speak with overnight tweeting damar hamlin suffered a cardiac arrest with a hit, a gae versus the bengals and on the field he was transferred to the uc medical center for further testing and treatment. he is currently sedated and listed in critical condition. the initial reaction of many was that they had never seen something like this before and damar hamlin briefly stood up on his own after making a tackle and before collapsing back onto the turf. now, an ambulance being brought out on the field. before he was rushed off, hamlin received cpr several minutes and many players visibly shaken and some of his teammates in tears. both teams coming together for an on-field prayer before returning to the locker rooms. again, suspended the game over an hour before the game postponed as everyone awaited updates on damar hamlin's condition. holding an nfl conference call with the decision just after

midnight. >> players, frankly those coming to the game all traumatized. what was most important tonight, it was not about proceeding with the game. frankly, that never crossed my mind internally. look, i've never seen anything like it since i've been playing. so immediately, my player that went on. in such a traumatic event occurred. >> space five's parents brought to the game. they rode with their son and the influence to the hospital. lighting candles at the medical center overnight for prayers for damar hamlin pour in. josh allen tweeting, "please pray for our brother" and the bengals receiver involved with the collision with hamlin, i am praying you pull through, bro.

and kelly tweeted never before have i witnessed anything like this. the game doesn't matter, praying for damar hamlin and his family, the bills flying back last night was some staying in cincinnati as hamlin remains hospitalized. there is no word if or when the game with the bengals will be continued. it is squarely on him as it should be. >> todd: brooke, thank you, let's bring in jason page sports reporter and analyst, jason great to have you on the program on a tough morning here. you heard that comment came throughout brooke's peace. nobody had ever seen anything like this before. in all your years have you ever witnessed what happened last night? >> no. look, we have seen guys partially and temporarily paralyzed and a whole host of different issues over the years, but never anything quite like this. it almost feels like a lot of people are going to go to the player safety route in the

story. this actually isn't a player safety story. this is like a lightning strike peer the confluence of events that had to occur in order for him to wind up in cardiac arrest, getting hit in the chest at exactly the wrong moment. it is a hit we see every day in the nfl. this is something you would see every weekend and you wouldn't think twice of it. to have it happen this way, you know, we always thought if there would be a tragedy like this in the nfl, sadly, we thought it would be head trauma, head injury, paralysis, neck injury but i don't think anybody could have imagined it would happen this way. >> ashley: you know, when you look at the play over and over again, it was not as hard as some hits as you have seen on a daily basis, especially with football. you said it is not a player safety issue, then what is it? what type of issue is this to keep it from happening again? >> you can't. this could have happened to anybody at any time.

in a zillion years we have been playing football's, we've had concussions, broken legs, broken arms, back injuries but you've never had anything like this. the reason is, it doesn't happen. there was no way to legislate or protect these players from something like this. i had doctors on my show last night. i have had players on my show last night. as much as people want to go towards player safety, everybody i have talked to seems to believe the same thing, he just got hit in the chest at exactly the wrong time. guys get hit in the chest all the time. maybe you get bruised ribs, bruised sternum. you don't wound up in cardiac arrest. i think there was something to be said for waiting and taking a breath on this just a little bit. because we don't know if there is any underlying issues. something that hadn't been previously diagnosed. we see these things although time. grant wall passed away in qatar

covering the world cup. no one knew he had an underlying condition until it was too late. hopefully, this kid survives this. he has 24 years old and it is a terrible story. hopefully he survives this and we can get some answers as to exactly how this happened. >> todd: it is too early to speculate but to the extent a lot of doctors and nondoctors are saying, which is the situation the heart just happens to be the inopportune worst time. we have seen this happen with little kids in little league. we have seen this happen just like on the street. you get a light punch from a buddy in something like this happens. so we have a lot of questions we still need to answer. instead of the medicine, let's go to the medical response by all accounts, the nfl has made it so the best medical professionals are on the field to deal with a situation like this. it seems like last night was no exception. what is your assessment of how they responded? >> i thought they did a

brilliant job in the most difficult circumstances, the ambulance was out there right away. a lot of people asking the question, why didn't they get off the field faster? the reality is when you are doing cpr and using a portable defibrillator, the actual suggestion is to do it outside of an ambulance. not to do it inside of an ambulance because you have moving parts, the vehicle moving around. they suggest to get the heart started outside of the ambulance and then transport once you have done it. so for all accounts, it feels like medical personnel did a brilliant job and do just about everything they could to save this kid's life. >> ashley: a lot of players coming out overnight saying this is traumatizing, especially for the players on the field and for really anyone watching that year they had to actually cut to a break. you know that is not a good situation when tb does that. do you foresee any changes with the nfl following this? >> i don't.

and look, i'm going to say this again, and i said it at the top, this was a one in a million shot that was like getting struck by lightning. and i don't know how much more you can protect the player. i am as crazy and fanatical about player safety. no one screamed more on the radio airwaves that i have about the fact that they have to protect players from head trauma and do what don't make a stronger chop with that. but beyond that, i don't know what more they could have done in the situation to protect from this kind of freak sort of flute accident that occurred to this young man. if you protect them anymore, how do you tackle a guy? it is not possible. so much like nascar, where guys know what they are signing up for. we know what the risks are in the nfl. guys drive around a track 200 miles an hour side-by-side in sometimes three cars wide.

sometimes, people get killed. in the nfl, players know by now that the risks are there. you do as much as you can to mitigate it, but the players know what the risks are peer they sign up to make millions of dollars. then, they know what the risks are. they never think they will wind up in the hospital with cardiac arrest though. >> todd: that's pull out the obvious in terms of hitting, damar hamlin is a paid hitter, a defender, a safety. it is his job the offensive player which is exactly what he was doing in the situation. you have to feel for t higgins, the player that damar hamlin hit and obviously he didn't want this to happen when he is trying to protect himself and the ball at the same time. let's focus on damar hamlin at a moment. everything i read about this young man his praise for his worth ethic and enthusiasm, his leadership on and off the field but what else can you tell us about it >> let me tell you one thing, he put up a toy drive in

2020 on his go find me page and he was still in college at that point. the goal on it was $2500. apparently people after this incident tonight found that gofundme they have now raised over $3 million! >> todd: wow! >> in a matter of hours in donations, which is amazing. it is a toy drive. to tell you all you need to know about this kid and how strongly people feel about him, the fact that people have gone peer at this incident, we say it all the time sometimes it takes tragedy to see the best in people. we have all these conversations about social media and the sand that. tonight is one of those nights where social media and twitter and that came together in the universal town square to give thoughts and prayers to that young man and people went above

and beyond and still going above and beyond to carry out his mission of getting toys for needy children in this toy drive. it is amazing. it speaks volumes about what people think about him. >> ashley: jason, how do you think the situation with him will change or affect the rest of the season? >> that is the big question that a lot of people in football circles are asking. does the league postponed the playoffs by one week? this is the game between the two best teams, to have the best teams in the afc. a buy potentially on the line. the nfl does have the luxury if needed of pushing back the playoffs one week if need be because you have a two week gap between the conference championship games in the super bowl. that is one avenue they can go. the other avenue is and look my talk to a national nfl writers about this tonight. last night, what they were talking about maybe they rule it a tie. i don't know what the ultimate solution is because there are

games coming up this weekend. this game is not going to be made up this week, which means if it is made up, it needs to be made up next week which impacts the whole playoff schedule for the following weekend. no, honestly, is this the biggest thing in the overall scheme of things? we are talking about this kids life? no, but it is something that from a competitive advantage standpoint or, you know, the leak has to think about. >> todd: kudos to the league and the coaches of all teams. everybody involved for realizing there is a lot more at stake than just a game but somebody's life. everybody involved made the right decision. focusing on the players, focusing on the bills team, we have heard all season long that this bill's team, the buffalo bills team was as tight as you can be. they are likable among teens that are their enemies, their rifles. how do you think that helps not only handling recovery, knock on would but the bills community,

buffalo on the whole and the nfl on a hole? >> listen, this is small -- the nfl is close-knit for eternity. think of the hundreds of millions of people in the country. there is 1500 nfl players in the league. you are talking about a tight-knit community amongst players in the league, the players in buffalo. they will rally to support them in a big way. and i think this, look, you try to find positives in a situation like this but right now the best thing we can hopefully get is good news about hamlin. everything we are hearing is not very optimistic. >> ashley: of course everyone would put his well-being ahead of everything. but as you know, we mentioned there are still things behind the scenes the nfl has to do. you have to deal with both. >> todd: whether it could be done in a situation, it is unclear. there are so many medical questions, jason we will have

♪ ♪ >> ashley: the clock is ticking for kevin mccarthy as he looks to show support to become speaker of the house. he needs 218 votes. g.o.p. members say they want back in. >> todd: alexandria hoff as the new congress to convene with a cloud of uncertainty. boy, alexandria, you can say that again appearance because this is getting tumultuous and he doesn't win the gavel a second will be conducted and has not happened in a speaker vote in 100 years. 222 republicans to be sworn in today and mccarthy must reach 218. he only has four to lose. in an effort to narrow, heat demand over the weekend to make it easier for members to remove him from the position if they didn't think he was doing a

good job. with that, mccarthy feels like he is in a good spot. >> it there's nothing he's done to earn my boats were indicates to me he will change his pattern since he's been in the leadership where part of the swamp cartel. >> right there you heard from republican congressman bob good. he is among those who say they will not be voting for kevin mccarthy. right now as many as 14 still not satisfied. the election for the speaker will take place prior to the swearing in of members and delegates. the sense from the large majority are supporting kevin mccarthy. they say not voting for him on the first ballot would simply hold up business republicans have been eager to get to. once again for kevin mccarthy does feel like he has had a good position today to earn that gavel. i will send it back to you guys. >> ashley: alexandria hoff, thank you. the cofounder of speak georgia and the first question they keep saying he siding with the democrats on some things and not

the right person for a speaker, but what is the reason behind it all? why are they so mad about it? >> yeah, that is a great question. it is something i ponder myself. i want republicans to understand this is bigger than a politician. it is bigger than all of that. it will set the tone going forward. i think what we are seeing you have a party that believes in the issues that the american people are currently paying attention to like inflation, like the border, and things like that. then you have the party, focusing come i should say on things that they think the american people should be paying attention to like hunter biden, the twitter bios, election integrity. i think all of it matters but at this point, we need to unify. when i look at what is happening, he has enough votes that he has majority of support. so i think we should get behind that and that's what the hell should do in order to unify and be able to show the main stage

and the world that we have stability. >> todd: there are 222 republican members of congress here they can walk and chew gum at the same time and divide up all these tasks. that is a general point from "the new york post" that echoes what you say, janelle. if they really cared about opposing president biden, they meaning those opposing mccarthy would vote for mccarthy and move on to important business of investigations and legislations. that key point needs to be made pure nothing can happen until you have the speaker. all this talk everybody who has panned out their chest over the chest of the biden administration which has not been good by any stretch of the imagination. they will not do any of that list say that vote for a speaker. at the end of the day, janelle, what do you think happens? do we have a speaker by tonight? >> i absolutely think representative mccarthy become speaker and we will have somebody by tonight.

but it is important that we show we are a unified party. a look at what is happening when it comes to the biden administration and the liberal left that is becoming increasingly more and more progressive. what we need to make sure as we step into this role we are stepping into this role with our focus on making sure to fix the issues the american people elected republicans to fix here this goes back to the economy. which goes back to education and the border. that is one of the things i did commit speaker mccarthy talked about, i did hear him talk about and i think it is important here that is why we need to unify around this. i am personally not a fan of the clause to put a political firing squad, however if that's what he needs in order to get us across the finish line, let's go with it. >> ashley: what do you think the democrats are thinking right now? the republicans are promised these investigations as soon as they take over control of the

house but they can't even come to an agreement and they are bickering before it is even starting. >> i think the democrats are looking at at the same way as they were before in this position. when there is a divide. the democratic party also their own divide and they have the corporate dems versus the progressive spirit so they have their own fight to worry about. but it is important for us to show that we can unify, and that we can move forward with this. there are a lot of issues on the table. i'm concerned about this as well. but i'm concerned what is happening in our schools. i'm concerned about inflation, gas prices. that is what the people are focusing on at this moment. >> todd: what do you think is the final straw for 14 house republicans who say they will not vote for mccarthy? because we were just talking the break, the spending bill and significant concern although may

not be to the level of these 14. but what do you think the final for those 14? >> i think it comes down to numbers, even though part of the minority that is not supporting him at the end of it i don't know if you have someone to take in the same amount of support that he has. so opposing him for the sake of proposing, that is what it came down to and didn't make a lot of success. i hope they saw it as a means of being able to show that even though there may be disagreement and disagreement is democracy, we are okay with that even though there is disagreement, we can unify and move forward. >> todd: we will see by the end of the day. i don't want to say that is pollyannaish because i don't want to insult you but optimistic way of looking at it. we will see if those 14 cave, you know? >> i hope so. >> ashley: janelle king, thank you. >> todd: so many big stories. idaho suspect expected to waive

>> ashley: we are back with a fox news alert come with the police chief shot and killed and another officer hurt trying to apprehend a suspect wanted for a probation violation. the gunmen reportedly stole a car before crashing into a housing development outside of pittsburgh. hours later the officers located the suspect who was killed in a shoot-out. just to mcintyre became chief of the breckenridge bureau police department in 2018. the fellow officer said the fallen officer live to serve

others. justin mcintyre was 26 years old. the murder suspect bryan kohberger not expected to fight extradition in pennsylvania meaning headed back to idaho momentarily. >> todd: jackie ibanez. >> good morning the public defender representing a man accused of murdering kaylee goncalves, madison mogen, xana kernodle, and should be not tried in a court of public opinion. today's hearing comes as bryan kohberger studying forensic dna and prosecutors used to secure criminal convictions two weeks before the killings of the university of idaho. one student in his criminology class at washington state university said kohberger over world-renowned professor saying, "it is as if he knew better." he was pulled over twice in indiana during his cross-country trip with his father with idaho

to pennsylvania. he was traveling in a white car, and authorities have been searching and connection with the murders. kohberger's defense attorney said i know they were pulled over indiana back-to-back. i believe one for speeding and following too closely to a car in front of them. i don't know if they were issued a ticket but the father of kakaylee goncalves, he will not stop until true justice is served. >> i want to stand against this person who is responsible for this and i want to say that we will not let it go. our mission is to find justice. the code they are combing through kohberger's life as they identify emotive in their case, ashley and todd. >> ashley: jackie ibanez thank you. retired police officer and a homicide detective brian foley.

brian, the first question, kohberger was allegedly threatening guards throughout his pennsylvania jail cell claiming he screamed "i cut them and you will cut you." how and these types of comments holed up in court to potentially bring a conviction? >> that is the first i've heard of that. yes, they can be used against them and initiating those types of comments out of them. you better believe it and everything he says can and will be used against them. all those cells and paste on security and people dying and policing custody. all of them have recordings and that will come out. look, the defense attorney had a lot to say about that as well as the duress. but you can bet the detectives are jutting that down the time

and place when that happens. >> todd: as a lawyer on that question, i will ask the psychiatrist question on that. what does that behavior tell you? first those comments in them basically what the inmate said about him, his behavior behind bars? >> look, obviously there is a lot of deep issues there and psychiatrist to look at the crimes that were committed. you know, i like to use the term the serial killer or psychological type of murders here that somebody initiated. this is not a stable person but erratic person and all the information the detectives will use and they will bring experts into the courts. they will not be allowed to have a beef in it but certainly adding his behavior, everything. even when you make a 911 call, that is recorded. and they will put potentially other prisoners in cells working for the police. that is not the case here, but

those types of utterances in jails are used in the trial moving forward to. >> ashley: to follow up in the same report from the same inmate, she said she is alleging kohberger tried to expose himself to her when she was in a cell close to him. that goes to the behavioral point you were talking to, brianna. what are your thoughts on kohberger really sagging over and over that he expects to be exonerated? >> look, they will be said that. and it will be interesting when that comes out. the arrest warrant will obtain but it doesn't have everything in it but the nuts and bolts as we like to say. the facts in the circumstances leading to the charge. i believe it will be obviously the dna based on what the cop said but you better believe it is going to be dna. based on what the captain said, just the cops involved in just the lab, he they didn't find

anything. he is thinking above and beyond the family dna. but really, the burglary charge will be interesting to see. what that is going to detail is the fact he did not have a right to be in that dwelling. that will establish the lack of relationship as well, which is such an odd type of psychological killer type of move to do. you don't see that burglary thing if there is a romantic relationship and wanting to get my keys and the suspect says that kind of thing. you will not see that. the burglary charges will be interesting to find the lack of relationship. >> todd: we know he was studying criminology at the phd level. we have also heard conflicting assessments of his ability. we heard a professor say it was the best student i ever had and the reason i recommended for two phds positions in my life. you have experts think the crime

scene itself was extremely sloppy. now the we understand the behavior behind his bars. does it appear to you like he is trying to set up based upon his knowledge of how these things play out in textbooks? do you think he's trying to set up a defense? >> good luck with him and if he is he is smart to know that never works. that is his footprints if he has studied these types of crimes. he's good enough to know that type of thing rarely if ever works if in his capacity to get through life fairly successfully. the phd program, you have to have some faculties about you. i don't think they will run with that. defense attorneys will show a lot of pasta against the wall to see what sticks. >> ashley: this is the last question i have for you, brian pure less than a week ago, six days ago the police are honing in on kohberger. do you think that media

attention in this story help lead to that? >> yeah. look, sometimes people complain that the law enforcement is claiming media attention and every detective out there and everybody has cold cases and you want this kind of attention for your cases. i wish they cut this kind of attention and sometimes homicides happen all the time. and the victims families and friends care because with attention comes resources and some more attention the case gets the more resources they get, the more possible witnesses. somebody out there know something and that is why shows like this and people talking about it, it is an ugly, horrifying event. the good that can come out of it is one to stay vigilant and start to dig up informants, tips, information. somebody knows something, intention equals resources.

alejandro mayorkas the national council had dhs, how can you justify sending federal air marshals to the border in huge numbers when the border is in your words secure and there is no emergency? we have a major security incident right now affecting our aviation security. we have these brave men and women specifically trained to handle a tragedy or potential tragedy in the skies, yet these folks are on the border making sandwiches and serving as uber drivers for migrant spirit is that basically correct? >> that is correct, 100% correct. >> why? this makes no sense. >> this makes no sense and todd, these are our families. our families will apply these commercial crops. this will impact us the private jets and the dhs secretary and maybe the white house travel and appear at it won't hurt them but

for us, for people, this will have a very, very great impact on us. >> todd: that is a great impact another way this administration and the elites sticking to the middle class. we thought it was texas but literally air safety in the sky. to that point, you are suing the government saying the use of air marshals is a violation of federal law. where are we in that case? >> we do believe it is a violation and that dhs has overstepped their bounds. we are waiting for congress to get sworn in hopefully today. and we can get some move. we need someone to step in congress and stop the federal air marshals, the statute originally an attempt by congress was not to deployed air marshals to the border and to be clear, there is no national emergency. no national emergency declared at this point. so we are still saying we need an injunction from congress to not send us to the border. >> todd: obviously your point
