morning this morning, mccarthy himself pushed to adjourn the house right wow last night until noon today by a thread. republicans won that vote to adjourn just to give some breathing room, some time to cool off and relax and talk behind the scenes. yesterday mccarthy sat through three separate votes. number four, five, and six, once again losing 21 members who just do not want to support his speakership. he spoke to him after some of the negotiations. listen. >> i felt as though we had a very good discussion. being able to do that vote, that the discussions are going well. >> these are the members elect to voted against mccarthy. they are called the rebels by some g.o.p. led by matt gaetz, lauren boebert, scott perry, chip roy, to name a few. the group voted for byron donalds from florida to be the speaker. he has just two years of experience in the house coming

from the naples area, and victoria spartz voted "present," and it's essentially a no vote. >> byron is a dear friend, a solid conservative, and now as a member of the united states congress. there have been two black americans placed into the nomination for speaker in the house. >> here's where we started to see some movement. some of the negotiations. a 1-member motion to vacate, meaning just one member could trigger a no-confidence vote for kevin mccarthy when he is speaker. before, he wanted five. he has apparently given in at this point. the house freedom caucus wants two seats on the house rules committee. representative elect ralph naumann wants term limits, three terms for house members. mccarthy has more than 200 supporters, even after all his defeats over the past few days, and those 200 supporters came to his defense time after time on

the house floor. remember, mccarthy has those supporters that essentially they say they will do whatever they need to do to make sure that he gets in to see this thing through. listen here. >> share, it looks messy. but democracy is messy. democracy is messy. speaker is elected and until a speaker's ways and members. jerrold nadler from new york said, what if there is some kind of emergency? the house can't spring into action until it gets underway with a speaker. >> brian: when kat cammack came out and indicated the democrats were drinking during this standoff, are they drinking -- is there a bar outside? i mean -- >> i have no idea. she made it kind of tongue-in-cheek. she was asked about yesterday. i think bret baier asked her about it and she brushed it off a little bit. >> brian: they didn't like that. >> they didn't like that. you can hear an audible sound on the house floor. but a lot of them have been in there the entire time, and every time, they stick together and they vote 212 for hakeem jeffries. >> ainsley: we don't know if they are drinking alcohol, but they are eating popcorn. >> steve: david, thank you very much. g.o.p. insiders are saying that,

while some progress has been made, they expect it to drag into next week. they are preparing for it to drag into next week. the problem is, kevin mccarthy is very sensitive to the fact that they keep having these roll call votes and he loses every time. there could be a delay of game. they might come back for a little while today and just say, "you know what? it's thursday. let's come back next week." >> brian: it'll be interesting to see when it's not 20 votes or 19 votes. if you do that vote at noon and then it's down to ten -- >> ainsley: after these concessions. >> brian: and they go, he basically did everything we asked, then there's pressure to say, "what's it going to take? this is personal. should you be hurting the country because you don't like kevin mccarthy for whatever reason?" lauren boebert seems without any substance to her objection. matt gaetz said he would rather vote for hakeem jeffries. when he say things like that you maybe need to move on from them.

>> ainsley: is not going to get lauren boebert come he's not going to get matt gaetz. he can stand to lose four. >> brian: maybe andy biggs is somebody to leave the never-kevin column. >> ainsley: but chip roy said we have a long way to go. >> steve: we had a congressman elect on in the first hour and he said there are at least five people who will never vote for him, according to this congressman elect from ohio. he won't win unless, as the congressman said, they change the rules. and they have a couple of times in the past changed it from a majority to a plurality. the danger for the republicans, if any members of their caucus are not in the room when the times to vote, and every time they've had a vote, hakeem jeffs has won the plurality. they are playing with fire here. and it's embarrassing for the republican party, because people are looking in thinking, why didn't you work this out ahead

of time? why do i have to watch this? they don't seem to be making a lot of speeches, per se. they are just talking broadly about "drain the swamp" and stuff like that. and people want stuff done. >> brian: he's friendly pro kevin mccarthy. he said this about this playing out and if there's any help. >> this reminds me of the ancient philosopher, mick jagger, who said "you can't always get what you want, but if you try sometimes, you get what you need." i think in this case we have something we need. it's time to move on, roll up our sleeves, and get to work. they have been a lot of concessions, discussions that went late into the night last night, with the holdouts. leader mccarthy and others, to give them more seeds at the table on committees, change some of the rules. at this point the rules that have been negotiated are really good to and power rank-and-file members and take the power away

from just one or two people in leadership, and that's good for the institution, it's good for the party. it's time to move forward, unify, and we've got to get back to work. i don't expect at noon that we are going to elect a speaker, but i do expect there to be progress, and hopefully by the end of the day today we will have a better story to tell. >> ainsley: all those 20 holdouts voted for byron donalds yesterday, and he said -- some of the members said they are worried about retribution. if they don't vote for mccarthy, how does that affect them later on? and byron says, "i'm not worried about that. i'm 6'2", 270 pounds, and i'm not worried about that." >> brian: one thing is clear. i don't care if he comes speaker or not, his profile has really risen. the way he handles himself and the respect he has in his caucus. >> ainsley: and he voted for mccarthy the first two times. the third time he said i can't do it because he doesn't have the votes, and then yesterday all three times he voted for

himself. >> steve: generally the house of representatives only works tuesday, wednesday, thursday. >> ainsley: they've wasted a week on this. >> steve: the big question is if they say let's adjourn until next tuesday, or, "look, we can't do anything." i was reading in the packet, a member of congress was supposed to have a security briefing from the pentagon, but they said, you are congressman elect, not a congressman. you don't have clearance. so it's impacting government across the board. >> ainsley: they have known for several months that republicans won the house. they should have been meeting behind closed doors. they should have been planning for this. they went in on day one and they already knew, they rallied around one person. this concessions could have been talked about behind closed doors before that date. >> brian: a lot of close doors. we have a lot of open doors now. everyone is watching everything. they all live in glass houses. >> steve: we have a lot of glass here. meanwhile, in other news -- and this is important, we are very

interested in it. the grad student accused of murdering four college students is back in the state of idaho awaiting his first court date in moscow, idaho, after landing in a private plane in washington state. >> brian: we are learning the fbi was odd him weeks before the arrest looking for any kind of clue. >> ainsley: todd piro joins us live with the latest. >> brian coburg will appear in court for the first time in idaho to face murder charges for the killings of ethan, kaylee -- the phd student landing at a small airport in illinois yesterday morning for a pit stuff before continuing the trip aboard a small police plane. this is the brand-new mug shot of kohberger as he awaits his day in court. he's been in custody since december 30th when authorities raided his parents home in pennsylvania. during his detention, one female inmate claims a murder suspect was taunting guards, singing explicit rap sounds come even attempting to expose himself. meantime we are learning

shocking details about what happened at the two traffic stops in indiana while kohberger was making that cross-country journey from idaho to pennsylvania with his dad. and if you are a surveillance team was tracking kohberger's entire journey, directing indiana state police to pull over his white elantra and get body cam footage of his hands for any evidence of wounds. listen. >> i'm having a hard time hearing you because of the traffic. you're coming from washington state university? and you're going where? >> i'm going to be going to pennsylvania. >> the fbi says agents were still building the case against kohberger at that time and those stops played a key role in his arrest. absolutely fascinating, guys. back to you. >> brian: didn't see any cuts on his hands from what we could see. steel and today he's going to go to a judge, read him his rights, and appoint a public defender. we already know her name. and the affidavit of probable cause will be revealed and we

will know what kind of stuff the cops have. >> that's when we will get most of the answers that we have been craving for the last six weeks. people have so many questions about this case and i think a lot of it is about to get revealed. >> ainsley: thank you, todd. when he read stories about who he is as a person, there are some weird things he has done, and you wonder, did his parents now? because when police say we are looking for a white elantra and this guy lives 10 minutes from that house where these girls on the one man where, do you think the parents said, "wait a minute, our child has a white elantra?" i don't know. these are questions we all have. >> steve: i'm sure as parents they think, "what a coincidence." >> ainsley: a parent as a child pretty well. if he was going to do something is horrific, i wonder if there have been signed before. >> brian: nancy grace was on a roll and thought the suspect has a lot of intrigue. >> it took me about five years prosecuting murders and rapes and child molestation.

one day i looked at the defendant and i said, why ask why? i'm not going to go into his head and figure out why. but i do know that he >> ainsley: these victims, spied on them. i think we will in that from his cell phone activity. being around them. one thing, i want to defend the cops in indiana. everyone was screaming, "why didn't you arrest him when you pulled him over december 15th?" did nobody think it was a coincidence he was pulled over twice in just a few minutes and not given a ticket? they want to video of his hands and face. >> steve: which they did get. and today when this affidavit of probable cause is released we will find out how big dna played a role in it, and the use of his cell phone. generally, your cell phone is a homing device, and that's how the fbi was able to call indiana and say, "can you have some troopers pull that guy over?" >> ainsley: and it was dna from a family member. >> steve: we believe that's true.

misspoke. he was only resuscitated once. >> brian: damar hamlin's representative giving an update on the buffalo bills safety. he remains in critical condition. we now learn he was only resuscitated once, despite what his uncle had said. during his reaction, dr. craig bosman. great to see you. do you think, from what we know publicly, what your sources might reveal, what do you think happened? >> thanks for having me, brian. a pleasure to be here. cardiac arrest is always difficult, and especially when it happens in a young and healthy individual. but i think that most people understand that the present of diagnosis -- again, we don't have the details -- but the presumptive diagnosis is blunt trauma to the chest, resulting in electric instability, and malignant arrhythmia with the heart can't pump synchronously. and it beats too fast so you don't get enough blood flow out of the heart, leading to cardiac arrest. >> brian: they say it happens

between 8-18 in kids the most. usually baseball, a ball to the test. 20% happens in car accidents. and the chance of survival if you don't get to cpr right away is very slim. >> i think most of these cases are in younger patients, but again, we have to keep in mind that there is more people playing contact sports when they are young, so as we get to an older age, there's less contact sports. but i still think the diagnosis is probably consistent. >> brian: there's only 200 document of cases, so that's how rare this is since 1995. what do you think he's going through right now? the only thing i know as they flipped him from his back to his chest. >> i think, from what he had, which was a prolonged cpr for about 10 minutes on the field, it is not unexpected to have a recovery that lasts more than a week. i think everybody is a little bit concerned that he is still

in critical condition, but to me that is not unexpected and it doesn't mean that there's no chance of recovery. i think there is still good meaningful chance of recovery. there is two prognostic signs that lead me to believe that he can get a very good recovery, and a patient like mr. hamlin. he got the cpr right away. >> brian: and the aed separate, right? >> cpi was the resuscitation and the cardioversion, the aed, they got to very quickly, as well. the time that you get to the patient, this was a witnessed arrest, and it's in the young and healthy individual, so i think the chance for recovery is still there. >> brian: full recovery? >> first we look for meaningful recovery. there's a few components after cardiac arrest. the first component is cardiopulmonary recovery, which is essentially the heart in the lungs which have been stunned, and then recovery. the second is the neurologic recovery, which is essentially

from brain trauma. obviously if you're not getting enough blood flow there is a chance that you can have brain damage. hopefully it's none, but there can be varying degrees, unfortunately, from minor to even major brain damage after cpr. the fact that they got to cpr quickly makes it less than. as long as they kept the blood pressure up, it also improves the outcome. the last part of this, he is still in critical condition, and there is inherent complications with patients that are in critical condition. infection, inflammatory disorders, electrolytes. >> brian: they are keeping him there. >> there are a few things we do post cardiac arrest as an interventional cardiologist. we have devices we can use to support the heart in the early time. i don't know the particulars on this case. and hypothermia protocols to help recover the brain. in his case, it seems like there was some lung injury, perhaps from the chest compressions and

the night to speak with anybody that will have a conversation about how we can change things moving forward. how can we be different? how can we deliver to the american people? i would give this one suggestion right now on how we be different. let's get through the speakers vote, and let's do it everybody is called to do. let's go out until the democrats on the other side, send your families home, cancel your flights, let's show the american people we are going to do what service members do. we will stay here through the night, through the weekend, every weekend, every night, until we get things delivered over to the senate that we promised to the american people for the last several years. that should be an example in my opinion. >> ainsley: the new concessions on the table that we are learning this member dominic morning, only one member could vote to vacate, and the whole house takes a vote to see if they don't like the speaker. now they're saying only one number can start it, and he's agreeing to that. the rules of the committee to seek the freedom caucus, they

wanted four people from the freedom caucus on a certain committee. he saying i will do two and someone very close to them, thomas massie, and vote on term limits. that's important to people like ralph norman of south carolina. he wants term limits on congressman. has kevin mccarthy agreed to all three of those? if so, how many of them will vote for him now? >> i can't say he's agreed to all of those yet, but i know he's been open to all of those things from the very beginning. this is an example of how kevin mccarthy is not mitch mcconnell. he's not john boehner, he's not paul ryan. paul ryan, years ago, when i first came in, he promised to have the term limits in the floor of the house by this month of this year. never happened. that's not kevin mccarthy. he says he'll do it, he gives his word as a man, and he'll do it. he is not mitch mcconnell. not that wendy pushed through a $1.7 trillion santos live gifts before christmas. he was fighting against that. these to something a lot of people to realize in my opinion.

♪ ♪ >> are you going to the border when he had done to mexico? >> that's my intention. we are working out the details now. >> ainsley: president biden might finally go to the border as the administration forces arizona to take on the shipping containers it was using to stop the migrants from entering. one of the officials sounding the alarm is yuma mayor douglas nichols. he joins us now with more on the crisis his city is facing. good morning to you, mr. mayor. big thanks for having me on. >> ainsley: i know that y'all have seen a 170% increase in migrant crossings compared to 2021. how do you feel about the shipping containers being hauled away yesterday? >> well, that is not such great news for us. we need to have that protection, and it is really not about people crossing as it is how they cross and where they cross. preventing people from crossing

is probably a different action that needs to have them by the federal government. but these containers really made sure that the traffic coming through was focused in areas where border patrol can be effective in picking up, and protected property, people's homes have been on the border for generations. >> ainsley: it is costing taxpayers a lot of money, first to put up these containers and then to take them away. to take them away, i believe it is $75 million. the president's administration said these had to be down by january 4th, which was yesterday. it's costing taxpayers even more for a problem he created. >> that's true, and the residents of arizona paid that bill. that is really, again, a shift of what should be happening. these are federal issues. the federal government needs to take care of it, not the taxpayers of arizona where the citizens of yuma. those are the things we have been focusing on, really, those federal decisions or lack of decisions impact the local community, and who carries that

impact. >> ainsley: what is the community saying about this? >> they are very frustrated, because this has been a very protracted. lack of time. even if you compare numbers from 2020-2021, there is still a very dramatic increase. so this is a historic level of activity that really puts our community at risk and puts our country at risk. >> ainsley: why do you think the president is now saying he has the intention to go? he's going to be down in that area for the north american leaders summit, which is in mexico city, but the mexico president of the prime minister of canada are going to get together and he says that he has the intention of visiting the border. why do you think all of a sudden, after being a senator, vice president, president, why now? >> i think it has to be about the shift politically in this country. he saw the midterm elections where some very central democrats were talking about the border and what it means to our nation. so i think that message has
