jeffries and six voting present. welcome to fox news live, i'm griff jenkins. hello, molly. >> hello, griff, i'm molly line. the new members of the 118th congress were sworn in and now the house is adjourned until monday. the contentious battle for the votes. >> it carried it the end. at one point it looked like this was not going to a 15th vote. following the 14th vote. congressman mike rogers from alabama had to be physically restrained after attempting to confront representative matt gaetz, but minds did change, a 15th vote was held well after midnight and congressman mccarthy was handed the gavel. >> the honorable kevin mccarthy of the state of california having received a majority of the votes cast is dually elected speaker of the house of representatives. >> and now the hard work
9:02 am
begins. i may not know all of you, some of you are new, but i hope one thing is clear after this week, i never give up. >> speaker mccarthy won the majority with just 216 votes. 212 democrats backed congressman had a keek-- hakeem jefferson. and six voted. >> there are many times we will agree and many times we will differ, i promise our debates will be passionate, but never personal. >> the stalemate over the vote started tuesday and led largely by the house freedom caw was broken as mccarthy agreed to concessions, including the ability to oust him more easily, and plus it array of
9:03 am
spending cuts and committee seats for freedom caucus members. with the speakership sorted, the 118th congress was finally sworn in despite the fracture and the partial reconciliation in the party, griff, speaker mccarthy maintained that this long drawn out process has not weakened the position that he's now entering into. >> you know, alexandria, the history is fantastic and people may forget that kevin mccarthy was majority leader from 2014-2019 under both speakers boehner and ryan and was then leader of the house freedom caucus. mark meadows, who had that one vote to motion to vacate that led to boehner's resignation, no one knows better than kevin mccarthy how delicate this majority is and what we really don't know as you highlighted in that piece, there are six representatives, gaetz, bobert and four others that haven't declared what they ultimately
9:04 am
wanted. they didn't vote for him, they voted present. >> congressman gaetz says he's run out of things to ask for. and having key committee positions at this point. what does that mean for the next coming weeks, upcoming legislation and how much power will the small number of republicans really have. >> and it was fascinating to watch it unfolding during the overnight hours after midnight, anybody up and watching, giving insights into the relationships and mccarthy coming across and seemingly making an appeal to gates to vote or change his vote. and to watch that on live television and think it will be adjourned until monday and come back and say, no, we're going to stick it out and see this get done and now the question is, what happens going toward? how do all of these members work together within their own
9:05 am
caucus and republicans and potentially what it could mean across the aisle collaboration somewhere down the road. there are just so many unanswered questions and we finally got to see just a little bit of the dynamic that usually goes on behind those closed doors. >> you know, there's a moment last night, i was watching and thinking to myself, am i watching the u.k. house of commons, you know how lively some of their debates really are. you don't always see it to the degree that we watched last night and we've been hearing, there was really never a moment when it was known for certain whether this was going to happen and then the outcome of that. >> you know, we know for certain how far mike rogers' patience will go and who knows what happens to him. alexandria hoff, thank you very m much. >> turning now to the crisis at our southern border. president biden is set to visit el paso, texas tomorrow. his first official visit to the border since taking office.
9:06 am
meanwhile, florida governor ron desantis is activating the national guard to help with the influx of illegal migrants. we have team coverage with charles watson tracking the story in florida, but let's start with lucas tomlinson from the white house north lawn. hey, lucas. >> griff, remembering peter doocy asking the president why he wasn't going to the southern border when he went out to arizona. the president said there were more important things going on and now a different story for the president. >> let's say he entered the second floor through the sliding glass door, which is what we believe? why go up the stairs and and take yourself away from an area. i believe that was his target area, he was targeting the two females, no question in my ahead. >> ahead of the trip to el paso, biden unveiled plans here and he says he's going to crack down on migrants coming to the
9:07 am
border illegally and asylum restrictions, and human rights groups and some of his own party. and parole he outlined, and the president did say up to 30,000 migrants from four countries can come to the united states legally if they apply and wait their turn, but texas governor greg abbott says that not enough is being done on border security, and now he took the following shot at president biden's dhs secretary. >> i've got to go back and clarify what mayorkas was saying, he knows he's lying to americans and americans know that he's lying because under joe biden, just in the past year alone, we've had a record number of people cross the border illegally. that border is open because of the biden administration, we've had about as many people cross the border illegally in the past year alone as we have residents of houston, texas. >> and a simple fact check will
9:08 am
see more than 2.2 million people residing in houston. that's the same number of migrants arrested by the border patrol in the past year trying to get into the united states, griff. griff: the numbers are absolutely off the chart. lucas tomlinson live from the north lawn. thank you. molly. >> florida's governor ron desantis is activating the national guard to assist with the alarming influx of migrants arriving in the sunshine state. the governor also slammed the biden administration for its border and immigration policies. charles watson joins us now with the details on this. charles. >> yeah, hey, good afternoon, molly. florida governor ron desantis as signed an executive order that calls on the florida national guard, law enforcement and other state agencies to assist with the stream of migrants who are showing up along florida's coastline and the state will now use air assets, including planes and helicopters from the florida national guard and increase marine patrols to try to help intercept and ensure the safety
9:09 am
of migrants who are attempting to reach florida. in his announcement, governor ron desantis blasted president biden and his quote, unquote, lawless governing oils and i'm enacting the national guard to help alleviate the strain on local resources when biden ignores his legal responsibilities, we will step in to support our communities. the current wave of illegal cuban immigration to the u.s. is the largest it's been in a decade, since august the governor says state, local law enforcement, most are fleeing from caribbean nations, particularly cubans desperate to escape the country's communist government and a terrible economy. over the new year's weekend, more than 500 cubans arrived in boats up and down the florida keys. the national guard rescued more than 300 who were stranded in
9:10 am
the dry tortugas, a remote uninhabited island west of the keys and transported to a border station in key west on thursday. the influx is overwhelming local communities who become responsible for taking these folks in and caring for them. foreclosures say the resources just aren't there. >> over the last week, you know, over new year's, that had to be a thousand, 1500 people that landed on our shores. you know, that's a huge number of people to have to manage, you know, when they don't have homes here, they have no resources here, and they're new to our communities. >> yeah, and lucas tomlinson touched on the white house's new restriction for migrants coming from nicaragua, haiti and cuba. and they're hoping that that helps some, molly. >> an unfolding story as president biden heads to the border soon, griff. griff: thank you, molly. now, back to our top story.
9:11 am
kevin mccarthy is the speaker of the house after the historic 15th vote. we're joined onset by republican congressman from texas and member of the house financial services committee, lance gooden. thank you for being here, you must be tired, quite a night. >> it was. griff: i'm fascinated with the inner workings, and historic, fifth longest in history. was there a moment when republicans thought you weren't going to get across the finish line with kevin? >> there were moments like that throughout the week and i don't know if kevin would ever admit that he thought it, but it had to have crossed his mind. this time yesterday morning, we were all thinking, kevin's got to show progress on the next vote, otherwise he may be in trouble and we'd already gone through 13, 12, 11, i lost count votes and sure enough yesterday morning, he flipped all of those members and we were down to a final 6 and then as the day progressed, we heard there was progress, but i kept thinking are we really going to get there?
9:12 am
and everyone was so confident when we came back in the became chamber last night and then the vote failed and there was talk of adjourning for the weekend, but there were last come to jesus moments. griff: concessions. >> i wouldn't say that, but i think that everyone got on the same page, whether they voted present or for kevin mccarthy, at the end of the night, what was best actually came through and happened, i'm so pleased. griff: and your colleague, scott perry, the chair of the freedom caucus, has said on cavuto's program earlier, a few hours ago, it wasn't concessions, it's wins for the american people, but the fact is, congressman, the concessions are back to the one member motion to vacate, changes to committees like the rules committee, how do you see it? >> i think it's wins for the american people, i really do, and i think it's a win for this house that these problems were hashed out this week.
9:13 am
and not throughout the next year. i don't believe we're going to be in a period of gridlock for the next two years. i believe that house republicans will be united and we got this out of the way and we're going to plan ahead and we're going to be on the same page and i think that that those hold-outs that had things they wanted and were for the most part reasonable. griff: let me stop you for a second. you say you're united with you it is obviously a thin majority and many say weakened because of the concessions, but that at the same time, those six hold-outs voted present and didn't vote for kevin so what to they want? and why would we not assume they're going to be trouble makers when it comes to the first debt ceilings and first votes? >> one can speculate. there are some folks didn't like him for whatever reason and perhaps will never get on board with him personally, but the rest of the group that came over, they were okay with where we were with respect to
9:14 am
concessions and rules changes. the end of the day someone like matt gaetz who was saying some rough things about kevin mccarthy from the last few days went from where he was, from hell no, to voting present and a victory to kevin mccarthy is a testament to where he was and matt gaetz' ability to be reasonable. griff: we'll see when the first votes come and the rules package. >> that's monday night. griff: and we'll see. and what we have, the president goes for the first time in his life to see the border, el paso, he says he wants to do something to get something under control and says the border is not open and the rest of the world is not agreeing. >> i'm thilled thrilled he's coming, and it's unfortunate that they're cleaning up the
9:15 am
tent cities, and the trash, and i wish he would have visited the border like the rest of members of congress have, but if it helps him getting to the point where there's a crisis. i believe that he's seen polling that the american people are fed up and they want serious change at the border and they have to do something. griff: 10 seconds left, do you believe that the president and the administration are sincere. >> i believe deep in his heart he knows there's a problem, but he's beholden to the far left that run his white house and i don't know what his next move is. griff: i'm headed to eagle pass after this program, and he can come and see me if he would. congressman, thank you for being here, get some sleep. you've had a rough, long night. molly, back to you. >> on the other side of the aisle we're joined by the
9:16 am
democrat member of congress and house and financial services committees, jake auchincloss. congratulations, congressman, you're sworn in longer than you wanted. thanks for getting up for us and chatting about what you witnessed in person and so many others watched on tv. after midnight. finally kevin mccarthy got what he wanted after a historic day's long battle and he's speaker. i want your thoughts, on him and what working with the republicans working to get to that point if the coming years ahead. your thoughts. >> good to be with you. you call it working together. i call it a near fist fight which is what i saw on the house floor. it may ultimately have been a w for kevin mccarthy and that he held the speaker's gavel, but it's certainly not a win for the american people of the american people in the midterms
9:17 am
rejected trump's extremism soundly. what does mccarthy and top lieutenants do in the first week in 118th congress, they go and make concessions and rule changes to placate the extreme right that are so egregious that moderate republicans nearly rebel and come to fisty cuffs on the house floor. >> this is not what the americans signed up for in 2022. >> in the recent days, democrats popped popcorn and felt like they were there for a big show and they're there for the american people. there are greater divisions within the parties themselves. where do you find the common ground and move forward because the news cycle is going to move forward. the american people, the four days are over. kevin mccarthy is speaker, and slamming the gavel down and getting things going. how do you move forward? >> let's talk about the
9:18 am
contrast between this. democrats didn't find this entertaining, we found it humil humiliating. two years ago, january 26th, 2021. democrats fought off an insurrection, by the extreme maga of the house g.o.p. and we went on for an infrastructure bill and tough and smart on china and manufacturing semiconductors. and medicaid drug prices and we got that done with the sam exact margins that kevin mccarthy has in the 118th congress and he has been totally unable to use for the good of the american people. so the contrast is stark. the contrast is going to continue. and house democrats are going to hold the house g.o.p. to account for governing for the people and not for their extremist wing. >> you raise a great point about numbers and right now, the democrats are the new minority. so then the challenge is, when
9:19 am
you're looking at what we saw on the floor last night, new factions coming up in the republican party and there are factions in the democratic party as well, the 20, they're talking about what will the republicans be able to achieve. but what will the democrats be able to achieve over the next two years? >> the democrats were unanimous for 15 straight votes. the republicans are at war with themselves, and this is not a new problem for the house g.o.p. they're on their fourth term. they' at a fork in the road. and there are members of the house g.o.p. who are serious, thoughtful-minded members who want to do what is right for america and the other fork in the road grovelling to donald trump and constituency of one. and kevin mccarthy, first thing he did was take a selfie with marjorie taylor greene. there you have it. griff: congressman, before we
9:20 am
run out of time. i want to shift over to biden in the border. in the midst of all of this happening and the speaker vote. a major headline that got buried a little bit. the president announced new border actions and finally making the trip to the border where republican critics have said it's far too long. will the changes make a difference and will the trip to the border make a difference? >> president biden inherited a broken immigration system and fixing it is the biggest problem, and both parties know that. ultimately we need a law not a trip. his actions will help, but congress needs to fix it. that's why president biden sent a bill to congress in his very first day in office and it does three basic things. one, more border security, two, it helps countries of origin with crime and poverty that are causing immigrants to flee and

9:26 am
logan airport. after checking with the airline, walsh did not board a flight. police say her husband has been fully cooperative and they see no connection had his 2021 criminal conviction for selling warhol paintings. and the search is expanded. >> we have been working with the federal partners and at this point in this morning, we have detectives with cohasset police along with state police to washington d.c. to interview people and interview you people in washington d.c. and work alongside the metropolitan police. she does have connections to the d.c. area. >> and walsh's employer, a real estate company in the district says it's assisting in the search. for now, there are few clues, her cell phone has been silent and the credit cards have not
9:27 am
been used. walsh is from european accident. and each hour they're becoming more and more concerned about her welfare, but for now, the case is being treated as a missing person's case and not, molly, a criminal matter. back to you. molly: yeah, still you see law officers searching through the woods and underbrush and can't help, but be concerned for this woman. thank you, david lee miller for reporting on this mysterious case in massachusetts. griff: it's christmas day in ukraine and for the first time in the 31 years of independence, ukrainians heard orthodox christmas service in the ukrainian language at kyiv's 1,000-year-old cathedral. another sign of their division from russia, this as ukraine dismisses vladimir putin's so-called christmas truce. alex hogan is live in kyiv with more. hey, alex.
9:28 am
>> hi, griff. despite russian claims of a holiday truce on what is today christmas in the christian orthodox religion, there is really no belief that that would happen and exactly what was expected here in ukraine. there was continued fighting on the front lines. the idea of a holiday truce was refuted by ukrainian government officials who tell me that any attempt to pause the war would only be a way for russian forces to regroup. and ukrainians that i met today say that they had no intention of believing that this could be possible and they still planned to go to holiday services regardless. these clouds gathered today at a moving and historic christmas church service kyiv led for the first time by the ukrainian orthodox church authority rather than the russian as the church takes steps to distance itself from moscow. >> it can be said that this is the liberation of the ukrainian
9:29 am
nation from the russian occupation. >> in russia, russians president vladimir putin attended a christmas service alone today where he thanked the russian orthodox church for supporting his troops in ukraine. as the fighting drags into a new year, the u.s. now pledged renewed support to ukraine with more than three and a half billion dollars in aid and this includes bradley fighting vehicles which are equipped with fighting power capabilities and can carry troops to the front line. germany will follow suit and send a patriot missile defense system and germany promised to send their own armored vehicles and all of this falls short of what ukraine says it desperately needs along the front lines. abrams tanks from u.s., and tanks from germany, which have more cape bit of protecting the manpower inside of them and have longer range capabilities. griff: alex hogan live for us in kyiv.

9:35 am
house where those four university students were brutally murdered in the early morning hours in november. when police returned there in the afternoon and began removing more evidence. among the items we saw being taken away were two mattresses, both of them were wrapped in dark white plastic, but you could see through the plastic of one of them that it was heavily stained. now, obviously, we do not know what that staining was, but we could make it out through that plastic and given that at least two of the victims were apparently murdered as they slept, viewers can draw their own conclusions as to what those stains may have been. now, in the meantime. we've been talking on fox to some forensic experts who say that the pattern that the alleged killer, bryan kohberger followed, when he went into the
9:36 am
house might indicate that he was specifically targeting either kaylee goncalves and madison mogen among the victims, they killed first, we believe, and they were in the upstairs bedroom. listen here to that forensics expert. >> let's say he entered the second floor which is what we believe. why go up the stairs? why take yourself away from a possible exit of any kind? because i believe that was his target area. he was targeting one of the two females on the third floor, there's no question in my mind. >> how, we have not been given in any anything that the police have released, any clues as to what they believe briyan kohberger's motive may have been. at trial they don't need to
9:37 am
provide motive, but just prove he was the killer and they have different us that his vehicle was in the area, and that he was in the area of the victim's house some 12 times in the weeks and months leading up to the murder, according to police could indicate stalking and planning. in the meantime, griff, he remains in the county jail which is behind me here over my left shoulder, due back in court for a status hearing on thursday. griff. >> jonathan hunt live on the ground in moscow, thank you. molly. molly: for more on the prime suspect in these grisly idaho murders, let's bring in forensic psychologist, daniel, thank you for being here and bringing us some of your thoughts and what we know is still unfolding in this case and we're beginning to get more details. because the suspect agreed to
9:38 am
go back to idaho, the affidavit was released and gave us insight as to what law enforcement officers have that led to the suspect, including one of the shocking things revealed, a surviving roommate in this document claims that they saw the suspect, the killer that night, a man dressed in black wearing a mask walked right past the surviving roommate identified as dm and towards the sliding back door. the paper work says she was frozen in shock phase and then locked herself in her room and she had been described as hearing crying voices earlier in the night, but 911 wasn't called until around noon. still the same day. but many hours later. i just want to get your thoughts on that witness and what she may have experienced. >> well, i think we hear about this with soldiers on the battlefield and police officer, sort of fight, flight or freeze
9:39 am
when the sympathetic nervous system when chemicals are released and sometimes people can disconnect from their thoughts and emotions and they're literally frozen. it may be possible in this case that that's what we're looking at. molly: now sort of in the mind of the killer. put yourself in the person who allegedly violently brutally killed several people and walks right past someone who spots him allegedly and out a door. why would this potential suspect walk past someone who appears to be a witness? >> you know something, molly, when i first heard about this case i was thinking of a classical stalking model where maybe he developed an emotional attachment, maybe an intimate relationship with one of the victims or someone who rejected him, but maybe i'm thinking he was like a lion, hunting his prey and had the victims in his sights for several weeks and he
9:40 am
pounced on them. thinking that it's cold, calculated, and turned over his phone during the hours of the group, there was conscious concealing the crime. i think he went there knowing what he was looking for and had been building this up for several weeks. molly: if the suspect is killer, innocent until proven guilty, he had ostensibly studied crimnology, and why would he have made so many mistakes, and people who watch crime dramatic, stalking the weeks before, the cell phone ping, using the vehicle that you own. >> obviously he wasn't as smart as you thought he was, leaving the sheath with the blood on it and giving to police the dna. he's fascinated with crime and put out survey at one point asking what was emotional for people about a crime and
9:41 am
motivated about them, maybe he was talking about himself or a form or projection, i find it fascinating. molly: what do you make of the information in the affidavit that shows the suspect returned to the scene the same day after these brutal murders were committed, that this was based on some cell phone pings noted in the document? >> we see this a lot with psychopaths and serial killers, a lot will return to the scene of the crime, they get a thrill out of it, watching law enforcement scurrying about, trying to find out who did it. for him, i think it's a rush and that he got some kind of a rush from it. molly: thank you so much. >> my pleasure. molly: and the suspect returning to court and thousands -- and we don't know if we have all the information in the case. thank you for your contribution. >> my pleasure, molly. don't miss fox nation's host,
