in "the faulkner focus." it is nasty. the battle for the gavel. the first time as i mentioned in a century the vote needed more than a single ballot. resistance to republican leader kevin mccarthy. it got hotter yesterday in the final rounds of votes. he started losing support. now 20 mccarthy defectors going into the second day. they are backing ohio representative-elect -- they're all elect because they can't be sworn in because they haven't chosen a speaker -- those 20 like jim jordan for the job. jordan supports mccarthy. how will that work out? he said he is not interested in being the speaker position. leading the charge for jim jordan and against kevin mccarthy florida congressman-elect matt gaetz. many of his colleagues not happy. south carolina republican nancy mace tweeted gaetz full ego was

8:04 am
province. i just think it is a little embarrassing it is taking so long in the way we're dealing with one another. the rest of the world is looking, can we get our act together? but what i focused on is getting things done. >> kevin mccarthy is ready for round after round of voting in an attempt to wear down his opponents but harris he actually lost votes yesterday by doing this. just a few moments ago he walked into the capitol feeling confident that he can get to 218. a reporter asked him what the game plan was for today and mccarthy responded same game as it was yesterday. it is to win. harris, there is also the rare chance that democrat leader hakeem jeffries might become speaker of a g.o.p. majority house. he has the most votes. it would only take six moderate republicans jumping to the other side to finally end this chaos.
8:05 am
on the other hand the moderate democrats could throw mccarthy a lifeline. that's not likely to happen as democrats are really enjoying this situation unfold. >> harris: before i let you go, how likely is it -- you talk to people on capitol hill. the six votes they would need for hakeem jeffries to be the democratic speaker of the house over a majority of republicans, how likely is it that any democrat would be among those six to make that happen? who are you hearing it from? >> right now it's not likely at all. hakeem jeffries was asked about this yesterday and he even said that no republican has reached out to leadership on the democratic side to try to negotiate a deal. in the meantime both republicans that are never mccarthy republicans and those supporting him have both said it would take republicans to have to really give up a lot to be able to go in and switch to the other side which they have not heard of yet. not very likely.

>> harris: thank you very much, good to see you. thanks for getting us started. on the left side of the political aisle it is a party. ted lieu of california tweeted a picture of himself with a bag of popcorn. headed to the house chamber. others getting in on the popcorn joke as well. they think it is thrilling. kentucky congressman elect james comer set to become the oversight committee chair once. i can only imagine what it is like. give us the mood on capitol hill. >> nobody is real happy about where we are right now. again, i don't think there is any reason to panic. we're 24 hours behind schedule. we can make up for that by working an extra day this week. so the republican agenda is still going to be in play. we will get to 218. i think the american people are seeing what true democracy is all about where you have public debate and you work really hard
8:07 am
to try to get to 218. it is hard to get a consensus and we're seeing that play out with the speaker's race unfortunately. >> harris: i love that optimism. we should be grown up enough in the country to have the debates. the fact that you would volunteer to work the days or hours you've missed i think is bold. you aren't hearing a lot of people say that quick frankly, congressman elect comer. let's talk about the logistics of pulling across the line now 20 people hard nose. what do you call them, the never mccarthy republicans? >> certainly i think it's personal with many of those guys unfortunately. traditionally the republicans or democrats, whichever party is in the majority, they have their election. no one ever gets 100% of the vote especially if there are two people running. but then they agree to go out and vote as a party for this speaker. that's not happened in this case. i'm hopeful that they can
8:08 am
negotiate and come to a consensus. i certainly support mccarthy as do 87% of my colleagues in the republican conference. we're just waiting to go back in in the next hour and see what happens. >> harris: 87% is not enough as you said. what about a secret ballot? has that ever been done? could it be done? would people vote secretly more differently than they would if it's out in the open? how does it work? >> i don't think you can vote by paper ballot. i think it's written in stone we have to vote in person for this. i don't think that will be a viable option. >> harris: let's move on. once a speaker is chosen and house members are sworn in republicans are ready to hit the ground running. i gave a list of all the things that are not on the back burner, they are on told until you can get back to work. where do you want to start? >> we'll start with abolishing the 87,000 new i.r.s. agents. that was going to be the first bill we voted on yesterday once
8:09 am
we elected a speaker. hopefully we can get to that today. that's a symbolic vote to show republicans are serious about reducing unnecessary spending. i think that's a perfect place to start and what we campaigned on and the first bill passed by a republican majority. >> harris: from that point you have the southern border, the chaos there, the deaths there of people drowning in the rio ground. i was down there covering it recently. our own peter doocy put it to the white house press secretary. let's watch. >> they claim to have evidence that joe biden lied to the american people about his involvement in his family's business schemes. did he? >> house republicans promised that fienth inflation during the mid-terms would be their number one priority. that's what they said was important to them. instead what they are doing is wanting to do an investigation on the president and his family. that's their focus. they don't want to focus on the american people and their families. they want to focus on political division. >> harris: in addition to the
8:10 am
i.r.s. situation and the border situation, the deep dive into investigating the biden family. what is your pushback when you hear the press secretary saying -- acussing you of not having the right priorities. >> they would be better suited to lead a kindergarten group trying to explain the priorities of the leader of the free world. we have inflation because the democrats spent too much money. one thing that we can do even with a democrat senate and democrat white house is put the brakes on spending. what i want to do as chairman of the oversight committee is highlight waste, fraud abuse and mismanagement. we're also look into the biden family influence peddling. something that amazes me the democrats criticize republicans for wanting do that when they have investigated the previous president for six years straight now and still going. so yes we'll investigate that but also pass a conservative

we've also learned from the family that damar is receiving 50% oxygen after initially receiving 100%. so some very small steps of progression there. there is still a long ways to go in his recovery but it at least appears his condition isn't getting worse. last night damar's uncle said the family has been absolutely overwhelmed by the outpouring of love and support that they have received. >> a lot of people don't get a chance to see how loved they are while they are alife so for him to have a situation where he could have been taken away and he has a chance to come back and see all that love he got is truly an amazing thing. >> the hamlin family is asking for folks to continue to pray for damar. we've seen a lot of that. in buffalo fans gathered outside the bills stadium to pray together. last night in cincinnati supporters held a candlelight vigil outside the hospital at 8:55 p.m. to mark the time damar

8:22 am
dr. marc siegel, a couple of things now. you have that half oxygen rather than 100% to 50%. talk to us about that. >> well harris, i will give you an idea what i think might be going on with the oxygen. i think it is likely that the heart got stunned at least with the initial cardiac arrest and then again we find out he was resuscitated in the hospital. that's a more control setting. the rapidity of response is instant. but generally when the heart gets stunned or damaged you get backup of fluid into the lungs called heart failure. then you need oxygen for that. needing 100% oxygen and put prone means you are stretched as far as you can go. coming back to 50% implies the heart is recovering and starting to recover. so that's why they are saying it's a very good sign. i would take it as such. the idea he is on a ventilator
8:23 am
that is automatic and sedating him and keeping him asleep and not breathing on his own that's what you would expect in this situation to protect the brain. they might even cool him down for that reason or use steroids. you want to preserve the brain so it can recover. can they stabilize the heart, which it sounds like they are doing and what is happening upstairs. >> harris: the rotation off the back to take the pressure off the lungs is something we're familiar with from the covid pandemic when people would lie on their backs in ventilators for so long and we have to learn to save more lives by rotation. >> that's absolutely true. we proved that during the covid pandemic in the early months of it. we started using prone. i saw a 90-year-old woman who was really towards the end put her in a prone position and she was discharged two days later. that helps in terms of getting blood flow and improving oxygen.

this is their reality. >> you know, harris, you always bring this up and talk about it as much as i do and i'm glad you bring it up. i believe in the power of prayer with recovery and believe that damar, someone who came out of nowhere in the middle of pennsylvania, very poor family, did it for his brother and rose up, courage, strength, skill, all of that is so tremendous at the level he performs inspiring fans. that also goes towards recovery. i think his youth, his strength, and his courage will help here. >> harris: absolutely. it will just feed everybody around him as well. prayer. on op-ed argues this tragedy should be a wake-up call for children's sports. here is part of it. it's imperative that youth sports officials adopt preventive measures, the trainers association encourages youth baseball and ice hockey organizations to use softer balls and pucks, chest

border. i don't know how anybody can defend that? >> harris: jose, would you like to try? >> first and foremost we have to recognize the president on day one put forward a bill to congress. nothing has been done on that front. look, the whole container wall issue is a joke. arizona, with all due respect, is not lego land. it is the united states of america. we need a congressional response. where are republicans in all of this? getting something done for the american people. put forth a bill. republicans negotiate with congress. democrats get something done. >> harris: imagine climbing over the height of those containers. effectively that is a barrier. and they have a wall in places like california, kamala harris coming from california. she has enjoyed the riches of having a protection at the southern border, doug. >> ill agree it's a federal

issue. don't hand me a bill to solve immigration problems. how about starting with the basics of protecting the border and don't talk about asylum. we need to reform our asylum laws. this is not an issue, we need to get immigration solution. but border security is not needed by a bill. it is enforced-in-law. you have to empower the border patrol and agents under siege now to actually enforce the law. don't want to hear an immigration bill. start enforcing the border and work toward immigration. if you continue to let people come across that's not a solution. you want to see them come in. >> harris: you and i have talked about the issue of legal immigration many, many times. i know that your family is have venezuela so you know the system is broken and has to be fixed at this point. to be able to slow down the people there when title 42 eventually does go away. what would you have this president do, a president that won't even go see how dire the

problem is? >> it's a fair question, harris. i agree with doug something needs to be done. democrats don't have an issue. let's do a piecemeal approach. border incentive bill. that has two things. more border patrol staff on the ground which we need and the dreamers, which is legalizing a portion of young kids who came to this country no fault of their own. democrats are getting something, republicans are getting something. >> harris: if i could be so bold to speak like kyrsten sinema. if anybody at the white house were listening to her maybe she wouldn't have jumped out of the party. >> this is an issue that needs to be fixed. if you walk into your basement and the floor is full of water and a pipe is broken on the other side you fix the pipe. you don't simply start bailing water. this is the problem we have right now. i would agree we can sit down and talk what we need to do to

fix daca and asylum. as long as you have a green light at the border. they are green lighting the send people across because we're fulfilling the contract of putting them in the can trachlight all the asylum. 90 plus% are denied that come to the court. the reason they're coming is denied once it gets litigated and most of the time it doesn't. that's why this is a problem. >> harris: they've been sending thousands of illegal immigrants to new york city. according to the mayor adams he is mad about that and now colorado mayor is doing the same thing because of an influx in denver. democrat will be sending them there. mayor adams calls the situation unfair. >> a real embarrassment on the national level we have had conversations around the issues of migrants for decades. i think the president has an

obligation to deal with the immediate concerns. going to be a combination of the executive and the legislative body. we have to address this. >> harris: this is a sanctuary city in new york city and they boast about it. that particular mayor when he was a candidate said illegals should be allowed to vote in this country. oh, but now what? it's too much for him to handle? exactly what he asked for? >> the mayor would have to answer to that question directly. i will say it is not a state issue, harris, for colorado to send migrants to new york, texas to be sending to florida. it doesn't work that way and never work that way. this is a federal issue and needs to be fixed by the federal government. >> harris: they take people from the border and fan them out to cities across the nation. how is it any different? >> hhs, responsible for refugees, they don't have enough

room to house migrants they can do that. that's the federal government. they are allowed to do it. states aren't allowed to do it. >> harris: doug, your last few words. >> last few words, this is broken, biden broke it. he won't fix it. we have to do something to make sure the border is secure and then we can get to solutions. >> harris: great to see you. thank you both. breaking news now, fox news alert. the house set to reconvene for that fourth round of a speaker vote. potentially. it will happen moments from now. kentucky republican james comer gave us his optimistic outlook earlier this hour. >> i don't think there is any reason to panic. we are 24 hours behind schedule. we can make up for that by working an extra day this week. i think the american people are seeing what true democracy is all about where you have public debate and you work really hard to try to get to 218. it is hard to get a consensus and we're seeing that play out
