this time courtesy florida. thousands of flyers that were facing hours and hours of delays even if they are not flying southwest. that log jam of jets going out of florida on the last day of holiday travel has the faa delaying flights on the ground. looks like the new year, the same as the last year when it comes to frustration and flying. we're live with the breaking news ahead as we enter a third house of fox live coverage. >> danger and distress. that's what migrants are facing every step of the way on their journey to the southern border. a harrowing report highlights the worsening trauma of migrants even before they reach the united states. that is where we begin in this hour, hour number 3 of fox news live. i'm molly line. >> i'm rich edson. with the resources strained, a

dangerous humanitarian crisis getting even worse. >> we can't continue going to way we're going. the drug cartels will get richer and the criminals will embolden themselves more and we'll have complete disregard for the laws of our country at all. >> fox team coverage begins with former acting dhs secretary chad wolf standing by. >> but first to matt finn live in los angeles. matt? >> hi, guys. i was at the border last week. when you're there in person, the humanitarian crisis is undeniable. in the summer in the extreme heat, men, women and children arrive in the united states pleading for water and on the verge of heat stroke. we see migrants just collapsed to the ground in exhaustion. the migrants tell us about graphic stories of rape and robbery. some say they have their money taken along the routes by police and criminals.

migrants tell us about walking through thick jungles and exposed to wild animals and bugs. once the migrants make it here, they have no guarantee of roof over their head. children being bright in to the united states by adults that are not their parents. arizona republican congresswoman debby lascaux has called for the biden administration to fix the border crisis. >> it's a absolute mess. it's a humanitarian mess for the illegals coming here. girls are getting raped, girls are being sold into sex slavery. i talked to the inspector general of dhs. they said they're not properly vetting where these kids are going. >> despite the ongoing humanitarian disaster, the president has never visited the southern border. the white house insists he's

working on the crisis. >> the president has done the work to deal with what we're seeing at the border since day one. >> and the biden administration says problems have voted against its proposals to better secure the border. rich? >> thanks matt. molly? >> let's bring in chad wolf, the former acting dhs secretary. thanks for joining us. we begin another year with the humanitarian crisis. we don't seem to see any light here for this coming to a potential end. what do you predict here in the coming months of 2023. >> well, unfortunately what we are in store for is more of the same. we've seen this almost two years. the biden administration is really not doing anything to secure that border. they're not doing anything to dissuade these migrants from making this dangerous journey in

to the united states. they continue to admire the problem is all i can say. admire that they have a crisis but not willing to take some dramatic steps and dramatic actions to curtail the illegal activity that we have on the border. so you're going to continue to see this crisis month after month after month. the numbers that they released just before christmas were the highest numbers that we've seen in december for quite some time. so they continue to break record after record. so i don't see any end in sight. their plan is the same, to process more and more migrants in to the country. >> fox news channel has covered this extensively. we heard this report from matt finn. bill melugin has reported on these numbers nonstop. americans underestimate the numbers. here's the total number for fiscal year 2022. 2,700,000 plus border encounters. when you talk about what americans think, what they believe regarding these crossings by illegals, 55% think

there's less than 500,000. just 6% a you'lly understand the real number being more than two million. how do you change that? our coverage has been nonstop. we are doing the work to get the information out there. if americans don't understand the real breadth of the problem, how can we pressure our lawmakers, our president to make a difference? >> well, it's a tough question. you're right. a lot of americans don't really understand the border. you have the president, even the vice president. they haven't been to the border. they haven't talked to the men and when to know what is going on and help them do their jobs. you can continue to cover the border. the challenges that you have there are so overwhelming the difficult situation that we have is you can't change this dynamic overnight. so the longer that this administration continues to accept the fact that they have

an overwhelming crisis and willing to take certain steps, they're just digging themselves deeper into that hole. so it takes, again, leadership and will to make some difficult decisions along the southern border to bring it back into a more orderly process. that's what -- certainly what the border patrol men and women want, an orderly process and not be in this crisis day in and day out. this comes with a new majority in the house of representatives that are able to now do some oversight to bring some of this to light, to really shine a light on what's going on in the border for over two years. you haven't had the secretary of dhs testifying before the united states congress. he's done it a handful of times. in over two years, the middle of the worst crisis, he should be up there almost every month detailing and being very transparent with the american public on what's going on there. >> the gop will be taking over the house here shortly. we'll see if that leads to some of these questions being asked

and potentially answered. when you talk about what these migrants are facing, once they arrive here in the country, there's an enormous backlog. a pile-up effect that is occurring. when it comes to these asylum cases, pending cases, 1.6 million. all right huge numbers. the average wait time 4.3 years. so even once migrants that are planning to seek asylum arrive, they get to the end of a very long line. and the line that continues to grow. we're not seeing the numbers to a great degree. your thoughts. >> you're continuing to see a growth because we continue to see numbers every month that are just historic. 230 or 240,000 illegal apprehensions in a given month with only 20 or 30,000 perhaps removed under title 42. these are astronomical numbers that we have never seen before. this idea that you process your way out of this crisis is absurd. so you're going to continue to

see the backlog and the numbers grow. at the end of the trump administration, we had that asylum backlog closer to 16 or 18 months. it's closer to four years. unless you do something to curtail the number of illegals, the number of folks released into the country under an asylum claim, that they know is fraudulent, you're not going to get control of this problem. it comes back to leadership and will and the ability to make policy changes that will change the dynamic on that border. >> we're talking about being two years into the biden administration. we're waiting to see if president biden will announce if he's running again. what do you do to create political will needed to address something that has yet to be addressed and continues to get worse. >> well, i think first of all, oversight and shining a light on -- fox does an incredible job

covering this crisis. until others pay attention to it, it's going to be very difficult. hopefully with the new congressional oversight, it's harder and harder to ignore the crisis. the border state governors, governor abbott and governor ducey and others are taking action that are causing the left and certain democrats to react. whether that is bussing migrants around the country or taking some other actions. so i think some of these activities can be done at the state level and you have to continue to push them in court. there's a number of things that can continue to go on the next two years. but accountability and making sure that we're not holding the biden administration accountable but holding these migrants that knowingly break the law and knowingly pay cartel members thousands of dollars to break the law and holding them accountable and not releasing to try to show up for a court days that we know they'll never show up for. >> chad wolf, thanks so much for your insights here as we begin a

>> rich: new details are emerging about a man that attacked three police officers with a machete. a high ranking nypd source says the attacker was alone wolf inspired by radical islamic terrorism. a trend that's been a concern in recent years for law enforcement. david spunt has more from working on the.

>> you can see it on the screen. the suspect was on the radar of the fbi. law enforcement talked to the suspect a few weeks ago. 19-year-old trevor wickford from maine is not an isolated case. the fbi continues to see more and more of these cases as time goes on. the george washington university run as program on extremism and tracks incidents like with americans that commit these lone wolf attacks. 239 people have been arrested for isis related crimes since march 2014. 194 have pleaded or been found guilty. this is originating in 34 states. rich, the majority of these people are u.s. citizens or legal permanent residents. the times square case has some typical hall marks on provoked, isolated an someone that pledged allegiance to the islamic state. this attack occurred on new

year's eve, eight blocks from times square. according to authorities, bickford pulled out a machete-style enough and started swinging. two were injured and sent to the hospital. you can see the weapon there. this posted by the nypd. bickford was sent to the hospital after an officer shot him in the shoulder. the george washington program reports that the peak of what they call jihadist activism originating in the united states is between 2014 and 2016. however, law enforcement still continues to track cases along with g.w. the good news, the officers expected to make a full recovery. rich? >> rich: thanks, david. molly? >> now to a fox weather alert. severs storm threaten the southeast. forecasters are warning that flash flooding and tornadoes are possible.

the highest chance of severe storms over parts of texas, arkansas and louisiana before then shifting in the days to come. >> a travel nightmare unfolding in florida where we're watching the live feeds from airports spread across both of florida's coast. what are we seeing? a lot of nothing. that's because the airways over florida are so busy on this final day of the holiday travel season, it has hours long delays racked up as jets are grounded. charles watson is live with the breaking details. charles? >> good afternoon, rich. really busy up there in the skies. flights destined for florida are experiencing hours-long delays due to an air traffic control issue. the faa confirms to fox news is that the issue is with the computer system of eram at the

air traffic centers that handles inbound traffic into florida airports. so to ease congestion, they slowed the number of flights to florida airspace as they try to resolve that issue. the miami airport appears to be affected the most at this hour according to flight aware. miami international is experiencing delays of anywhere between 1 1/2 hour and 45 minutes. ft. lauderdale international is seeing delays in the same time frame. orlando international sees disruptions but considerably shorter with delays now sitting anywhere between 30 to 45 minutes. tampa international appears to be doing well considering the situation. they posted on twitter that miami air traffic control is having some issues at the moment. almost all flights are in and out of the tpa are unaffected. so folks that are flying out of tampa don't seem to be having

speaker. his team floating last minute concessions in order to shore up the votes. will it work? we will ask karl rove. he's standing by. first, we head to senior congressional correspondent chad pergram. chad? >> molly, house minority leader kevin mccarthy lacks the votes. he agreed to demand of his opponents. they want to lower the bar to kick him out if they don't like the job he's doing. the house can't do anything until they elect a speaker. >> sometimes it's taken hours, sometimes days, sometimes weeks. hopefully that won't happen. the america people voted the senate and the house. the american people want us to be unified. >> the house is paralyzed until it elects a speaker. they can't even swear in members. the vote for speaker has not gone to a second ballot in 100

years. the long test house took to pick a speaker was two months in 1856. >> shouldn't be in a hurry to make a bad decision. it's worth it to fight a few hours, a few days to get the best possible person for speaker instead of surrendering to the establishment. >> republicans hope to have a big majority but the smaller majority is commuting expectations. the gop is worried about how bad this looks after winning the house. >> you could have total chaos. the republican party right now is in the greatest danger of meltdown that its been since 1964. it's a remarkably short-sighted and selfish position. >> on two occasions, the house made it easier to elect a speaker after the house struggled to elect speakers in the 19th century. it adopted resolutions to award the speaker's gavel to the member with the most votes, not the person with an outright majority of the entire house.

molly? >> molly: it will be interesting to see how dug in that anti-mccarthy vote ends up being. chad pergram watching it for us. rich? >> rich: with that, let's bring in karl rove. thanks for joining us this afternoon. is mccarthy doing the right things here to secure the speakership? >> well, he's trying awfully hard to get the speakership. that's caused him to make some concessions. i expect he would prefer not to make them. let's see if he gets the votes. i'm doubtful that the gang of five, the knucklehead caucus some have taken, will bend easily. their goal, you heard it from mr. goode. mr. goode's object, he's a sophomore member. he has no interest in who the speaker is. he said that before. i don't care who the speaker is. as long as it's not somebody currently in power. this is about power. it's about kicking out the longstanding leadership of the house that has worked very hard

to get there, get if majority there and replacing it's in the minds of these five malcontents with one of their own. something that they would choose. it's interesting none of them have done much at all to help get the republicans in to the majority in the house. they've not raised money or campaigned hard or articulated a winning message. they were overwhelmed in the caucus when they had a vote on what should be the caucus' cand candidate. they want to be in charge and the five of them will use the leverage they have to get this charge. >> you think mccarthy has given away too much to that group? they have already decided that mccarthy has exceeded to the demand that five members have to say hey, we want to have a vote on vacating the speakership here. does that begin to kneecap what he can do as speaker moving forward? >> i'm not certain how much it

kneecaps. there's a big difference requiring five people and and then one person. in the politics that we're in, you can see democrats trying to gum up the works saying we want to declare the chair vacant. you have to move to it right away. certain amount of time to debate. they can gum up the works. so at least five requires you to get a cobble of people together that say we're going to do this, which is better than one. a lot of what he's agreed to is widely accepted. get rid of proxy voting. the people that will never show up for debate, we had one democrat from hawaii who was not in washington for the better part of a year. you know, a number of those changes are constructive and have wide support. the desire to have one person on the house floor and jamming up everything saying privilege

motion, i declare the chair is vacant, let's remove the speaker and be guaranteed a certain amount of time and energy and effort and an absolute vote, that is not constructive at all. >> rich: karl, the white house going up pennsylvania avenue here is facing a re-election if the president decides to run. his press staff has been talking about low unemployment, talking about a economy that continues to grow. why not tout that and move that in to 2024 and make that your case for becoming president? i know you've written about this before. what is your case? >> well, look, the president's people say that everything is honky dorie. great. economy is good. people are coming back to work, et cetera, et cetera. people don't believe that. the guy has a 43% approval rate. it was 45% at the beginning of last year. you'd think if the economy was booming that the numbers would get better, not worse. nearly two out of three americans thinking the country

is going in the wrong direction for a very important reason. inflation is bigger at the end of 2022 than it was at the end of 2021. wages, i think it's now 19 months in a row, wages have been rising at a slower rate than prices. so people are falling further and further behind. i think this is a mistake for the president to be so focused on running for re-election. if he does want to run, my advice is use 2023 to be constructive and lay a predicate for winning re-election in 2024 rather than engaging in weird politics that suggest that everything is great. it's not true of the voters and of democrats themselves. >> rich: you think there's any possibility that we have a 1980 situation here that you have some in the democratic party, some who will challenge the current president if he decides to run?

>> rich: i think there's a real likelihood of that. what is to be lost? i've written about this a couple times in the "wall street journal." we've had 32 years which we've been givened by somebody that is a baby boomer. that was preceded by 32 years that we were governed by somebody from the greatest generation. we're at the same point that we had in 1960 when the american people said it's time for a generational change or in 1992 when they said we like george h.w. bush but it's time to give the baby boomer as chance. it's going to happen and may happen with the democratic party with somebody challenging biden who will be 82 by the time of the election or 86 if he won and served an entire second term or if it doesn't happen, it will happen inside the republican party. may happen inside the democratic party as well if biden does follow-through and say i'm going to be a candidate. there's people that say i'll

treat him with dignity and respect but i'll make the argument that we need a change in energy and change in generation. >> rich: biden declared today, they would be the two oldest in history. molly? >> molly: all right. we go now to our next guest for reaction. jose is the former dmc pres secretary. i want your thoughts on some of the things that carl just talked about. starting with what is happening in washington right now with the speaker's race. he talked about five malcontents. do you think that this battle going on with the republicans and kevin mccarthy and the speakership does weaken the republican party? they'll be in charge now. >> i think it does. it shows the division within the republicans as a whole but the republican leadership. i think mccarthy will get elected as speaker.

the question is not so much whether he will get elected or not. the question comes is can he lead the republicans to work with democrats to get things done for the american people. that's the real question. >> molly: now shifting to the run for the white house, we're expecting president biden to say whether or not he will run as early as february. he had some victories in the mid-term. the red wave did not materialize. he talk about what he feels are economic victories. karl rove saying it's not how americans feel. should president biden run? do you think he will? >> i think he should run. i think he will run. i think he needs to run for the american people. he beat donald trump, he beat the last election. whether he can do it again whether it's trump or desantis. he's in a better position than a year ago. this president has set forth a record setting of legislation. this is bidenism at its best. there's no better candidate than

for joe biden to be the next president of the united states. >> molly: no better candidate. let's say the democratic party does need another candidate. is vice president kamala harris that candidate? her approval ratings have not looked so good. favorable rating at 39%. unfavorable at 50%. you think she would be the options that democrats would turn to if not for president biden? >> first and foremost, if joe biden runs, which i think he will, kamala harris will be haven't once again. we have a slate of candidates if the president decides not to run that kamala is one of them but there's other options. i'm not worried about that. democrats are united behind joe biden. i'm optimistic. i think he's going to run. jill biden, rumors that she supports the president. he's been talking to his family. i think he's going to run for office. i think he needs to run for office. no better candidate to be the

next president than joe biden. >> rich asked a great question to carl. someone might step up to challenge president biden. you're arguing that the democrats are united. do you she a potential challenge from within? >> i don't think so. i will say on the other side, on the republican side, i think democrats, we have to be careful with people like ron desantis. i think ron desantis will be a bigger threat to job if he decides to reason than trump. we beat trump already. he's got a lot of obviously political baggage, legal baggage. i don't think donald trump is the right nominee for the republican party. but if they go with ron desantis, that will be a bigger threat for democrats not only because he's from florida, he's a younger candidate and we'll see how he can do in the national level. we have to see whether the governor decides to run or not. he's preparing himself to run for president.

then the real question is how trump and ron do on the political stage. >> molly: if you were going to give advice to president biden, what would your advice be here? >> talk to the american people. don't spend too much time on the defense. talk about the things you've done for this country. talk about the accomplishments. talk about how you've been able to bring people back to the middle. people are not interested in extreme left or extreme right. they want a moderate president. this is why -- we saw it within the same democratic party. we saw bernie sanders. he didn't get elected as the nominee. there's a clear message that the american people are looking for politics as normal. they don't want this divisiveness that we saw with president trump. so if he talks to the american people and talks about the good things he's done and will continue to do as president, he will do just fine. >> molly: all right. jose, thanks for joining us. appreciate your insight here as we kickoff a new year and

potentially another run for the white house. we'll see if president biden decides to do it. >> all the indications point to whether the president can do it again. it's tough to say as a sitting president, i'm not the person to do that. i've already won. we'll see what the landscape looks like. >> molly: people will make those trips up to new hampshire and things will unfold. >> rich: yes, yes. idaho police say 28-year-old brian kohberger acted alone. they haven't been too quick to rule out additional suspects. our analysts will weigh-in next. >> there was some defensive wounds. meaning that the -- some of these victims fought back. if kohberger's skin is found under the nails of any of these victims, it's over.

>> they had the dna evidence while he was in idaho, they would have arrested him in idaho. to let them go for four days with being observed and then arrested him in -- that would indicate there were other things besides dna that were involved. >> that was pathologist dr. michael bowden saying while dna evidence led idaho police to focus their investigation on brian kohberger, they probably needed additional evidence to arrest him like a white hyundai elantra. they fund that the kohberger's parents home last week. we could get a first look at the suspect tomorrow in court. his attorneys say he will waive his extradition, which means he could be back in idaho within days. let's bring in our panel. jack is here from the fbi.

bob bianchi is a criminal defense attorney. jack, you think the prosecution that police have with they need here or what are their next steps to prove this case? >> thanks, rich. without seeing the evidence in front of me, rich, obviously they have enough probable cause. they have enough evidence gathered for a judge to sign the warrant for the arrest. as some of your other guests have mentioned, there's other things other than dna they're looking at. they're looking at phone records, they're tracking him. we can ping the phones and identify where he's be and look at the history of somebody's phone records. that will give them also more probable cause to maybe say hey, this individual, the defendant here was stalking the victims for some time before this event happened. >> bob, police say they have their suspect here and he's the

only suspect. you think they should be looking for more suspects or are they looking at more, do you think? >> absolutely. as a former homicide investigators we do that for two reasons. one, to make sure there's not another suspect and two, when you go to trial and we talk to our investigative staff and sometimes there's tension there, we have to eliminate every single possibility that a defense attorney will say that they went to a certain conclusion and disregarded the possibility of all other things. so one, you do it for the health of the investigation and two tactically you're doing it to eliminate defense arguments down the road. secondarily, the prosecutors right now want to make sure that they're looking at the case. even if they have enough evidence, i agree. we don't have the affidavits. they're not only looking at proving the case beyond a reasonable doubt but anticipating what will the defenses be in the case. could it be an insanity, impassioned provocation.

could be self-defense. what prosecutors do, they want to continue to develop the evidence so they can also eliminate what they anticipate will be the potential defenses at trial. >> rich: jack, we had several weeks between the murders and the arrest here. is that a normal timeline? every case is different. what do you think took this long to get a suspect? >> rich, in a case like this, they're dotting their is and crossing their ts. as bob said, investigators are working side by side with multiple law enforcements agencies as well as the prosecutors. they're not going to submit that affidavit forest after they feel they have a probable cause. as bob mentioned, you have to think about what the defense will be here, too. the reason that maybe he didn't get dna that quick for what you said earlier in the show. there were defensive wounds. so the theory of transfer where every time an event takes place or crime takes place, ed is left

and brought away from the crime scene. as you said, if there's any hairs, fibers, blood, saliva, anything, such as that, that was cross contaminated or across the scene, we can match that up. the defendant will have a hard time talking his way out of this one. >> and defense attorney will likely to point out that police have yet to establish a motive around could likely argue that maybe he was in the house before the murders. his dna, it's a college house. people go all the time. what do you think defense attorneys are going to be pointed out here? what kind of case are they trying to build? >> exactly what you just said. a prosecutor always wants motive. that's huge. motive is not an element of offense for murder. so it doesn't stop the prosecution. of course you want a murder weapon what is relevant here, what is the dna that was recovered. is it underneath the fingernails? as we indicated, trace evidence

is going to be very important. of course, there's some anecdotal information out there that there may be evidence that shows that his phone was pinging around those victims days before the incident. prosecutors will try to tie all of those things together to say that this isn't just somebody that was there, maybe unless some dna on a phone but rather this is a person that is the perpetrator. no matter how you add it up, they go through the social media history, the electronic data. the question asked before, this is an immense investigation. it takes time to do this correctly. i wouldn't doubt that they surveilled him for the purposes of getting some of his dna. they can try to match the dna of his with the dna at the scene. 19,000 leads, tens of thousands of cars. this guy may have -- is in the vicinity. i heard that he was on one of the victim's social media
