eric: congress had to get to work for the border, the budget and so much more is the fight for the speaker's gavel is finally over. publican leader kevin mccarthy elected in the early morning hours after 15 rounds of voting, the most since the civil war. it came only after four days of bitter negotiations with freedom caucus holdouts. also some the last minute drama take a look at this. rogers of alabama lunching republican colleague matt gates being held in a restrained as he

did that. that during the 14th about it last night as gates was an opponent of mr. mccarthy. lawmakers you can see stepping in to prevent a scuffle on the floor of the house. we will ask washington examiner if that might be a preview of more inviting to come and they wondered 18th congress, hello everyone this is fox's live i am eric shawn. hi arthel. arthel: hi everyone i am arthel neville but two other major stories we are following this hour, president biden prepares to visit the southern border for the first time tomorrow, former border patrol chief rodney scott on that he is ahead. at first law enforcement removing two mattresses that may have been blood stained from the home were fort university of idaho students were brutally murdered. this, as we learn more about how investigators track the suspect in the weeks leading up to his arrest. former d.c. homicide detective ted williams is just moments away from the crime scene and

idaho. but first, chief correspondent jonathan hunt is also live in moscow, idaho with the latest in his end, jonathan. >> arthel, investigators continue to build their case against as part of that they are continuing to gather evidence from the house where the murders happen. our cameras were there as they brought out more of that potential evidence. including mattresses. now you will remember of course at least a couple of the victims were stabbed to death as they slept. they mattresses that they brought out were covered and thick plastic wrapping. but we could just make out underneath that wrapping, dark stains on at least one of the mattresses. now we obviously do not know what those stains were. but given that a couple of these stabbings at least happened

while the victim slept, viewers can draw their own conclusions. we've also been talking to forensic analyst at fox. and they say the movements of the alleged killer, through the house might indicate that he was delivered see targeting either kayleigh or madison. both of whom were stabbed to death on the top floor of the house. listen here 20 forensic experts. >> let say he entered the second floor of the side cluster which is what we believe. why go up the stairs? why would you take yourself away from a possible exit of any kind? because i believe that was his target area. he was targeting one of the two females on the third floor there is no question in my mind. >> now, bryan kohberger of course a 28-year-old accused killer wasn't making his first

court appearance here in idaho this week. he is due back in court on thursday for a status hearing. and in the meantime of course we have that wealth of information from the probable call affidavit for what police call a dna match. that vehicle surveillance footage putting his hyundai a launcher at the scene of the crimes at the time the murders were committed in the cell phone pings that they have trace the history, putting his cell phone near the victims home some 12 times remember, before the murders. in that weeks and months before the murders. police say, arthel, that very will indicate the stocking of one or more of the victims and detailed planning before the killings actually happened, arthel. arthel: unbelievable jonathan hunt thank you very much, eric. >> what else police have found that could point to kohberger.

let's begin ted one's former d.c. homicide detective at the police station. ted, could there be likely more dna found to link kohberger to the murders besides the sutton knife something taken at the mattresses, do you think the police are holding anything back? what else could they have? >> eric, they are holding a great deal back. they are keeping law enforcement a lot of information close to their chest. but i've been told by a source they have quite a bit of dna evidence that they have processed. i would have to believe at this stage they have processed that white vehicle that brian kohberger drove from the state of washington to pennsylvania. and where he was arrested in pennsylvania the automobile was confiscated. eric: in terms of the automobile any blood or dna linking hair fibers and that sort of thing

could be in the vehicle? if he indeed stabbed them, walked in the blood, came out. what could that mean? >> absolutely. from what we have been told by the medical examiner this was a very gruesome crime scene. that there was a great deal of the blood. you would have to believe that the killer and at this stage the law enforcement has named bryan kohberger as that killer bread he would've had to been covered in blood as he left that crime scene. he would've gotten in that automobile and at some stage from what we have been told was attempting to clean up that automobile. but i can tell you that law enforcement has all sorts of ways of processing an automobile to find out if in fact it was associated with that crime sc scene. eric: 's pretty spectacular law enforcement was able to get onto

him and follow basically has 2000-mile trip with his father back to pennsylvania. when it make the fact they have the surveillance team on a watch 24 hours a day some for him in the morning they say taking garbage bags out of his house. putting them in the dumpster of a neighbor. authorities retrieve that skill dna match. >> eric, i can tell you this is very good law enforcement work. what they needed was to connect kohberger to these murders. what they waited for in pennsylvania once he arrived there, was for him to throw some trash out. they were able to show a dna nexus between kohberger and the knife sheath that was left at the scene of the crime by the body of one of the victims. eric: what a defensive three main deal you've been involved in homicide prosecutions. he could say the knife was stolen, it was his but he lost

it. he was driving back with his father, the cell phone pinged around the house is why he drove through there. how do authorities try encounter of any of those types of arguments? >> quite naturally the defense in me having been a defense lawyer would want to start using those type of techniques. because the surviving witness waited approximately eight hours to call law enforcement and did before calling law enforcement called some friends over that scene was contaminated. when law enforcement believed they have built a very solid case. i think the case is going to be predicated in based upon kohberger automobile as well as a dna that they are still processing. some of that dna may very well

show defensive wounds about some of these victims. and they fought back and they very well may be some physical evidence of kohberger's under the skin -- mike under the of some these victims. eric: it's so heartbreaking and sad the witness identified as dee, the housemate. so there was a man in the house, or some kind of crying, did not call police when you're young and in shock you locked the door and you cannot second-guess that. in terms of motive and why he targeted this house. what is your gut? kayleigh and madison on the third floor he had to go play third floor first you think you'd kill someone on the second floor before he go upstairs. can you dissect, ted, why there could be that motive? was he targeting someone specifically? >> that is a good question, eric. i believe when he entered the second floor he encountered zana

and ethan. i think he killed them right away and then went up to the third floor where he found kaylee and mattie. this is when he came in contact with one of the surviving students. that has been borne out by information we have received from the courts concerning these killings. we received some information last night to show the sequence of events and it appears what i am saying, what a sequence. under those circumstances i believe one of the individuals, maddi or kaylee on that third floor was his target. >> a lot more to come out, ted williams during spectacular work in moscow, idaho the police station. ted good to see you, thank you. our coverage of this will continue thought the weekend here in fox news channel, lawrence jones, his show across

closest to who we are. it is the closest member in washington that represents people. so it should not be surprised that it was all over the place. because american politics is all over the place. and the demands of the small became louder and more boisterous then but the rest of the body was willing to engage in. now, in terms of giving power we do not know everything he gave up. in talking to voters i try to take a perspective outside washington as people are watching this. there are some people that were really interested in watching how this process went in terms of history. however there were others who were very frustrated. i went to pennsylvania's district they were very frustrated with him, there were many voters who said look, this

is not why we sent you to congress. and he eventually did go along. i think were people began to lose their patience with this was when it became about getting positions of power and not about getting things done. that hasn't voters started. arthel: exactly voters spoke in the midterms they want things to run as smoothly as possible they are in d.c. as we don't matt gates was a star of the show last night. among other things, the holdouts. they want to get rid of the omnibus bills and hold separate and individual votes on all 12 spending bills. they want to vote on term limits. none of this is likely to become law. but let's take a look at what they did get. they won two seats on the rules committee that sets the term for debates and amendments. as you know this could water down speaker mccarthy's mojo to

cobble together majorities for legislation. they also will call a promise ring that the budget for domestic discretionary spending in fiscal 24 won't exceed what it was in fiscal 20222 years a ago. that includes defense spending which could potentially lose $75 billion of funding. so how in the world as the people's business and get done with these concessions and play? >> that is the challenge in play. they have to make up their mind with the freedom caucus members and those that were setting these demands. they have to make their mind up. they have to listen to their district. their district should dictate how they votes. you are supposed to represent the needs of your district. george district send you to washington to be a disrupter? to be someone that causes nothing to happen? that is something they really

have to think about. voters really had a lot on their minds when they went to vote in november. i don't think it was for them to send the caucus and nothing get done for thou be a failure to understand why they were sent to washington. this happens every two years, voters send washington a message with their votes. and it washington misreads it every time but that is why we get new majorities. i think they really need to think hard and long about this one. survival of the weather. speaker mccarthy agreed to allow one member to call a vote to get rid of him, get rid of the speaker produces the most consequential concession? >> yes absolutely i think so. it always holds sort of this shadow over it mccarthy, this pressure over mccarthy and everything that he does. you know, the speaker isn't just the speaker for republicans.

he is the speaker 435 people. and to always have this hung over your head is going to make it very difficult to govern. that is the challenge freedom both of these parties always a face when they when the majority, can you govern? can you get things done? or do you just do things to showboat or do you just do things for your party? that is a challenge they face. arthel: it's not about the party it's about the people as we always say. but at this new gop house majority let's say they can kiss and makeup, can we expect all investigations and no legislation will that work? >> that might work. i think people totally understand there's a small majority there. you are not going to get and it has to go to the senate. the democrats have the authority there. so there's not a ton of legislation they can possibly get done.

eric: desperate search continues her messages as mother print she's been missing since the early hours of new year's day. investigators say 39-year-old ana walshe was supposed to catch an early morning flight to washington d.c. she works in washington. she never got on the plane. david lee miller is following the latest in the story for us. >> eric, police say every hour they have become more concerned about the fate of a missing mother of three. early new year's day kohberger

left her home in cohasset, massachusetts which is not been seen or heard from since for the husband lives in the home with the kids reported her missing three days after she disappeared. look at new video now that shows investigators at the home today. now, employer was based in washington d.c. also reported her missing. investigators are looking at whether she took a ride share from her home to boston's logan airport. they after checking with the airlines, walshe did not board a flight. an interview box police chief said earlier today the search is expanding. >> we have been working with the federal partners and at this point this morning we have detectives from cohasset police along with massachusetts and state police en route to washington d.c. to interview some people and chase down some leads in d.c. and work alongside washington metropolitan police. she does have connections to the d.c. area.

eric: present biden said to travel to el paso, texas to marty's going to firsthand look at the border crisis as it is unfolding under his watch. this will be his first trip to the border during his two years as president. some critics are saying with the migrant encounter setting record levels in his visit is just a little too late. administration has to do a lot more to ramp up its policies for illegal immigration but lucas thomason alive at the preview of the president visit, hey lucas. >> that is right present biden is never gone to the southern border as a sitting president is also never been to the border as a vice president either for the last time he went was during the campaign in 2008. he explained why the time is right to go there. >> i wanted to make sure that i knew what the outcomes or at least the near outcome was on title 42 before i went down. i wanted to make sure there was a rational way we can begin.

let me share with the president's new plan they announced this past week that we heard about. you need a u.s. sponsor you have to apply first before you comfort of got to be able to work legally here. it's reported out they have sought to end title 42. any of these new so-called restrictive policies make up for their wanting to get rid of title 42 not taking actions. >> that's exactly the smoke and mirrors we are talking about. they're not serious about border security. we need more immigration judges me too speed up the asylum process for their needs to be integrity behind it that what they don't talk about as they water down the credible hearing criteria to make it easier to get to the second phase of the asylum process. which means they are released into the u.s. then thing they don't talk about is a sure numbers for this not a

>> florida governor desantis signed an executive order that calls on the florida national guard law enforcement and other state agencies to step in and try to help with this stream of migrants that continue to show up along florida's coastline. they use their resources including planes and helicopters that belong to florida's national guard. an increase in marine patrols to try to not only intercept migrants but to ensure the safety of those who are attempting to reach florida. and his announcement, desantis blasted president biden for lalas immigration policies for the governor saying and part quote i am activating the national guard and directing state resources to help alleviate the strain on local resources when biting continues to ignore his legal responsibilities, we will step in to support our communities.

and it migration is the largest it has been in the decades since august the governor said state, federal, local law enforcement have encountered more than 8000 migrants off the coast of florida. most are fleeing from caribbean nations. desperate to escape their countries. and in terrible economy. of the new year's weekend more than 500 cubans arrived in boats. up and down the florida keys, national guard rescued more than 300 who were stranded remote and uninhabited florida islands just west of the keys. they were transported to border station in key west on thursday. the influx is really overwhelming local communities who have become responsible for taking this folks and in caring for them. the resources just are not there. >> over the last week there has to be 101,500 people landed on our shores.
