about that then funnels everything to the floor. and we want to be able to have a say on that. it's not enough just to get the same old rules, the 72 hours and stuff that's already in the rules and gets waived regularly. it's a majoritarian body. you can put whatever you want in the rules and they get waived away because mitch mcconnell and the house decided to jam through a bill we have no say. this is all about defending the american people against the swamp. and we're having conversations right now literally i'm going to leave his interview and go right back to keep having those conversations and we're making progress but we still have a long way to go. >> brian: what he wants is about four members of the freedom caucus on the rules committee. he wants a part of the rules to get to debate to broaden out these topics. i think that's it. >> steve: it's too many. >> brian: something to negotiate at least. congressman andy biggs came ahead of the never kevin class i do sense progress. i have do think there is going to be a rest lewis. mccarthy emerged from a meeting making progress not

going to vote now because we're not ready ken buck came out and said i'm firmly for kevin. on the sixth ballot, if he's not going to get the votes we need to cut a deal and he needs to step aside and then maybe steve scalise would emerge. you are going to get with steve scalise the same thing as kevin mccarthy. someone who is going to be able to collect votes and push forward an agenda. >> ainsley: you said too many to request four. >> steve: the rules committee is 10 members. and they want 40% of them. they only represent 10% of the republican caucus. look, the day one agenda for the republicans, every person on the republican side said on day one, we're going to do this with the irs. we're going to do this with the border. they broke that promise. and so what do they do instead? they are watching joe biden. joe biden at 11:00 this morning on fox news is going to give a big speech about migration and immigration. is he going to say look, the system is broken. we're going to change some stuff. give cash to different places i'm on it. and i'm going to go to the border next week.

along, and do some things behind the scenes, they've asked for a bunch of stuff e has given them almost everything, and they're still not satisfied they don't like him. >> brian: what he should be doing is saying his position regularly that's why it's not a debate. if he has given in on certain areas, here's where i gave. in this is where we're negotiating. but he keeps everybody in the dark. until yesterday at about 6:00 for the most part we don't know what was happening behind closed doors and don't know who were weighing in. people on the rules committee and represent a small portion of it. maybe give up on another committee to get more impact there what they're going to find out of many part of the freedom caucus is in lock step with kevin mccarthy about what they want on the rules committee. kevin mccarthy is not looking to jam omnibus down anyone's throat. not looking a void border investigations and border security. i look at it differently. i think republicans are making progress they forced a president who had a job since 1970 to do something he hasn't done yet.

photos show the ph.d. student landing in a small airport in illinois yesterday morning for a pit stop before continuing the trip aboard that small state police plane. and this is the brand be new mugshot of kohberger as he await his day in court. he has been in custody since december 30th when authorities ray raided his parent's home in pennsylvania. during detention there one female inmate claims the murder suspect was taunting guards, singing explicit rap songs and even attempting to expose himself. meantime we are learning shocking new details about what happened during the two traffic stops in indiana while kohberger was making the cross-country journey from idaho to pennsylvania with his dad. this is what steve was referencing. an fbi surveillance team was tracking kohberger's entire journey. directing indiana state police to pull over his white elantra and get body cam footage of his hands for evidence of any wounds. >> i'm having a hard time hearing you because of the traffic. you are coming from washington state university? >> yes. >> and you're going where.

>> going to be going to pennsylvania. >> the fbi says agents were still building the case against kohberger at that time and those stops played a key role in his arrest. back to you. >> steve: supposedly, they said that they pulled him over because he was following a vehicle too closely. todd, put on your lawyer hat. >> todd: yes, sir. >> steve: for just a second. the affidavit of probable cause is going to be revealed today. it has been sealed because of state law out in idaho. that's going to be a jackpot of information about what the cops have on him, right? >> todd: absolutely. i think we have gotten piecemeal detailed up to this point this fbi nugget is absolutely fascinating. up until this point a lot of it is just speculating and conjecture when we get this affidavit with the information it finally released per indiana state law as you said it is going to be a treasure trove. we also need to remember we need to operate with a sense of dignity. details in there about what happened to those four slain individuals that's going to be really tough to hear especially

condition with signs of improvement noted yesterday and overnight. expected to remain under intensive care as his healthcare team continues to monitor and treat him. the one thing is they flipped him over to his stomach. they said that they can decide to bring him out but there are more and more encouraging signs. they still don't know what happened to him. they don't know if he had an underlying condition. they don't know if it was this other condition that we did discuss. also, being investigated that is that condition if you are hit right in the heart in between beats at the exactly the right time. usually happens between 12 years old and 18 years old. your susceptible to having going into cardiac arrest. we don't know if it was that actually happened to him or not but the nfl is investigating that. >> ashley: i was impressed with the bengals coach yesterday because he spoke out press conference well wishes sending prayers to the family of hamlin

and the bills organization and praising the first responders in cincinnati. and he talked about what happened leading up to the postponement of the game. and he said he walked across the field. and he goes to the other side and he talks to the coach of buffalo. and he said mcdermott was so distraught. and he said when i got over there, the first thing he said was "i need to be at the hospital for demarre and i shouldn't be coaching this game. he looks at his players at his own sons and he needed to be at the hospital. here is zac taylor the coach of the bengals talking about it. >> i have seen the tv copies now. and everyone else was forced to think that way because they're not down there in the moment that never crossed any of our minds. it was just how is this player going to be okay. so then when the ambulance starts to pull away was really the first moment anyone gets to even think about anything. and in that moment, you know, it came together with sean mcdermott and the officials kind of led the way there determined just to take a few moments as teams to just process what happened.

it was like after they took him to the hospital. for the players there, well joe burrow, the bengals quarterback, summarized it quite aptly. nobody wanted to be there. >> tried to do all we could. you know, we went over there and saw him and just tried to give -- like you said, give as much support as you can in a situation like that. nobody -- nobody wanted to continue to play the game in a situation like that. and i know how everybody would be feeling in our locker room if it was one of our guys and i know how we were feeling and it was one of their guys. so it was a scary, emotional night. >> it was pretty, pretty immediate. you know, everybody that was out there saw it. and the reactions of the guys who were near and it wasn't -- it was pretty clear early that it wasn't just a normal football

interact with the nfl and divide if we are going to postpone this game. there was criticism for waiting so long. now you understand why. they have thousands of fans in the stand. they are worried about his health above and beyond anything else. then when they finally try to regroup they have to talk to the nfl. they decided the coach of the bills wants to be with his player at the hospital. everyone is distraught. the players can't really get out there because one of their best friends is fighting for his life in the hospital. everyone just needs to take a pause and realize there was a lot going on behind the scenes. >> brian: ending up being paralyzed carted off and playing again. first time they actually stopped. back to the top stories, the house will attempt to elect a speaker today. the deal worked out on the table last night. go over the details with ohio congressman elect warn davidson nominated kevin mccarthy by the way during round five and shares whether the republicans are any closer to choosing a leader next if he should fail.

there was a motion to adjourn there were four republicans that did not support that motion to adjourn, but there was enough to get to an adjournment. so we did adjourn and the discussions continued and so overnight, people are talking about it after the negotiations are over. the 20 holdouts are meeting together this morning and kind of saying does this get us to yes. and i think what they're trying to decide is do we stick together or do we start saying okay, well you won over a lot of us. i don't know if that will win over some of the people though. >> steve: when you say some of the people. there are four or five who are so dug in. it they will never vote for kevin mccarthy. but here's the problem. can hesonly lose four. if five. he does not have the math. >> he doesn't have math unless some other procedure involved. people not voting. i doubt there are democrats that are going to cross over and support kevin but safe to say. there are some possibilities with really low numbers and then

once you need bigger numbers as is the case right now. you just got change the course and frankly, that 20 -- group of 20 people saying unless you change the needle, you're going to have to change the person, and there are a range of other people that group says they find acceptable and would probably broadly be acceptable across the conference. but the conference has backed kevin mccarthy and i think they really want to see this deal done. not just for the sake of who is the speaker but for the sake of how do we operate together in the two years ahead in this congress? >> steve: that's right. because, what we have seen so far is embarrassing for the republicans. but, it means the most essential functions of congress, given the fragile majority the republicans have, hard achieve because so far they haven't been able to do the simple job of getting the speaker. congressman elect. when you go back to the office, and you talk to the person who is answering the phone, what do they say the people of your

district are thinking about, what they are watching on tv. >> i have got to say, people in the district overwhelmingly ahead of january 3rd were saying we got to have somebody other than kevin mccarthy. i think that's the challenge for our party is, you know, the grassroots, the people that supply the votes. will people that go out and knock on doors and provide energy that elects republicans. they are so frustrated the speeches that my 20 colleagues are giving resonate not just with people back home but at some level with all of us. we all want a lot of the same reforms to change the status quo. and it is frustrating to say well, why should it have to be so hard to change it so that this place functions better? and so, i think they're frustrated back home and then on the other side people now are saying can't y'all work that out ahead of january 3rd. >> >> steve: exactly. you are an army ranger, a team player. if you are in a room with those 20 holdouts, what would you say to them? >> well, as i have been.
