day out there. the first tuesday in january. thank you very much for joining us. the drama in d.c. starts three hours from now. keep it here on fox and we'll have am the details. >> you have radio. >> can the whole town hear ed sheeran. can you answer us if you're in the crowd? >> speakers in the street downtown. >> bill: good morning. there will be drama on the hill today. congress convening for the first time in 118th congress. hundreds of members sworn in. they need a speaker to do that. kevin mccarthy the vying for the gavel may not have the votes. the whole voting process could go well into the first ballot. something that hasn't happened for 100 years. republican conference set to meet at the bottom of the hour keeping an eye on that story today. another story now, sports world in shock this morning.

a terrifying injurey prompting the nfl to call off a monday night football game with millions watching at home. between the buffalo bills and cincinnati bengals. this morning a young man's life is hanging in the balance where we begin a brand-new year. i'm bill hemmer, good morning at home. hello, partner. >> dana: asme owe dana perino. this is "america's newsroom." we hope you had a very happy new year and we're here ready to go to bring you the news for a great 2023. buffalo bills safety damar hamlin is in critical condition. he collapsed on the field and something was very wrong. >> bill: the play it happened in the first quarter monday night football. hamlin is on defense wearing a white number three jersey right there. higgins makes the catch. leads with his shoulder into the chest of hamlin. hamlin stands up briefly. he signedly collapses on the field. >> dana: medical staff rushed to his side and started cpr.

the team announced he suffered a cardiac arrest. his heartbeat was restored on the field. >> bill: coaches and teammates looked on in horror. this went on for a while. 30 minutes. the medical staff loaded him into an ambulance and teammates were huddled on the field in prayer. >> dana: league officials were talking behind the scenes how or whether to move forward. they say the decision to postpone the game was an easy one. >> we saw the coaches and players and frankly they were all traumatized. myself personally, just thinking through what is actually happening and taking place realtime. >> an occurrence we haven't seen in our time. >> dana: clay travis is here with reaction. let's go to garrett tenney following the story from chicago.

hi, garrett. >> this was hard to watch. to give you a bit of context on what damar hamlin is, he was a star player out of high school and really could have gone to any big time program across the country but his dad was in jail for selling drugs and he had a 2-year-old brother at home. so he decided to play for his hometown team in pittsburgh so his brother could have a male role model to look up to nearby. his whole career he has done a lot of good in the community which explains why there has been such an outpouring of love and concern for his well-being. going back to last night, this happened five minutes into the first quarter of the game. as you mentioned this collision wasn't one that was particularly violent or vicious. it was a pretty routine tackle. you could tell right away something was wrong after hamlin stood up and started to wobble and fell straight backwards. medical personnel rushed onto the field and performed cpr for nine minutes and using a

defibrillator. he restored his heartbeat and they rushed the 24-year-old and his mother to the game to u.c. medical center, a level one trauma center which was a few minutes down the road. the latest update we received overnight is that his vitals were back to normal. he has been intubated and sedated for additional testing and remains in critical condition. fans gathered outside of the hospital overnight some holding candles. the entire sporting world is offering thoughts and prayers for hamlin including his teammate quarterback josh allen tweeted please pray for our brother and higgins, whose collision led to the medical emergency tweeted my prayers and thoughts go out to the hamlin family. pull through, bro. it was a big playoff game has been postponed and the nfl says its focus is on damar hamlin.

we'll keep you updated as we learn more. >> bill: clay travis, analysis. want to run so our viewers know. kickoff last night 8:30 p.m. eastern time. call for one. 8:55 damar hamlin injury occurs. 9:18 temporarily suspended. 9:25 the ambulance leaves. 10:01 game postponed. late into the night the bills announced that hamlin suffered cardiac arrest. i don't know what to say about it, clay. it is a game that involves massive collisions almost on every play. and it seems for this young man, age 24, on that play, he was hit in exactly the wrong spot for him physically. >> yeah, look. i was watching as i'm sure many

other people were as well. this was -- i believe you are a bengals fan. it came out of the rose bowl. people have been looking forward to this monday night football game for weeks because of the match-up between joe burrow, josh allen and playoff implications at stake here. everyone in the nfl was watching. if you aren't a big sports fan, this is the signature event alongside sunday night football where the nation is watching one game. to your point we've seen 5,000 hits, 10,000 hits in an nfl game that are far less severe than the one that we showed at the beginning of this segment and so as you watched him collapse, that was obviously incredibly ominous to see but it also wasn't something that seemed to be directly connected in the same way where somebody hit somebody and their head has to immediately be stabilized, which is typically what we see in

games like these. it reminded me -- this is going back in time -- to the hank gathers situation for people who remember the early 90s. he was an elite basketball player on that time. they later went to the ncaa tournament and gathers was left handed and beau kimball shot every free-throw left handed in honor of his teammate. but that collapse during a game scenario frankly and fortunately we haven't seen it very often. it happened in european soccer in 2020. but there isn't a direct correlation that is able for most sports fans to think of. we're all praying and hoping for the best for hamlin and i will say one great story, bill and dana, that has come out so far. his charity, which gives presents to underprivileged children, had an initial goal of $2500. i talked about this last night. this morning i just checked it.

over $3 1/2 million has been raised as sports fans and football fans all over the country have just tried to do something. i saw over 133,000 different people have now donated, which is, i think, just a sign of everybody trying to make some good out of what so far has been a tragic circumstance. >> dana: really great point showing on here the amazing outpouring of support. maybe talk a little bit about the bills and bengals and the sportsmanship and teammates' reaction last night. >> yeah. i think that's a huge part of this. this game was on the road in cincinnati. everybody is fired up and waiting all day for a massive game like this, the bengals come out and immediately score a touchdown and then it is interesting, josh allen and the bills came down and beasley, their stop wide receiver, allen

missed a throw that he would most likely hit. on the sideline he was disgusted with himself. shortly there after this pivoted. this is such a big part of the story here is football exists in a world of entertainment and frivolity. we the end to treat what happens on the field as if it's a massive story but we saw so quickly that difference between entertainment and real life between fun and tragedy and the serious things in the world of sports that suddenly happen, dana and bill. the cincinnati bengals stadium you could have heard a pin drop. what you saw so quickly is the common humanity of all sports fans coming together and i believe they have the cincinnati bengals stadium lit in the colors of the bills. maybe fans showed up outside the hospital where hamlin is fighting for his life.

again it symbolizes how sports tends to bring people together. how quickly this went from a fun contest to see who might be the number one seed in the afc to the story of a 24-year-old football player fighting for his life. >> bill: good to have your thoughts today. thank you so much. as you mentioned we'll have to hear from the doctors and hospital to get to latest word from cincinnati. talking about the sportsmanship. zach taylor the head coach of the bengals went to the hospital late last night. nfl sets the schedule months in advance and they knew that if these teams played the way they expected, that you would have a massive viewership and a lot of drama to determine the fate of both teams going into the postseason. what happens now? we don't know and we're waiting for the nfl to answer the questions based on the schedule. >> dana: we want to go back to capitol hill where the republican conference is set to meet this hour before the new congress convenes and that's when the house starts voting for

a speaker. this might not be like any other opening day in the last century. how so? congressional correspondent aishah hosni can explain what this day will bring. hi, aishah. >> good morning, drama and drama is what the delay bring. in the next 20 minutes we expect a meeting of the full g.o.p. conference ahead of the big involvement as hopeful kevin mccarthy tries to use every last minute to secure enough votes for his bid. last night mccarthy has partly moved into the speaker's office invited five groups of the g.o.p. conference to talk. he needs 218 votes. with a slim 222 majority he can only afford to lose four republicans. right now there are at least five republicans who openly oppose his bid because they don't think he is conservative enough and there are about nine

more ready to join that opposition. in the last 24 hours mccarthy has made some major concessions to appease these folks. he has offered up a new rules package which includes a very controversial policy that would allow any five members to call a vote to remove the speaker at any time. here is mccarthy monday night telling fox he thinks that these concessions will turning the tide. >> do you have think the rules package you released last night has moved any votes to yes? >> yep. >> and what will you do if you don't have 218 on the first ballot? >> fox is told that there are still some deeply unsatisfied and those opponents may vote -- will vote for arizona representative andy biggs instead in that first round and perhaps unveil a mystery candidate, dana, in the second round of voting. this is where we enter some historic territory. a second round of voting hasn't

happened for about 100 years on capitol hill. some republicans calling this a huge crisis for the g.o.p. >> dana: you are there to cover it. keep a journal. you might want to know this story later on. >> bill: allegations of a cover-up hover over the investigation in the hunter biden. what an attorney is accusing the justice department of concealing coming up. >> dana: a rocky year for the economy is in the books as stocks took their worst plunge since 2008. why your 401k could be in store for another hit. >> bill: seven weeks after false leads and unanswered questions there is suspect in the brutal murder of the four college students. how strong, however, how strong today is the case against him? he will appear in court later today. >> he wants to know why people commit crime, what is the key reason behind crimes, and how people think while committing

>> bill: so there is a suspect in the gruesome idaho quadruple murders behind bars. hours from now he'll appear in a pennsylvania courtroom. bryan kohberger will wave extradition to be brought back to idaho to face four first degree murder charges. let's begin with the reporting in pennsylvania. we're on the ground there today. alexis, bring us up to speed where we are at this hour. hello. >> good morning. here in pennsylvania this is the first time we'll see bryan kohberger walk into the courthouse since the murders happened in moscow, idaho in november. they believe he is the killer but kohberger's defense attorney says his client is looking

forward to being exonerated. this was the mug shot in pennsylvania the other day. he faces four counts of first degree murder and a felony burglary charge. the 28-year-old expected to waive extradition and taken to moscow, idaho. returning to the city where police say he stabbed these four innocent university of idaho students to death inside their off-campus home in november. sources tell me police matched dna found at the crime scene with dna that one of oh kohberger's relatives submitted to a dna site. they will try take to do their own investigation by the defense. >> sounds to me the defense lawyers are doing a good job. they've already stopped the idaho police from tearing down the crime scene so that they can have their own experts come in.

>> we know kohberger was a student at washington state a 10-minute drive from the crime scene in idaho studying to get a ph.d. in criminology. after he committed the quadruple murder, investigators say he went back to class. they say he drove his white hyundai elantra back to pennsylvania for christmas break with his dad. during the cross-country road trip reportedly they were pulled over twice in indiana for minor traffic offenses. we can tell you the victims' families are waiting for kohberger to have his day in court since day one. he will be in the courthouse later this afternoon. >> bill: thank you, alexis has a pennsylvania angle. >> dana: let's bring in paul morrow founder of the ops desk. one of the things you've been saying for a while to us watch the digital forensics and you were also supportive of the police department and the f.b.i. saying you believe they were going to get him. it comes over christmastime. were the digital forensics important to them finding him

that the point? >> we'll learn more later in the week. today just the extradition hearing. sounds like he won't fight it. he will be back in idaho fast. once he hits idaho, he will be in a probable cause hearing, an arraignment. read the formal charges. what does it matter? we'll get a copy of the complaint. that's the formal document that alleges what happened. there should be details in there that tell us a lot more how the police decided they had probable cause, which means what it sounds like. in their opinion he probably did it. we very well may find out there is some digital -- some of the reporting there is digital evidence beginning to point to him. i don't know that it will be right at the scene. sounds like he ob files indicated that according to what's out now. they can put pings from his phone that we've discussed on the show in the vicinity of the girls. soft victims in the time leading up to the event. and that might explain why there

was some speculation that kaylee had a stalker. >> bill: we were both away last night. every time the alert comes on your phone i tune in. two things stick out. what's the significance of putting out the description of the white vehicle, one. and two, every time the cops came on tv they deferred and were very tight lipped. >> they're remark will be atight on this for a large task force like that. they are to be commended. they did have some indication that it was him from the dna according to the reporting. i think what likely happened is they had somehow or other developed a data point of the elantra. when they got the name that went back to his father, up to that point it was okay, let's look for a kohberger in the area.

here is a bryan in the vicinity and look, he drives a white lon tray. so at that point you are really in the game. the question becomes if that's the case and they did know about him before he drove cross-country, what were they waiting for to make the arrest? were the two car stops in indiana, did they occur, why? was it planned or happenstance? a lot of questions left. i think we'll find out more later this week when we get a look at the document. >> dana: here is his attorney saying that mr. kohberger is eager to be exonerated of the charges and looks forward to resolving this matters as promptly as possible. the language that knows defense attorneys would use at this stage. you and lawrence jones will go back to idaho later this week. he won't be exonerated. the attorney -- that language to exp explain to the virus at home,

highly unlikely. >> these are some things that will come up after reading the formal charges. he may ask for bail. he won't be exonerated this week. we have to remember innocent until proven guilty. they could ask for a psych eval. the defense has roadblocks and things they can do that we'll begin to see this week, all part of the tactics that will go on here. i think waiving the extradition. he wouldn't gain much by fighting it. he is going back. one of the things lurking behind the tactics, though, is the idea that idaho is a death penalty state. >> bill: he was studying for a ph.d. in criminology and we'll see where it goes from here. thanks. we'll see you back in idaho later this week. a nail biter on the hill. kevin mccarthy trying to get enough votes to be the next house speaker. but that right now is an open

economist steve moore told me that spending added to the inflation rate outpacing wages. >> the difference between how much wages went up for workers versus how much inflation went up for the price of things that we buy, the heritage foundation says it is a $4 thousand increase in costs above inflation. >> president biden signed at least 5.8 trillion in spending into law. we have inflation now at 7.1%. gas prices on the rise again. the last seven days. american's checks don't go as far. california, for example, 8.3 billion in stimulus checks has been sent out. another 1.2 billion will be going out this month. other states also sending those checks this month. that's not long-term help for americans who will continue to feel economic pain as the federal reserve raises rates 2 to 3 more times this year and keeps rates above 5%. >> keeping it there as the

economy slows with these higher interest rates and unemployment rises with these higher interest rates and the economy slows, that's when they'll get the pressure to start reducing rates before inflation is close to 2%. that's what you already see coming with some of the politicians and so forth. >> the president back after a week of vacation. he has no public events on his schedule today. we don't have a chance to ask him about the economy. >> dana: a wintery day at the white house. >> bill: also in washington the new congress convenes for the first time this afternoon. the first order of business is to elect a new speaker where the drama begins. kilo kevin mccarthy's top spot is in question. we have two fox news contributors. thank you for you both being

here today. those who oppose mccarthy, what do they want? what do they not see in him? scott perry is a republican from pennsylvania. he was not part of those five who objected to him. he is in another batch now and put out a statement two hours ago that said we want him to agree to vote on a balanced budget. texas border plan, term limits, individual earmarks voted on the floor of the house and he is making the case mccarthy will not agree to that. is that fundamentally where it is or do you see it a different way? >> i think you're right. there are five members who say they won't vote for him under any circumstances. that's enough to if they hold strong that's enough to complicate his life enormously. there are nine others, perry, chip roy of texas, crane of arizona, freshman member bishop of north carolina. there are nine other letters who said we aren't inclined to vote for you unless you agree to a series of changes.

he has made a lot of those changes. many of them are rules changes that have importance to the outcomes in the house. whether or not that's enough to first get the nine members to begin to support him. one person who had said he would not support him morgan griffin of virginia, after mccarthy said i will agree to certain items said that's enough for me and i'll support him. we're likely to see at least 14 votes against him out of the 222 republicans and maybe a few more besides that. >> bill: if it goes that way, mark, where does it leave the republicans now in majority of the house that they fought so hard for? >> well, certainly from the democrats' perspective it is get out the popcorn. who knows, somebody may make a parliamentary mistake and elect a democrat speaker. maybe go outside. the speaker doesn't have to be a member of congress. look, i think the republican

party here is looking disunited and disorganized and part of the reason they didn't win is that they didn't really have a framework for the election that the voters felt confident about. i think this is just showing exactly that. >> bill: give me call for two. newt gingrich on monday. he wasn't holding back, the former speaker. >> the choice is kevin mccarthy or chaos. nobody will replace him. he has far more people totally dedicated to him than this handful of never enders. the result is going to be anybody who tried to replace kevin would face total chaos. it would be impossible to govern. it is a remarkably short sighted and selfish position. >> bill: what do you think, karl? had republicans won more seats mccarthy wouldn't be in this situation. >> absolutely. let's be clear. one of the leaders, if not the leader is the congressman named

bob good, i don't care who the leadership is. i want to blow up the republican party. he got elected two years ago only after kevin mccarthy raised and spent 1.5 million to get him elected in a safe republican seat and the national republican congressional committee spent 1.2 million. 2.7 million to elect this guy and what should have been a safe cismd he was a weak candidate. now he says i'm in charge. i have four other knuckle heads who agree with me and we'll blow it up and all we want to do is get somebody different than the people who are now in charge. that's a really short sighted and as a former speaker said selfish motivation. >> bill: mark, do you have a prediction for how it goes? we've been talking about drama today for hours. how does it work out? >> look, usually politicians are famous for coming down to midnight, to the very last

moment and then they come together. i still think there is a reasonable chance that happens. that's what intelligent politicians would do here. if that doesn't happen, you know, newt gingrich said it best. the republican party is in for chaos. it won't stop with today. that's just an indication of more chaos and a caucus that maybe can't be led and a margin that's unsustainable. a lot of problems until the republicans have a presidential nominee that could show a lot of drift in the party unless they get their act together by the end of the day and unify in a solid way and show that kind of unity which, as karl said in a clear bout of frustration, it doesn't look like it's happening. >> bill: mark penn and karl rove. thank you to both of you. >> dana: great guests today. what's interesting. i imagine if you're kevin

mccarthy and you had all this and being able to win back the majority. he got that done. the margins are slim. if you think about the states, you know them better than me in pennsylvania, for example. there were republican house races that were winnable but because republican turnout was lower because of the senate candidate and republican gubernatorial candidate you didn't get those votes. it will be very interesting today to see what happenings. we'll have coverage all day. >> bill: we racked up the power rankings. they underperformed the worst case scenario. the mid-term is not the way kevin mccarthy wanted it to go and hence they are in the situation they are today. this afternoon will hold drama. >> dana: today mitch mcconnell becomes the longest serving majority leader for the republican party and he won't get any attention. we make note of it but watch to see what happens in the house as well. the first round of severe weather in the new year is

targeting the far west and deep south. you might have been to the deep west this holiday. look at this dark funnel cloud. it was captured on video looming over jones borrow, louisiana. the twitter knocked down trees. thankfully no reports of injuries. in northern california i couldn't get enough of these pictures, so sad for these people. look at the severe weather unleashing intense flooding blamed for at least three deaths. torrential rainfall on san francisco, oakland and other areas. forecasters warn more rain is on the way. >> bill: it has been some kind of storm there. we're waiting an arraignment for disgraced ftx founder sam bankman-fried expected to plead not guilty. january 1st is street day when many folks look to jump start their fitness routine. one high-end gym says they don't want your new year's resolution business. oh yeah? jimmy failla is not one of them but he is next. >> there it is.

mexico. it's a small part of it but mainly this is an international human smuggling network. people showing up from 150 different countries taking advantage of our broken asylum laws and guaranteeing their entry into the united states perhaps never to be heard from again. so i think this would be one way for president biden to at least show that he cares or -- and is trying. certainly i would be happy to be one of those to work with him and our democratic colleagues to stop the flow and this humanitarian crisis. >> dana: would you want to join him on a trip if he decides to go? >> i would be happy to welcome him to texas and introduce him to the experts, the border patrol. they could teach him a lot as they have taught me a lot about what we need to do in order to stop this border crisis. primarily to stop catch and release. that's the problem we saw during the george w. bush

administration with people coming from as far away as brazil. once secretary decided we needed to detain people while we process their asylum claims, it stopped a lot of the flow. i think that is what we need again and president biden could learn that if he would just come and listen to the experts. >> dana: one of the reasons he will be down that way is he will go to mexico. in mexico we've been reporting here and you talk about it, the cartels are making billions of dollars on the border through human and drug trafficking. but they are causing a lot of violence and it's seems as if they're in charge of the country. just yesterday over the weekend a drug cartel assaulted a prison across the border from san diego and they freed 24 inmates and left 14 people dead and there was nothing -- not a blip from the mexican government. what can our president do to put pressure on the mexican

president to do his job? >> we've talked a lot about failed states like afghanistan overseas. we have a failed state, i believe, on our southern border. the president there has waved a white flag to the cartels. they continue to get rich smuggling people and drugs into the united states, drugs that took the lives of 108,000 americans last year alone. i don't think they've been a responsible partner. basically the mexican president said our american agents who were there to try to help them control the stem of people and drugs are no longer welcome in that country. a i'm increasingly concerned is becoming a failed state on our southern border. >> dana: 30 seconds left. want to ask you as the new congress begins today what do you think are the chances of some sort of bipartisan
