him, mccarthy does have plenty of supporters, 200 of many of them are angry this is turning into just spectacle. mccarthy himself played it cool, calm and collected late last night. at least publicly, telling reporters in part quote i think we'll find our way to get there and this is a healthy debate. it might not happen on the day we want it but it's going to happen. before the first vote was even cast yesterday morning, democrats predicted multiple problems for republicans. that is a familiar picture right there of democrats with popcorn. congressman elected lu tweeted about to go to the house floor with popcorn in hand even if they have been elected before

congressman elect yesterday at noon the last congress ended and they were about to swear in everybody after they got a speaker but they don't have a speaker. so everybody is designated as a congressman elect. meanwhile, the "new york post" summarizes it absolutely perfectly. they say grow up. small group of republican saboteurs blocks mccarthy from taking power. michael good win says stop this madness and go after biden. that's what you were elected to do. >> ainsley: making republicans look ridiculous. newt gingrich was on with sean last night. i was watching his show. he said on monday night he has sources that said they went in to meet with mccarthy. three of these individuals, these holdouts and they presented 30 demands to mccarthy. and he says it was blackmail. they were saying well we will vote for you if you give so and so a committee. if you give so and so the chairmanman position. he said you cannot give into these holdouts. we don't give into other people when there are hostage

situations we can't give in here. >> brian: so, what are they asking for? i don't know. you get to the bottom of it. one thing is pretty clear the meeting they had in the morning before the vote didn't go well because mccarthy said i'm done giving in. this is the way it's going to be. i deserve this. i have earned this. mike rogers warned everyone you better vote for mccarthy and lose senate seats. chip roy started cursing and said how dare you a hard no ever since. they want to get on the committees they want. everyone in the freedom caucus want to get on their committee. wanted to have that five vote margin if they want to oust the speaker. whoever it is. he got that they also want to set up a separate legal authority to investigate the fbi and other law enforcement agencies. and he did not want to give into that. he says we have systems and committees for that no reason for that. >> ainsley: pay down the deficit, too. ralph nor man. >> brian: in nine months want to raise the debt ceiling again. i want guarantee he is not going

from negotiation to a hostage situation. and 90% of the republicans that were voted into this majority can't be held hostage for the agenda of a very few. especially when there's been a lot of concessions toward that agenda. i think many of them were very good. but, defend, when asked what will it take and you don't have an answer, it just seems like it's becoming, i don't know, personal or there's not a real strategy there or the goal posts are moving. it's really not clear. but what is clear is what we were elected to do. that is to stand up to the democrats in the senate. to stand up to the biden administration and get this country back on track. and we have laid out in a commitment to america to do it. but we can't get started. we can't even swear in until we get past. this. >> brian: i think it's embarrassing for democrats in the beginning, great days on the other side. after a while i have my family here. i would like to get sworng. in get a picture have. a formal day. a lot of people worked hard and spent a lot of money to

we are learning new details about the washington state grad student's arrest. police say force was used in executing the search warrant at kohberger's family home pennsylvania early friday morning. investigators hired by kohberger's defense team went to the home where the murders took place. taking pictures of the property and gathering their own evidence. this all comes after a court order stopped the cline clean occupy of that crime scene. the affidavit allegedly connecting will kohberger to the murders is sealed until he is transferred to idaho. that is idaho state law. >> regarding mr. kohberger, there was some stories about some inappropriate behavior behind bars while he was being held there in pennsylvania. and yesterday, the monroe county jail warned said this guy has been a model prisoner. not caused any problems. he is held in a cell monitored by officers at all times. he has been quiet and followed instructions. so that flies in the face of what we might have read

ventilator so they are trying to get him to breathe on his own so we're just kind of taking it day by day. still in the ivu. they have him sedated so just continue to administer the medical treatment that they have been doing. i'm really, really thankful for the medical staff that have been working with him. they have been truly awesome in helping him with his recovery. it's really truly scary. >> steve: the uncle, right there dorian glenn said they felt likes a they tried to get him to breathe on his own initially in the ventilator he was on 100 percent oxygen. now he is on 50% oxygen and he said that is a good sign. he also said, you know, yesterday, while we were sitting here on the couch along with everybody else on television, speculating about his health and worry about any brain damage the uncle said the worry is actually any damage to his lungs. so that is one of the reasons why they have got him on this ventilator and have 50% pure

20. what's going to change today and why did he do it? congressman elect byron donalds joins us now. congressman, after watching the vote astoundingly and seeing 19 short. we saw you jump ship. first off, your mindset for doing that? what did you think would happen when you decided to go with jim jordan? >> well, a couple things. one and i had signaled to people i would vote for kevin on ballot one. i was possible on a ballot 2. i made that vote. at that point we were basically dead locked and it was pretty clear that he didn't have the votes. so my thoughts is okay, if he doesn't have the votes what are we going to do as a conference to either find someone to get to 218 or at a minimum adjourn wht we were doing, get off the floor so the needed negotiations can happen. i think that it was actually not in a good place for the republican conference to stay on the house floor yesterday and continuously vote. look, a lot of people back home are trying to figure out what's going on on capitol hill. what we are really having is a deliberative process about house

leadership. and about what is needed to get washington back on track. for too long in the nation's capitol everyone has done with along with the next wave of leadership. that's not an anti kevin mccarthy statement. that's a statement about what a deliberative open process means for the constitutional public that is the united states of america. >> brian: pete sessions who voted for kevin mccarthy about it no doubt about it the republicans have lost prestige and opponents to kevin mccarthy have dug in. he feels like there is a lose-lose. you don't feel that way? >> no. i think if you -- listen, i have not been here as long as pete session has. one thing i know about this place every time there is something going on we find a way to make it' ha. i firmly believe we will find a way to elect a speaker and make this happen. you have people nos against kevin. some of the though those members need to have one op. one meetings with him and hammer this out.

i don't know if that's happened or not. what i'm hearing it's probably farther apart than it needs to be. amp i talk with you this morning. sit with some members and try to find ways to hammer out a resolution so we can go ahead and elect a speaker and get down to the business that the american people sent us here to do. >> brian: i understand the demands. it's hard to get the demands. it's the weirdest negotiation ever. he agreed to allow five lawmakers to oust him. he did not guarantee committee spots to freedom caucus members as most demanded. he did not go ahead and agree to a legal board to pursue investigations and creating a select committee just to investigate the fbi. these are all things that you guys could have hammered out behind closed doors because your objective is the same way because you want to get the same results. these seem like small things. >> well, look, i think what you are talking about small are actually critical to the house moving forward. we know we have an issue with elements of the fbi. that's not a shock to anybody. we know that.

number two, with respect to the motion to vacate, the motion to vacate rule, whether it's been 100 years, 200 years something many speakers have lived under. >> brian: okay, but he gave in. >> well, no. he actually did not give. in he tried to have a five vote measure. there are members who want a single member motion to vacate which was the rule in the house. i know people back home why are you arguing about the rules in the rules matter in how you govern this place. because once we elect a speaker, the rules are going to dictate how the house functions that goes directly to the ability of us actually accomplishing the solutions that everybody wants to see here on capitol hill. i think if you go -- whoa, whoa, whoa, brian, real quick. >> brian: let me just finish. want to be speaker if you know one person could vote you out? >> if you are trying to have the job and lead you shouldn't be afraid of one person. and i have been very clear about this. i think too much has been made about the motion to vacate. that was a rule here for 100 years here or more about one

member being able to file it. in the real world, not the political world, in the real world, if you are going to lead a company, the board of directors at any time can hold a vote against you. it only takes one member of the board to bring a question about the ceo, the chairman of the board. that happens all the time. so, in here in politics, we're taking pelosi's rule and saying well, pelosi's rule that she changed is now okay? that's not true. there's nothing wrong with having a one-member motion to vacate. i think that any leader who wants to be able to stand firm and say look, i'm the guy. shouldn't be afraid of that. >> brian: congressman, do you blame him for 30 trillion in debt. >> no, i don't blame kevin per se for 30 trillion in debt. it's the institution itself we are why we are. we know washington isn't working there are members who want to make fundamental changes to it to get the nation back on track by getting the house of representatives working and functioning again. >> brian: how are you going to vote today? >> that remains to be seen. like i said there is a lot of stuff that needs to be

and we are expecting close to a foot of rain north of the san francisco area. so, this is the next seven days inundated with rain. it's already sat temperature rate offed ground. any more rain is just going to act as runoff. so i'm really concerned about flash flooding. debris flow. mud slides. and then the wind alerts, we could see 60 to 70 mile-per-hour winds. so that on shore flow is going to continue. this is a major, big problem for this area. ainsley, i know we always talk about the fact that we are into a doubt situation for california that much rain on top of what they have seen so far is going to be life-threatening. people are already being urged to stay inside. do not travel because rescue vehicles are just not going to be able to do too anything. that's a huge story. potential for severe storms across the gulf coast and it's going to be 65 degrees here in the northeast in new york city. so, fox weather has all your latest details. over to you.

>> ainsley: so bizarre. all right. thank you so much, janice. >> janice: you got it. >> ainsley: biden's border crisis overwhelming the keys as 'hundred migrants arrive in boats national park. forced to close, quote: for the safety of visitors and staff. the monroe county sheriff is now calling it a mass migration crisis. and that sheriff, rick ramsey joins us now with more. good morning to you, sheriff. >> good morning, ainsley. >> ainsley: good morning. so the reports were 300 migrants land at national park west of key west and 160 plus also landed in the middle and you were keys. and you needed help. you called out to the federal government. what happened? >> well, we have been dealing with increase in migration here for a elder pooh of time. buff it's really ramped up here. the last three to four days we have had about 30-something landings. just this morning within an hour window of driving here, i had three landings coming in here. so we are seeing record numbers of landing. we had two days ago 10 landings in one day.

we're a small rural county surrounded by water. so it's very manpower intensive. i'm having to pull resources all day long to respond to landings where we are diverting police irfire, rescue. dealing with just a mass migration for us for a rural county we consider mass migration. we are worried about the humanitarian crisis about this going on. border patrol is overwhelmed at our level. that we're having groups of migrants having to sit along the side of the road for periods of time waiting to be picked up, processed or taken care of. we called for a pick jump of a group of migrants they were so busy they told us they may not be able arrive until the following day. we are like what are we supposed to do leave a group of women and children and kids on the side of the road for a day, day and a half? no bathrooms? no food? no shelter? so it's a little concerning. we're all worried about the public safety of my citizens in monroe. this does affect my ability to do my job to protect, serve and

patrol and take care of my citizens. >> ainsley: so when they tell you they might have to sit on the side of the road for 24 hours and you feel like they don't have a plan, what do you do? >> well, we have to do what we can to help these migrants who are in a difficult situation, so we're trying to get medical attention. we're trying to bring them water. trying to reassure them and tell them the best of what we can tell them. there is only so much that i can do. we are talking about 120-mile long county with migrants scattered north, central, south. so we keep checking on them. we get a lot of calls because we see the group of the side of the road. we have already checked on them. but then people drive by and see these groups so they keep calling about migration. and we have to keep sending officers back out to make sure it's not enough new landing. so it's difficult because, you know, we are just worried about these people out seas 4, 5, 6, 7 days sit on the side of the road. it's frustrating we want the
