thing. it is a new year and a new era here in washington tomorrow, republicans regain control of the house of representatives and their first order of business, picking the person to lead the chamber congressman kevin mccarthy, the longtime minority leader. he is running for the speaker's job. on sunday, he held a conference call with fellow republicans hoping to address some concerns about how a speaker he would operate. he was reportedly saying the simple fact is that congress is broken. and needs to change now. mccarthy is walking a tightrope within his caucus because he needs 218 votes to become speaker. and as you can see, the republicans only have a slim majority, so there's little room for mccarthy to lose votes here overnight. nine republican lawmakers who have yet to back mccarthy announced they are glad to see some concessions being made, but they also believe more needs to be done in their letter. they write, despite some progress achieved , mr mccarthy's statement comes almost impossibly late to address continued efficiency.

this quadruple murders two months ago. the university of idaho, kohberger's downstairs neighbor told the following about it, "it seems like he never slept because he was always doing something at night. i don't know how he could kill people because he doesn't look that tough." we are all phd student so it takes a lot of hard work and smarts to get to this point." and he was also a recovering heroin addict. the prison stabbings of those four students and finally spoken out rushing to his defense after his arrest friday morning. the family said again, "we will fully cooperate with law enforcement agencies in an attempt to seek truth and presumption of innocence rather than judge on felonious assumptions." the teaching position of part of the phd program in 2,000 miles from idaho to pennsylvania to allegedly hide out at his parents home in the poconos but the weapon has not been found.

>> ashley: we will bring in jonathan gilliam, navy seal. jonathan with all we heard from lucas in that report and everything that has come out since this guy was caught in pennsylvania, how hard is it going to be to prove anything without a murder weapon? >> we don't know what other evidence they have but typically they can put a person using the cell tower information in the dna evidence once they start building a motive and start building a picture of his movements and evidence that puts him in there at the time of the scene, then it is going to be an easier case to prove especially if his dna was actually mixed in with the dna of the victims. >> todd: john, one of the many reasons that we love having you want you can look at situations and pick details that maybe the

rest of us are not paying attention to. based upon what has been publicly put out there about the suspect what stands out to you as an investigator about his profile? >> first of all, i think the knife will be found if the investigators are diligent about the search. i think when you look at the type of weapon that he used, that type of weapon was probably not something he just grabbed and decided to kill with. it is probably a weapon he has used before. so it is like a trophy. i think they will be able to find that weapon and potentially it will be in pennsylvania somewhere. i think looking at the reports of people who live in pennsylvania and a bar where he used to come in there, we actually start to get an idea who this guy is. he is of the dark triad, mack pavilion, narcissistic and psychopathic. when you put those things together and you look at the type of crime that happen, you

look at the way that he maneuvered after the attack, than what you are going to start to see is that he is a well thought out individual, puts cells in his career field but somebody regardless of whether he has empathy or conscious or not still has a deep hatred of who he is, but lacks the consciousness to stop himself in fulfilling these dark desires. when you look at the totality of all of these things of who this person is and you put those with the actual attack and how he moved, it starts to show us where he might have slipped up. and i do think there's a possibility that he may have been intoxicated that night when he carried this out. it might be one of the reasons why they were able to find dna in that location. >> ashley: you know, investigators are confident he acted alone, but he did, he was

quoted asking if anybody else had been arrested when they caught him. did that stick out to you as strange? >> it did very much so. i think the fact that he was in kind of in authority position, i wouldn't say authority, but as a phd student in the university, i think what you might have seen is that he could have somebody subordinate to him that he told things to her that knew of this. when you look at the columbine attacks, for instance, there are times where a psychopath will be able to bring somebody along with them who will either take part in it or will have knowledge of it and do nothing about it. so that if something also that i think investigators need to look into. >> todd: meantime right around the corner islamic extremists attacking three police officers with a machete and security checkpoint just blocks from

times square new year's eve celebration this week and peered as a former fbi agent and new york unit for special events, explain how somebody who is being watched by the fbi's counter terrorism task force can still pull off an attack like this? >> well, somebody who is being watched versus somebody being surveilled are two different things. we have to realize that. if he's made threats in the past, they will be keeping a watch over his social media. he could have had his phone tapped, and there could have been an investigation going on with him that they closed already. i'm not sure about any of this stuff, but it may have led to them not surveilling them on that night in particular, although i do think if it comes out that he was actually a target of the new york office and he was not followed or his whereabouts were not checked into that night, then that is a big problem because typically,

when we have people who are known subjects who may be involved in terrorism, when it gets close to one of these types of events, they will make sure they can put that person down where they are that night. >> ashley: you know, as a wife of new york city police officer in counterterrorism unit and this has where my husband who has worked this numerous times, so it is concerning for the family members of police. it is concerning for the police for these types of things to be happening. my question is, is security not tight enough when we have these large gatherings, especially such a publicized gathering like the times square new year's eve celebration? >> well i know this is a hard thing for the nypd wife to hear. for a lot of people, but the reality is that security worked. it can keep that individual from getting inside and attacking other people. so, that is what law enforcement, the hard part about her job and we are out

there. i worked eight years and was in charge of their liaison and the coordination in that area. when i did the threat assessments and operations order on that, i always knew there was a possibility that if we make this ring as strong as possible, that ring is where an attack is probably going to happen. there is just that event alone. there are some several other events in new york. they are so big. i work sometimes in new york where you will have 2 million people in times square for new year's. there is only so much you can do to build this perimeter and keep the people inside safe. unfortunately, what that does is create other soft areas. one of those areas is where law enforcement is that that is most likely the place where that type of attack happened. they did what they needed to do. i think it says a lot about the fact the guy showed up with a knife and not with a bomb.

i think the experience of this guy was not what we have seen before. but it is also a reminder that these threats do occur. >> ashley: i hope that they keep him locked up, you know come away from the public as long as it takes and to get to the bottom of everything and they don't just release him back to the streets. >> todd: this is new york city. >> ashley: jonathan gilliam, thank you for being up with us on january 2nd, i guess it is the holiday now, we appreciated it. happy holiday. >> happy new year. >> ashley: crime crisis new year's eve rocked violence across the country has eight people are dead and 32 are hurt in shootings. starting in alabama, people were seen running for their lives while shooting broke out during new year's celebrations. police and one person was killed and nine others were here at chicago, 12 students reported over the weekend. 16 are reported dead and dozens others are hurt. victims range in age from ten years old to 55. the state of wisconsin reporting

seven shootings this past weekend. so far, no tests have been confirmed. to a fox news alert, at least 14 people are dead including ten guards and 13 injured after a gunman and bullet proof vehicles open fire on a mexican prison just miles away from the border. around 24 inmates escaped before the military and state police able to take back control pier that prison is 9 miles away from the u.s. border and 10 miles away from el paso. no word on the arrests. >> todd: debbie lesko outlining details at the southern border as republicans prepare to take over the house. >> republicans already have a bunch of legislation ready to go to introduce. i have legislation myself that would reinstate the remain in mexico policy. we also have legislation that would require that illegal immigrants be turned back to the border if there is not enough to

restrictions and other countries. but morocco starting tomorrow will plan chinese passengers from entering their country. do you think we will see more countries and places to follow suit now that these new numbers have come out? italian officials with bloomberg said half of the passengers on two separate flights tested positive for covid and the countries will test rivals from other countries. these numbers are startling. >> here is the bottom line prevention is a pound of cure and we have noticed that. the incredible impact of shutting down schools and look down into this country. we do not want that again. so a little bit of prevention here may offend some people but at the end of the day, taking time to present to mike prevent chinese travelers from coming here. it is not practical to simply say, "show us a test." because if the test shows negative a quarter of the test shows up negative are actually

because nothing really has prompted this other than the fact that north korea, like china, like russia sees that we have a week, we seem to have a weak executive leader out to lunch at the moment. what they did unlike 2020, we had four missile launches and in 2022, we had 90, more than 90 ballistic and cruise missiles launched. now they are saying they just tested two icbm style missiles, they aren't armed but they were showing they could do it. so it means three things for us, number one, we need to think harder about deterrence and focus on north korea and make it clear and make it ultimately clear and unacceptable price for hitting any of our allies never mind the united states. number two is we need to work hard on ballistic missile test. we have lift the gas pedal but we need to push the gas pedal and the last thing we need to do

be any type of tax across the board which eventually trickles down to all of us, it is really going to hurt and we are going to feel that. why do we have higher taxes? it is very simple: congress keep spending. nothing is for free. the more they spend, the more we have to pay. >> todd: the dialing down on energy prices, they are already through the roof. that was the story of 2022. so why would democrats pass legislation to raise taxes even higher on already high energy prices? it makes no sense. >> what is kind of a stealth tax, todd. remember, this goes back to inflation reduction act which passed a while ago. they put these taxes and effect into 2023. so because it's not in income tax, it is not necessarily something that hits the news that quickly. so, now we are talking about natural gas tax, crude oil tax,

coal tax. you say, i don't use coal why do i care about that tax? wait a minute, coal is used to create energy. so, all of these energy costs we are going to peel across the board and of course, the winter months. that is the worst possible time for these time gnomic things to take effect. >> todd: basically the providers get taxed and of course they pass that tax on to you. dan, you know me pretty well, i have run out of likes to shut off in my house and i can't yell at my family anymore to sht off lights. we are tapped out and there were no more lights to shut off. listen, there is no question there. i just wanted to vent. walk us how the retirement accounts will be impacted, even though many of us don't even know what a stock buyback is peer that is another part of this that was a little bit confusing, hoping you can sort of explain it to us. >> sure, what happens with stock

buybacks is when you have companies that have excess cash, they go and say, "instead of paying a dividend, we will purchase our stock back." so what happens there is the company's earnings-per-share, which is an important factor to look at look much better. okay, how does that affect all of us? all of us have 401(k)s, iras, and pension plans. while we have the stock in those plans, right? so when companies buy that stock back, we get a windfall. we make more money. so, if we have an excise tax on corporate buybacks, corporations are less likely to do that. and then all of us don't get that benefit of having that stock purchased at a premium. >> todd: my gosh, dan, look, i'm full of rhetorical questions or complaints or disguised

questions but how much more can they squeeze the middle class? they being the powers that be? >> they will continue squeezing until people start to fight back when they vote. because that is what politicians listen to. everything they do is based upon reelection. so, when we all get to the point, and we should be there of paying so much tax, of being burned by inflation that we say that is enough, both the bum's out. that is when things will start to change. if we continue to accept the status quo as we have been doing, well, then nothing will change, todd. >> todd: this will impact everybody. i got a note from energy company basically the introduction, if you thought your bills for electricity were bad in 2022, just wait for 2023. that is a great lead her to get at the beginning of the year. but it is a reality that will face every american. happy new year to you, my friend

today it is one thing or the other. each constituent has their own problems, obviously, i should about earlier in the segment. rising prices and taxes. people really care about securing the borders and making sure that we can control the increased criminality. making sure we rid ourselves of the indoctrination into military cabinet and school system and protecting our children. we need to stop ourselves on the reliance heat of the nations china and russia to join the western hemisphere. so we have to start thinking about what the priorities are based on national security, based on health and economic crises as well as get back to america and unleashing american energy once and for all. >> todd: before you can get down to any of that, there is this major elephant in the room and not just because the g.o.p. single is an elephant, does kevin mccarthy make it across the finish line as speaker? >> you know, i'm hearing so far.

but one of the big stipulations was to ensure we brought back a rule that has existed for a very long time that nancy nancy nancy pelosi got rid of, which is the ability for the rest of the body to hold the speaker accountable if they do not follow through. i'm not sure who threw their hat in the ring. i've heard a lot of different murmurs. i think we will come together january 3rd and do what we are supposed to do to govern. at the end of the day the infighting, the squabbling with behind closed doors when we think about the american people and needs to get done. that is things like managing the checks and balances and out-of-control spending and get our inflation under control. >> ashley: explaining the importance of quickly picking a majority leader. take a look at this, corey. >> we move on, the freshman members sworn in, you have to have a speaker. you have to have rules you are following. so the vote we will have on

tuesday is extraordinarily important. i hate to say as soon as we get the majority, this is how we are starting off because there are way too many things we need to focus off when we are in the majority. >> ashley: cory, the concern for the public, there is so much bickering going on right now just to get a speaker. as she said commission makes perfect sense, they need to be thinking of the public. what do you think? >> my congresswoman is right. how we step in january 3rd amount domestic matters to the american people and to unite and take the week. it wouldn't be overly concerned but we will come to a decision. i think this is something that should've been been done the last two years and not fall to the freshman class however, we are prepared to lead and get in there and make things happen. this is about the american people at the end of the day and not any one party. >> todd: to that point, obviously this is a mess for the republican party going forward
