person's mouth and nose walking toward her. d.m. described the figure is 5'10" or italic, male, not very muscular, but athletically built with bushy eyebrows. the male walked past d.m. as she stood in a frozen shocked face. the male walked toward the back sliding glass door. d.m. lock yourself in her room. the affidavit also detailing a timeline of what went down that night. around 4:00 a.m., xana received a doordash food order at home. then she heard what sounded like kaylee playing with her dog in her bedroom upstairs. between 4:00 and 12:00 a.m., she thought her domain she heard her say someone was in there. then she had what she thought was crying from xana's room. around the same time, xana showed she was on tiktok leading police to believe she was still alive at this time. at 4:17, and neighbors security cam picked up a noise that sounded like a loud thud and a whimper. around four clinic 20 is when d.m. encounters the killer.

he is believed to have left the scene moments later between 4:20 and four: i-20 five. his car picked up on security camera footage at 5:25 near wsu. in his dna was found on a knife sheath left at the crime scene, lying next to one of the victims. the document also lays out what authorities believe to be the suspected escape route from the crime scene. fox news digital taking a ride along retracing what believed to be his exact path. based on kohberger's phone records, we know he returned to the murder scene around 9:00 a.m. later that morning. police did not arrive on the scene until afternoon. meantime, kohberger appeared in court for the very first time yesterday in idaho. kaylee goncalves' father too emotional to speak outside the courthouse, but here's the family attorney. >> it's obviously an emotional family stomach time for the family. this is the beginning of the criminal justice system and the family will be here for the long haul.

that they would need in order to back kevin mccarthy on a 12 ballot, which would be the vote that happens later today. they are saying lowering the threshold for a motion to vacate to one member. it was five, now it's one. the house freedom caucus wants representation on the very powerful rules committee. the question is how many. >> ainsley: i think they only represent 10% of the republican party. but they wanted four seats. >> pete: there's been changes in what those demands are. they want to vote on term limits and stand-alone votes on 12 individual appropriation bills, which is how the house of representatives used to work. the committees pump out bills, you vote on them separately, and members actually have time to read them. imagine that. a lot of these changes they are demanding our changes to what nancy pelosi did to consolidate power inside the speakership. we will see if it's enough to move the vote today. >> ainsley: these congressmen and women can do whatever they want. they say they are representing their constituents and they've worked with kevin mccarthy her a long time, but the majority want kevin mccarthy.

matt gaetz is one of these holdouts. he says he will never vote for him. he was on with laura ingraham last night. before you play the sound bite, if you say these are the concessions, will vote for you if you give us x, y, and z, and he gives you x, y, and z and you still say you're not going to vote for him, laura was questioning that, saying, is this personal? listen. >> it would be betting on my vote for kevin mccarthy under almost any circumstance, but it's important to note -- >> so it's personal, then. congressmen, hold on, hold on paid weight. that's personal then. you just made this very principled point. no, no. you can't have it both ways. >> kevin mccarthy has been in the leadership for 14 years, and he has sold shares of himself to special interests, to political action committees, so that's why i don't think he is an appropriate choice. >> so why is trump one? >> brian: what proof does he have the he is sold out to special interests? if you don't like paul ryan come he's not there. john boehner is not there.

down. is he in such a straitjacket, when he gets this, that he'll be unable to be effective? >> ainsley: on tuesday they took the vote, three failed attempts. wednesday, three failed attempts. thursday, six failed attempts. everyone is like, "just let me know when someone wins and maybe will take an interest in this." it's been a wasted week. we could have gotten a lot of things done for our country and that hasn't happened because they are so busy trying to go against the speaker. 90%. >> pete: i think the most likely outcome here is still that kevin mccarthy becomes speaker of the house. if it leads to a more conservative and ardent and solidified republican majority, then there is fruitfulness in this. but if it's just a holdup because of personal grudges, it could go on forever. how many votes will it be? i don't know. ultimately, they better hold those hearings and they better be aggressive as majority, as the only bulwark against what

accused of killing four idaho college students, apparently stalked their home at least 12 times before the crime. he was face-to-face with another roommate during the murders. >> pete: cell phone data also shows he apparently returned to the scene just hours later before police were even called. >> ainsley: our next guest unfortunately lost his daughter, kaylee, during that attack. his name is steve goncalves and he joins us with attorney shannon gray. good morning to you both. eve, were you there in the courtroom? >> i sure was. we expect to have someone there every day. >> ainsley: what is you think when you saw the suspect, the man that might have killed or allegedly killed your daughter? >> when i seen the defendant, i seen somebody that looked like he was overwhelmed and had no idea what was going on. he didn't look as confident as i thought he was going to be based

off his background. >> ainsley: how did you feel, though? >> my feelings were -- i was angry. i'll be honest, i was angry. i wanted to do -- my mind was filled with different things, but i kept my cool in my composure. there is a right way to do things and that's what i was thinking about. >> pete: steve, i can't imagine. i also want to get your reaction to this affidavit which revealed a lot of information we didn't previously know. what details were new to you and stick out to you? >> the actual location of the knife sleeve. we heard there was a sleeve but we didn't know the location. he heard there was dna, but there wasn't a hit in the database. so knowing they'd put all those things together and the timeline they wrote from the beginning to the last page was very precise, and it painted a picture of

weeks and weeks of invest investigation. each line gave me a little bit more confidence that we were in a very good position. >> brian: steve, they are so many questions. as great and informative as the affidavit was, there are so many questions out there. just curious, do they keep the families involved? if so, how? did they say they are very confident they have a suspect, getting closer? did they let you see this timeline before they actually made the arrest? >> he filled in parts of the timelines. it was cowork. those guys by far to the vast majority of the work. we kind of inserted ourselves and said we need to be communicated with, that we want to have meetings and be helpful. we had this audience, we had people who are willing to listen and willing to help and provide information that may have been missing. we had this white car to look

for. so they helped, and we worked together, but i didn't have the details and i told them not to give me any details that could accidentally mess up the case. >> brian: did you know for the first time like we did that one of the roommates came face-to-face with him and described him with bushy eyebrows, with a thin build but an athletic build, the way we now know as written? did you know that? >> i had heard that somebody had seen somebody in a mask. i didn't know if it was something that was yelled out, and one of the people that was downstairs heard that. i did not know that it was one of the people downstairs that actually i witnessed this person. to me it was just a call, so i wasn't positive that it was not just a rumor. so he never mentioned it. the details in the affidavit are kind of shocking, so i'm sure we will get more details as time goes on.

but yeah, it reads very bizarre. >> ainsley: shannon, if he is convicted, do you expect the death penalty? >> i think steve and the family have talked about it and it is something, a decision that would be made by all the families on whether or not the death penalty is something the state pursues on this case. i don't think it is just a decision for the goncalves family but for all the victims' families, and they will see where it goes from there. >> pete: shannon, you had a chance to look at this affidavit, as well. how airtight is the case as you look at it right now? >> i thought the affidavit -- a lot of information is in the affidavit. that sounds like it is a solid case. as a former prosecutor myself, and now a criminal defense attorney, i look at it in both ways, and as prosecution it looks like it has a really great timeline. there is dna evidence, there is the evidence from the cell phones, and the automobile, that he was aware of the location coming back and forth.

so there's a lot of good information there. then when i flip over to the defense side, i still have a hard time understanding how they are going to get past the dna evidence on the sheath. a lot of times, and cases i've defended, sometimes you sit down and talk with the defendant and say, "hey, this is a great piece of evidence. how do we get past this piece of evidence?" so i think that's one of the most convincing pieces of the affidavit, the dna evidence. >> brian: sometimes, steve, you have got feelings. did you think when you look at the sky in the jumpsuit, that you are looking at your daughter's killer? >> yeah, i did. i did research before i came to that courtroom. i was looking for a certain look, and i wanted him to meet the eye. he had the same behavior previously when he was in pennsylvania, and he chose not to her he was afraid to look back.

for me, that wasn't a good sign. >> brian: what about the fact that he smiled? >> i didn't see it. i heard about that later. i don't know. it's hard to comment on that. >> ainsley: you know, steve, we are all parents. for every parent watching, when you give birth, you hold that baby and you have all these dreams for them. you go through the hard years, the years of them always being with you and needing your help, to get the small things -- the serial come, the milk, all of that then the hard teenage years. and you look forward to their 20s when the going get married, they're going to bring grandchildren home, and you've gotten through all that and you have raised these amazing kids. he robbed that from you and your wife. what goes through your mind when you think about that? do you think about that when you see him, or do you want to just jump over and do what most dads would want to do and take him out or take them down, beat him up, whatever it is? >> the physical side as they are, but i know that's not realistic. so what i go with it is i can
