a nativity scene is a common sight as christmas. none like this. violent video shows the pooches at the u.k. dressed up as the figures from the nativity depicting the birth of christ. which one do you like? >> dana: i love them all. good dogs. great to be with you this morning. harris faulkner is next. here she is. >> harris: the u.s. supreme court has hit pause on ending title 42, but it is a fragile situation. now we wait to see what the department of justice will do. but we're being told the trump policy that has helped stem the enormous tide of illegals flowing into america will likely end very shortly. i'm harris faulkner and are you in "the faulkner focus." chief justice john roberts approved that last-ditch effort to save the border protection tool of title 42 keeping people in mexico and deporting some

2 1/2 million over the course. there is now a temporary hold on a lower court's ruling that would allow that trump-era public health restriction to expire in fewer than 24 hours from now. 19 republican-led states are pushing to keep the mandate in place even if it's temporarily. they say the chaos and danger at the border is already too much to handle. el paso, texas's democratic mayor declared a state of emergency in his city now seeing more than 2,000 illegal immigrants per day. more lawmakers from the president's party say something has to give. >> this is a humanitarian crisis. we need to acknowledge that. we need to deal with this. the root causes of migration. >> people are understanding across the world the fact that the southern border is open. >> harris: what do you do when you are the president and your own people call it a crisis? say it's a crisis. despite what we see on the ground. the biden administration is

insisting the border is not open. free to cross into. it claims anyone who says anything different is doing the work of smugglers. as illegal immigrants fan out all over the nation, don't be so sure anyone is keeping track of them. >> operation horizon, the background on this over the summer we had well over 150,000 folks come in. they were issued a piece of paper that said find somebody in ice and that was it. no processing. >> harris: those are the ones we know about. the ones that we try to vet. the ones that at least have come through that we can at least attach some name that they choose to give us to. there are a million others called gotaways. we don't know where they are. national border patrol council vice president in "focus." let's begin with jacque heinrich at the white house. >> the final order on title 42s future could come before it

expires tomorrow at midnight and we've still not been given all the details we were promised last week and yesterday on how the administration plans to manage the coming surge. two really big things that we've got a lot of questions about. but the president has no events on his schedule today. there is no press briefing. the white house has already called a lid. we don't think we'll get those questions answered. the department of homeland security says of this legal back and forth while the stage of litigation proceeds we'll continue in our preparations to manage the border in a safe, orderly and humane way when the public health order lifts. they are pressing forward as if it's going to happen. the white house urged congress to pass this 3 1/2 billion dollar spending bill. painting congressional republicans as the ones standing between a border security and safety. they've been distancing themselves from the push to end

title 42 in the first place. >> there is a court order telling us to lift title 42 and we'll comply because we follow the rule of law. that is what it is a court order. >> started by you guys. >> it was a court order provided to us. >> the president made clear who wanted it back in april. >> president biden: i can give you a straight answer. we had proposed to eliminate that policy by the end of may. >> and when the courts have previously blocked the administration's push, the press secretary said the administration disagrees with the court's ruling. so this current court action means there is a chance that title 42 stays in place either for the short term or indefinitely. the white house, as we said, is moving forward as though this is going to lift. according to them, it is the courts that want to lift title 42 and republicans standing in the way of securing the border. what the president has done on this issue so far has been a

success, even though under the president's leadership illegal crossings have hit all-time highs and anyone who suggests that the border is open is spreading misinformation the smugglers. >> harris: they want to shut us down telling the truth. good work on your part in who wants to get rid of title 42. you had the president on video. thank you. art dell -- first of all, this is temporary more than likely. tell me what it accomplishes any stay in title 42. >> it's very minimum. the problem is, like you said, it is going to be temporary. the facilities are already overrun. this administration took over the numbers jumped from the previous administration being 1,000 a day, the numbers jumped to over 5,000. right now the apprehensions are over 8,000 per day. so everything is stretched thin.

you have agents that have been removed from the lines having to do -- cover positions in processing in the detention facilities. the border is pretty much wide open. there seems to be more consequences for individuals entering the united states right now. they claim some type of asylum and they get released. as you said at the top of the hour, one of the big problems, of course, is the gotaways. what we have right now is numbers of what has been caught, what has been vetted, and what has been released. but god only knows how many people have come through and, you know, we don't know that number. no one knows the number. it is just a guess. or what their intentions would be to come into the united states right now. >> harris: you and i have known each other a number of years and done the job a long time and you know the numbers that you just gave us are going to increase when this goes away. that 8,000 that we pop to now we're looking at 14 or 18,000 is what we're hearing. with all of that knowledge, you say the border is basically

open. how does it register with you when the white house says if you tell people the border is open, you are helping the smugglers, you are against the united states? >> look, right now saying that is ridiculous, a slap in the face to the men and women out there putting their lives on the line and a huge slap in the face to the american public. these individuals are coming into the country and being led by the cartels. cartels know where to send them to bring their products and drugs across. they continue to bring drugs, fentanyl, heroin, methamphetamine. the drug dealers don't care what side of the aisle you are sitting on. they just want to bring drugs into the united states and harm american citizens. at the same time, when they are crossing individuals that don't even pass the vetting system for asylum, those are the individuals with serious criminal backgrounds. they don't care about the american public or what side of the aisle they're sitting on. this administration needs to rea realize it's a problem for every american in this country.

biological boys to compete in girls' high school sports. the court has rejected arguments about four female runners who said they were unfairly forced to race against transgender athletes. the lawsuit was filed after two biological males won several track and field titles due to a policy allowing them to compete in the girls' division. in their ruling the court saying the plaintiffs simply have not been deprived of a chance to be champions. the lawyer for the girls says the court got it wrong. >> our clients deserve the right to compete in competition fairly. it does not happen when you allow biological males to come and dominate women's sports. this is female athletes. the point of title ix was to protect the integrity of women's sports and disappointing the court failed to see that. >> harris: what do we tell our girls? are they not liked?

>> it's -- are they not protected? is feminism dead? this is not an instance of 1 or 2 wins by a biological male over a girl. these two transgender biological males broke 15 state track records and won 17 championships. these were average male runners. they were not going to win state championships or set records. they were average male runners who transitioned, ran against females and deprived those females of the opportunity for victory and championships. possibly for scholarships and public recognition and future employment that emanates. this is discrimination against women and girls. it is judges like this happy to put their hands in front of their face and deny reality, which is every cell of our body, of yours and mine, is either male or female.

hill. >> this is all moving very quickly on capitol hill so we're already expecting the senate to take its first procedural vote today about 2:30 p.m.enter not a lot of time after it was release overnight 12 hours for lawmakers to sift through some 4,000 pages of text on this massive spending. here is a quick look at the biggest headlines that we've been able to find. the bill includes $45 billion in ukraine aid. 40 billion for disaster relief. funding for programs that were authorized by the infrastructure investment and jobs act and the chips act and pact a veterans. electoral reform act and so is senator hawley's tiktok ban on government devices. it will be interesting to see how he votes on this. what is out of this is the safe banking act that would have allowed marijuana businesses access to banking and money for afghan resettlement and the

child tax credit. now gop leader mitch mcconnell is endorsing this spending bill as a big republican win because it includes about $850 billion in defense funding, which does outweigh the $770 billion in domestic spending and says the military spending is a lot more than what the biden administration originally asked for. >> compared to where the negotiators started, we've transferred huge sums of money away from democrats' spending wish lists toward our national defense and armed forces. >> he has to get ten republicans in the senate to go along with this in order to get it to the house. harris. >> harris: that's a lot of our money. can we see it before christmas? >> we could, yes, it could happen. but we're short on time. >> harris: no doubt. aishah, thank you. big backlash hopefully to all that spending. meanwhile there is big backlash

times," which at a time when religious jews are beaten up in the streets of new york they keep coming back again and again to do quote, unquote, expo says on jews. we can understand the outrage. but i have to tell you the truth, i have swastikas and ss symbols in beverly hills. colleges where -- we have real hate crimes we're trying to make sure we have an alliance to actually defeat and also have the full attention of the f.b.i. and social media giants. that's a big struggle. >> harris: you need attention from alameda. -- all media. i'm aware of the violence against communities but also aware of the tick up and how problematic that is not just for our beloved jewish community members but for everybody in america. hate is hate and it does spread

like wildfire. what is the right thing for the times to do. what would you say to the "new york times" about this puzzle? >> i think "the new york times" can make the gesture of putting out an apology. the jewish community, whether it's a media outlet or politicians, words are important, alliances are important. actions are much more important. when "the new york times" questions whether israel is now a democracy that just went through five national elections. and basically it's a woke agenda that has created help i think to fuel some of the new arenas of anti-semitism including con can -- kanye west. for example. we need the social media giants to walk away from the political arena and get back to the area
