congress are out of touch and according to the majority, republicans. and it looks like a real good chance of rain. will it rain on kevin mccarthy's parade again today? stay tuned, buckle up. because, what happened yesterday we haven't seen in 100 years. >> ainsley: yeah. three different votes. and we still don't have a speaker. it is day two of this new congress. >> brian: right. it's got to be embarrassing. pretty sure -- i'll stop talking now. >> steve: republican leader kevin mccarthy says he will not back down despite hitting a wall of resistance in a series of failed votes with 20 fellow republicans lined up against him. >> ainsley: all right. start talking. >> brian: thank you. peter doocy joins us live from the white house with the latest. peter? >> peter: good morning, this vote is not really competitive. there are 20 against mccarthy. there are more than 200 that are for him. but, mccarthy took republicans behind closed doors to tell them he's earned this job. and he just is not able to convince enough members of his

own party of that, at least not yet. >> our candidate is jim jordan. he may not want it right now but george washington did not want to be president. he did what was right for his country. we have the numbers and sorry jim jordan we're going to make do you what's right for the country. we love you. >> peter: because of this process the democrat leader hakeem jeffries actually getting the most votes each round. you can see mccarthy gets the second most. in the first round there was a smattering, biggs, jordan. donalds. republicans all consolidated 19 of them in the second round for jordan. in the third round he actually increased his total. he had 20 to mccarthy's 200. even though he says he doesn't want the job. >> the differences we may have. the differences between joyce and jordan or biggs and bacon, they pale in comparison to the difference between us and the left which now unfortunately controls the other party. so we had better come together.

i think kevin mccarthy is the right guy to lead us. >> yesterday was the first day after the christmas and new year's holidays that everybody in congress and at the white house and at the agencies was back in the office. but, the white house was happy to keep president biden off camera all day so that all the attention could be on republicans. >> look, i can't speak to it if he has been watching the vote today what i can say is he has had a pretty busy schedule. he was a senator. he understands how this process works and he is just ♪ going to assert himself. >> peter: this president and this white house insert themselves in the doings of republicans in congress all the time. and they are not afraid, generally, to say hey, republicans, do the right thing. but, in this case, they are backing off. they want to talk about policy. they're going to send the president down to kentucky today to talk about his bipartisan infrastructure law. that's what they want to do.

they want to show that business continues here while business is frozen in the house. back to you. >> peter: so, peter, the white house and democrats in d.c., they love. this because rather than argue with republicans this shows that the republicans are arguing with themselves. >> yes. and right now they don't have to deal with any of the republican day one promises. they said they were going to come in on day one and defund the 87,000 irs agents. they had a border security package. they have these subpoenas they want to send over here. but they can't swear anybody in to the house without a speaker and so none of that is happening. so to answer your question, yes, it seems like they are happy. and here, we were hearing awful day yesterday this president is eager or he is willing to reach across the aisle and work with republicans. but, right now, his counterpart would be the speaker of the house. there is no speaker. there's nobody to reach out to. >> steve: no kidding. >> ainsley: thank you. >> steve: peter, thank you very

much. you can almost hear the giggling at the white house. >> ainsley: popping popcorn and posting pictures of popcorn saying we are enjoying this and watch watching the show. it's only one day i'm not so worried right now. if this continues to go on and on there are 200 republicans that stand behind mccarthy. you have 20 holdouts, 19 or 20 holdouts. they are not going to convince all 200 people to change their minds. they need to get on board with the party so we can move forward. this is how politics works and it drives everyone crazy. because constituents wait in line for hours to go vote, to go cast their votes and then they go washington to represent their constituents and they just hold everything up. we could be working on the irs investigation. we could be working on getting rid of those agents. we could be working on the doj investigations. hunter biden investigations. everything is just delayed. and this is how washington works. >> steve: you are absolutely right. they have already broken their day one promise. >> ainsley: you're right. >> brian: 13 of the 14 ballot

election, reballot elections multiple occurred before the civil war. one in 1923 and since. it's like going into the locker room to elect a can't captain ba season starts and getting in a fight in the locker room about who is going to lead your name against another team. >> ainsley: when you are supposed to be a team. >> brian: make a vote and have it. >> ainsley: and the games can't be played until you choose your captain. >> brian: exactly. >> steve: this the "new york post" called them saboteurs. the republican saboteurs being led by the house freedom caucus and before the voting started, their plan was to coalesce around their back-up candidates were going to be steve scalise and donald trump. those were the two names being mentioned. but then in that first round, jim jordan got six votes. >> ainsley: he doesn't want it. >> steve: because they don't have a plan on the other side. they said oh, he got 6. let's see how many he can get.

so then they coalesced around jim jordan. we understand that overnight, last night, kevin mccarthy sent his emissaries from other members of congress over to talk to the 20 saboteurs, essentially. and they had some back and forth for a couple of hours trying to figure out how to get them to a yes and after two hours, nothing has been decided. >> brian: i saw the pizza roll in on a cart. >> steve: maybe they are doing it for the food. >> brian: i think at that point you say cheese. you don't ask people what you want on it. we're ordering pizza. >> steve: if it's washington i would imagine there is a lot of bologna on it. >> ainsley: mccarthy ordered pizzas afterwards to discuss ways to get around this and discuss today at noon. >> brian: just how insincere the

insurrectionists are. i probably shouldn't use that word: aat least agreed to some things and didn't agree to other things. these other people you are writing in, mccarthy. whoever you want, biggs, they haven't agreed to anything. so you are willing to take how think they might be as opposed to someone you have been negotiating with for the past few months. >> steve: right. to your point, brian, jim jordan is on the precipice of having -- getting his dream job. he has always wanted to be the chairman of the house judiciary committee. and once, if they eventually get a speaker and everybody can get sworn in, he will get that. but the problem is, with the house freedom caucus, remember, they're the ones who for the most part forced out john boehner. >> brian: 2015. >> steve: 2017. and then what happened, kevin mccarthy tried to get elected and it didn't work out. and so then after that, they wound up with a consensus candidate and that person was paul ryan is that going to happen again this time?

we don't exactly know. but stay tuned. >> ainsley: nancy pelosi goes in there and she gets to become the speaker. and she says but i don't want this motion to vacate. i want to keep my job. even if you are not happy with me i want to keep this job. they all voted for her, they always did. when she says it's time for the younger people to have leadership roles. they all get leadership roles the democrats get behind them and they support it. in the republican party they are so divided. they have been waiting years to have the house. >> steve: unity. >> ainsley: waiting years for this. they get their opportunity and then you have these 20 holdouts. >> brian: byron donalds and ainsley gave it away he switched on the third round he switched and voted for jim jordan. only one to do it. shows a lack of progress. today's vote here's what he said about flipping on yesterday's vote. >> we were basically dead locked and it was pretty clear that he didn't have the votes. so my thoughts is, okay, if he doesn't have the votes, what are we going to do as a conference to either find someone who can

get to 218 or at a minimum adjourn what we were doing, get off the floor, so the needed negotiations can happen? what we are really having is a deliberative process about house leadership and about what is needed to get washington back on track. for too long in the nation's capitol, everybody has just gone along with the next wave of leadership. i want a resolution. i want us to elect a speaker. get down to the bills of the american people. i can tell you what i saw yesterday on the floor, we were not there. we were dead locked and it was not looking good for the republican conference and we needed to get out of that room and really have those conversations. >> steve: as i mentioned a moment ago, the house freedom caucus drove out boehner in 2015. they would not vote for kevin mccarthy. paul ryan elected. in 2017, former speaker john boehner said this about the house freedom caucus. they can't tell you what they're for. they can tell you everything they're against. they're anarchist. total chaos tear it down and start over.

so if a for the most part they don't really have a plan. went to the benghazi investigation and hillary clinton. he was somewhat vulnerable to stepping aside. he has made no mistakes this time. in fact he spent the last few years just campaigning for people and raising money for people. that's why he said i deserve this, which really didn't rest soften nate too well. matt gaetz goes up and says i think he should be out. he is squatting in the speaker's office? that is just petty. you are not taking on nancy pelosi. you are taking on somebody in your own party. >> ainsley: he said we need to kick mccarthy out of the office he has already moved into the speaker's office. i was watching on social media. he was talking about aoc. they were having words. people have a lot of opinions about that. so, in texas, we have seen talking about border and all these migrants that are coming over. we just talked to a sheriff down in key west.

they are getting so many migrants there. many of them from cuba. in texas we saw the republican governor there sending buses to chicago and d.c. and filly. in arizona sending them to d.c. and in florida sending them to martha's vineyard. now a democratic governor, jared polis from colorado is sending them to major cities as well. >> brian: new york. >> ainsley: can't take them on sending them to new york and chicago. here is what the new york city mayor said. >> we were notified yesterday that the governor of colorado is now stating that they are going to be sending migrants to places like new york and chicago. this is just unfair for local governments to have to take on this national obligation. we have done our job. there's no more room at the inn. but we are compelled by local laws here that we must provide shelter. >> steve: new york is a sanctuary city.

that's what you've got do when you are doing that look, colorado is not a border state. but the migrant surge, particularly in denver, that's why the mayor of denver recently declared a state of emergency. they're asking the feds to help. and so now what they're doing is they're turning to these nongovernment organizations to try to get the migrants because, remember over the last couple of weeks there has been a lot of snow storms and stuff like that. suddenly people can't fly. so they are taking a bus. so, suddenly, the city of denver and the state of colorado is trying to find some buses to send the people to chicago and new york where it's really cold, except today. really nice. >> brian: you know, for example, the mayor is in a tough spot. mayor adams along with sid rosenberg wabc say a conservative but they have hit it off. so he comes on all the time now. in fact, they are going to go to a homeless shelter again today on 34th street. but, what he says is this: i have 30,000 illegal immigrants in my city.

not just 4900 from texas. 30,000 here. we have no place to put them. mr. mayor, you have the courage to take on your governor and your democratic state legislature and say get rid of zero cash bail. have the courage to say sanctuary city in theory good idea not patrol car. no longer a sanctuary city. not fair to have the taxpayers where 6 out of $10 goes to city, state and federal taxes. no one is staying here. everyone is leaving on the behest of your governor if you don't like it leave like republicans. so stand up and say we can no longer be a sanctuary city. then you would have a leg to stand on when the democratic mayor of el paso or the democratic governor of colorado puts them on a bus and sends them your direction. but, until then, or you have the courage to take on a president who really likes you, democrat, you are really without an argument. >> steve: that would be great if it happened. it's not going to happen in this world. >> ainsley: three out of four new yorkers are democrats.

>> brian: they don't want. this. >> steve: they love the sanctuary status they love being able to say we will take anybody. >> brian: no one is happy with 30,000 illegal immigrants walking around the city taking over hotels and sitting in overcrowded classrooms. nobody is happy with that. >> steve: all they want is they want money. they just want money. colorado wants money. down in arizona, they had the chance to bring in somebody who is going to be tough on the border. they didn't vote for the republican candidate. it depends on your point of view. a lot of people say okay, bring them. in. >> brian: i'm tired of my kid learning. i want overcrowded classrooms. i'm tired of them coming home. >> ainsley: if you talk to democrats, they believe that everyone coming across the border that they're all good people. and most of them are, probably. but, they don't -- they fail to hear about the fentanyl. because you only hear that on certain networks. >> brian: unless your kid dies in his bedroom. unless you find out about your neighbor dying. you know, getting stabbed to death on the subway.

so i mean, the thing is, you are not pro-crime. like people don't like people overcrowding your city. mentally ill deserve rights but do they deserve the right to throw you into the tracks. >> steve: fix it at its origin and the origin is along the southern border and the responsibility for that rests entirely on joe biden. we know that. >> brian: democrat can get the attention of a democratic president before any republican. >> steve: they are trying and they cannot get it because joe's hands are tied. he doesn't have the money. >> ainsley: ashley has headlines for us and we begin with damar hamlin. >> the team says he is still in critical condition after going into cardiac arrest during monday night's game against the bengals. hamlin's uncle says his nephew is still fighting. listen. >> right now they got him on a ventilator. so they are trying to get him to breathe on his own. i'm really really thankful for the staff, the medical staff that's been working with him. they have been truly awesome. >> his family also released a

statement thanking fans for their thoughts and prayers. newly released body camera footage body cams show police officers lift a car off a cyclist mowed down by a driver stolen car near san jose, california. watch this. >> 1, 2, 3, go. >> steve: southwest airlines is giving away 25,000 frequent flier miles to furious fliers left stranded over the holidays after its epic meltdown. it impacted thousands of flights. just as the airlines thought everything was getting back to formal. more than 1500 flights were canceled again yesterday. what's up with that our next guest was as you can see right there a southwest flight attendant before law firming her broadcast career. does she look familiar? well she is fox business anchor and host of american dream home cheryl casone. hey, cheryl, good morning. >> good morning, steve. >> steve: you're not supposed to be that close to the motor the turbine. what were you guys thinking? >> we had a lot of fun back in the day. i will say that it was a good place to work. >> steve: yeah, but now it's got to be complicated because everyone is mad at southwest for the ceo to say you know what? we have tens of thousands of really angry customers who have said they're never going to fly on southwest again. so, rather than give them their money back, we're going to give

them points. so they have to come back. >> well, to be fair to bob jordan the ceo, are the company. they are issuing refunds. they are honoring requests and trying to find people their luggage still to this day. but 3% of the schedule canceled yesterday. and then the 25,000 bonus miles, i think was kind of a sad offer to their frequent fliers. they sent them a link and said click on this link to get your miles back. well, guess what in the virtual wait for some of these people was over an hour just to get your 25,000 bonus miles. it's the technology. it is the systems at southwest that are to blame here. management knew about this for years. not just bob jordan but also the previous ceo gary kelly. and the pilot's association is blasting the company. they are still in contract negotiations to be fair here with the airline. they say you knew about the it systems. you knew we had old routers, antiquated systems and you didn't spend the money to upgrade it and now here's where we are with this unbelievable

meltdown of operations at southwest airlines. and i want to say i still have a lot of friends there that fly for southwest. they are really good people. they didn't want this to happen. they're just about as upset, i think, as the travelers are. >> steve: real quickly, i don't know if you have the answer. are they going to upgrade the computer system i think yesterday everybody -- there was a ground stop for all the flights because they couldn't download the weather data which when you are flying on the airplane you want to know where the super winds are. >> yeah. you need that, yes, to fly a plane, true. what they did do blamed ibm third party surrender for this chaos with the weather system. again, it's just another technology failure at southwest airlines. and so at the end of the day -- i will say they were starting to update the systems. this has been a progress but too little too late. and what's interesting about bob jordan he actually used to be in technology and he has been at that company since i believe

>> brian: the family of buffalo bills safety damar hamlin says he is showing improvements but remains in critical condition after collapsing during monday's game against the cincinnati bengals. joining us former nfl player carson palmer as well as chris valetta. carson, let me start with you. were you watching the game? if you weren't, what are your thoughts and did you have a chance to see it being that you played this game for so long? >> i was downstairs. my daughter came running downstairs and said a player collapsed on the field. and i kind of -- i didn't think a whole lot about it until i walked up in the living room and saw the atmosphere in that stadium, what was going on. it was a reaction unlike anything i had ever experienced

as a player or anything i have ever seen on tv. >> brian: so, chris, we find out later that he had cardiac arrest not only on the field but when he also entered the hospital. have you heard of anything like this before? >> absolutely not. i mean, i'm sure carson can say the same thing. we have both been on the field for serious injuries. it's sort of par for the course with the game. but, this took it to a whole new level. i think the fragility of life was put on display not only for the players but for the entire world and when something that drastic occurs, i think it showed sort of instantaneously that what mattered most wasn't the game but what mattered most was damar's health and safety and, obviously, it stopped everybody in their tracks, brian. >> brian: carson, you said to me just now in the break, you told peter king the legendary nfl writer you worried with the speed and strength of everything that happened on the field you worry that somebody could die out there today but you didn't

mean this. >> no. the focus of the nfl and players' safety has really been on the head and head trauma and concussions. really that's where a majority of the scary injuries that play out later on in your life that we have seen as players and now former players are struggling with. but to see something like this, i mean, a chest injury is not something that we anticipated. but what we can anticipate is the nfl making a big move on player safety and really focusing not so much on the head more anymore maybe starting to focus on heart injuries like this. >> brian: right now we understand, too. he is in critical condition and induced coma. he is making progress. and everyone focuses on that. but, chris, if it turns out that that hit to the chest caused the rhythm of the heart to push him into cardiac arrest, is there something that could be done in the uniform to protect, to absorb that hit? >> well, i think this was, first of all, i think everybody -- this was a terrible accident.

and this sounds like this was one of those one in a million chances that can happen in several sports. it sounds like this it can happen in baseball and soccer and certainly happen in football. >> brian: lacrosse. >> the nfl is constantly looking at player safety. that -- the game has gotten a lot safer over the years. when you look at when football first started there were multiple deaths every single year. the game has gotten a lot safer. but that doesn't mean the game is still as safe as it could be. i think the nfl and the pla platform that they sit on is in a unique position to double down on safety and be a beacon for safety for sports down at the high school level, especially when you have think about the number of collapses that occur in high school sports. and the amount of aeds that exist on the sidelines for athletic trainers and high schools and the like. so i think this is the model for the way we should respond to these types of injuries on the field and what can the nfl and the nfl teams do to be a model for some of these high schools at the lower levels where these
