emergency in effect. this would danger more americans themselves. kevin corke joins us live in washington with the very latest, kevin, good morning. >> the administration was asking the high court to basically leave and affect the covid era restrictions under title 42 and just a little bit longer not indefinitely. the supreme court the government recognizes that the end of title 42 orders will lead to disruption and temporary increase unlawful border crossings. the white house acknowledges that title 42 will lead to increase in unlawful border crossings, but the truth is that is a gross understatement to say critics who know this has been a devastating and growing crisis unfolding in real time with relatively little help from washington. and now with freezing temperatures looming, el paso

my lifetime. the facts are more people will come when title 42 expires and they will become a more dangerous situation not only for the border communities but for those migrants themselves. i absolutely think the president should visit the border and affect anyone responsible for setting or making policy on the border should come and visit the border. i mean, that is a no-brainer, right? >> todd: a no-brainer but not for this administration and sheriff thank you for being here. this makes the obvious question if acknowledges it needs title 42 for another week to prevent a bigger crisis from happening, why not extend this thing long-term? >> well, it is ludicrous to not extend long term. one of the tools we have to stop this search and of course that is not enough to stop what is going on down there and of course, not to stop the

interior of the united states and states and communities like mine. the victimization is overwhelming. there are resources, and it's not sustainable and never has been. >> carley: that is exactly right. you are 1900 miles away from the southern border. saying that fentanyl is pouring into the community. that is still the case and title 42 does come in fact, go away, what does things look like for your neck of the woods? >> first of all, thank you. viv fentanyl pours in and we have rainbow fentanyl and yesterday we are seizing rainbow fentanyl of course for the young adults and children. and the fact is, we have an administration that doesn't have the courage either the president or the vice president to get off at their chairs and get down to the border and see it firsthand and see the catastrophic effects of their policies and insistent that this border is secure.

it is just a statement and the vice president stands on her platform saying secure. we had problems and republicans who won't help us out. give us something to work with. we are inundated and overwhelmed and our colleagues at the border are taking the brunt of it. the law enforcement across this country, and we are all inundated and dealing with this crisis and yet, this administration fails to do anything except complain and their own ineptness they don't talk about but they need to. >> todd: this fact is chilling. the dea reporting that it sees 379 million potentially deadly doses of fentanyl just this year. you know this just isn't an idaho problem but a problem that affects every single state in our nation. we look at that number $379,000,000.03 to 30 million. we talk about the destruction of the entire u.s. population yet

there is no urgency on the part of this administration to stop this. why? >> i simply cannot comprehend it. i don't understand. that, the numbers you just gave, dealing in the streets one in four are illegal doses and dose after dose. i have an overdose just this week in my jail from fentanyl smuggled in. a woman literally was not breathing and my staff brought her back. this is almost everyday that we are seeing in my facility let alone what is happening in the streets. and to have this administration complicit in these crimes and the victimization. and then, are they complicit in working with china to destroy this country, to evade it and destroy this country and the mexican cartels? i just heard that the president, will meet with the president of mexico and what good will that

do? to control against the on cartels he needs to take a hard stance against the hotels who are literally destroying our country and victimizing migrants coming across and the people and the populace of the united states. >> carley: that is a great point. the president will be in mexico city january 9th and you have to wonder how he will address the fentanyl issue and the border with the mexican president. we will keep a close eye on that meeting. there are also, sheriff, democrat speaking out and kyrsten sinema who declared herself a independent but on capitol hill, saying that the border issue is a crisis. do you think that x sort of pressure with the president's own party might change things? will they give you hope? >> it actually does, carley. that is a great point. and finally, i'm hoping that they are seeing it because they are realizing the devastation of their own communities and what is happening on the border.

and probably from a political standpoint but it does give me a little bit of pause and a little bit of hope that they can help screen the momentum to force this administration to do something on this border. again, it is literally not sustainable. i'm hoping that the democratic party and walk across the aisle and say, book, we have to do something together or we will lose this battle. >> todd: fox news bill melugin tweeting yesterday in the main person covering this person throughout all of media, "the trekkers with the texas department of safety with three illegal immigrants from honduras smuggling 2.40 pounds of fentanyl pills and 172 pounds of marijuana as they snuck through extremely remote root terrain from that sector in texas. one smuggler was only 14 years old. let's focus on that last sentence, sheriff. this is a humanitarian crisis.

this is not just impacting the citizens of the united states, but these young boys and young girls who are being exploited in ways i don't want to talk about it 4:09 on christmas morning. where is the white house on this aspect? the humanitarian aspect? these young girls, young boys being abused? >> and i appreciate your candidness there and conservative approach to that, what we say on the week of christmas. but this is the highest levels and they are being abused, sexually abused, human traffic, exploited and how we as americans cannot pour our hearts out to these people. it's not people that are coming across to cause damage. these are people looking for a better way of life. they are fleeing their own

country because of turmoil and chaos and corruption and criminality, but along the way the cartels are exploiting every single one of them. you do not cross this border without cartel involved. they have to pay a price whether monetary or means or just the abuse and then exploitation of d as a smuggler. how do we not stop and pause and say, oh, my gosh, what are we doing to humanity? where is the humanitarian outcry for these young victims? on both sides of the border and especially migrants coming across? it is incomprehensible. >> carley: it is. you think about national security and securing the border, that is a federal government and a biden administration responsibility from law enforcement perspective. you have to wonder if they understand the gravity of the situation. sheriff donohue, thank you for joining us this morning.

a letter to members of congress searching to be there to vote on proposed $45 billion in an aid package for ukraine that reads in part, "we are entering a special session of 117th congress with legislation to make congress for the american people as well support for democracy. pleased to be present for a special focus on democracy wednesday night. $1.8 million already on the way to ukraine to pay for military equipment which includes patriot military systems and they add to the war-torn country. some republicans have come out against the bill and thomas massie said more sprinting should be carefully considered. we should have a separate vote on funding and most constituents do not want the money sent to ukraine, especially without without oversight. and the president with a joint session of congress later today.

it is only going to dig deeper across the united states. early this morning, temperatures, the winds plus those cold temperatures down into the negative 30s, negative 40s up her tiers of the northern plains peer that will continue to settle down across some of the southern portions of the country. we got windchill advisories in texas as far down as the texas/mexico border deep, deep into the south and the cold air will plunge that direction. the current windchill even down into texas is currently into the 30s but it will get colder than that. we haven't seen windchill warnings and the dangerous cold air for 48 -- this is the future forecast that takes all the way through thursday and friday. you start to see some of those negative 20s and 30s and the central plains, dallas all of a sudden feels like 0 degrees, negative four, chicago negative 34, negative 23 in columbus and cold air across a huge portion

year, we could glaze over the numbers, but in a practical sense, what does that mean for communities across the country? >> well, look, what the administration is doing is they are not detaining ice facilities. you have to understand right now there are thousands of feds contacted by ice sit empty. already paid for, sitting empty while they line the pockets of ngos across the country to take custody of people and finish processing to the final destination. by at rio grande valley come i don't know how many times i took a plane out of rio grande valley back to d.c. i'm sitting on the plane and the plane is not full of illegal a lance, process them, and send them on their way. this is what happened in tennessee. and michio to get new clothes,

that is why you see overcrowding with the border patrol facility. not enough ngos. but believe me, they will find more ngos to get them out of custody quicker. that is the latest story about ice trying to locate these people who are not processed. the border patrol under strict command to process, release as quickly as it can so doesn't appear to be overcrowding because if there is overcrowding, nothing here but it crisis. so they do minimal amount of processing. biographical information, kick them out the door, and more than half of them according to my sources aren't showing up in a i.c.e. office. the feud that do, they get processed if there is time to process them. but jose lopez in dallas taxes, what the hell is i.c.e. going to do with that? they are overwhelmed and have too much to do and they are

being instructed to get them out of custody, get them out of custody. and the whistle-blower recently told me they are processing so quickly that they don't wait for the better thing to come back from the bureau. he was hot on data screen database. an urge to release these people. the border patrol is under great stress. these men and women are doing the best they can. >> carley: we have audio of someone in i.c.e. in a training video talking about how the agency lost track of 150,000 migrants in the summer of 2021. and now i.c.e. agents are trying to figure out who these people are, where they are, and they have little information on all of them. this is a huge issue. listen to this. >> operation horizon in the background, and may be over summer, we had well over 150,000

folks come in. they were issued a piece of paper that said, "you will find somebody in i.c.e." that was pretty much it. there was no processing. >> carley: this is that exactly what we are talking about, border patrol is so overwhelmed they had to give illegal immigrants a piece of paper and say, "go find your nearest i.c.e. agent and quote. of course they will not do that and if so we don't know where these people are or where they are in this country to begin with. >> looked, they will not find 98% of these people. i love i.c.e. and the men and women of i.c.e., they are overwhelmed also so. so these people processed in a piece of paper saying close dallas. i talked to i.c.e. and they are not looking for them and not wasting time looking for them. because they have people showing up to be processed. so we can, border patrol is overwhelmed and i.c.e.

overwhelmed. this border was opened up on purpose. all they have to do is remain in mexico, forget about title 42. they will get shut down and what can the administration do to control the border? reinstate remain in mexico like the trump did and that was a game changer. so we can actually try to secure the border into their job. that would give i.c.e. relief and state prisons. it is they are planned, open borders and not only open borders but making it impossible for i.c.e. remove anybody on asylum which according to court data, 9 out 9 out of 10 will fel asylum case and be ordered removed. but they will not leave because secretary mayorkas said thing in the country illegally -- >> carley: it makes illegal immigration completely legal just another court battle playing out. tom, thank you for joining us.

so we are hoping for the better change for us. we went loretta who said the city maybe doesn't want you to be there but that doesn't make sense. small business and small business owners are the lifeblood of any community. why wouldn't they want you there. >> if our property is being devalued companies can come in and buy up property at a lower rate. and they can do what they want with it. so, we come out they are at their mercy and that's how i feel. >> todd: that is a fascinating theory, jim, how does portland turn this around and do they turn it around? >> first off, the first thing that you do is what do you do with the district attorney the anti-prosecutor. we have district attorney mike schmidt who does not prosecute crime. that is the bottom line. we have police officers that are doing the hard work of trying to capture criminals with half of the size of the police force

they actually need. we need to double the size of the police force just to be average for a city our size. then that group, when they turn around and capture somebody and they turn it over to the district attorney, the district attorney lets them go. doesn't actually prosecute anybody. one of the key things is we need a prosecuting attorney that actually prosecutes crime. that is the bottom line. >> todd: i mean, that seems logical. ten years you would have to say that statement because it was assumed. not anymore, loretta, the people of portland struggling so much, why do they keep voting and far left politicians that are implementing these policies that are hurting them? >> i don't know why. i mean, i really don't know. it is hard on those of us who are business owners. i have no idea. i don't know. i am at a loss for words on it. there are those of us trying to
