trump years was kevin brady during the biden years. i trusted him. congressman brady joins me now for a bit of an exit interview. sir, welcome back to "fox news sunday" and happy new year to you. it's. >> new year to you gillian. gillian: let's kick off at the house leadership struggle. a handful of republicans have already committed to not backing mccarthy. others say it is mccarthy or bust. take a look at what rep david says. there is no plan b of the plans to get them elected as speaker but at the end of the day we could be the two or three days, doesn't really matter. politicos are important group of house republicans have approached steve scalise quietly and told him you've got to be ready to take up the gavel, is that true, should he be ready? >> so look at my hope is kevin mccarthy's elected speaker. he has led us into the majority but he has united us behind an agenda of the commitment to america. frankly he has worked so hard to get us in this place and he is ready to lead. i'm hopeful we can unite as a

can unite us. gillian: is not easy; an enviable test racer, sequential order sanchez the congress collective spacing a slew of investigations, multiple accusations. he lied about everything from where he wants her graceful to where he went to college. his religion, his employment history, so far republican leadership though no condemnation. largely silent altogether on the issue. you think kevin mccarthy should condemn him? >> so look, this is troubling in so many ways. certainly he has lied repeatedly. at the end of the day that this is a decision whether he resigns or stays that needs to be made between he and the voters who elected him. he certainly going to have to consider resigning. he's got two choices i don't know the show and he doesn't need my advice surely. one he can try to politically ride it out. we've seen that happen in washington d.c. or he can take the tougher choice which is i think almost

every lie he has made. apologize to everyone and anyone for as long as it takes. secondly you've got to change your life here. there is a real problem here. we are country of second chances. when people are willing to turn her life around can own up to this, then do it takes to earn trust and respect again. we are willing to do that. i am hopeful he chooses the right path here pretty quick. gillian: with reaction of ants on this are pretty chaired committees in the past of your insurance committee he was slated to serve and would you feel comfortable having him as a member? >> well, right now he would not be on a committee that i lead. and frankly he's got to take some huge if he wants to regain trust and respect in his district. at the end of the day he has got to make that decision. gillian: talk but the former president's tax returns now, you railed against the democrats decision is made to release those let's play a quick look

back. parks over our objections and opposition democrats on the ways and means committee unleashed a dangerous and political weapon that overturns decades of privacy protections for average taxpayers. the air of political targeting of congresses enemies list is back. as you well know servicemen tradition in american politics dating back to the late 60s the presence of voluntary or candidates release her tax returns. why is it that president trump in your estimation should be an exception history? >> this is not whether about president trump should have release if that's not the law it's a tradition. it's not what is in the tax returns frankly that's between the taxpayer and the irs. this is a dangerous new precedent. overturns 50 years of protections for american taxpayers that began in the watergate era. now that is all change.

simply the ways and means chairman senate finance chairman of either party has nearly unlimited power to target private citizens were not just public officials, not just political enemies not just supreme court justices were private americans to seize their tax returns and make them publ public. usually in an effort to embarrass or destroy them politically. so every american ought to be frightened by this precedent. as he said the enemies list is back. you may will find yourself on it. gillian: take a listen to the former president and his own words and look at your reaction. >> but one under order i won't do it if i wasn't under him i wouldn't do it for them that one under audit i would not give my taxes i would love to give them but i am not going to do it while it's very simple. >> in the release, there is no evidence that the president was under audit during the years he told the american people multiple times that he was in

use that as a justification to not release his returns voluntarily. >> in the returns we saw he is under audit for all six of those tax return years plus a number eight of his business ventures that are affiliated as well for those audits are not yet complete. but that's not the point here gillian. to enter onto the second thousand 13 he told the american people for office. so coming to my point all of the six years that have been released are still under audit. the truth and the matter is that it isn't about whether he should release it or not. but it is whether americans should be targeted by members of congress for political purposes and having a plain text released and made public. this is a reality. this is a dangerous new precedent and every american

ought to be frightened. as an answer i do not want to belabor the point of clarification use any of seen evidence the president was in fact under audit between 2015 and 2020 is that right? >> in the six years every transit have been released he is undergone by the irs and all six years. i want to transcend this now. but give you an opportunity to show reflecting time in washington. when you look back, what do you think americans will remember most about them from peers? >> well, i think you sound very pro- growth agenda. i'm very proud of the work i did with the president and reforming the tax code. we saw 6 million americans out of poverty. we sat household income more in one year end 2019 and in all eight years under president obama and vice president biden prince resolve income equality shrink in the first time in half a second century.

>> guess that is only one element of the very strong agenda. house republicans made it clear in the commitment to america that we want a nation that is safe. an economy that is strong. we want a washington that is accountable. what a future built on freedom. america has been in the dark the last two years about what their government is doing. there was one of waste, fraud and abuse in east vandross forgiveness economy no contract is job number one for republicans, creating a nation that is safe in our communities along the border. basically a priority for us. i would not be misled by one element holds washington accountable. this is an agenda that is sourced sorely lacking in america today. i am excited about republicans in the majority. and as i said i'm optimistic about the future. i know who i work with in congress for there is a middle class. you do not see them or hear them

for humans for all walks of life to learn. >> i think that's absolutely right, gillian. i think we think about pope benedict you think about what he's best known for is he resigned present first pope to do so since the 15th century which we heard lauren green talk about at the top of the show here. that will be his legacy. he resigned understand that this point in time he was not the right person to lead the church into this new era and gave it over too pope francis. and at the same time while he resigned he remained quiet for the rest of his time on this earth but he will be remembered for that. the leadership of staying quiet and resigning and knowing i am not the strongest person to lead to something that's very powerful. >> certainly a complex legacy. let's turn now to politics. catherine, we talked about incoming representative elect george santos a moment ago with kevin brady. how does this type of thing make it pass all of the political

operatives whose job it is to vet candidates. and specifically how did democrats dropped the ball twi twice? >> it is pretty stunning. the scale of the falsehoods and the deceptions and the statements and i think we are still unpacking all of it, correct? i think there's a lot more we need to know about what happened in terms of the candidate of vetting and review from democrats. there was some reporting from a local newspaper raising some questions before the election but that did not really get picked up for whatever reason. and now you are in this situation for all of this has been revealed after he has been elected. which creates problems for your hearing calls from both sides for investigations for questions about what to do, questions parts of his bio we're still trying to figure out where his finances are coming on for example. and it really puts kevin mccarthy in a difficult position as he heads into this vote on

tuesday over the speakership. he has been very careful so far not to say anything critical about santos because this is a vote he might need. gillian: charlie, house republicans handling this? not only is santos is taking a seat as he is insisting he will do but they as a welcome into committee assignments? >> well, it truly is a remarkable example of a failure on the part of the media i thi think. to have not smoked more of this out before now. but, i think it is also important to remember the guy does represent seven or 50000 new yorkers. but he did not just when he won by six points which is pretty extraordinary considering all we are learning now. he sounds like a real nut job. but it is not the first example of where that media has dropped the ball on these things. when you look around at other members of congress, other politicians who have done very well for themselves not the

least of which is joe biden himself, who has spent his entire career at lying about his biography. lying about his accomplishments. lying about where he went to school. and so it's kind of interesting how much attention is suddenly being given to this guy while he does represent seven and 50000 new yorkers and that is a very important position, it is not like he is the leader of the party or anything like that. but i think it's probably good we are digging into all of it. i wish we would've done it before the election that might've been a little more helpful. >> certainly for voters. richard comment democrats of slammed house republicans plans for oversight and the new congress specifically they laser in on the investigation surrounding hunter bidens born in business dealings but they say straight up the american people do not care. >> listen, this is going to be the question we're going to have to ask ourselves the next couple of days.

what did the american people actually care about? do they want to see more blockbuster investigations in front of all the cameras are to the action want to see a congress that gets things done for the working people? sitting in the middle of all is is a fact right now as we speak kevin mccarthy does not have enough votes to be the speaker of the house. so as he makes it more concessions to the far right to members of the freedom carcass of his party and give them things like select committees that are catchall to investigate everything from anthony fauci to the fbi to how generate six rioters were treated and they were incarcerated. this will be the question the american people ask themselves, as this congress serving us as well as they thought they were when we decide to elect them? and on top of all that they too have to do with representative elect george santos and his resume. and the lie after lie after lie that comes out. while we have seen some tried to make comparisons between him and other elected officials the difference is we know where those officials went to college

it unfolds on the republican side. and see some new leaders rise in the democratic side. the big think we need to be watching us we have been talking about his how they're going to work together or not work together across the aisle. the white house obviously we are not expecting to see the legislative collaboration was seen in the last two years and have been sitting significant bipartisan legislation but on things like infrastructure, on guns over the summer. there are some things are going to have to work on like the debt ceiling for example. we are going to have to see how they will work together while house republicans have been very clear about a series of investigations and oversight that they want to do and how that will define the next two years. gillian: panel we've got to take a break right here. we come back the supreme court case that is putting a pragmatist justice against a purist and tearing up washington and the progress. we will be right

empty-handed. >> certainly the secretary is saying he is going to push to make sure people are made whole it was a disastrous holiday weekend, holiday travel season for so many people stranded across the country people who miss celebrations of the family paid people who lost baggage et cetera. he is saying he will address this. he is facing pressure from both the left and the right on how this is going to unfold. what kind of measures need to be put in place. what kind of checks to bug you on airlines going forward. and how will people be made whole? there's a lot more to this we will have to see how it will unfold and how it will be resolved. she said let's talk title 42 now. richard, neil garces blessed they held the white house this week in his dissent over the ruling. he writes quote should not be perpetuating administrative edicts designed for one emergency only because elected officials failed to address a

folks to apply for asylum in their home countries. especially pre-existing relationships are in the united states. a decrease event is wednesday border crossing by 70% into the united states but that's not enough. what needs to happen is a new congress to pass legislation into, create a legal pathway for those folks living in this country in the shadows to come out of the shadows i'm a part of our society. so far look ahead at 2023 this a lot of hope but no chance congress will do anything about immigration. charlie, what responsibilities do elected republican officials in the border states have here? >> i think unfortunately because obviously immigration is a federal issue. the court several on them. it should be and i agree with richard this to be a situation handled responsibly by the federal government and congress has failed to do it. the one bright spot of the last

several years is president trump solve the immediate crisis at the border. he did not fix the larger immigration crisis members of both parties in congress have sort of ignored since 1986. donald trump did solve the immediate crisis at the border by doing exactly what richard just said. to go down talk to and work with mexico and other countries to keep the migrants from coming to our border in the first place. president biden because of trumper because he cares more about foreigners and he does about americans he does not like the united states he hates our borders i do not know why has made this decision to undo all the things trump put in place that solve the crisis at the border and created this humanitarian and national crisis of millions of people pouring across our border. that is a 1% created by joe biden.

by the way i think neil gorsuch i also agree with him for the court is not supposed to be that legislative body of last resort. but what is interesting here i do think the court did biden a bit of a favor by keeping title 42 in place. it is going to keep this horrible problem from getting even worse. gillian: cap and i want to make sure he turned to the former president's tax returns. those returns are being held up people are seeing in them what they want to see republicans either beautiful, perfect, exemplary tax returns. democrats say they offer direct proof of the former presidents corruption. >> that's often the way in washington, right? everyone seeing what they want to see. certainly knew ahead of them coming out they would have different views the democrats were arguing this was necessary for oversight reasons

republicans say sets a bad precedent. certainly these returns show us more about how the president use the tax code, used business losses to his advantage where they show more detail about charitable giving and that she gave a lot in the years he did not give any money to charity at all. there's a lot to unpack here. certainly one thing to look at moving ahead as the political opponents from both parties could try and use information of these tax returns as he runs for president to try and make arguments about the successes of his businesses or failures. gillian: charlie what did you make about the point it's a new political weapon that's being unleashed. forget the fact trump did not voluntarily release them, congress should not be the ones making that call. >> certainly donald trump broke a lot of norms. that's not a newsflash exactly. it is a dangerous precedent. we have seen in the past mitt

romney releases tax returns that did not stop senate majority leader harry reid at the time from lying about on the senate floor and claimant mitt romney never paid any taxes which is a light. he never apologized for onset it works. mitt romney destroyed his campaign for the big take away for me from trump's taxes are two things. one is donald trump.poor by serving in public office. people like joe biden and nancy pelosi have made a fortune on government salaries working in public office. that is a big difference. to me that the most important take away. all his hoople squalling about trump's tax return put in place all the irs rules. all of the tax loopholes that donald trump took advantage of. i really do not know why they're so upset about all of this. alicia: rigid and going to be 15 seconds of a button on it.

europeans that we are in this for the longer fight. what ukrainians want more of is more assistance from the united states that they can grow their leverage to enable a future peace negotiation. i do not think it's right right now. i think russia still feels like it has cards to play. they are buying new weapons from the iranians are putting more troops on the field. ukrainians it was like they've a long way to go. after all they are winning and making progress. especially in the south. while zelenskyy can put out a peace plan to here's what i get to eventually no one is in the mood to really compromise yet. talk to that point zelenskyy is pursuing and asking for peace summit at the same time he when he was in here in washington a few weeks ago he asked congress for a full slate of offensive weapons per what does that tie what he sees the end game on? >> think zelenskyy knows he has

to keep his foot on the gas in order to get russian out of his territory before the west gets tired of funding his campaign. i think that is a big rub here frequency signal especially to the europeans he is willing to do peace talks eventually. zelenskyy came here and i'm glad he did to thank the american people for the generosity for finding and transferring weapons to the ukrainian people. i think ukraine's defense in their war with russia is in the actual interest of the united states. they are also able to degrade the material and manpower of the russian army so we might be able to eventually pivot to asia and not worry so much about russia if they are degraded.

more they will put to death by execution. i think they are firmly in control right now. but eventually they are sowing the seeds of their own destruction. >> what about the nuclear deal? do you think the protest and affect public opinion there and iran is now so firmly against the deal could mean it is dead once and for all really? >> i know biden keep saying it's dead. his administration said something like it's not on the agenda right now. i think they want to revive it is soon it would be decent in their mind to do so i don't think they can do it right now and the protesters are on the streets getting killed and the rest by the regime. i think they want to keep it warm and return to it one day. i think they have the sort of religious zeal they believe this is the best way for them to tackle the wrong program, the eye ron issue. even if the deal was struck with them is not that great on nonproliferation issues.
