i don't know that there's going to be a lot of information. the basic case that they have in front of them right now. >> edward: chris swecker, did -- ted williams, maureen o'connell. thank you. our coverage continued >> helloe katie pavlich, joey concha, lawrence jones and kennedy. and this is "the five." this is a fox news alert, major break in the brutal murders of four college students that gripped the nation. after seven weeks of searching and over 19,000 tips, police arrested bryan bryan kohberger 2500 miles away from the crime

scene in pennsylvania. he's been charged with four counts of first-degree murder as well as felony burglary. the officials reeling kohberger is a graduate student at washington state and had an apartment a few miles from where four university idaho students were stabbed to death. officials say mostly tight-lipped throughout the process of the investigation but are now providing the public with answers. springer is in idaho with the details,, what are you learning? >> they only provided some of the answers. they said at the news conference which we attended 30 minutes ago, they can't say anything what led them to the suspect. kohberger and to speck in the physical state of idaho, they cannot unseal the probable cause affidavit. for they were very vague about what they know about him and what led them to him and what tips did but they did say they made that arrest at 3:00 this morning.

this was eastern pennsylvania in monroe county 100 miles north of philadelphia at his parents house. we don't know how long he was there, but probably he has been there a long time. these murders took place over six weeks ago. i can tell you, this is a monumental day for the folks here in moscow, idaho, and the whole university of idaho campus. this shocked not only the folks here and people across the country, the brazenness of the mergers. somebody going into a home, a home right off of the campus and knifing to death for costudents, young students in the prime of their lives there. about to graduate a couple of them. and now they finally have an answer, somebody in custody. we can tell you the police did say that they have the suspect, not a suspect but the james talking about the safety of the people on the campus right now. >> what i can tell you is we have an individual in custody

who committed these horrible crimes. and i do believe our community is safe, but we still need to be vigilant. >> kohberger is a student washington state university, it which is just across the state line about 8 miles away from the home where the murders took place where he has an apartment. the police were at the apartment at 7:00 going through the search warrant. we also saw the county prosecuting attorney bill thompson who was there as well going through that apartment, executing a search warrant. we know that kohberger is a criminology student. he is getting his phd or was getting his phd at the department of criminal justice and criminology and pullman appeared we don't know if he has any sort of connection to the v. the police are keeping that stuff under wraps right now, but we do know that they have the car they were looking for,

james. >> so we are still looking for all pieces of evidence, but we are still looking for the weapon. and i will say that we have found a lot. >> the pennsylvania state patrol s.w.a.t. team from the state patrol present at the arrest today as well as local police. we know that the suspect is in custody. he was in court making an initial appearance in court in monroe county. the judge there said he would not be issuing any sort of a chance for bail. he did order extradition order but kohberger to come fight that and if he does, you will have a hearing tuesday 3:00 in monroe county. he can waive that and be brought back sooner than that, but again, they will not be talking about the details what led them to this arrest until kohberger

is back in the state of idaho per state law, katie. >> katie: we'll wait, thank you so much. lawrence jones, you have spent a lot of time in moscow in idaho with the families of these victims. what are you hearing from them? what are you thinking about what we heard from the police today? >> lawrence: we will hear from the family members later on in the program. today is kaylee and madison's memorial surface. they had their memorial service and still struck with grief. they grew up together and tied together. what a fitting way to celebrate their life by bringing this killer to justice. what a sick guy he was, someone who was a criminal justice major, masters, getting his phd. he thought because he studied criminals, he was going to get away with what he did appear to what we know he left a messy crime scene that the victims for fingernails. we know there tied when they

wheeled out the bodies to preserve that information. we also have learned based on the 20. i have talked with people on the scene, that the cops, in fact, did preserve the crime scene. we did not hear that during this investigation, but now we have the person who allegedly did this crime. i think this is a great day for justice and a great day for the victims. what is happening though in some states they have different laws. we have the supreme court of idaho has put in a gag order. this is not just for this case but all cases where the most that we will hear will be from the court of record. that means as the judicial process takes place, as they release the probable cause statement, as they turn over discovery, the defense get their information in the prosecution turns over their information, then we will know more about that. the murder weapon has still not been captured. we do know the hyundai elantra car they have put on the screen, they were able to capture that.

what is the information? that is what we will look for going forward and what was the straw that broke the camel's back? i would caution though because he is a criminal justice students. we have heard reportedly, did you catch someone else? was there someone else there? that could be true or this could be a man so full of himself if he looks at his reddot post, that will try to throw investigators off. but you can't run away from the physical evidence. this is how law enforcement able to capture the task force of the state police with the fbi. >> the standard is beyond without a reasonable doubt, judge jeanine pirro joining us by phone, thank you so much but looking at the evidence of the charges, the suspect charged with four charges of first-degree murder. there wasn't a lot of information coming to the public about how the police came to that conclusion. but what kind of evidence do you

think the prosecutors and the police have to have two be sure of those charges? >> well, what we have here is probable cause affidavit. that affidavit will be sealed after the arraignment, which the authority said will only occur if the defendant or the accused at this point waives extradition voluntarily and returns to idaho for prosecution. or if there is an extradition hearing and the judge in idaho gets involved in it. i've done it many times as d.a. and extradition can take a week, ten days and slows the process down somewhat. but my sources tell me that there is genealogical dna established in this case that led the police to this particular suspect. so, although that was the party of my sources very credible and reliable, the case has been made

clear is just beginning. if you try other cases, special murder cases that involve several victims, you understand that really investigation begins now. as it relates to this guy kohberger, now that he is out there as the defendant, the issue is, what did he say? who did he hang out with? when he was in school, did he talk about the criminal justice major? he was interested what the criminal was thinking when the criminal committed a violent crime. so, there are all kinds of additional evidence that will be gathered at this point going forward. so when you try a murder case, you understand that you are still investigating until you your closing statement and i've done it many times. as it relates to genealogical evidence, they literally can get evidence back to 1800s.

it is not your typical coding. your typical person who knows coating and dna says, "okay, if you are at the bank as a criminal, or dna can be matched to what is in the bank." the truth is, if you're not a criminal and kohberger come as far as i know does not have a criminal record, so he would not have matched in the databank. they would then have to take the blood, not if any of those four victims and have that blood analyzed. then build the genealogical tree from that. so they find out who were the relatives? once they figure out who the suspect is, they then start to investigate, spread out from idaho to pennsylvania. and they populate historical data. this is genius going on.

so coating, 30% of cases, but this genealogical dna gives us a 90% chance of solving these cases. so in addition to what will be unequivocal, unequivocal, i should say, evidence, they will have all kinds of filmic circumstantial evidence in addition to wind the affidavit is unsealed. >> kennedy: judge committed is kennedy and i have a question about what lawrence brought up and that is the statement that this person allegedly made to the arresting officers in pennsylvania. and that was, did you arrest anybody else? obviously, that could be a red herring of an intelligent sociopaths with throw out in order to prolong an investigation and litigation potentially. but what are the chances in your estimation of seeing cases like this that he perpetrated this

alone? >> look, kennedy, i don't know that i can give you an answer on that because it's not grounded in evidence yet. but what i can tell you, the guy is clearly a sociopaths. by that, he is clearly saying. anyone listening, he will not get away with any kind of mental insanity. but number one, but number two, the police are looking for all the occupants of a white hyundai elantra so he may be feeding into that. we don't know what he may have said that he thought innocently other members of the hyundai elantra will now take on a different meaning. >> joe: this is joe concha. it is mind-boggling fees for murders carried out while two whether sleeping the entire time. so i go back to kennedy's question before, which is the suspect asked if anyone else was arrested. it is hard to believe that he

was able to. this out alone. it was not a gun come obviously used to kill four people and no one else hears it. it is almost as if he would need help to get this done. so what are your thoughts on that? >> well, you know, i always wondered about that. but let's talk about the fact that, they've got this genealogical dna supply sources which is spot on. if anyone else was cut on the scene, that person's blood would be in there and trying to put it altogether or looking for someone. but i don't know. that is what you can't do, you can't speculate at this point. i always thought it would take more, joe, look when kids go out partying and it's a weekend, saturday night, who knows how much their drinking at the party? the toxicology and medical examiner, the corner didot want to get into that because

they didn't want to in any way maligned with the victim. we don't know how much partying they had done and whether or not they could have been awakened by a fire truck. >> j>> lawrence: judge, we interviewed people that used to live at the residence and they said of this kind of like a basement. you really can't hear what is going on upstairs. but i want to get to the destination because it is critical how it is tried in court. what do you expect because again law enforcement talked about preserving the crime scene. we know there is an order released by the court that will turn over the house to the owner of the house so they can get back in the, but a judge said stop that. why is that important to preserve the crime scene? >> i will tell you why, i will tell you why, because the judge is concerned about the defendant and the defendant's rights and they will want access to the scene the way it is. smart move to protect the

record. >> judge jeanine pirro thank you for your expertise and joining us today. see you soon. >> happy new year, judge. >> joining us now on this bittersweet day, the father of kaylee, steve goncalves, thank you for making the time to be with us today. your first reaction to the news of the suspect that has been arrested. >> to me and my family, it feels like the first joy i've had in seven days. you can't even smile when you have this over your head. it feels like a little bit of weight has been relieved and things are on the right track and moving the right direction. >> was there anything in the press conference the police just gave this afternoon that was not said to you as a parent in the situation? did they leave something out that you wish the public knew about? >> you know, the whole struggle of communication and everything has gotten better every step of

the way. i want to commend those police officers and everything they have done because they have been very difficult to work with all the media, especially me being so vocal. i think it's gotten better. and i really appreciate that they've made some adjustments for our family. we have noticed those things. >> lawrence: steve, i have told my colleagues there is a different tone from you today as we got the news that they did, indeed, catch the suspect. we were talking earlier today and one of the things that stuck out to you was, this guy was not from moscow. he was an outsider. >> yes. the community is real in idaho. and idaho, i want it to be a part of that to where we say, "hey, this is not our new

normal. we will not allow this messaging to be our new normal. we will put our foot down and plan every resource we can. we have nothing to hide. if we have to pull enforcements because we are close to location, jurisdictions are there, we are still going to come together and unify for t this. "and i think that is what happened. there was some horses that pulled us apart. but in the end, we all came together. and a celebration of life today. we actually have hope that we have somebody in custody that is a person of interest. of course, he's not found guilty but a lot better off than we were 48 hours ago. >> lawrence: steve, why is it important today to have the memorial service not only for kaylee but for medicine? being the day that it is, why did you guys decide that you would push through and have this

celebration of life for your daughters? >> it was important for us to have this person of interest in custody so they weren't possibly in that audience because we made it open and we knew we made ourselves vulnerable like that. we didn't want somebody to take advantage of that and feeding off of that. we definitely don't want to see somebody lose a predator to our environment. so, it is nice that we have disclosure. there is a lot of prayers going across america. >> kennedy: steve, it is kennedy. everyone here at fox, we pray for you, and we hope that god continues to sustain all of your families through this unspeakable tragedy. i know that you have done so much work. and you have been so vocal. and you have done so much investigation. i'm just wondering, had you

heard the name bryan kohberger before today? >> no, we have not appear that is completely honest. everything was kept under wraps. the investigation did whatever they could to keep this away from the public, to keep the jury untainted and do everything by the book. i believe they've done an amazing job of that. >> steve commit is padilla and as a parent i can imagine what you are going through. one of the things we have found heartening is how a tight community has been pulled tighter by the love they have for your daughter. can you speak to the sense of i don't know may be relief? is there some type of emotional liability today given the captioner of this guy? >> yeah, it felt like we were all in this together. and i feel like something uncomfortable. they took photos and took time

but in the end i hope when the story is closed we actually do find out that some of the leads from the minute they were critical. i would not be surprised. this is going to be a community-based justice that was exercised in this whole process. >> lawrence: steve from a brother you been so strong. i'm so glad they caught this guy before the new year. thank you so much for stepping away from the memorial service and spending time with our audience. >> thank you steve very much for taking the time. thank you. hearing from kaylee's father one of the four killed in moscow, idaho, in that house brutally murdered. one question i had that came up as a result of the press conference today is the motive. we don't know anything like this

guy did this. complications between pennsylvania law, idaho law and what they were allowed to say. i would like the pennsylvania police to hold a press conference and the fbi involved as well. lots of layers of law enforcement looking at this. but it is good to know they have somebody in custody. the suspect also said maybe someone else was arrested. it was somebody else arrested? hopefully the police and idaho know this is actually the guy given for days on end the beginning of this when this crime was reported. they said the community was safe and clearly, the suspect was still on the run. >> lawrence: you know, katie, that interview with kaylee's father, steve, so important because we have known from the reports as well as his ability to look at the autopsy reports that he believes his daughter was the target. and if that is true, the family members deserve to know that. there were inconsistencies just to lay it out for our audience,

kaylee and madison were close and tight in the same bed together. and as a result steve picked up both parties. both autopsies and inconsistencies in that. i know there was confusion about the talk that was different. the stab wounds were different and with kaylee more aggressive. so what led him to plead his daughter may have been the target. if that is the motive, the public deserves to know that as well as the family members need to know so they can have closure in this incident. speak to bigger questions about stocking and targeting and why. joe, your thoughts. >> joe: i hope we don't glorified this killer. and now coming up on the 10-year anniversary of the boston bombings and we remember "rolling stone" magazine cover where they took the scenario, one of the brothers that survived and turned him into a young billy bill mcmillan. the series on jeffrey dahmer got renewed on netflix. i would like to say let's not glorify this person but it seems to be the way these things go.

suspect allegedly said he was getting arrested. but did you catch someone else as well? what do you make at this? >> jimmy: i wouldn't feel safe or based on the answer he gave because it did sound a little evasive. one is probable cause affidavit that they cannot speak to the specifics of the investigation. the other is we have to be mindful of the pack when communicating with the public if, in fact another suspect, the idea they could be consuming this information involved, which is part of the maddening experience we had with the moscow, idaho, messaging from time to time during the cases. a lot of people were criticizing and inconsistent, but again, they are facing forward towards the public with an eye on potential suspect consuming any information. with that being said, that answer was not a "no." the only thing i took away because i don't have the criminal justice background or the judge or anybody on here. but the poor ain't is the

suspect said if you know how mug these type of crimes both as a major and on reddit, this speaks to evasive news to throw them off the scent potentially contaminated investigation. >> lawrence: these play out all the time behind the scenes but inconsistencies between the police department and the prosecutor who is a chief law enforcement officer of the town. at least try to build a case what he can prove in court whereas investigators are grabbing evidence as it goes. >> katie: when i first heard what the charges were today, four counts of first-degree murder, i automatically went to, "well, they must have a lot of evidence they believe they can get him on four counts of first-degree murder. there must be a lot of dna evidence and premeditation, jimmy talked about the reddit post emphasis creep following the students on social media following katie on social media,

targeting her com stalking her " asking those kind of questions and his criminal justice classes about criminal behavior and how they target victims. we are going to find a lot of that out. it will take a few more weeks. the hearing for him in pennsylvania is on tuesday. then he has to decide whether he wants to be extradited or stay in pennsylvania. they have to issue a extradition request for idaho. idaho cannot release the affidavit until he gets to his preliminary hearing. that cannot be released to the public. as you said, the prosecutor and the police during the press conference continued to say, well we have a suspect in custody and charges filed, the investigation is ongoing and still -- they said it is just the beginning and they want those thousands of tips to come in if somebody heard something, knew something to continue to build their case has judge jeanine said up until the prosecution in the courtroom

appearance before joe, let's talk about that, a lot of information was not released before and still not released now because they want to protect the integrity of the investigation. but now we have a phase of the person who did this. people who interacted with him over the weeks leading in and the days leading up to this, this crime, this horrific crime. do you think that will be critical in this investigation? >> joe: you see what we are seeing from the police. they are being very, very close to the nest in terms of what they have and may still be out there. i'm with you, jimmy, if my kid was at the university of idaho and lived off campus i would not have 100% confidence they are safe right now because it would be outright denial that there may be another suspect. so he is either plaintiff suspect playing 3d chess by saying no, did you arrest anybody else? or maybe there was an accomplice. but that reddit post is very, very telling, lawrence. where he was actually putting

here we are at the let us do good village. first community like this in america. a hundred families together that lost their loved ones. the kids that lost their mom or dad protecting us. and today is the day that we're going to deliver the first beautiful home to the thornton family. some wonderful people donated. a bunch of land in land o' lakes. to let us do good village. having stood here on this same property with a shovel and now seeing a home where a family is going to move in. built all of our roads, all of our infrastructure is here. we've got several homes are under construction. and this is absolutely amazing to me. it's going to have a pool gym, rec center, beautiful facility, a movie theater where the folks, again, can live and heal and grow together. to see it completely done, to see it fully furnished, it's a blessing to be able to get a home like this. my children struggle a lot, but i feel like this community will bring a closeness

rules don't apply, you know. there is a double standard, like again, if you are questioning the legitimate of the 2020 election you are a collection denier but it questioning 2016 you are a cabinet member of the biden administration. there was always that working double standard in place. but the bigger issue i have and i applaud elon musk, of course, science is about questioning everything obsessively to form a better hypothesis. a lot of things we were banned under discussing under the old regime would say people's lives. we are talking about treatments banned from discourse that are now fda approved. they like to say blood on their hands but you have covid on your hands at the very least. sp>> katie: they keep touching their faces. >> jimmy: grows spirits boot >> kennedy: katie, he's not the only one that thinks this. there are a lot of members of the media curing this exact same kind of order dismissing the twitter files, dismissing the idea of free speech but it is

interesting within the first amendment, it is not just free speech protected, but it is also a free press. you think they lost sight of that as well? >> katie: absolutely. senator cardin said this is about hate speech and violence and protecting people against hate speech. the problem is they think jimmy failla is hate speech and anyone who doesn't agree with them politically. >> jimmy: but it's after 11:00 p.m. p.m. speed to taking funny jokes and making fun of them they think you should banned from the internet. they tried to disguise the censorship as, "we are trying to protect people from harsh words and violence, which is not true." they are perfectly fine throwing out their own side of hate speech that they are told its acceptable spirit and fine with using private industry in this case big tech to subvert the first amendment for their own goals. this hate speech, they would not throw a fit over debate about covid appear they would not be frustrated the fbi exposed for a political machine for democrats

for years now and interfering in elections. when it comes to cooperation or regulation of big tech, i think congress is focusing on the wrong thing here. house republicans should focus on raining and the fbi and dhs and executive branch because the power and can prevent them from colluding with big tech. but in terms of over regulating on the internet, there is no place for that in congress and i don't understand what kind of written legislation they are trying to write. >> kennedy: one of the most dangerous things as katie points out is subjectiveness. i will decide what hate speech is because it is hateful to me. you know, the framing of the constitution is not supposed to be subjected to factions. us versus them, red versus blue, it is supposed to apply to everybody. that is why the language is sparse and vague. but they are acting as if it is very specific and hate speech is now protected. >> jimmy: that is a great
