neil gorsuch sided with liberal colleagues. he writes the current border crisis is not a covid crisis and courts should not be in the business of perpetuating administrative ed ictus for one emergency. we're a court of law, not policymakers of last resort. some democrats want the president to act on the crisis and show his administration has a real plan in place once title 42 is gone. congresswoman elect in a border district length it rip. >> they refuse to come down to the border to see what's happening. they haven't put any policy nor any plan in place for this surge of migrants that is going to come across our border once title 42 is lifted. >> molly: former border patrol chief set to weigh in on this.

we begin with aishah hosni in washington keeping us updated on these changes. >> good morning. lawmakers on both sides are urging this administration to use this time, this extension, to come up with a better border strategy. texas representative henry cuellar this morning. >> here we are with a little time for the administration to come up with a policy. there are some laws on the books right now that can work but they have to tweak the policy on how they enforce those. i'm talking about title eight. remember, president obama had title eight. he did not use title 42. and he was in a very good way he was able to treat migrants with respect and dignity but at the same time he deported the ones that had no right to be here.

>> some democrats might say cuellar and others should do soul searching after approving that omnibus last week. the massive budget bill only includes $60 billion for dhs, a $3 billion upgrade from last year not keeping up with inflation. we found only $60 million will go to hiring cbf officers. a whopping $8 hundred million is going to sheltering programs for migrants. that's a 650 million jump. the white house continues to blame republicans in congress. press secretary karine jean-pierre wrote this last night. she said the supreme court order gives republicans and congress plenty of time to move past political finger pointing and join democratic colleagues in solving the challenge at the border by passing comprehensive reform measures and delivering additional funds for border security the president has

years later after an entire last year of record surge across the border, now we're in the second year of this presidency with the largest surge across the southwest border we've ever seen. congress has the role here. the threshold for asylum claims at the border without sufficient detention is causing part of this problem. it has been a problem for quite some time. congress failed to act for quite some time. this president made choices that put us in the predicament we're in. title 42 wouldn't be important if they were enforcing the law in a specific way the at the southwest border. >> molly: there is a new op-ed titled biden's unserious border solution, mass amnesty for all illegal immigrants. biden's invitation to jump the border wall will attract more poor people from abroad to el paso and other communities. hundred of millions of people would move here if they have could and word is spreading that now is the time to try. there is new data. you mentioned some of these

numbers something what could be a defact o amnesty. back logged asylum cases under president biden. syracuse university uses government data to monitor the numbers. right now there are roughly 1.6 million asylum cases pending. in 2012 just 100,000. fiscal year 2022, 750,000. in just the months of october and november of this year alone nearly 800,000. the wait time for court appearances now the nationwide average of more than four years. so it creates this pocket of time which in some sense could be frustrating but in another sense if you can't get a work order and be a legal worker this is putting a lot of people in a difficult situation when they are trying to find solutions and the government has yet to come up with a solution. your thoughts. >> correct. again the asylum system needs to be looked at very strategically by the legislature. they can change and improve that

problem and improve the processing, improve the timelines it takes. add detention at the border so when people come in and want to make an asylum claim they can be held in custody until seeing the judge or the remain in mexico program. that worked. that produces conditions at the border that allows agents to be on the line instead of what they are doing now as we see the huge on the network every day people waiting to get processed and put into the system. they said over the weekend christmas weekend 16,000 people were encountered by cdp and 14,000 of them were released into the united states. that's going to be problem and what is encouraging people from all over the world to come her. >> molly: communities along the border is incredible cost. soave it has been reimbursed by the federal government. the challenge is what to do with all these people coming across. texas governor greg abbott hitting back at the white house after the president called the busing of migrants to the

nation's capital on christmas eve a dangerous and shameful stunt. an abbott folks experience called biden the hypocrite in chief for criticizing texas while flying plane loads of migrants across the country in the cover of night. here we are one finger pointing the other direction, each side calling the other a hypocrite. at the same time these people who are years to have their claims heard have to go somewhere. >> this administration made choices about what they would would do at the border and enforce consequences. texas is doing more than anybody else standing side-by-side with the men and women of dhs trying to control the border. in cities like el paso and eagle pass there aren't sufficient resources to hold thousands of people waiting to come further into the united states. there is not enough trains, planes or buses in some of those locations. so texas not only deploying

their public safety and guard, the national guard, they are doing more than anybody else. so this administration made these choices. these are the consequences of these choices and texas is just looking for a little relief. the whole case of title 42 was brought by states like texas trying to get the government to enforce the border which they are refusing to do. >> molly: bill melugin has been doing an-out standing job. the liberal media has suddenly started covering it. this is msnbc. >> a developing situation at the border is described as a crisis with multiple border towns and cities overwhelmed by the influx of migrants. >> molly: your thoughts in the way he framed it as a developing situation and that some are calling it a crisis.

southwest passengers. other airlines are rebounding from the winter storm disruptions but southwest still in full meltdown. of the 3,000 domestic flights canceled yesterday southwest was 85% of them. right now the carrier is only operating 1-third of its route. southwest flight attendants say they saw it coming and the airlines technology is squarely to blame. the biden administration taking notice. here is transportation secretary pete buttigieg. >> it is an unacceptable situation. you look at the number of passengers stranded and how hard to get somebody on the phone to address it. i made clear our department will hold them accountable for their responsibilities to customers both to get them through this situation and to make sure this can't happen again. >> molly: mike tobin live at chicago's midway airport. mike. >> the big visual from this mess is purgatory for lost bags which

you have at baggage claim at midway airport. hundreds of bags are piling up. analysts say it is part of a problem triggered by the storm. they say it's logistics technology that southwest caused to get out of date caused this. passengers are stranded by the staff is, too. the union for the flight attendants sent a screen graph showing flight attendants dialing into the scheduling center. seven hours, 45 minutes. five hours, four hours. this is the staff trying to get people home. flight attendants union wrote it's generated by southwest airlines's decision. not winter storm elliott. something we've forecast. southwest is in this remarkable position canceling 2/3 of their flight and the ceo is apologizing. >> the tools we used to recover from disruption serving us well

populated cities in america. and this is just one example. eric adams, former police officer in new york city made the commitment to fight crime. a year later murders are down by over 12%, shootings are down by over 17%. mayor adams has restored some of the more controversial facets of the new york city police. he has the street units team that is back. that was put away by deblasio. he has that back and he started a program to involuntarily remove people that are having episodes of a mental health crisis. somewhat controversial but he said we have to do what we have to do. new york city there is always wins, always losses. depends where we look. i think overall mayor adams is doing a good job. crime is up around the country. there is no question about it. overall new york city is still one of the safest big cities in the country and on the planet. overall i think mayor adams has

vacation over christmas? >> of course he is allowed to vacation. if there is a crisis or something brewing at that time like all of us. we all can plan our vacations and if we want to go on those vacations fine. if we have something come up with our family or business we may have to adjust the plans. that's the concern that a lot of people are stressing. i don't fault an administrator mayor to the president taking time off. it comes in the time of when they do it. he needs the time-off but what is going on at the time and could he do it later? >> molly: david, your thoughts? >> new york city is always going to be something. don't matter when you try to take vacation. the mayor has the right to do that. it was only two days. may what matters is the system in place no matter what happens the city is operating smooth and everything is under control. the mayor did that. there was a deep freeze, a lot of problems during that time but he had the operation under his

deputy mayor in full control. and the city ran as it should. >> molly: shifting topics liberal media coming to the rescue for vice president kamala harris. a recent "washington post" op-ed said she had a most excellent year. they argue much of the attention she received in her first year has been rough. stories about staff departures were hyped as disarray in narratives that called into question her competence unfairly. the nation's vice president has had to -- they come with charitying notions of what should be in that position. critics point out a series of failures, though, when it comes to assignments. specific assignments. and some pointing to her struggles in interviews and public appearances. >> i truly believe they are our children. >> we have been to the border. >> you haven't been to the border. >> and i haven't been to europe.

a new study suggests that learning loss from school closures to cost our kids financially. throughout their entire lives. fox business correspondent lydia hu is live in the new york city newsroom with the details on this. >> hi. this is a study by a stanford university economist who says learning loss accrued during the pandemic will cost each student $70,000 in lifetime earnings and the country $28 trillion over the course of the rest of this century. the study is based on declines in scores on 8th grade math tests. this means there is a correlation between policies that forced children to stay at home and the largest drop in math test scores in more than 30 years. the study highlights how some states suffered learning losses greater than others like in oklahoma, delaware, west virginia. idaho, alabama and alaska showed the smallest declines.

numerous other studies have found that learning losses lead to lower graduation rates, higher rates of arrest and incarceration and lower skilled and less productive adults who earn less money in their lives. some are asking what is being done to reverse the learning loss here? schools received more than $190 billion in pandemic aid. there is concern. less than 15% of those funds have been spent by school districts. now with this study saying $28 trillion is on the line for the country over the course of a century the economic impact of learning loss is coming into focus here. molly, it touches every american regardless of whether they've had kids in school during the pandemic. molly. >> molly: thank you so much. fox news contributor tyrus, co-host of gutfeld to talk about this. totally predictable. yank the kids out of school and tried to learn from home in a new way and send them back with

masks on their face for up to a year and now dealing with the fallout. do you buy that this will mean a totally different future for the children that they will have a lot of making up to do and future financial losses? >> not because of the study. i feel like this study is a misappropriation of funds. so we can see the side effects of what has happened but we aren't seeing the remedy. we aren't seeing the government being active. not seeing this administration taking active steps to increase the ability to learn. we're seeing a dumbing down of education. oh, we'll take math out and english out and change history. we're seeing a dumbing down effect on top of the fact our scores are low. this study tells me they've accepted it. so now we talk about spending money. you put all this money into the schools and only 15% going towards the skoochlt that's the problem with this administration. this is what parents have to steeped -step it up.
