>> almost every state is expected to be impacted by the brutal winter storm. more than 200 million americans under warnings or advisories and more than 1.1 million people are without power. subzero temperatures and snow pummelling the midwest. the worst still yet to come for those here on the east coast. >> john: the rapidly intensifying storm making travel a christmas nightmare for many people. more than 4,000 flights canceled today alone. officials warning travelers to stay off the roads as frigid temperatures are likely to turn highways into sheets of ice. >> we have rick on the forecast, and stranding travelers at the airport. but first, max gordon live in new york outside of buffalo, a lot of snow. how are you holding up? >> well, we are pretty chilly

here in hamburg. we are along the shores of a very angry lake erie. wave heights, 14 to 18 feet are expected today. officials had to evacuate a neighborhood nearby us because there are concerns of flooding in the homes there. you can already see this parking lot starting to fill up with lake water. now, we are also, of course, concerned about the snow totals, up to three feet of snow, potentially more. a wind gust of 72 miles per hour measured at buffalo niagara airport, gusts up to 80, 85 miles per hour possible. road conditions are very tough, and a no travel advisory, a travel ban has been issued in buffalo and surrounding erie county. very, very tough travel conditions. whiteout in some places. just have to stay off the roads.

guys, back to you. >> thank you so much. john. >> john: more than 4,000 flights as we mentioned are canceled and 4,000 more delayed. jonathan live at heartsfield jackson in atlanta, the country's busiest airport. how are travelers dealing with what might in atlanta might not be a problem, but other places around the country, lots of delays. >> yeah, exactly. it's all interconnected. but so far we have yet to experience the domino effect here in atlanta. it's one of the few bright spots. you can see long lines outside the tsa, but they are constantly moving. airport doing a very good job keeping things organized inside. the main concern with the temperatures in the teens is outside. they are looking after employees on the tarmac, making sure that they are not exposing their skin to the low temperatures and

plenty of opportunities to come in and warm up periodically. according to the website flight aware, 132 atlanta flights have been canceled so far, but airport officials are keeping a close eye on developments and the country with those thousands of cancellations going on natider airlines are now offering storm-related waivers and flexible rebooking options. >> no more fare difference, no change fee, you can go ahead, call your airline and make a change to a flight you think is better. >> aaa predicts nearly 102000000 americans will drive to their holiday destinations. up north, icy conditions on many roads. >> we encourage residents to avoid driving if you can. fewer cars on the streets means fewer chances for dangerous incidents to happen.

the historic storm as it now moves east. so, rick, what are we in for here on the east coast? >> i'm glad jonathan is driving south, that's good news. most of the country has dealt with the rapid fall in temperatures and if you experienced it, it's been extreme, in some cases 40, 50° temperature drop in an hour. so the front is really strong. these are actual air temperatures 22 in dallas, 42 in new york, by the time we get towards 4, 5:00 this afternoon, temps will be toward the teens. a rapid drop of the temperature is now, that's where the front is. and because of that, we have seen all of these flight delays, we have been talking about that, across pretty much the entire country is dealing with that. this is a windy storm, feels like minus 28 in bismarck and duluth, so many places i could focus on, don't be offended if

i'm not talking about your spot, impacting just about everybody. feels like minus 2 in little rock. this is where the snow is right now, you see the one warning there, that's excessive snow we have going on. coastal areas dealing with rain from this right now because the front has not moved through, but the idea, 7° in state college, 42 in new york city where it's been rain, not snow. but where it is snow, it was rain just before this, and all of that rain that is still on the ground is going to freeze really quickly and that's why you have to stay off of these roads and places around buffalo we had the record breaking storm last month, we are going to get feet of snow behind this, so it's going to snow on top of that frozen precipitation, that ice and that's going to cause problems. here is the temperature change, fort cleveland, 50° cooler than yesterday. one positive thing to this, aishah and john, take a look at the orange color. those are temps warming up behind what we had yesterday.

so, this is a pretty short-lived cold spell. we are going to be talking 48 to 72 hours, and by the time we get towards, say, mid to latter part of the coming week, almost everybody will look at temps above average. so, the colder air is here for a short time. it's dangerous. check in on your friends and neighbors and family if you have to and invite them over if you have heat or a fireplace, so many people without power and this kind of cold, very dangerous. >> very good advice. rick, thank you so much for tracking it for us. a massive, massive storm, sounds like several different temperatures next week, sounds like indiana weather. my parents in indiana, not a lot of snow. a couple of inches but the cold, the wind chill is down to negative 25, i mean, obviously my parents are not going anywhere. >> john: it's pretty amazing how cold it gets. but warm air behind it. here in washington, d.c., a week from sunday, it's going to be

575,409 people that we know of have crossed the border illegally, compare that to all of fiscal year 2020, which was 458,000. i mean, you can see why the white house does not want the numbers out there, particularly when congress is debating this how long omnibus spending bill. >> thank you for pointing that out, and it would be the white house holding the numbers back. when i was chief, i had final end of the month numbers in a few days. we give it 5 to 10 days to let anybody that's going through the process filter out. but they don't want the numbers out and the reason is that's just a piece of it. those are only the knowns. what america needs to be worried about, that is taking up 80% of the border patrol agents so hundreds of miles of border are wide open, and even with the border being wide open, there is still an average of 2,000 got-aways every day, where

agents see them but no one left to be able to respond to stop them. that is a real threat to this country and this administration is doing nothing to slow it down. >> john: when you consider 575,000 people from october so far through december, this is usually the quiet time for illegal immigration. if those numbers were to hold for the other three-quarters, we would be back to 2.4 million people, but those numbers will likely increase as the weather warms up in the spring. we talk about title 42 coming off, and one day it will, there's no question about that, the white house acknowledged it cannot stay on forever. so far in fiscal year 2023, 177,818 have been expelled from the country under title 42. but take a look at this. 397,591 released into the country pending court dates and 86 migrants have died and i believe it's 84 days. i mean, these statistic, rodney, are stunning.

>> yeah. this administration talks about wanting a more humane border, they have done the absolute opposite. this endless flow of humans handed to the cartels allows them to shape the border, to bring in fentanyl, heroin, cocaine every day, and it's at the expense of the lives of these migrants, not to talk about the sexual abuse and everything else that takes place. most of the morgues along the southwest border were overflowing and no one wants to talk about that. it's a humanitarian crisis, national security crisis, and the administration might be frustrated but refused to do anything about it. it appears they are frustrated with the optics and not the real problem. >> call for number four, a new book by chris whipple says president biden has lost it over the border crisis, fight of his life inside joe biden's white

house, biden was furious, aide had said he would be cursing and apologized when women were present. if memory serves me correctly, he took off all the protections in place keeping people from crossing the border. >> yeah, that frustration sure does not play out into action. the reason we are talking so much about title 42 today is because this administration took the playbook that career government employees with years of experience put together to help secure the border. and then he threw that out. every single initiative that we had in place to secure the border, slow down the flow of illegal immigration, that's what they used to amass the other criminal activity, this administration threw it out. just pull the playbook back out, reinvest in the remain in mexico

program, reinvest in building some barriers that make every agent more effective and reinvest some pressure on mexico to enforce their own laws and bring some transparency to some of the challenges we have down there, and all of a sudden this crisis starts slowing down. they won't do any of that. >> john: the president is under increasing pressure from members of his own party. we'll see if they rethink it or continue along the same path. rodney, always great to catch up with you. merry christmas to you. >> thank you, and shout out to all the first responders working over the christmas holiday while we are enjoying it. >> when you think about this omnibus bill, how many money is going into it, not a lot for dhs. congress, yes, inching closer to passing a massive spending bill with some bipartisan support to avoid a government shutdown. are republicans giving up too

columnist at the new york post and a fox news contributor. thank you so much for being with us. i want to start with this new lawyer, a very powerful attorney that hunter biden has hired, same lawyer jared kushner used during the russia probe and worked for dems during the clinton impeachment. so clearly hunter biden knows he's about to have a rough year with republicans taking the house. how do you read this? >> well, look, i agree that this is clearly, he's gearing up for the republican investigations. what's kind of amazing, of course, is he didn't feel he needed the top flight lawyers for his own, for the fbi investigation of him. the fbi has had his laptop since 2019, and as far as we know, they have done nothing with it despite the fact that it's been authenticated. so, i think the republican investigations are up against the fbi as well as they are

hunter biden because what is the justice department doing about the hunter biden investigation. it's hard to believe that they are doing a real due diligence investigation because frankly, aishah, if they did, it would lead quickly to joe biden. i mean, you cannot investigate hunter biden seriously without raising the question of whether joe biden was helping him in these -- this influence peddling, we know funds were moving between their bank accounts, emails authenticated attesting to that, so the idea that the laptop is in the fbi, and sleep walking to eternity. >> seems the case has been put together for the doj by "the new

york post" and other media. i read your op-ed and this morning you write here, we are on the cusp of the cover-up phase of what the fbi and perhaps the cia and others did to influence the outcome of the 2020 election predictable denials of nothing to see here, come despite clear proof that agents interfered with the first amendment rights of the american public and not just on twitter. so, you know, clearly there are some in this country that were shocked by the revelations, and others who are just watching this and thinking we don't care. why do you think that is? >> well, look, i think that the mainstream media, which has been effectively covering for the bidens in this case, has a lot of sway, a lot of sway over small town newspapers, over big city newspapers, i think the washington press corps is part

of the problem here instead of the solution. simply not interested in anything that would shed a bad light on the bidens. i mean, if they cover joe biden the way they covered donald trump i think we would have learned everything there is to know about hunter biden and joe biden's relationship to the businesses. i think the media -- go ahead. >> i'm sorry, quickly, because we have 30 seconds left, do you think the fbi or the cia are going to face any legal challenges? >> well, look, i think there's no question that they are both involved with twitter, with facebook, the top -- the former agents and then the current agents, of course, leaning on them. i would hope at the very least the republicans would call in christopher ray and ask him about the problems. the fbi has defended him. but what they are defending is silencing americans for speech on the ground that the fbi does

vote on the senate 1.7 trillion funding bill to try to avert a government shutdown some time today. the measure is expected to pass but not without creating some division between house and senate republicans. our panel has a few things to say about that. former senior communications adviser for senator chuck grassley, and former biden campaign surrogate. i thought kimberly strasel yesterday in the wall street journal had an interesting take on the omnibus process, writing never has washington contemplated such a monstrocity, passing off lazyiness, as success, it would be hard to compete with this week's senate show. omnibus is everything broken in d.c., dumped in one steaming

pile, of what she did not say, but only certain piles that steam. garrett, is she on the money here? >> maybe, but yes, absolutely, john. let's get the facts straight here. democrats when they pushed the omnibus it was released in the middle of the night. over 4,000 pages long, and $2 trillion more. we have 31 trillion in debt already and historic inflation as we go into the christmas season. 16% more this year for christmas dinner than last year. families are trying to buy christmas presents, folks are struggling. this is not the priority of the american people that just fired house democrats shoving this through. they want republicans to have a seat at the table and it's very unfortunate a lot of senate republicans joined in with democrats to move this omnibus, is clearly out of step with the american people's interests. >> john: i was about to bring that up to kevin, your esteemed colleague to say that republicans are railing against this thing.

yet 18 joined with democrats to pass it in the senate. >> john, i think that's the fascinating thing. you have 18 republicans, mitch mcconnell team, john thune, john cornyn supporting the measure, working with democrats across the aisle to pass this, a big increase for the military, key priority that they wanted to see happen and increase for domestic priorities. but listen, kevin mccarthy has ten days to lock in the votes for speaker. i think you are seeing a lot of the flourishes about this playing out with that as the backdrop. i loved what kevin kramer said, from north dakota, he said let us do the governing. it's clear that house republicans and he was once a house republican are not actually interested in governing. so that divide, i'm happy to take a back seat and let them play out over the next ten days for the speaker fight. >> john: aishah, who knows all there is to know about congress was saying this morning the one thing that nancy pelosi and chuck schumer do well, they are in lock step when it comes to

legislation. now you have kevin mccarthy, as a result of the vote in the senate saying oh, the 18 republican senators if they co-sponsor legislation that comes to the floor in the house it's dead on arrival. he tweeted out when i'm speaker, the bills will be dead on arrival if the nearly 2 trillion monstrocity is allowed to move forward. he's trying to win over conservatives who are threatening his bid at the speakership. but does this infighting benefit the republican party at all, garrett? >> leader mccarthy is absolutely right here to do this. you have things like title 42 that were not included, democrats did not want to bring it to a vote, popular policy for humanitarian, and national security and otherwise. there is infighting in every party. progressives and democrats, throughout the time president biden has been in the white house and democrats had control of congress. so i don't think necessarily

this changes a lot with that. but going forward, i think what house republicans have shown is that listen, democrats were fired here, they want a seat at the table, public wants house republicans to have a seat at the table. >> john: democrats were fired but not fired by a whole lot and if the republican party is in disarray, can it get anything done in the next congress? >> that's very true, john, and i think kevin mccarthy is maybe breathing a sigh of relief. he has been to be out there against this bill for his right flank. i don't think he wanted a government shutdown, at least until september, where this is put off to in terms of the fiscal year. he did not want it shutting down on his watch. so kevin mccarthy, do as i say, not as i do. >> john: we'll see if it passes the house, likely it will and then heads to the president's desk. talk about a continuing

resolution to bridge the gap if it did not get in for the time for the signature to be on it. chad pergram is watching all the goings on in congress. >> and many more. >> john: merry christmas to both of you. >> aishah: a big change could be in store for the marine corps. calling senior officers sir and ma'am may become a thing of the past. david lee miller has the story from new york. so, when might this all start? >> well, aishah, marine corps says not so fast. a study by the university of pittsburgh gender, integrated recruit training recommends doing away with sir or ma'am when addressing drill instructors. the policy will not change overnight if at all. the corps, when asked about the 738 page report released in june

said marines have adopted and taken action and some recommendations but have not changed how they address instructors. they say they address the drill instructors as sir or ma'am in adherence with marines corps regulations and courtesy. no changes made to time tested methods without scrutiny and feedback from the leadership. chief of staff from the education command raised concern telling advisory committee on women and services we want to avoid any quick solutions that might introduce problems in the future. the report recommends recruits stop using sir or ma'am and instead use what it calls gender neutral identity, it primes

recruits to think about or search for a gender first before their rank and role. the report states further "gendered identity have the potential to remind recruits of the negative stereotypes they hold." the marine corps did not provide a timeline how long it will take to review the sir or ma'am policy. the study said recruits in the army, navy and coast guard have already replaced gender identity with the rank or role followed by a last name. aishah. >> aishah: wow, david lee miller, thank you for that report. incredible, i mean, think about how hard it is to be a marine, and this is added on to it. how much do you think the marines will put weight into this? >> john: we'll find out. it's whatever gets dictated from the pentagon will determine whether or not they do it. what's interested, a study done at the request of the marine corps back in 2020 by the university of pittsburgh, it's an academic study.

the total to almost 170,000 irs agents in this country, almost the size of the u.s. marine corps and take that money and divert it to use funds to help at the border, to make sure that we have enough border agents who can handle the influx. looks like it's up to the supreme court to determine what happens with the status of title 42. as you know, it was rejected in this big bill, it was a subject of controversy and delay. the democrats wanted to end title 42 and the republicans were looking for a solution in this massive omnibus bill but it did not happen. let me tell you something. the border numbers are shocking and getting worse by the day. this is an assault and afront on american taxpayers and the health, safety and security of americans across the country. it's also harmful to the immigrants making the trek because they have been incentivized by the biden administration to come here because they are told they are going to be able to get across the border because our border
