path to speakership. welcome to fox news live, i'm mike emanuel. coming up this hour on fox news live we will speak with republican congressman matt gaetz who was at the center of the drama. we will find out more about the negotiations and what's next for the 118th congress, stay tuned. president biden is in route to el paso, texas for his first trip to the southern border since taking office. we have fox team coverage with mark meredith in el paso, jacqui heinrich in mexico city and griff jenkins at the border in eagle pass, texas, let's start with lucas tomlinson live at the white house. good afternoon, lucas. lucas: president biden will land in el paso shortly, first trip to u.s.-mexico border as president. he never visited as vice president and there's some debate whether the drive-by during 2008 campaign counts as a

political pressure to do what he's doing today to come to the border but his trip is quite brief. he's only going to be on the ground for 3 hours or so. el paso like border communities have struggled to deal with the large influx of migrants coming into their community. despite recordings of crossings in their view things are improving, number of migrants trying to cross in el paso is down 70% in the last several week since mid december, on the visit today president will get a firsthand lack at bridge of port of entry, busiest port and meeting with patrol agents and expect today highlight improvements they are working on tied to 2021 infrastructure bill which granted the port $600 million to improve facilities including beefing up security but texas officials say they hope for the president during his visit that he's going to get a better idea, a better understanding of why so many people remain frustrated. >> i hope he does. i hope he takes a good look at it. i hope he's open and listening

to what's going on because there's a big issue, if it wasn't for governor abbott, governor abbott has done more to secure the border and providing us resources, the better combat the cartels, drug smuggling and the human smuggling. >> the president is going to be meeting border patrol agents on duty every day. he's going to be meeting with nonprofits in the area that are helping deal with the migrants because, of course, there are so many but just ahead of trip little bit of controversy because there's critics out there that say that el paso officials have been going great lengths to clean up the city, remove migrant camps out there to make things better than they've been up until the president's visit today. we will be looking to see if he responds to critics when he touches down here in texas in a little while. mike: after stopping in el paso, the president will head to mexico city on monday for north american leader summit but tensions are building as it

comes just days after the mexican governments arrest of the son of notorious drug kingpin el chapo. jacqui heinrich in mexico city with the latest, hi, jacqui. >> this arrest has been described as a gift to president biden and also a message that mexico is in control of its security situation and president lopez obrador's hugs has reasoning, cartels declared war trying to shoot down military and civilian aircraft to prevent transfer to prison outside of mexico city. also blocking roads, setting vehicles on fire, at least 30 people have died in the shootouts. a federal judge paused guzmán's extradition in the u.s. and remember, this mexican president freed him once before in 2019 amid terror from the cartels. >> the cartels are using the human smuggling and they are making a lot of money off of it

and they are flowing drugs right across behind it. when you're talking about the wars in sinaloa right now, that affects everything that happens in the united states because there are sinaloa cartels in every major city in america. jacqui: so far this fiscal year nearly 500 pounds of deadly fentanyl seized across the u.s. border, two pounds of fentanyl will kill half a million people. we are quickly approaching last year's number of total seizures, more than 14,000 pounds, republicans in congress see this violence after guzmán's arrest as clear sign the u.s. needs to support mexico in fight against the cartels. >> the mexican army sent battalion against them, they killed or wounded over 50 mexican soldiers. i want to be clear, i'm not talking about u.s. troops, but i'm talking about cyber, drones, intelligence assets, naval assets, we need to go on offense against them. i plan to introduce legislation

pass, part of del rio sector where officials tell me in the last 24 hours they had 1,155 migrant encounters in this sector alone, that's why you can see high in the sky the con tapers, the shipping containers that governor greg abbott texas governor greg abbott placed here with razor wire on top to try to slow it down and mike, stunning new numbers, cbp sources giving fox news this morning across the entire southwest border, we can show you more than 718 total migrant encounters in first 101 days of fiscal year 2023 which began on october 1st, nearly 200,000 released under title 42 meaning more than half million were released into the u.s. let's go just to the el paso sector where mark meredith was. the encounters in first one hundred days, can see nearly 170,000 and they are up more than 220% from this time last year and that bottom number,

mike, more than 78,000 known got aways, we don't know where they came from, where they are going or why they are here. we just know that the border officials observed them and were not able to bring them into custody. now let me just show you some video from texas dps lieutenant kris oliveras pursuing in the rio grande valley more of the got-aways, migrants who run and do not want to be apprehended an big part of the crisis. only time will tell whether or not that will be a part of the president's new plan to try and secure the border. here is what governor abbott had to say about the president's plan. take a listen. >> listen, this visit is about two years too late or about $20 billion short of what needs to be done. all it's going to do down there is rearrange the chairs on the deck of the titanic, he's not going to achieve any solution that is will make the border safer, more secure and stop

illegal immigration. griff: mike, finally one thing i want to leave our viewers with having covered this many years, one thing mexico does they give migrant that comes in southern part of mexico when they cross, they get a temporary visa, this is a gentleman named jonathan from ecuador, he was stamped in on january 2nd of this year, so just six days ago he threw this and discarded when he crossed because he didn't need it anymore, he had a 30-davissa to apply for asylum or whatever but mexico just facilitated the ease with which they move north to come across. that is going to be hopefully part of these talks that the president has with president obrador with mexico to change policies and ease which migrants from all other the world are coming to our southern border and simply crossing. mike: griff, thanks very much. in studio now former acting ice

director tom homan, thrilled to have you. >> thanks for having me. mike: let's start with comment today from secretary alejandro mayorkas on asylum policies, let's play it. >> we want individuals who qualify for relief under our laws to come to the united states in a safe and orderly way and that is why we are building lawful pathways. so people do not have to place their lives and their life's savings in the hands of ruthless smugglers. mike: how do you respond, tom? >> it's a bait and switch. they want to parole 30,000 people a month. that's abuse of parole policy, case-by-case basis for significant public benefit. you can't just group up 30,000 and think bream, there's lawsuit pending in florida it's going to trial this week, it needs to put a stop this. this is smoking mirrors. they will bring 30,000 people

in, decrease illegal entries by 30,000 they think, they will claim victory. it's illegal, it's wrong and it just again legalizing illegal immigration. they should be securing the word --border. they are going to end up losing in court. mike: president biden going to the southern border for the first time today, going to el paso, is this a photo opportunity or something more significant here? >> i will wait and see. what i want to see is he going to apologize for the men in horse patrol that he slanders from white house podium saying they whipped migrants and they are going to pay which ruined their careers, which caused them and their families to be bullied, is he going to apologize for border patrol for abolishing everything that the trump administration did to give us the most secure border in the lifetime, writing 90 executive orders. is he going to understand 14 border patrol agents committing

suicide this year and apologize, 20,000 american patriots who stand in line every day to defend the nation, is he going to apologize to them? he had an event recognizing the capital police officers and i understand that, that's great, how about the 20,000 men and women staying on the land protecting country every day and dealing with horrendous situations in their lifetimes. 14 suicides, i'm not saying out of control border caused it but it's certainly -- certainly leveled on them whatever internal struggles they had because they can't do their job, they can't uphold the oath they took to enforce the laws in the border. mike: let's put on the screen numbers in customs and border protection, 198,071 title two expulsions, this fiscal year.

>> historic numbers. beat the first year historic numbers. what people need to understand and no up with is talking about is based on court data, 90% of these people coming across the border claiming asylum don't qualify for asylum, they will be ordered removed. 90%, look, they break the law and enter the country illegally, it's a violation of title 8 united states code, they committed a crime coming across the border illegally. claim asylum fraud which is a felony. order removed and this administration is not looking for them. you can come to the united states, you'll be released and lose your case and you are going to get to stay and you get a work authorization. mike: what if house speaker kevin mccarthy, majority leader steve scalise or alis stephanie conference chair were to call you and say what can we bo do with with the new republican congress? >> you have to subpoena the right people, subpoena the right information. i will volunteer to be witness

mike: the 118th congress set to reason seen tomorrow for the first time that kevin mccarthy won the speaker's gavel in chaotic late-night vote following negotiations and concessions. alexandria hoff is live with more. alex: tomorrow is test how well the republican majority can work together moving forward a vote is scheduled on the new rules package. congressman jim jordan saying on fox news sunday that he believes it will pass adding that the dramatic differences that played out during 5-day long speaker vote has only strengthen the party. >> so sometimes democracy is messy, they wanted real debate, real input from all people. alex: republican congressman tony gonzales stating he will not be supporting rules package due to agreements made by house speaker kevin mccarthy with freedom caucus member who is vowed to block speakership if he

did not give in to demands, cap on spending and the ability to more easily oust mccarthy, house democratic leader hakeem jeffries feels a small group of republicans have been given too much power. >> while the congress was held captive this particular time what is going to be a problem is if the american people will be held captive over the next two years to the extreme maga republican agenda that apparently has been negotiated into the house rules and the functioning of the congress. that's going to undermine the health, the safety and the well-being of the american people. alex: house republicans as a whole do have ambitious plans moving ahead as they promise today quickly launch investigations into areas such as the justice department, the southern border, covid-19, the afghanistan withdrawal and the business dealings of hunter biden, mike. mike: alex, many thanks. for more on the discussions i'm joined here in studio by florida

republican congressman and member of the house armed services and judiciary committees matt gaetz welcome, congressman, great to have you. >> good to be with you. mike: is it worth going 15 rounds to elect a speaker? >> absolutely. we got concessions that really were being rejected as early as monday when it comes to being able to read legislation, 72 hours before its adoption, individual appropriations bills and ultimately what we negotiated ensure that is we will never again have a circumstance like omnibus spending legislation because bills will have to comport to a single subject. there will be germantiy requirements, open process and i'm thrilled where the house of representatives is today. mike: the construct of these rules concessions functionally turn the speakership into a ceremonial position, do you mean that? >> long live the speaker. i look forward working closely with him but he did agree to his great credit to democratize

power and what the spending paradigm is they are controlled by people loyaled to the speaker. now what we have real representation of different viewpoints within the conference on the rules committee, on the appropriations committee we fought hard to get agreements to have conservatives, budget hawks on appropriations and i can't wait to see what we are able to do when we unlock the potential of all of our members going forward. mike: what about the concern that the delayed process weakened him and to recap we have a democrat in the white house, we have democrats running the united states senate, don't you need him to be a strong as possible? >> well, i think the way to have a strong republican position on a lot of these issues is to have strong republicans on the most relevant committees. i don't really get to critique that taking from tuesday to friday to work this out puts the majority in imperil. you know, mike, in the summer

the entire congress takes like six weeks off where we are not around at all and takes 4 days to be who is second in line to presidency and ensure we have a house of representatives that is a fighting force going to check the biden administration, absolutely worth it. mike: up next the rules package, governing rules for the next two years and the house of representatives, any drama there? >> i don't expect it. i think this is an requisite -- exquisite rules package but oftentimes when you make the rules better you can actually improve the health of the institution long term. some of the rules will allow us to zero in on specific elements of federal spending and force votes on whether or not that is an appropriate use of tax dollars, also baked into the rules we are going to vote on a church-style commission to evaluate the weaponization of the government against our people. that's the fbi, doj but even other entity that is we see

abusing their power to the detriment of the liberty of our citizens, this is going to give us more staff, more resources and we are going to get government back on the side of the american people. mike: there was a tense moment late night friday night when congressman mike rogers expected to be next chair of armed services confronted you, you guys both serve on the armed services committee, what was that all about and are you guys going to be able to work together on armed services? >> mike rogers is going to be a terrific chairman of the armed services committee and we share a deep commitment to our national defense, to our men and women in uniform, of course, in a late-night moment of high drama, people can have moments of frustration, mike rogers and i have six-year productive working relationship. we are going to work together wonderfully going forward. i don't think there should be any punishment or reprical just because he had animated moment. he has my forgiveness and certainly is someone who has done great things for our national defense and will continue to do those great things. mike: you have taken praise for

people who like the fight led this week and taken criticism, some people say it's fundraising, more media appearances, do you consider yourself a serious legislator? >> absolutely. one of the reasons we fought for these rules was to ensure that all members of congress can get involved in the legislative process at a granular level, far too many years power wills been- has been centralized in a few. i think i'm someone who appears on your network and others more than any other member of congress so it's an odd criticism to say that i'm doing this for media hits when i do those a lot anyway. even before the episode i was top fundraisers in congress who i'm only republican who doesn't accept w lobbyist money, i belie our politics it is more pure when it is funded by the people of the country and not those

unfortunately for people who think they should do more of them, he doesn't celebrate his wins as much as he would like to. he will come back and find bipartisan solution. that's why you see people like mile and chris coons working together, kyrsten sinema and tom tillis working together. that's how president biden likes to operate. that's what he does, then he will meet with the president of mexico and he will have serious conversations about that. what he doesn't do is stand in front of a photo-op and say let's build this big beautiful wall that nobody will ever get over and then steal money from different areas of government like the previous president did. he actually likes to find tangible solutions to our problems and i'm confident given his past record of the last two years he's going to find a solution to this in the next two. mike: you want to react, respond? >> well, the president is going

to the border because it is the most vexing problem the country faces in the domestic policy area. we have millions of people crossing the border, thousands of criminals, there's drugs, there's prostitution, this is a whole huge mess that has occurred during the last two years and this is the one issue that this president has almost ignored. he's had some success with the inflation reduction act, with infrastructure, with, you know, staring down the republicans in certain situations but this is really the vulnerability of the presidency and signals the beginning of the appro-- presidentialelection. mike: secretary mayorkas is critical of governor's abbott's policy. >> we cannot have the rights and

the needs of individuals who are seeking humanitary relief in the united states be exploited for political purposes. we cannot have unilateral governor action that is not coordinated with the federal government to address an issue that is of national importance. mike: jonathan, no surprise, there's friction between the feds and texas officials, your thoughts? >> i think, look, governor abbott has used a lot of the immigration issue as photo-op, as political tool, shipping people who are seeking asylum in 20-hour bus ride to the vice president's house in the middle of the night when it's freezing cold to new york without any notice. it's awful that we would do that to human beings. i think the president should call governor abbott and figure out a way to work together but he can't if all governor abbott wants to do create photo-op and harm innocent people who come to

the country seeking asylum. some people came from nicaragua. they are not running 10 feet to do this. this is tough what they are going through and putting them on the bus somewhere where they no idea they will wind up. mike: you understand governor abbott's frustration, though? >> everybody who has this on doorstep is facing unparallel on law enforcement, on the safety of their people and the governors are left with no choice without a comprehensive policy for immigration. i don't know what they will do but looking for publicity stunt. mike: live in eagle pass, texas, shot on the screen right now. so, john, divided government can be an opportunity to get things done. do you think there's some kind of immigration bill, i think

comprehensive immigration scare it is heck out of some conservatives? >> sure, i'm old enough when we had bipartisan immigration bill in 2013, it got 67 votes, it was stronger on border security than even donald trump want today do because it was predonald trump and we were doing border security in a smart tough way, john hogan and bob corker who teamed up and billions of dollars to secure the border in a smart way. i think that's one of the areas you could see bipartisan work done in the next two years. mike: nearly out of time, your thoughts? >> i think it's extremely political issue when both sides are wrong when they get to extremes on the issue and it's going to require some of joe biden's bipartisanship and some good will among republicans like mitch mcconnell to see if we can solve some of these problems. >> absolutely correct. bipartisan support right there. mike: let's leave it there. they agree on something. thanks, gentlemen.

i'm joined by the author of the book, kate anderson broward. you had access to 7,000 letters and unpublished dairies, i find that fascinating. what did you learn? >> i learned that she was a smart, savvy businesswoman. she's most famous for being married 8 times to 7 different men and romances and the glamor of her life but i was amaze add first of all incredible writer, i had access to 7,000 letters and dairies as you said and she's a thoughtful person who was the first actor male or female to negotiate a million dollar contract. so she's a smart lady. mike: her work on behalf of aids and hiv at the time there was a huge stigma in the country. what about her effort by her? >> there was so much homophobia and back in '84, before rock hudson her dear friend came out

and said he had aids and she was going and visiting hospices, i found beautiful letter that is she wrote to different aids patients. she did little things like she would arrange for a patient to be buried who didn't have the money. she said no -- no mother's son is going to sit on a cold slab in a morgue when i can do something about it and it was the little things that she did including funneling her own money into experimental treatments that i was touched by h. mike: you touched on many husbands one was republican senator of virginia, there were a power couple in washington, that was interesting to me. what about that relationship? >> that's how the whole book came about. he wanted a younger generation to know about all that she did. he put me in touch with her family. the truth is she hated it here. she hated being a senator's wife. i think she thought that she would be a partner and instead

he went and voted and left her at home where she drank too much and ate too much but what she used from her time here made her aware of how the get legislation through congress and so when she was pushing for aids funding in the 90's she was looking back at those relationships she had developed with people that she had met through senator warner who was a republican and close to barry goldwater and all of these old republicans and so she -- she was somebody who just used her experience for good. mike: you touched on substance abuse, there were concerns that she was being overprescribed, the family was very concerned about that, what about those challenges that she faced as well? >> i mean, that's a big part of this book because i interviewed her four children and they don't speak very often in personal ways and her son told me terrible scene where she had a syringe of demoral and he
