hoping new concessions offered to those 20 plus members voting against him will put him over the top. one aide told fox news mccarthy is now open to allowing just one member to introduce a motion to vacate the speaker's chair. they could get the conversation started on kicking him or anybody out of the seat with one person coming forward. also putting more house freedom caucus members on top committees. and he is promising to hold votes on the caucus's priorities like border legislation and term limits for members. patience among the rank and file is wearing thin with some suggesting that kevin mccarthy should step aside for a different candidate at this point. the leader's supporters are going after all the defectors saying enough is enough. >> people who are voting against kevin mccarthy in the republican conference are aiding joe biden,

$1.7 trillion omnibus bill. two weeks later you have folks saying we don't want to be united. you can't have it both ways. what you have will see today and in the coming days, hopefully not, but if it goes that far is people coming to the table and negotiating in good faith. i think it will happen and i'm the eternal optimist. in the end we'll be better for this. >> harris: talk to me about what kevin mccarthy can offer. he put a few things on the table. i know representative-elect boebert had said she would like that one person can raise the issue of removing a speaker out of the seat. talk to me what he has left in terms of possibility. >> that's one of the frustrating things amongst the majority of the conference. 91% of the way there. 91% of gop members support kevin mccarthy. there are several that are within the freedom caucus that are also supporting kevin mccarthy. more than half of the freedom caucus. when you look at what the deal

was eight weeks ago, four wakes ago, a motion to vacate by a single member. now they say it is not enough. how do you negotiate if good faith if the goalpost keeps moving. there are folks like chip roy and paul gosar and byron donald and jim jordan and others are trying to get to a resolution to works for all of us. these conservative wins in the rules packages are great for conservatives and america. things like having time to read the bill. 72 hours. single issue bill. being able to hold people accountable so we can drain the swamp are all good things. it will take us a little time but everyone who is at the negotiating table are doing it in good faith. it's those that have walked away and put their own personal agendas at the expense of saving the country from the radical left are the ones that need to be held accountable. >> harris: to hear you say some of the things for those who

would vote against mccarthy are good for the party. no journey is wasted if at the end you are made better, right? it's only been three days as chad pergram schooled me on. it felt longer. quickly, why do you think -- i don't know if this is being talked about on the hill. it is hard not to make this at least observation. nancy pelosi hardly ever walks on that floor unless she knows she has votes. kevin mccarthy had weeks up to this between the end of the election and now to try to whip the votes. do you think he was shocked to find out he didn't have them or couldn't he get them? >> this was a continuing moving goalpost at the behest of a small number of members. the name calling back and forth hasn't been helpful. we're one team and one mission we have to be. some of the commentary hasn't been helpful calling names back and forth within the gop. that's not helpful. we need to get back to what the original deal was. there are other things we can throw in there. a vote on a balanced budget

>> harris: breaking news at this hour. president biden is about to speak on border security at any moment now. we have learned he will go to el paso, texas, on sunday. it will be his first visit to the border as president, as you know. we cover this all the time.

crisis rocking. he hasn't been there. now he says he intends to go. a visit to the southern border would be president biden's first. it follows months of insistence from republicans and even democrats that he needs to go see the crisis firsthand. a new report finds that december border encounters shattered previous records. 226,000 in that month alone. people apprehended trying to get into the country illegally just last month. but december of 2021 it was close to 74,000. what we saw just last month was the highest number recorded for december since 1997. while the battle over the next speaker of the house may be getting most of washington, d.c.'s attention, today's "new york post" cover points out the chaos at the border is the real crisis. not too long ago president biden said this. >> why go to a border state and

not visit the border? >> harris: power panel. charlie hurt and kevin walling. what changed? >> i think what the president is signaling is a willingness now to work with house republicans and senate democrats to forge some kind of consensus on immigration. i've been saying for a long time it is a crisis. i'm very happy to see the president -- i'm very happy to see the president going to el paso and announce from the white house new measures with regards to title 42, with an expansion of legal migrant visas for folks who want to come legally that have sponsors in this country. he will announce that in the coming minutes from the white house. these are positive things for the american people. you compare it to the chaos we're seeing in the house of representatives and real presidential leadership.

came along after that and undid every single one of those arrangements that president trump put into place with mexico and other countries to stop the immediate flow. to stop the humanitarian crisis at the border. 100% he owns this crisis as it is now. it is true he has spent the last 40 years talking about in congress and congress has failed to deal with the problem. but the most important thing right now is to put those trump measures back in place to solve the immediate humanitarian crisis. >> harris: we're told the homeland security secretary mayokas and the vice president kamala harris, two people have been tasked to clean up the situation down there will be with the president on his visit. we'll cover it from stem to stern. big question, though, would you move to get rid of mayokas? he has been really off the rails at many times on the realities on the ground, border patrol agents have told me that on the record to my face.

for the president. your thoughts. >> i think it's important the secretary and vice president are traveling there. >> harris: will they be held to account? >> they should be held to account and hopefully see bipartisan solutions coming out of this. at the end of the last year we saw a republican and a democrat working together to forge some level of compromise that involves amnesty. something we saw in the 2013 comprehensive immigration reform bill sponsored by marco rubio. there are solutions out there. we need the political will to see them through. with a republican house and democratic senate we can stop the politization of this. you make an important point. these are lives on the line. both our brave border patrol agents, many who we lost and the migrants seeking a better life for them and their children that have drowned or died along the route. it is a horrifying crisis and we need solutions. >> harris: one last quick one. there was a big prison break

down there two days ago and an important to the drug cartel leader is out and about. they are looking for him. several of the prison guards on the mexico side. this is just across from el paso where the president is going. your last thoughts, charlie. as this situation heats up in a new way. >> it is perfect symbolism what happened at the border. he handed the border to the drug cartels and criminals who now have operational control of the border. all three, mayokas, harris and biden will all be at the border. my belief is that all three of them are going to ultimately be fired in the next election for this. i this i the mayokas should be fired before then but my bigger concern, harris, is that the biden administration will fire mayokas and he will be the fall guy for what is actually a much broader responsibility that should be held to joe biden. because joe biden is the problem. not just mayokas.

embraced colin kaepernick not because of his stance, but because they don't like football. they liked football being under siege and being attacked. colin kaepernick said the nfl draft directly compared it to a slave auction because they take your height and weight and measure your talent. the difference, of course, is manifold but you choose to play in the nfl. no one is required to put their body at risk, just like you aren't required to box or be involved in a ufc fight or compete in any physical endeavor that requires the danger that might arise when bodies come into collision. these guys are highly paid. they understand better than anyone what the risks that they are assuming and they are doing it very often for a chance at generational wealth and certainly to be compensated in their 20s at a level that almost

today won't fix our entire immigration system but they can help us a good deal and better managing what is a difficult challenge. my first day in office some of you may recall who cover this area and you cover it well i sent congress a come pro henceive piece of legislation to completely overhaul what has been a broken immigration system for a long time. cracking down on illegal immigration, strengthening legal immigration and protecting dreamers. those who temporary protective status like farm workers are part of the fabric of our nation. republicans have refused to consider my comprehensive plans and rejected my recent request for an adeletional $3.5 billion to secure the border. and funds for 2,000 new asylum personnel, another officers and personnel and 100 new immigration judges so people don't have to wait years to get their claims adjudicated. they have a right to make a

claim legally. the failure to pass this plan has increased the challenges as we see at the border. no one knows it better than the vice president. we need to see the bigger picture. it is hard to see. our politics are deviceive it clouds the picture. it clouds the picture. let me explain what i am going to do as clearly and plainly as i can. it is a complicated issue. i don't want to pretend there is anything easy about it. people come to america for a lot of different reasons. to seek new opportunity and what is the strongest economy in the world. can't blame them wanting to do it. they flee oppression. we're the freest nation in the world. chase their own american dream in the greatest nation of the

world. the story of america is the story of so many families including mine, now there are a number of ways to immigrate to america legally under our existing laws. for example, an american citizen can sponsor an immediate family member from another country. an american company can sponsor an employee from another country. there are visas for students stow study in our colleges and other special categories. regardless of the legal pathway they process, this process them to require everyone be involved in following the law. that's the notion. there are laws to get here legally. that includes another legal way for someone to come to america by seeking asylum because they are fleeing persecution, like a lot of our ancestors did as well. for many people that's what's happening at the southwest border now. over the past several years thousands of people have been fleeing from central and south

america and caribbean countries ruled by oppressive dick tours including cuba, nicaragua, venezuela and escaping gang violence in haiti. currently these for countries account for most of the people traveling into mexico to start a new life by getting to the american border and trying to cross. but instead of safe and orderly process at the border we have a patchwork system that doesn't work as it should. we don't have enough asylum officers or personnel to determine whether people qualify for asylum. there is a standard you have to meet. we don't have enough immigration judges to adjudicate the claims of immigrants. in fact, the previous administration used a rule called title 42 to deal with the pandemic. to rapidly expel people who crossed the border. designed to deal with the pandemic but used as a means to

expel people at the border. people turned away under title 42. and they are not barred from trying to come back. they go back, they try again and again. well they can and do try to reenter the united states again and again that makes the problem at the border even worse. under the united states supreme court a case on title 42 later this year they will make a decision finally what to do about title 42. in the meantime we'll continue to use that authority. the supreme court has required it. until congress passes the funds, a comprehensive immigration plan to fix the system completely, my administration will work to make things better at the border using the tools that we have available to us now. today my administration is taking several steps to stiffen enforcement for those who try to come without a legal right to
