the gavel, the house taking a break until 8:00 p.m. after kevin mccarthy lost his six the vote for speaker, republicans backing him saying enough with the nonsense, it is time to move forward so they can go after joe biden. >> they have gotten together and decided that they can only blackmail the republican conference in effect they are blackmailing the american people. it's because of their headlines about the chaos, this and that, yesterday our colleagues on the other side of the guy over tweeting their bags of popcorn that they had out, they love it. >> i plead with all, all of my republican colleagues, let cooler more rational heads prevail. >> i've had a number of conversations with kevin, and basically said that this needs to break loose. he needs to make a deal, or he needs to step aside and give somebody else a chance to do that. >> judge jeanine: but the 20 plus republicans who oppose aren't giving up. >> i think the path is very

difficult right now for kevin, at the core of this is, yes, we were successful in taking back the majority, but we still have to deal with the reality is of governing here in washington. in a one-day delay or a two day delay, even a three day delay does not stop us from being able to do the things that we were elected to do. >> judge jeanine: and democrats smell an opportunity, aoc thinks the republican fighting could open the door for her party to gain some extra power. >> is there anyone in their caucus that can build that consensus? if there isn't, the team may have to come to the democratic party, and if that is the case, then what would that even look like? could we get democratic chairs of committees as a result? if he chooses to approach the democratic caucus, then that would be a negotiation in and of itself for a potential coalition government. >> judge jeanine: okay, great, i will start with the on this

political issue. i've not asked the question. it's before i don't need a question, i have my strong feelings, this is not groundhog day, it is the opposite of groundhog day, because in the movie he actually got better, remember every day, this is the opposite. he is not -- no one is learning anything, it is anti-groundhog day, pour them kevin mccarthy losing more ballots than the democratic poll worker. sue me. anyway, i'm starting to change my mind on this. i wanted to go on forever. it's like an extra-inning game that like when it's on you go, is that the 22nd inning coming want it to go to 27, how long did this go? it is a horrifying spectacle, but it is also hypnotic, and everybody says, oh, what is it, democracy is messy? oh, stop it. everybody knows this is just a pain. but i love how the democrats act like this is some kind of catastrophe.

end of the world or democracy, it has been two day is and i could go for a few more, but it probably won't. today there was no movement towards kevin mccarthy, there was a slight movement back, so a little bit at a stalemate, the other thing that is happening is the name calling is getting ratcheted up within the party. and they are going to get through this, there will be a speaker at some point, and then they have to work together and they are saying a lot of things that are going to be very difficult to prickett and heart to forgive. so i think that there is only one solution they should do tonight which is -- >> greg: get drunk! >> dana: yes, everybody needs to go to the bar and they all need to get drunk and have a moment, because that's what you do with the team when you're having a little bit of a problem. i'm not saying coming yes, i am saying, go get drunk. and just like check the phones at the door, no one can take a phone in, and everyone just have a chance to talk about some something, trump and a statement said why are you giving up this opportunity to celebrate?

you got back the majority and you are blowing it, guys. and i thought he had a good point. to the last thing i want to mention as i feel like they are forgetting these lessons that happen during the paul ryan years switches if you don't give your team the votes, then whoever the speaker is going to be, and that might not be mccarthy, could be somebody else, let's say it's the debt ceiling, if you don't have the votes of your team you have to get them somewhere else for must pass legislation come over to get them? moderate democrats, what does that do? it opens up the legislation to change things to their will which makes the outliers even more mad and then they can point to them and say you are so establishment, it is not good exercise, and the other thing is they are missing this opportunity, today what does joe biden announce? under the cover of all of this his intention is to go to the border after republicans have stayed they want to go over two years, who is going to talk about that in the morning? no one, because they will talk about this or getting drunk. >> judge jeanine: does mccarthy in order to get 218 votes, does he try to build a

coalition with moderate democrats by turning to the democrats and if he does succeed that a lot of people hurt their careers? >> jesse: if he cuts a deal with the democrats, he is toast, because then he has to give them something. and you can never give democrats anything. [laughter] politics is tough, you get this close to power and their own team kicks you in the groin, six times in the groin, i hate this because i don't like talking about republican infighting, i have a personal policy not to get involved in primary battles, so i say this under duress, but i feel like this is all my fault, because i have been calling kevin mccarthy speaker on prime time for about three months, i jinxed it. i don't know if he is dead yet, but he is close, because i have never seen a situation where

what do you think of that? >> jessica: not very nice, i have talked a lot about people supporting policy is that i do not think it's in their best interests, whether it is women, people of color, other disadvantaged groups, obviously that does not help, and cori bush i think has really supplanted aoc as the biggest thorn in the democrat side and all of this, aoc has really gotten in line, notice even in how she conducts herself in interviews, the people that she talks to you, i've seen from the coverage of what is going on on the floor, she is talking to more republicans than almost any other democratic member of the house, it's not going particularly far with matt gaetz or paul gosar, but she is out there trying to figure out some way that democrats can -- spewing why would cori bush say that? >> jessica: because she thinks that he has an uncle tom, if you are a black person that supports the republican party it strips away your blackness because republican policies do not, and

glamping. you can get a tent and live there, and even the outreach volunteers and the people that work for the homeless are saying, man, this is just a scheme, this is now, people are just doing it because they can't live above and beyond civil society, which i get. i understand what she is talking about, no boss, no bills, no mortgages, free meds, free meals, but there has to be some reciprocity to society, don't make our lives hell. you can have your commune in the desert, hell, i will help pay for that, but you can't be on the street or scare the crap out of our kids or make our lives a living hell come you don't want to live by our rules, but then you don't get to live with us. it's like the parents cutting off the drug addict and kicking them out of the house no matter how much they love them, cities have to do this. homeless by choice, they are not

guess you had is right that tough love is compassionate, that's what you know for everybody. and these drugs, some of them they make you not care about your personal condition, so you are happy to be in a tent and you can be in a city like denver where they don't force the no tent policy and you have tents everywhere, you leave union station and there are tents everywhere? that should be unacceptable, and our police officers, they should not be social workers, they should not have to be, but they also should be given the power that they need to move these people on into care if they need it, and the last thing i would say as it is not compassionate to the families who are worried about their love ones who are out there living on the street. >> judge jeanine: i've been very critical of mayor eric adams, but he did one good thing and i want to give them credit, eric adams is -- he is trying to get the homeless into hospitals, mental facilities, and there is a lot of pushback from, the left, from

people who say it is not fair, they say specifically that it is inhumane to force them to go into a mental hospital, but he has got it under the umbrella of if they can't take care of themselves, and might be a danger to themselves or others, then the police have the right to take them into a mental health facility where immediately they have a psychiatric evaluation and can stay there, not unlike what i did as a judge, now one of the other things, and this is our fault, it is our fault, in missouri it is against the wall to sleep on the street. in new york now, eric adams is saying, if you appear to have a mental illness, we are going to pull you off the street involuntarily and put you in a mental health facility. in the problem is, people they get free food, they get a lax drug policy where they allow them lsd,, heroin and everything else in cocaine and they take it as like a violation, like

getting a traffic ticket, and they suffer more fatality is in terms of overdoses than they had ever, so the bottom line is this, as a society we have to make a decision, are we going to tolerate it or not? >> jesse: are we going to tolerate it or not? >> jessica: somewhere in the middle, the 50%, you have to give us some, and we will continue to give us some coming his not saying tomorrow you can't come back here, but there have to be coming in oh, standards, there have to be goals that you need in order to keep getting benefits. that's how it works in the welfare system, and i think on the eric adams front that that policy when i first saw it, i thought this is a good thing, because it feels dangerous especially in the subways and things like that and i think if you use police officers with social workers and have those conversations and people are mentally old, because that is a problem that we have mentally ill people on the street and i think we can do a lot of good with adding people to get the care that they need to come about one of the main problem since we don't have enough
