would it have been better if it were done in private or better it is happening in front of the world? >> i don't think it matters if several days go by where the house has not elected a speaker. the decision is who is going to be the speaker? at some points, if kevin mccarthy is not able to round up these votes, it really speaks to the fact he is not able to lead this congress. i think that is the big issue here. i would like to see if this thing doesn't get resolved tomorrow or today, i guess, friday, i think kevin mccarthy needs to find out who is going to be the other candidate. what the guys have done is brought forward a lot of issues about how the house has been functioning. it is terrible, not been amendment put forward in debate for years now, there is no regular order and everyone in america agrees. you cannot dump 4000-page bill

on your congressman and expect them to vote six hours later when they haven't had a chance to read it. many reforms people have been pushing for are pretty good. most things now, mccarthy has succeeded to and the vote hasn't really changed. if that is the case going forward, we need to find someone to round up the votes and get working for the american people. >> todd: based on alexandria hoff's reporting, does this get done today? >> well, again, if it doesn't, i think it is time to move on. we've seen vote after vote after vote where the numbers haven't changed and the problem is, there is not like there is obstannent 20 standing in the way. kevin mccarthy can't afford 14 or 15 people, he needs to bring

all people to get elected. i think my choice at this point for mccarthy to go to jim jordan and say you have the backing of the house, people really like you and trust you in way they don't trust mccarthy, you need to stand up and take on this role or kevin mccarthy can do what nancy pelosi did. nancy pelosi was elected with 216 votes, she was not a shoe-in, last time she ran. she promised only to serve for two years, so maybe mccarthy makes that kind of deal. all right, i want to be speaker and show you what i can do, if you are not happy after two years, i agree to step down. he's got to force their hand. right now, i think a lot of americans might sympathize with what the fellows are trying to do, men and women in congress opposing mccarthy, but they have not come forward with knowa alternative, they look a little

bit insincere, i'd say, and more show boating at this point, when mccarthy has agreed to most demands. >> ashley: president biden is set to visit the border in el paso on sunday, that is his first visit while in office. imposing new consequences for illegal immigration, surging resources, disrupting criminal networks at the border and providing additional support. there were no specifics, maybe he mentioned with surging resources to help secure the border. do you know anything in particular about putting the weight behind border patrol agents? >> well, exactly. this is a very big promise with some specific ideas about how to stem the flow.

but color me skeptical about this. i don't think joe biden cares if our border is secure at all, his administration has said it is secure already. what is happening here, joe biden is running for president or certainly leaning in that direction, one of his worst approval ratings on immigration and the border. people are concerned about it, other than fox news, no one has been covering the fact we've had four million people cross into the country since joe biden has been president. were it not for governor abbott of texas and governor desantis of florida, people wouldn't be aware of what an open sore this border has become. it's a crisis, it's a fentanyl crisis, security crisis and now according to people like eric adams, mayor of new york, it's an economic crisis for many cities where the governors have been sending migrants and having

>> ashley: newly released affidavit reveals suspected murder bryan kohberger stalked the four idaho students leading up to their murders. >> todd: brooke singman has details. >> brooke: bryan kohberger phone pinged 12 times near the moscow home leading up to the killings and lays out what authorities believe to be his escape route. they retraced his exact path and know based on bryan kohberger phone record he returned to the murder scene around 9 a.m. the following morning. his d.n.a. was found on a knife sheath found next to one of the victims. the surviving roommate came face-to-face with the killer.

the public defender to prove and get him off the hook, when you have details in this affidavit? >> the circumstantial evidence is so strong with the phones, the timeline with regard to victimology and timeline with regard to the car, so what you do, this is mantra defense attorneys have if it is filed as death penalty case. keep him alive another hour, minute, second, not to say he didn't do it, but if the client gives permission, can we take this out of death penalty and do life without parole? the real question is what can defense do to get out, what will the prosecutor do here? will they file as death penalty case? i suspect there are six aggravating factors that apply

here. prosecutor has to stay strong and i've indicated to your producers and others, i was a prosecutor prosecuting murder cases, this is not a case i offer plea offer. they will say to the state, prove your case. we'll wait to see what they come up with if there is any other explanation, evidence is powerful. >> todd: joseph, what was your initial reaction, key takeaway from the affidavit and what holes are in the affidavit that you want filled? >> i got it tell you, certainly my first thought, i was overwhelmed, i don't know in memory i have seen a document like this, where you have so much data they talk about. the tie-back with d.n.a., we have d.n.a. actually left behind on the button snap of the sheath left in the bed next to one victim. that is just overwhelming, you don't have a knife, you have the

sheath that originated with a knife we've talked about for sometime. then you have this d.n.a. that was collected out of the trash at the parent's home in pennsylvania, not to mention everything else relative to timestamps and one more thing we have to mention is this footprint. there was a footprint found on the floor adjacent to dm's room, comes back with what appears to be a van-style shoe. they are taking this car apart, there is so much more we don't know about the vehicle relative to physical evidence, if he got into that car after this murderous rampage, he would have essentially bathed that area in d.n.a. because he would have been covered in blood. if you get this co-mingled

mixture of the blood of victims found inside of that vehicle, blood groupings, d.n.a. tie backs to the victims, overwhelming amount of evident defense would have difficult time explaining away. >> ashley: can you speak to the fact so many people we heard on this network and social media having no faith in this police department, sometimes the fbi, because it seemed like it was going cold for so long. and not only that, but when you look at the affidavit and the roommate who came face-to-face with the suspected killer trying to keep that under wraps, the fact it didn't leak speaks volumes. >> trust me, i've been doing this a long time, that was biggest problem i had as a prosecutor, you don't want information to leak, they are following leads and you don't want to taint witnesses. that piece of evidence about

bushy eyebrows and be on lookout for this vehicle, this case was solved because two washington state officers because law enforcement knew what they were looking for and noticed vehicle in the parking lot at washington state, ran it undo issue got the picture of the defendant in the case and noticed he had bushy eyebrows and this set that off. it is amazing it was tight. meed management in the beginning was poor, that led to people thinking they were not working well, they were saying different things. last point from reading this affidavit, the guy's goose is cooked as far as evidence in this case, led to conclusion if i were in the game, i would contact law enforcement officers from any place this guy has gone to that i can figure out to find out if there are any other dead

bodies that have cold case things, this is unusual thing for guy to go out on first one-off and murder people like this when he's been plotting and planning it according to this affidavit for three months, something with the creep factor in this case. >> todd: one of our frequent guests, jonathan gilliam said the same thing on another show, curious you said that, something we will look into. joe, you mentioned depth of detail in the affidavit, that is true, but one question i still have and i don't know if you can expound on this, why is this eight-hour gap between when the roommate who was alive encountered the defendant and then called 911 or the 911 call was made? thoughts? >> massive mystery, i don't know, some people opined she may have passed out at that point in time, we don't know her status

physically. how was it police was not alerted? we have a huge gap of time. i have to be honest with you, as time goes by, there will be more revealed relative to this timeline going forward. we didn't know when any of this had occurred. there were just speculative guesses at best relative to everything that had occurred that morning. now we've tightened that down. i think this will continue to have a sharper focus as we go forward, more information will come out and we'll find out the status of dm. right now she is the key witness in this case. >> todd: that is what it looks like. thank you so much, appreciates it. turning to a story "fox and friends first" been following closely, this weekend marks two years since california mother went missing and tomorrow morning loved ones are gathering for a hike to raise awareness,

wind up on the front page of the paper. >> ashley: betsy, 48% of americans express confidence in police in 2020, all-time low, how do you see this being solved? >> recent polling says that is up to past 65%. people have learned since 2020, they need american law enforcement officers, polling shows they want us, they worry about us, they do not want us defunded, like to see people with a large platform like christopher wray, step up and denounce the defund the police movement and take on politicians and activists who stand up everyday and say cops are not the problem. we had 52 million citizen interactions last year and use of force was used in less than 2% of cases. cops are not the problem, we know what works, let cops do
