a full report from idaho is just ahead. biden intends to visit the southern border for the first time since he left office. take a look at what biden said in the past about the border visit and the common sense department is wondering what changed. we begin in the nation's capital where they adjourn without electing a speaker for a second straight day. kevin cork is live in dc with the latest. >> three more failed votes today. a round of closed door talks to boot. and congressman-elect kevin mccarthy looks no closer to securing the speakership -- that's speaker of the house, if you haven't been watching. the battle continues tomorrow at 12:00 nooning. we i think this is interesting. i crawl before i walk, before i run. a bit of optimism, perhaps, for kevin mccarthy. see if that's warranted. in all, the californian has fallen short in six, count them, six, votes over two days as a

group of 20 conservatives who have deemed him i'd logically unreliable, i would say, have refused to back him, leaving him short of the 218 votes needed to win the job. >> are you considering dropping out. >> not at all. >> are you angry with the people in this situation? >> not at all. it's productive. >> we can't have a situation where 20 members hold 202 members hostage and our agenda hostage, we were elected as well. this is turning into a blackmail situation. >> meanwhile, gop insurgents say it's mccarthy who needs to step aside. >> even having our favorite call us and tell us we need to knock it off. it needs to be reversed. the needs to tell kevin mccarthy, sir, you do not have the votes, it's time to withdraw. >> speaking of former trump, he

said this in a statement, i think it's a dangerous game. frankly, if they're not happy with him, they can do something about it at a later date. he added this, i support ken mccarthy. and i support getting the deal done. but what i don't support is allowing this to continue on ward. while the battle as mentioned rages on tomorrow, it's important to know that as long as this continues, committees can't hire staff because there are no committee chairs and no ranking members, which has led some democrats to call this a crisis. of the congress. others, frankly, trace, feel like this is all good stuff. it's battle as it should be in the nation's capital. >> yeah, i hear both sides. kevin cork, thank you. matt gaetz, thank you for coming on. kevin mccarthy tonight did not want to hold a vote in the house because he believes he might be getting closer. do you think that's a fair

assessment. >> there's a reason he doesn't want to continue having votes and it's because with each vote, he seems to be decreasing in his vote share and we've only increased with votes in our vote share in opposition to kevin mccarthy. we suspect that trend is likely to continue. this ends one of two ways, trace. kevin bows out, realizing there's no path to become speaker of the house even if he picks up one, two, three or fiver of the 20 who have opposed him a half dozen times on the floor. or he has to wake up, bring the house in session, and put on a straitjacket with a rules package that we presented to him that doesn't allow a lot of discretion for the speaker of the house. the reason we demanded that is we do not trust kevin mccarthy. it's not a small body of work. the guy has been in leadership in washington, d.c. for 14 years. this town needs to change. we're going to change it one way or the other. by changing out the speaker or by having the most fundamental rewrite of the rules in my life.

>> there seems to be a lot of confusion about what this group of 20 wants. you said rules changes. a lot of people have said different things. is there something specific, congressman, that you want, that would gain your vote to kevin mccarthy if that thing was fulfilled. >> i'm not voting for kevin mccarthy. there are some of the twenty who i suspect might if we got control of the rules committee or the appropriations committee in the hands of folks who don't vote for bad rules and bad appropriations bills. before the last omnibus, kevin mccarthy was paving the way for the worst legislation driving the country deeper to debt and borrowing against the futures of the next generation. if we got control of those key committees in the hands of conservatives, there are some of the twenty who might vote for kevin mccarthy. if things stand as they are, i suspect the opposition will only grow. >> you have people like former congressman trey gaody who said

he called the opposition a clown show on national television. the form her speaker of the house newt gingrich says you're holding the house hostage. what is your response. >> trey gaody would know about clown shows. that's how a lot of us would categorize the benghazi hearings that result in people yelling at each other in a big report. i remember the trey gaody who went on your network as a congressionman and said he reviewed what had gone on with the department of justice and the fbi and they had done nothing wrong and the american people would be happy of what they were looking at with president trump. we know that to be false. and trey gaody expressed regret about it. i don't take a lot of armchair quarterbacking from someone who during his time in congress wasn't among the fighters. >> representative elect mike lawler said the following. i'll get your response. >> the people voting against kevin mccarthy in the republican conference are aiding joe biden,

hakeem jeffries, and chuck schumer. >> how can you come together and do what you promised the american people you would do as republicans after this kind of chaotic house speakership vote? >> oh i think the world of mike lawler. he's going to do an incredible job. there are days in the united states congress where the only vote that happens is to rename one post office. so, if we could do that for a day, if there are days when all we vote on are how we're going to take the next vote, then maybe takes two or three days or several weeks to select the person second in line to the presidency is worth our debate and deliberation. after that, abc lurtly. we will come together. -- absolutely. i have every confidence we'll be able to come together. we'll be an effective fighting force if we can get rid of kevin mccarthy and get jim jordan or

recollectified, they just do not trust kevin mccarthy to give them their vote. >> unfortunately, we're never going to have a perfect speaker. they're looking for perfection. i think he's earned this position. not everyone loves him. i think there could be other people. they haven't presented anyone. they haven't presented a plan. and kevin mccarthy has gone out and litigated this. he's gone out, travelled around the country, raised the money, gone to districts. made sure we have gained a majority, though not as big a majority as we would like. is so, they're basically never kevin but haven't put forth anyone to garner the votes. i love him. he doesn't want the position. i would love to see us get down to work and have jim jordan get to work on the judiciary committee as the chair and start holding the biden administration accountable and get to the issues we need to get to in terms of judiciary. i would love to see everyone get their committee assignments. and kevin mccarthy has

negotiated with these group of five, now twenty or so. and made huge concessions that would change the house in an his tore tick rules package. this is what it looks like to have a constitutional republic that's self-governing. i love we're having the debate and that the american people are watching what's going on. i formed the caucus hoping that every citizen would vote in every election. that's an ideal position. the more people are engaged, the more they realize how important it is to be part of this constitutional republican to be self-governing. that's the issue here. >> robust debate is good. but some think it's taking too long. here's congressman elect ken buck. i'll get your response on the other side. >> i've had a number of conversations with kevin. i told him, at some point, this needs to break loose. needs to make a deal to bring the 19 or 20 over. or he needs to step aside and

give somebody else a chance to do that. >> difference between robust debate and twenty house members saying they're going to have their way or it's the highway. your thoughts? >> i agree with michael wallace and ken buck. they look like they're taking hostages. they're getting the concessions. to be honest, i think kevin giving them a lot and what could be damaging to the rest of the conference, the other 202 or 201 of us to make sure that we're making sure we govern and that the democrats don't pull a fast one and take back the house in some way after our hard earned gabs that people went out and came pained all across -- campaigned across this nation, in grassroots efforts. i know what it's like to be in a swing district and a strong republican district which i'm in now. kevin mccarthy has to govern and lead over an entire conference. it's a very difficult task. we need to come together or we'll end up in this situation.

at some point, we need a compromise. i think saying never kevin. >> are you convinced? because i think it's a big point. you talk about coming together. are you convinced in the little time that we have left that this caucus can come together after what has happened in the last couple of days? >> look, i think we can. i think that kevin is going to continue to negotiate with this group. and at some point, their -- they're either -- someone is going to negotiate with the democrats and we could lose control of this house that we should be running and governing. and we lose ground. this shouldn't be about personal grievances. it's about the american people and some put forth personal issues they wanted to gain e-mails thises. not the american people or the conference. we're the last line of defense against a democratic party that's controlled by authoritarians and communism, quite frankly. a democrat on the floor of the house who supported hakeem jeffries and said i support hakeem jefferies from the

border patrol has been inundated with record crossings in the city in recent weeks. the city had to declare a state of emergency as a result. speaking of el paso, security cameras caught a mexican fugitive trying to cross illegally to el paso following the break of ciudad juarez. if you didn't hear, gunmen attacked the prip on new year's tay, 19 people dead, ten yards. including the leader of a major mexican gang and several of the top lieutenants. nobody knows where they are tonight. >> cartels are having a field day. bill, thank you. >> fox news at night common sense department wonders how biden got from having more important things to do to agreeing to visit the border. downplaying or quite frankly being dishonest about the border crisis.

breaking tonight, doctors seeing small but encouraging signs of improvement in damar hamlin's condition. he's receiving 50% oxygen after receiving 100%. he's still in the icu sedated and on a ventilator. doctors have flipped him on to the stomach to relieve pressure on his lungs. hamlin's family and friends are feeling positive about the direction things are headed. >> there's not clarity at this point in terms of how long things are going to be, how long it's going to take, where things are going to go. so, for the family, it's a matter of seeing more positive signs and hopefully keep building on that. >> in the first news conference since monday night, ben taylor shared interactions on the field with the bill's head coach and how the teams decided to stop playing the game. >> when i got oifr there, the first thing -- when i got over there, he said i should be at the hospital with damar.

shocked by the quadruple murder of college students, the worst crime the city has seen. once at the jail, he was taken inside for booking. because he must be arraigned within 24 hours of booking, he'll almost certainly make the first court appearance tomorrow. and we're learning tonight this was at the works for sometime. the law enforcement source tells me there was surveillance of coberger two weeks before he was arrested. i'm told the two traffic stops made by indiana police december 15 were directed by the fbi surveillance team that was tracking him all the way from washington state. they were still building their case and wanted video images of his hands. he was finally arrested december 30 at 1:30 a.m. in his parents' house by a pennsylvania state swat team. when they went in, they stormed the place. >> multiple windows broken to gain access as well as multiple doors. the video in the house after the fact confirms that. that would be on the tactical floor plan of the house and what

fascinated by this whole thing, the who is criticizing china saying that we believe the current numbers being published from china underrepresent the true impact of the in terms of hospital admissions and icu admissions and particularly in terms of death. are you concerned about this rising -- one, are you surprised at the who going after chie in and are you concerned about china's rising infection rate? >> the world health organization has consistently supported china, helped them to cover up the covid case numbers at the beginning of the pandemic. never held them accountable for the wuhan lab leak, whether it happened and the origins of the virus. now finally, three years into this, they're trying to hold china accountable. why? the numbers coming out of china are outlandish. they're saying 20, 30 people dead? it's impossible, physically impossible for a country of that size with so many people.

the contract of carriage but also federal law. it was supposed to fly december 27 from new orleans to portland, oregon with his daughter. the trip was cancelled. like thousands of others that fell victim to the air carrier's massive failure. according to court documents,e claims he was not given a refund as promised by the company's own policy. he was, quote, only offered a credit for use on a future flight. the suit claims southwest owes customers $5 million in refunds. southwest airlines has released a statement saying in part, quote, we're reaching my email to every ticketed customer to offer a tailored gesture of goodwill and another heart felt apology that redoubles our commitment to customer. our teams are focused on returning baggage, processing requests for refunds and reimbursing certain incidental expenses related to the disruption and travel in the
