the rockefeller christmas tree. the centers were supposed to be temporary. the first stop for migrants before being reunited with

family and move to one of the 60 emergency shelters around the city. the services offered at the hotel which listed rooms for $2 hundred open to travelers have been so good. many migrants have been here since october. they get private rooms, three appropriate warm meals a day. snacks, baby formula available on every floor. free healthcare including vaccinations and enrollment into city schools. but being a sanctuary city is expensive. the city is spending $93,000 a year for every migrant family of four. the city says the migrant crisis will cost at least $596 million this year but could reach a billion. eric adams says the city cannot afford to foot the bill and all city services could face cuts. >> cities should not be carrying the weight of a national problem. this is unfair to all of our cities to have to go through

laugh. he said there is strong support for the president and approval is on the upswing. on election day it was 42.1% approve in the real clear politics average. 54.6% disapproved. today it's 43.3% approve, 52.5. a change of up by 1.2%. that's a big jump, really? okay. spectacular. here is the other thing that gets me. they say look, the election results were a strong vote of confidence in the administration's record on the issues and his proposals and vision. wait a minute, wait a minute. was it a strong support for the administration in ohio where the republican governor swept the entire republican ticket winning by 26 points? was it a strong vote of support in the critical battleground state of florida where the republicans romped to victory? georgia, they won it last time around in the presidential race.

the entire republican ticket with the exception of walker won mightily. the election was not about support for biden. it was about rejecting republican candidates who did not measure up to voters' expectations. look at wisconsin. a u.s. senator, ron johnson, who voted against everything the biden administration proposed and won re-election in the battleground state. if i were planning the president's re-election i would be nervous. nevada barely won biden in 2020. a republican governor gets elected. new hampshire won by biden by 7 1/2 points. the republican governor wins re-election by 57-42. new york, four new members of congress in new york in a deep blue state. was that a vote of confidence in the administration's proposals? arizona where republicans had a nutty candidate for governor and she loses but the republican candidate for state treasurer

first time candidate got a huge victory running thousands of votes ahead in a state by biden won by 3/10 of 1%. i don't think i would be painting a rosie picture that they are painting for the biden administration. >> dana: the other thing they don't mention is the number out of our fox poll. we aren't the only ones with a number like this. how many people want biden to run again? 33%. that's all voters. for democrats it's only 63%. that went up from 51% in july to now 63%, but still, that's a number that might give them pause. do you have a prediction whether biden is for sure running again? >> i don't know. i don't think he will be the nominee of the democratic party because we aren't going to -- they're not going to nominate an 82 already suffering. go back to that poll for a

second. here is where donald is making a big mistake. now before the election half the democrats wanted him to run, today 2/3. only a third of the country wants him to run. let's put the republicans aside. what that means is independents who will decide the 2024 presidential election by an overwhelming majority do not want him to run again. so go ahead and run and it will irritate the independents looking for a generational change in this election and biden will be in trouble as long as the republicans do not nominate a knucklehead. this is why they are misreading the election. independents will settle the presidential election just like they helped settle the 2022 mid-term elections by voting for republicans in ohio and florida and democrats for governor in arizona and pennsylvania. >> bill: very interesting analysis. >> dana: got it all up here. >> bill: he did great. thank you, karl. merry christmas to you.

time ever there is a minority of britts who call themselves christian. okay, of course part of that is immigration, huge immigration from muslim countries. but it is also people now calling themselves totally unaffiliated with any religion. that's very different than saying no, i was raised catholic, christian. that's the next step, right? it is either i am christian or i was christian or i was raised christian and then i'm nothing. that's where we're at now. >> bill: does that come from the home, meaning the family, does it come from peers, meaning friends or does that come from modern day digital technology? >> the second stage come from parents saying we're catholic, we're christian, we are jewish just because we were born that way. that's not motivation. it is like when somebody is a little kid asks his parent why can't i go to do this? and the parent says because i told you so. that's not very motivational.

in order to pass on the faith, i'm as you know a former catholic priest given dispensation by the holy father, a theologian as well. i know this for certain. faith is something that comes from experience, not from just book knowledge. if you don't have that experience of a personal relationship with god, why would you follow something? >> bill: you generate it by going to church with your family at a young age. >> dana: 76% of people would not avoid spending holidays with those they politically disagree with. that seems like progress. >> bill: 21% said no. >> dana: maybe the 21% have a good reason to. >> i'm with dana on this. if you cannot say i am unable to control myself and i will fight with my mother-in-law about politics, you should stay home, okay? that's number one. number two, if you are not sure
