his vote. what is the rationale for changing your vote at this poin in time without having to take day delay, without having to be pressured farther. >> and going to have to ask these members and you can bet your bottom dollar that everybody on capitol hill is going to be chasing these members out of the building. that is the first thing. but someone might argue the outline. there is. or pressure here on capitol hil and at some point i was told very early in this process around christmas time, so think of the context. there's going to be a naughty and nice list. those people who were against kevin mccarthy are going to be on the naughty list. it is such a narrow majority, can you afford to have a naught list. this going to be tremendous pressure applied by rank-and-file members on these members who voted against kevin mccarthy. that was going to pose problems. >> we look at the bottom of the

>> let's just walk through this little bit here. if you have four to 34 members near five present right now let's just presume that everybody is going to vote just like they've been doing on the previous rollcall vote. so 429. so really what you need is 215, 215. that presumes every other numbe in this universe holds. 215 would be the magic number and we have speakers elected with fewer than 218 votes so this would be two lower than what we thought on the last rollcall vote but the five present does not count against the overall tally. it's as if you are not there yo are not casting a ballot for jeffries or mccarthy or anybody else. >> chad chat during the 14, the were to order 32 members proved we believe that number has increased by two numbers or is 4232 the totality of the house members right now voting. >> it was 432 because he had tw

change his boat from present to kevin mccarthy. he maintained his present boat. and eddie surprises? welcome it as nothing but surprises but what is the biggest surprise in your estimation? >> i think the democrats actually missed an opportunity strategically pure the democrat should have voted to adjourn instead of staying in bed i think that would've played thei hand and extended it out and created more present -- more difficult for kevin mc carthy. for the republicans, i think that boebert did exactly what they said they were going to do. they were not going to change off at that and the story comin off the latest round is the fou people that voted against mc carthy, as chad has been doing the math for everybody, allowing kevin mccarthy to get to the place that he wants to g but i think they're happy with the rules package. i think that vote will be tougher and i think that they want to try to build on the momentum of tonight's. you're going to have some

centrist members were just goin to vote no because they are so mad about how this has gone on and that is going to create a whole other fight because you can't do the business of the house of representatives withou the rules package in place. >> but you had this fascinating even the body language, you loo at the body language and you watch people walk up to matt gaetz you see people walking up till lauren boebert and it is kind of amazing. when kevin mccarthy walked in i talked to matt gaetz for a while, matt gaetz whispered in his ear and kept mccarthy walked up and he was red and he had this red piece of paper and he walked up and voted to make sure that they can keep on voting. >> the vote is extended as long as somebody is in the well of the house and wanting to vote s if you get below that threshold and already voted but it is below two minutes, you've got to . up the card and do it by hand and so that vote will stay open to perpetuity until it has been exhausted. the democrats were a little bit

asleep at the wheel right there. they could have made it difficult for people. thus we are having this vote. it really does matter. i can tell you most conversations on the floor are about as the clerk happed the fritos back there or are the hotdogs warm. that is what most of those discussions are. it matters who is talking to hooper sheila jackson lee is very political pushy will go talk to anybody and everybody. there are people that have a real sway with gaetz and boeber and those are people like chip roy, people like andy biggs, ji jordan. when they are whispering and having a discussion, it is probably something pretty important. i think the lip on this was poorly done and that -- we haven't heard his name yet but that is tom emmert's possession. that is not the speaker's position of the speaker to be pretty got a lot on his play. you have a whip that is put in

members. it's an interesting image, as may be the former president was making some last minute calls prospective fascinating page yo can see kevin mccarthy fight fry there and he looks to be able to bit more pleased during the 15th round then he would be at least he was by the end o the last round and chad pergram just for housecleaning facts, when bret talks about the fact that they will swear in all the house members, is that a mass swearing-in, individual thing, is it a pomp and circumstance thing. at how does that come down exactly. >> it is definitely pomp and circumstances but they do everybody all at once inside th house chamber. we had a situation a few years ago when there were some member who were not in the chamber whe they have the swearing in and they were downstairs in the basement -- in the basement and they were looking at a monitor and they help their hand up and they set that doesn't count them you hav to be up there in person so the swore them back in person in th speaker's office. so they do it in person but you

often see the ceremonial swearing in. this is where you see somebody with their family holding their baby, their grandmothers there and they bring in a family bibl or whatnot they bring over all these religious historic texts, different creeds from the library of congress. you can do whichever one you want and you stand there with the speaker. what's interesting is that on tuesday the building had kids, grandparents, college roommates all running all over the building. it did not happen. there was a photo op at this wa set up in the rayburn room wher they were going to do this and then they scheduled it for wednesday. here we are in the wee hours of saturday morning most of those people have gone back home and they have not rescheduled the ceremonial photo op yet and conceivably they can do that sometime in the coming weeks. but that is the picture that yo will see. it's not the actual thing. >> this is a great thing becaus you have a lot of people were about to be sworn in in fact if

this vote goes the way we believe it's going to go and there's not going to be kevin m ccarthy -- there's not a lot of family around. there's not a lot of celebrator atmosphere tonight with these members. >> it is custom of the house if you have a child 16 years and younger are to be able to be on the floor at any given time. so there is always something funny going on with that. i can tell you i have two daughters with me and it was a very emotional moment. you bring your own bible and yo price or handed you get sworn i two congress. it is a neat moment. you get a picture taken. it is just a light moment. to a lot of people getting swor in for the first time. it something that very few people get to do. that sad that they have to miss that moment that there will be some ceremonial things along th way.

the question, jason. >> i think the country will be better for it but i'm glad they went through the process. i think it is going to be more open and it will be more transparent and more accountabl and members are going to have t work harder. i think that is all good. one area where they gave up too much is to vacate the chair. verbally person ethic the threshold has to be higher than one met. democrats also get the play by these rules. democrats again vacate the chai with just one person. there are some real ramifications but i don't know how many times they have to do this vote but i think that threshold should be at 25 or something for me personally. i think the democrats behind th scenes are going to be elated with this. it's going to open up their ability to offer up amendments and beyond the record for thing that they've never been able to do under nancy pelosi. >> interesting. let's bring in bret baier. he was talking about a motion t

point, is really crucial. it is the ability to know where you are and when the majority i this slim, that is imperative. they're keeping everybody on target as far as the vote. they can get different democrat default and they will try to go across the aisle but to get a conservative agenda through, yo have to know who was voting and when you can get them to the chamber. >> you're watching the numbers on the right-hand side of the screen. jeffries that 153. the most important number could be the bottom, present, which lowers the threshold. this is going at a rapid clip. in the early phase votes 1-2-3, it was taking the better part o two hours to get these done.

this is usually surrounding the voting process and they get in the room and they both sometime 40-50 votes takes and it is jus vote after vote after vote. it starts out slow and everybod starts to get closer to the chain. they've been at this almost not quite around-the-clock but they have been through on the fifth day, saturday and the east, since tuesday afternoon so that got them a little bit better at this. here is another thing to consider. the house of representatives at this moment is not fully constituted. if he is elected in the next half hour, i was told a couple

weeks ago that the house was in all the way together by the 13 th of january and that certain committee staff had not been paid so that's an issue. here's another problem that the were starting to encounter. they are not full members. they were getting calls in thei offices for constituents with caseworkers, immigration issues problems with the irs, problems with other federal agencies, they couldn't address any of that because they are not members but so think about the backlog of work that is piled u over the last week and they couldn't address that he of those issues if this were go on for another week. >> it's fascinating. 175-165. the magic number is 215 because there are a -- if you take the present in ther and you do the number, the magi number is 429 and you need better than half of that so two out of 15 would be the number.

people are saying this was a clown act and others are like relaxed bit it is all going to work itself out. >> it does work out. this is the american way we hav these debates but team threats point, it is about three hours. things accelerate when they get out and go home and go to bed. these are long days for them. i say that with a big smile and nobody has left. you have a member whose child i in intensive care and he's back on the floor. he had to attend to a personal medical issue who came back fro denver to be here to do it so there are real sacrifices going on behind-the-scenes. this is what they have to do on monday have to do it but you know what, it wasn't so bad. if it would going to next week, that it would become much more --

to get across this finish line. there was a lot, there were a lot of people saying it is time to put steve steve's gleason or somebody else in again and again . i don't know if you had it on your phone but i had tons on social media. they come to an and because he is the house speaker and he is in a long line of speakers goin back to 1789, and think about this is now as he takes the gavel. is going to have a lot of challenges ahead. one of them is the debt ceiling peer-to-peer land in negotiations, they are not goin to agree to a clean that ceiling . that is what we are hearing tonight. if that is the case, it is goin to be a battle and you have to deal through all these votes. but he is the speaker. let's listen in. >> they are going to go back through the people who did not vote or if they had any change.

speak before he makes that procession into -- we are going to get into ceremony. receive this at 1:00 every afternoon on january 3rd or a couple of days later as january 3rd unfolds of a sunday. under the constitution the congress starts at noon on january 3. they do it put much that day or sometimes on the sixth on january 3 and they pass a resolution to do it a couple of days later. i'm never seen it done at 1:00 in the morning. so you lose this by about 12 hours. there will be a lowball they will take kevin mccarthy outfit i saw akeem jeffries and he will presumably present the gavel to kevin mccarthy and he will be sworn in at there will be a speech and we will swear i the house of the house will be constituted several days late

into the chamber when he has announced a speaker up the house . he will be sworn and and constantine in the house. when they have this narrow a vote majority and that don't have proxy voting, that is something that has assisted because of the pandemic. is going to be a real challenge to get everybody there maybe democrats will be able to win some ballots and they don't hav everybody there.

and in every major bill is goin to be a fight. they might have people there at certain stages. of proxy voting worked in favor of the democrats that we just concluded. nancy pelosi had essentially th same breakdown that kept mc carthy for half. they could vote remotely even though they violated the rules lot of times. here supposed to only vote remotely if you were suffering from covid are taking care of a child or grandmother or somebod with covid or who had been exposed or something like that but people were not doing that near the end. so that goes away and that is going to be a real problem for kevin mccarthy because i do not have majorities in the hous of representatives that are thi narrow. when it comes to funding the government, which is funded until september 30, dealing wit that that ceiling, this is goin

to be an issue. out both kevin carthy play politics here. we talked about not passing thi rules package. they can't constitute committee until they get the rules package . there going to do that monday. from what i've been told, they might do a little more massagin on that because even though the cut the steal with these member to vote for mccarthy, they may have fixed one thing and broken it with others. and people like congressman gonzalez said he was not going to vote for that. that is one vote off the board. everybody is there and you can only lose four pallets of this is going to be a challenge for kevin mccarthy. >> it is amazing too much myth. he makes a very good point. the question going forward now is how they governed. them a very small majority, similar to what they had under nancy pelosi and every bill wil be a challenge because somehow we will keep hearing this number , 218, again and again and again because that appears to b

one of the magic numbers going forward that kevin mccarthy is going to have to herd people toward the question is will he have time doing that with the freedom caucus, the 35-40 members who now have seen that they have a little bit of power of persuasion. >> they have juice. and they can stand together and they have the ability to with this one vote vacate motion. however, i do think that this all came back to a real anger about the process of spending i congress. conservatives were sick of it and they were sick of this omnibus spending bill deal wher 1.7 trillion gets jammed down their throats at the end of december as they are going jrue holiday break and they have 24 hours to read 7,000 pages and they said this is not working that is one of the ways that they express themselves that
