hammer out a resolution so we can go ahead and elect a speaker and get down to the business the american people sent us here to do. >> dana: aishah hosni is covering this for us live on capitol hill. good morning, aishah. >> good morning, dana and bill. supporters of kevin mccarthy met last night to talk it over how to proceed forward. it appears nothing really has changed, dana. both sides are not budging. kevin mccarthy, as you know, has been ready to go round after round after round of voting in an attempt to wear down his opponents but as we saw yesterday, he could actually -- things could get worse for him and started to lose votes by doing this. so today his supporters could call for a recess as opponents now company less around jim jordan as the possible consensus candidate. jordan does not want the job. he nominated kevin mccarthy yesterday. but he may not have a choice

here. >> every time he speaks up to defend kevin mccarthy he reaffirms why he would make a great speaker. >> if you heard from him that he does not want it in any way, shape or form, what do you say? >> i have heard that from him and if we have the numbers, then sorry, jim jordan, we'll make you do it for the country, we love you. >> there is also the very rare chance that democrat leader hakeem jeffries walks away as speaker. right now he has the most votes. only six members away from leading a g.o.p. majority house. moderate democrats could hand mccarthy a lifeline. it is not likely to happen as the left enjoys watching this. >> we're looking for a willing partner to solve problems for the american people not save the republicans from their dysfunction. >> if you're wondering when it will be over,

representative-elect byron donalds who switched his vote in the final round yesterday to jim jordan said he doesn't think it will go past this week but honestly it is anyone's guess right now. >> dana: we'll pay attention to your reporting all day. >> bill: the scenario republicans got on the mid-terms. 222 seats in congress, good enough for the majority but the majority is 218. their majority is super slim. only by four votes could mccarthy lose members of his own party. vote number one and vote number two from yesterday there were five republicans who said they would never vote for mccarthy. he could lose four. five puts him underwater. first vote and second vote yesterday mccarthy only has 203, much smaller than just losing five members of your 222 house majority. so there was a second tier of republicans making demands that mccarthy did not agree to and they didn't like it and jumped

off the band wagon for mccarthy. on third ballot his number went lower. he went down to 202 when another republican went to jim jordan. where does it leave us today? great question. want to bring in a new congressman, we think. a congressman-elect mike lawlor out of new york. he hasn't been sworn in yet. thank you for your time. question. did anything change overnight or are you looking at the same situation today at 12 noon when you reconvene? >> as i understand it, there were multiple conversations that were had overnight. we will see if we'll have a conference this morning or not. i'm prepared to reconvene at noon and vote for kevin mccarthy or speaker. the overwhelming majority of our conference has supported kevin from the beginning and will be supporting kevin to the end. we are not going to be held hostage by a handful of members who refuse to negotiate in good

faith. kevin has made over 20 rules changes to address their concerns. at the 11th hour they move the goalpost once again trying to get more out of kevin in exchange for their vote. he said no. yesterday when we had conference, scott perry was asked very directly by kevin in front of everybody, who else do you want and he could articulate it. it is shameful and embarrassing and proofing themselves incapable of governing. this is about the fact that the american people elected a house republican majority to be a check and balance on the biden administration. we cannot get about that work without electing a speaker. so jim jordan's committee on judiciary to do their investigations, guess what? can't do it. securing the border, can't do it. reining in wasteful spending, can't do it. the 19 individuals have tried to

hold the rest of us hostage and no plan and no person to be the speaker. they keep talking compromise. well, guess what, there are 18 of us from biden districts. what compromise do you think they'll get when they try to extract so much out of kevin mccarthy? >> dana: i wonder if you could tell us if the president -- former president trump's statement he put out on truth social will have an impact. one of the things he said don't turn a great triumph into a giant and embarrassing defeat. do you know if it be persuasive to any of the 19 who are hold-outs at this point? >> it should be. most, if not all of them, are strong supporters of the former president. and they should heed his warning. the bottom line here is this. we have been elected to a majority, 222 members. yes, it is slim but guess what it is a majority. and we were elected to do a job. the commitment to america. kevin mccarthy led that effort

to flip the house. and we are the only ones who have won consistently during his tenure. so for these folks to continually try to push back and try to upend the conference for their own personal gain, whether it's notoriety in the press or specific concessions that they think they are going to get, it is wrong. we have to work together as a conference. and this really -- this whole episode is an embarrassment to the party and they are doing nothing to advance the cause of conservatism and nothing to advance our agenda by doing this. >> bill: thank you for your time. we're about three hours away from reconvening on the floor of the house as you point out at the beginning of this conversation, there were conversations overnight. hopefully we'll find out whether or not they're revealing conversations about the next step. thanks in new york. when you come back maybe we can call you congressman.

unemployment rate the federal reserve believes will happen and the trifecta is inflation. the president will tout his more government spending under the bipartisan infrastructure bill and joined in kentucky with mitch mcconnell, republican senator. the white house holding onto the fact that the president's spending policies will work whether for climate change, inflation or energy crisis for regular unleaded price jumped $0.04. the white house blamed it on refineries closing because of cold weather before christmas. >> we made significant progress in lowering the prices, gas prices specifically. prices are down nearly $2 per gallon and lower today than they were a year ago. >> when the refineries come back online do you expect the price of gas to come down. >> i was talking about one year ago. one year ago was not when he came into office. >> those refineries most of them are coming back online now.

if you don't have mexico cooperating you will have all these people coming and have the drugs coming, too. mexico is on the verge of being a failed state. it is very fragile. we can impose trade restrictions. president trump was tough on mexico. mexico responded. the biden administration barely admits we have a crisis on the border. you have dysfunctional government in washington. republicans can't put together even a speaker of the house, you have the president of the united states ignoring the fact that this is a crisis. i want what the president is doing today, dana, with senator mcconnell, a bipartisan approach why everybody admits it's a crisis, two, we must get mexico engaged and number three, work together for goodness sake. >> dana: yesterday we had senator cornyn on and he said he believes mexico is a failed state. president biden likely is going there later this month.

america is not powerless, geraldo, in terms of being able to fight back. the will does not seem to be there. in the meantime there is an immigration problem that you've mentioned and the migrants coming across have gone to different cities. this is pretty interesting. governor polis of colorado is going to send some migrants to new york. here is what he said. there is a lot of pent-up demand right now and a lot of frustration among our migrants trapped for a week or two in a place they didn't want to be through no fault of their own. and here is what mayor adams said about polis sending migrants to new york. >> the governor of colorado has now stated they'll be sending migrants to places like new york and chicago. this is just unfair for local governments to have to take on this national obligation. we've done our job. there is no more room at the end. but we're compelled by local

laws here that we must provide shelter. >> dana: what's interesting to me governor police is democrat. adams is a democrat. other democratic mayors saying we can't handle this, it's a national problem. why not go together and go to biden and say you have to do something in order to help us? >> what a great idea, why not? why not try working together to solve a problem? i support mayor adams. he is a friend of mine and i'm sympathetic to him. this latest wave, 35,000 undocumented immigrants coming to strain city services. but that obscures the bigger picture, dana. there are over 1 million undocumented, illegal immigrants in the new york city area alone. there are -- but they're part of the fabric of the city now. they deliver the -- every delivery guy you see on the street with his bicycle or moped are undocumented.

the people who care for the children generally speaking, the people washing the dishes in the restaurants, in these factories, there are entire towns in new jersey, patterson and others reinvigorated by undocumented people. it is a shadow situation of monumental proportions happening. it is not just new york, it is not just mayor adams facing this. it is everybody. damn it, why can't we work together. if we don't work together all we'll do is point fingers, when i was there i put up a wall. oh your wall didn't stop anything. oh we have to have an ellis island for lot-in american, oh, it's so easy to have excuses and blame, so difficult to solve because everybody in a certain economic class in latin american, almost everybody, tens of millions of people all want to live in the united states of america. that's the reality we deal with. you have a very poor part of the

father. they were in the hyundai elantra that was seen ton night of the stabbings. >> this was the first time we saw the suspect in the courthouse behind me. people from all over this area in pennsylvania were trying to crowd around to catch a glimpse of the guy at the center of one of the most high profile murder cases in the country. i got off the phone with the jail trying to figure out movements. we were told he would be moved this morning by the u.s. marshals. keep you posted on the latest developments on that. his family was sitting in the front row as he walked in and read the charges. look here, the video from the courthouse here in pennsylvania that we got just yesterday afternoon. this is also the sketch that shows bryan kohberger sitting in front of the judge at the center of this case as people are closely watching. look and watch him wearing the red jail jumpsuits and walked out of the pennsylvania courthouse dodging questions after he agreed to waive his

extradition. now the 28-year-old will be taken to idaho by authorities. we're told it's happening possibly right now. he faces four counts of first degree murder for stabbing four university of idaho students back in november. the body camera video from indiana state police recorded on a drive from washington. the still frame shows kohberger and his dad stopped by state troopers for following a truck ahead of them too closely. it shows the suspect in the driver's seat of the white hyundai elantra that police were looking for and dad sitting in the passenger seat. there was no information on the suspect or license plate when they stopped the car according to police. >> as a father you are impatient and want to know everything right then and there. i feel good. i feel like they've done a tremendous job. i know that they have been working hard. we just have a lot of holidays.

these guys were working out of town and i appreciate all the effort they gave. >> we're still trying to figure out exactly where kohberger is now. we talked to his family yesterday briefly before they drove off and said they had no comment on the case but heading back to idaho and we'll learn the new details about the quadruple murder. >> bill: nancy grace host of crime stories on fox united nations good morning. what a crazy thing this is. the father for christmas break goes to the state of washington and they drive cross-country together and get pulled over by cops twice in the state of indiana. now, once this suspect is returned to idaho, we will probably see the affidavit based on your experience, what will we learn from that document? >> we will finally see the affidavit which supports

probable cause. that's what is presented to a judge or magistrate in order to get that judge to allow the arrest. we know that this arrest was an after-dark arrest which normally requires a little bit more p.c. than a normal arrest. several doors and windows reportedly were broken in an attempt to affect that arrest. they didn't know what they would be facing when they went into that home. we'll learn a skeleton, bare bones about dna. we will learn which i believe will be very, very persuasive about cell phone data. i believe we'll learn that guy right there kohberger, was around the victims very often based on cell phone tracking, spying on them, stalking them, wherever they went, he was there looking in their windows, watching them. maybe at the food truck or wherever they went and learning their patterns.

i believe he stalked them for weeks before he went in methodically and murdered them. >> dana: when you look at this case, nancy, and you are looking back over your career and experience anything you see here that resembles cases or patterns you've seen in the past? >> well first of all it makes me sick. you know what? a lot of people don't want to do, i don't either, but i made juries do it, to think about what happened to the victims. waking up to someone stabbing them over and over in the torso until they were dead. that's not something you want to think about. but it does remind me not only of ted bundy when he entered into another sorority/fraternity scenario in florida stealthly,

after he had spied on them and murdered them. and also reminds me of btk dennis radar who would spy on his victims and take his time killing them. he reminds me of certain facets of btk. >> bill: i want to play something for you, monroe county, pennsylvania where he and the father drove. this is the assistant d.a. giving an explanation as to why he would waive extradition. interesting answer here. get your reaction after we play it. >> i definitely believe that one of the main reasons the defendant chose to waive extradition and hurry his return back to idaho was the need to know what was in those documents. >> bill: the need to know what was in those documents. he is getting his doctorate in criminology. next hour we'll have the daughter of the btk killer with interesting things to say.

do you believe the d.a. was right he wants to learn more about what they've learned about him? >> i think his reasoning to waiving extradition was two. number one, why fight it? i've done a million extradition hearings. all they are is simply are you kohberger? if he says no i would have a fingerprint kit there in the courtroom to prove him wrong and send him on his way pronto, number one. why fight it? number two exactly what the d.a. said. this guy was so obsessed with violent crime as part of his studies, he sent out reportedly questionnaires to violent criminals, murderers, rapists including questions like what was going through your mind at the time of the crime? while you were killing the victim, what were you thinking? this guy is obsessed with murder and all things criminal. i think the d.a. was right. he has to know what they've got. why? because of an obscure, bizarre

marijuana gumies according to a study that says cases of kids ingesting them have grown exponentially. jonathan serrie is on that story. where is it going? >> emergency health and poison control experts are sounding the alarm saying that increasing numbers of very small children are accidentally ingesting edible cannabis products mistaking them for candy. the number of states allowing recreational cannabis has doubled over the last five years and during that period the number of reports of children under six years old ingesting these products increased by more than 1300% according to an analysis in the journal of pediatrics. the authors believe a number of factors are driving the trend. >> was it because of increased legalization or the lockdown with more kids being at home? we don't know exactly the answer to that. the fact that the numbers did increase significantly was something we wanted to bring

improve because of the influx of people. if you go to texas you can see, if you drive across the country you drive through texas, right when you cross the border everything changes. the rest areas, the cars look better. it is amazing when you have a state that has a strong economy. >> bill: so in japan they're trying to solve this. we are talking a lot about moving. southwest airlines, u haul, they want people to leave the city of tokyo because it is too crowded. they offer you $7 thousand 700 per kid if you move outside of the town. >> take it, take it and get out of there. i think cities are kind of overrated. there is a problem. when you are young you want to move to the stechlt when i was a little kid i used to go in the city and thought it was -- who would ever want to live here. at 17 i want to get in there and live in the stechlt city and i wanted to live in boston but at some point it starts to wear off, the magic of the city.
