support for mccarthy starts to wane. he got a boost this morning from former president trump. mr. trump wrote that quote it is now time for all great republican members to vote for kevin. but mr. trump's wattage is not what it used to be. republicans are starting to shoot inside the tent. >> a lot of these members have been irrelevant. they haven't passed anything and now they are in the limelight in enjoying fundraising off this tomorrow -- these actions. >> if mccarthy doesn't begin to gain votes serious conversations could talk about mccarthy dropping out. >> these five people need to take a deep breath tonight and ask themselves are they really want to send a signal that every five people in the conference can screw up everything for

yesterday. the hold-outs have strong feelings as well and are trying -- they have the power to do what they're doing. what do you think happens today? >> yeah, i think the speaker -- i keep wanting to call him the speaker. kevin mccarthy has probably got to lay out a plan for how he will restrain spending. i'm not saying it would pull in all the hold-outs. there is a question of how much some of them are motivated by philosophy versus opportunism but i think he would do himself a lot of good to say here is the plan. we know a lot of republican voters were upset about the spending that just happened at the end of the year after they had voted in a republican house. here is how we are going to change the trajectory and get discipline on federal spending. >> bill: did you see karl rove yesterday? he laid out what happened on sunday night. he believes that a minority of members went to mccarthy with demands that they had not presented before basically

putting a gun to his head and say you agree to this or we will abstain. >> i don't -- i'm not saying he needs to endorse every demand that comes up. i think he does need to come out with something on the substance of here is how we'll do things differently and here how we will be the bull work for the taxpayer. but this is the job. corraling 218 people, managing a razor thin majority, managing the floor. if he can't do it for this, he is probably not going to be able to do it for less votes that are coming. this is a first test. >> dana: for more consequential votes. the debt ceiling has to be raised. many republicans who think spending is out of control. you will have people who will have to be dragged to this vote. not going to want to do it. the democrats don't want to be

helpful necessarily. so you think who actually wants this job? kevin mccarthy actually wants the job. jim jordan says he doesn't. we haven't heard from many others. if called upon to serve they would do so ably. but to go into this fight without a different plan for the 19 of them now, you just sort of leave everybody in limbo. it's true, people at home when this is over there will be a speaker and it will be fine. for those people who worked every day on a campaign, donated a lot of money to these campaigns, really want to hold the biden administration to account, all of that is delayed. >> it is. that's really the fundamental debate. how do you hold the administration to account? where do you -- do you set the line. i don't think it would kill him to say we'll have votes on the spending restraint items. maybe he doesn't like all the ones on their list but to promise this will get a hearing

and get a day on the floor, i think that's a reasonable part of this sort of negotiation. >> bill: mccarthy will likely to have conceded. karl's point is saying they said want to head up this committee, this subcommittee and want to appoint the members to be on my committee. that's always been the job of the speaker. >> if they are making unreasonable demands he has to negotiate more in public. i have seen him to this point talking a lot about process and not so much about the substance of restraining spending. when he is talking about -- i don't care how many votes it takes. i'm hap to have the record on the number of votes, he should be making substantive points to persuade if not those members at least the voters it is time to get on board. >> dana: we want a purple

science. that might sound familiar. ned price is insisting it follows the science all the way. >> this was and is an approach that is based solely and exclusively on science. ever since the earliest days of this administration, we have based these types of decisions that are made, by the way, by the cdc in close consultation with the department of state and others, but that are based on science. >> dana: ned's comments come in response to the chinese communist party foreign ministry accusing the u.s. and growing list of countries now restricting chinese travelers as being politically motivated and unscientific. the white house yesterday afternoon also responded to that. take a listen. >> there is no cause for retaliation here. just because countries around the world are taking prudent health measures to protect their citizens, it is based on public health and science.

>> the u.s. is requiring travelers from china over age two to show a negative test taken bin 48 hours of departure before allowing them entry. the list of other nations requiring similar measures includes at least 14 countries spanning the globe from canada to france and u.k. and europe to india and malaysia. italy became the latest country to test all arrivals from china after almost half the passengers on two flights to milan were found to have the virus. china's threat of retaliation reveals how sensitive the communist party is now about the latest covid outbreak as a political issue. they're continuing, they say, to crack down on covid spread at home while allowing it to run rampant across the rest of the world like they did when the virus first broke out. >> bill: interesting. stay on it. >> dana: an update on avenger

>> dana: we'll move to this. avenger star jeremy renner sharing a picture from his hospital bed as we learn more about his terrifying snowplow accident sunday in reno. that left him very severely injured as you can see there. national correspondent william la jeunesse has an update for us. >> the good news is renner is out of the surgery and talking and in good spirits according to a rep. before we tell you what happened i want you to take a look at this image from a 2019 video of renner in his snow cat. there is no way to get into the cab without stepping if we can drop that banner there. he can't get into the cab without stepping on the tracks. imagine the tracks are moving. sunday renner was plowing the driveway when the car they were digging out got stuck. renner stepped out of the snow cat to help. the machine started rolling. when the actor jumped back in to

apply the break he got stuck in the tracks and was run over by the seven ton machine. >> the piston bully started to roll. in an effort to stop it he attempts to get back into the driver's seat of the piston bully. it's at this point mr. renner is run over by the piston bully. >> family members called 911, neighbors tried to stem the bleeding. an hour later he underwent surgery for chest and leg injuries. he posted the photo saying thank you all for your kind words. i'm too messed up now to type bust i send love to you all. according to piston bully the operating manual the snowplow is not like a car. it does not have a foot or service brake for stopping. it only has a parking brake and does not stop abruptly when you lift your foot off the accelerator, unquote. meaning if you are on a slope, dana, the only way to stop it is to pull on the brake or push a

stop button that will deactivate the drive shaft. the sheriff impounded the vehicle and handling like an accident investigation. >> it's a serious piece of equipment indeed. thank you. >> the white house regularly engages with official eaves from a range of industries and sectors. this meeting with sam bankman-fried was focused on the pandemic prevention-related matters and crypto currency and exchanges. >> bill: the white house asked questions about ftx and they talked about covid apparently. sam bankman-fried met with senior biden administrations officials. he met the president's aides at least four times. connell mcshane is here from fox business. we know he gave millions of dollars toward democratic causes. we do know he gave what, $5

million to biden's campaign in 2020 and we do know now he met four times at the white house. about what? >> about the most recent took place in september. there are other meetings in april and may. reported to -- it was an influence campaign trying to implement crypto currency policy. karine jean-pierre said it was about the pandemic. his brother runs -- what is acknowledged is that these meetings took place and we do know that sam bankman-fried freed although he claimed he has given an equal amount of money to democrats and republicans, the publicly disclosed funds are exclusively to democrat and liberal causes. it puts him second behind george soros in the last election

cycles. >> dana: some of the document we saw they were virtue signaling by saying we'll give money to causes to get their foot in the door. in the west wing there was this part where president bartlett is in the oval office and the cattlemen want to say hi. they don't want to just say hi. what do they want? they said nothing. he proves them wrong. told you they want something. the pretense was i will have this charity and make sure the pandemics never happen again and here is money for it. they get the meeting at the white house. if you give that kind of money. we don't know what was said but he had a presence to let everybody knows we care about the crypto currency policy. >> he lived in the bahamas but through all of these disclosures and the reporting that we and others have done he spent a lot of time in washington, d.c. and certainly gave a lot of money to washington politicians and publicly disclosed funds

almost all to democratic or liberal causes. that much we know. those are facts. the $40 million is a fact and it's a lot of money. i spent my day in lower manhattan covering his arraignment. he pleaded not guilty to all of the eight federal crimes he has been charged with. we'll see how that place out. an october date for his trial. >> bill: the younger brother is gabriel who set up a foundation surrounding coronavirus. and gabriel attended one of the four meetings. which kind of gives you -- if you are at the podium, dana, you have an out. >> there were other ftx officials. >> dana: i'm sure they talked about pandemic. the other thing is by the way, could you make sure elizabeth warren is off our back? that kind of thing if that's what happened. >> bill: the west wing. it was a good episode. i'm sure court was interesting yesterday.

>> dana: fox new confirm the suspect in the gruesome murder of four university of idaho students now in the air on his way back to idaho after being caught in pennsylvania. attorney for bryan kohberger's family say they look for the probable cause affidavit, the next step. >> we're looking forward to the

probable cause affidavit and seeing what information they have in the affidavit. i won't show the entire case but give us an idea of what hard evidence they have toward the defendant in this case and we're hopeful it is strong and moving forward. >> dana: dan springer is live in moscow idaho with the details. >> it means bryan kohberger is on his way back and in idaho sometime today maybe within the next few hours. as far as the gag order, it applies not only to the police but prosecutors and defense attorneys. it appears as if our time getting news conferences and interviews is over. we should get a very good roadmap of what the case is against kohberger when three separate probable cause affidavits are unsealed in the next day or two at the outset. the u.s. marshal service is responsible for transporting kohberger back to idaho. they have up to ten days. he will be here to face those charges in a few hours.

we've learned prosecutors in pennsylvania obtained three separate search warrants including a hard to get no-knock warrant to breach his parents' house during violence. each warrant came with a probable cause document with a lot of evidence apparently. >> having read those documents and the sealed affidavits of probable cause, i definitely believe that one of the main reasons the defendant chose to waive extradition and hurry his return to idaho is the need to know what was in those documents. >> while kohberger was in pennsylvania court waiving extradition his court appointed defense team was at the house in moscow, idaho where the murders took place taking pictures inside and around the outside of the house. there was also a crime scene reconstruction worker who stayed inside for several hours. we've learned his lawyers and

taylor where three of the four murder victims live. taylor was assigned to the case, the closest public defender to handle a death penalty case and familiar with moscow having graduated law school from the university of idaho. the victims' families are relieved a prosecution is finally happening. >> i feel lucky knowing we have somebody and there is a person of interest. not feels worse than having nobody and just nothing but doubt. seven weeks of that, or close to seven weeks of that was a tremendous amount of pressure on us. >> this building behind me will serve as the jail for kohberger, as well as the courts. so it is a one-stop shop. brought by us today and be processed. we don't have any idea whether he will be in court today. probably more likely tomorrow. there are 37 jail cells in this jail and he will be in one of

them within a few hours. >> dana: dan springer, thank you. >> bill: want to go to what could be an intriguing collection. we are learning more about kohberger and he studied under a famed crimenologist. ramsland has studied dennis rader. he has been convicted of killing several people between the years of 1974 and 1991. he was arrested more than 15 years ago behind bars. raider's daughter, she is concerned her father may have been in contact with kohberger. carey is my guest now. a lot of confusing connections. take it slow here, karrie, okay? this teacher had a contact with your father as she was teaching in lehigh, pennsylvania.

kohberger was studying in the state of washington. why do you believe he had a connection to your infamous father now in jail? >> it is really common in general for people in the public or criminology students especially to correspond with my father via letters and talk to him on the phone sometimes. since the doctor had a long-term several years academic intimate relationship with my father and personal friendship i wouldn't be surprised if kohberger at least tried to contact my father or had contact. at this point we don't have proof of it. we would need to see letters either at kohberger's home or in my father's jail cell. >> bill: that physical evidence may be out there. hasn't been confirmed. maybe it is a possibility as you express here. your father studied criminal justice at wichita state. and then you say he went on to continue studying about his own crimes. can you explain that to us?

>> yeah. might have father's first murders were the four members of a family in january of 1974. then he quickly entered into the criminal justice undergrad program at wichita state university in wichita, kansas. he was a student mainly taking night classes at wichita state for several years while continuing committing btk murders. committing a total of seven in the 1970s before i was born. he was a prolific student of his own after he graduated. as i was growing up he had true crime books in his house and since he has been in prison, he starting to understand what's wrong with him and been a studier of himself and other serial killers and he went on -- >> bill: can i ask you this, then?

why is it that students would reach out to your father? why would professors reach out to your father in this case? >> professors try to reach out to my father from an academic standpoint. it is rare to pick the brain of a true psychopath. and have them at least be willing to talk to you. ramsland developed a friendship with my father and published a book in 2016, biography on my father and my father interviewed for it intensively and massively had input into it. it's a first-person account of his crimes. students in general sometimes are even assigned to contact criminals as research projects. or to develop their own research. i'm contacted pretty regularly by students asking me can you get ahold of your father and have him return my letters. >> bill: you don't have any proof kohberger reached out to

your father. you are trying to draw a connection through the professor. has the professor said anything about this? >> saturday she made a public statement she was not making public statements at this time. i believe due to her connection with the university and her possible legal connection here with kohberger as being his professor in the masters program. >> bill: is that the only connection you are tying here or is there some measure of evidence that you have learned through the media over the past 7 or 8 weeks after these murders? >> my first time i heard of any connection to dr. ramsland was after kohberger's arrest and there is speculation about kohberger's ties to my father. we'll have to wait to see if anything comes out in trial or after the trial. >> bill: one question here the kohberger family, you know the father drove in mid-december all the way across the country from

the state of washington to pennsylvania. the family statement says we cooperated with law agencies and we don't want to judge unknown facts and make wrong assumptions. what -- can you reflect on what the family is going through after your own experience and you lived this. and you have not had contact with your dad in a year and a half. >> i mean as far as we know his family is innocent. and so from my perspective of what my own family went through it is utter hell and shock. no knock warrant come into their house in the middle of the night are probably still in shocked, confused, grieving. it was reported that the mother and sister were upset at the hearing yesterday. it is a process trying to how to pay for legal defense.

can't afford it. you trying to answer questions to the f.b.i. and manage media and ask yourself what went wrong, what did i miss? as parents you are probably dealing with a massive amount of guilt. it will be a long time for them to recover. >> bill: thank you for sharing your story. it is unique and you have not had contact with your father since march of 2021. you have a court order to make sure you can't contact you again. we'll stay in touch and see whether or not your theory plays out. thank you for your time today. >> thank you. >> now we see in fairfax county violations of civil liberties where we have students who had achieved a real accolade to be a national merit scholar and they weren't told because they didn't want to make the other students feel bad. it is not right and not consistent with virginia and american values and we will go

to work to make sure we fully understand all the facts here. >> dana: glenn youngkin calling for an investigation into a top high school there in the state. educators are accused of withholding important test scores to protect the feelings of lower-performing students. mike emanuel has the story. hi, mike. >> we expect an update at the top of the hour from virginia's attorney general after governor youngkin issued a call for an investigation saying quote, we need to get to the bottom of what appears to be a deliberate attempt to disadvantage high-performing students at one of the best schools in the country. after reports national merit awards determined by student psat scores were withheld from thomas jefferson students until after important deadlines for college scholarships passed. the lieutenant governor says the equity push sends students a terrible message. >> it teaches them that in school anyway you get a participation trophy for everybody.

these are the states that passed laws that allow students mental health days. washington all the way through colorado. ten on the map. maine in the northeast, arizona in the southwest. and at the moment i don't know what your kids got but, i mean, christmas breaks. it is just a week or two. it's more than a month for college. you add mental health days on top of that. what do you think? >> it is ridiculous. there is a mental health crisis for kids in this country, no doubt about it. and i see it as a combination of missing school. they were held back from school all during covid. they sat in front of their laptops in their rooms. this is creating mental health problems. and then you lay on top of that social media. social media and covid are the two biggest issues i think that lead to these mental health problems. if you want to help kids, you want to help mental health, you have to build their confidence and give them more time in

there. and then to learn that this accident was no accident according to police. this happened on monday morning right around 11:00 a.m. video captured the dramatic rescue that involved dozens of first responders and several helicopters. witnesses called 911 to report a car went off of highway one with no guardrail and flipping over several times before dropping more than 250 feet landing on its wheels wedged against the cliff just feet from the surf. a 7-year-old girl and 4-year-old boy were taken out first. their injuries were moderate. their 42-year-old father and 41-year-old mother were more seriously hurt and airlifted out. all four passengers were alert and conscious. >> we come out here unfortunately all too often for things like this and this was nothing short of a miracle that they survived. >> after gathering evidence and
