♪ ♪ >> emily: hello, everyone this is "outnumbered" i am emily compagno with my cohost, harris faulkner, and joining us today martha maccallum, carley shimkus, and brian kilmeade. now we begin with classified documents found at a private office used by president biden. they were found only days before the midterms and it's raising a lot of questions. the documents date back to biden's time as vice president.

his attorneys found them in a closet while cleaning out an office at the pen biden center in washington. biden used that office from 2017-2020. the white house is immediately handed them over to the national archives. the discovery has prompted a doj investigation. the federal prosecutor is now reviewing the classified documents and watch as a president ignored questions about the discovery when asked about it yesterday in mexico city. ['s people speaking over each other] speech it was just four months ago when he criticized his predecessor following an fbi raid on mar-a-lago, remember this? >> when you saw the photograph of this top secret documents laid out on the floor of mar-a-lago, what did you think yourself. looking at that image?

>> how that could possibly happen. how anyone could be that irresponsible. >> emily: it appears the media is already downplaying the discovery. >> tonight the white house is acknowledging that a small number of documents marked "classified" were found in a locked closet at the penn biden center in washington, d.c. that office had been used by joe biden after he left the vice presidency but before he became the president. the white house says the neighbors were discovered the day before the midterm election and were turned over immediately. >> we are told there are only a handful of these classified documents. >> how significant is it that these documents were self-reported voluntarily turned over? >> i think self reporting is probably the single most important part about the situation. it indicates a lack of intentional conduct. is completely different from the mar-a-lago case. >> emily: oh, harris, i heard you during that time.

>> harris: looked. they were going to move, you know, makes a movement at penn biden center locations periods so they had a private attorney come in during that process. you know, at least there were some sensitive papers there, perhaps legally for the penn biden center in the business they do philanthropic lay, who knows. but the fact an attorney found those, just stumbled upon it, i asked some of the questions of the former chair of oversight with me last howard jason chaffetz is asking and how long have they been there? it's a nonclassified facility so who else had seen those papers and what if they see with the information? will we see depositions? jason didn't go that far, i'm going for the. we see depositions from people who may have read that material? it's a small batch within a larger batch apparently of paperwork that had occurred during the time of then vice president biden's vice

presidency. i want to know what of the contents, you don't had to give me all of them but should the president declassified the mic to classify them? the vice president couldn't do that. i don't like biden can do it now but that is a question out as goals also. would he cover his tracks now? that's a good question for you, can he do that? >> emily: you can declassify or classify documents that you classified as a president. if you are the one who because of idem to with, kill need this raises a lot of questions and this is in a nonsecure facility but the team is saying it's okay we submitted them so it's all good and the apologist media says it was a small amount to all is okay and the american people are supposed to look the other way? nno and wonder half of congress is calling for impeachment. >> brian: the first alert i got was nbc then cbs and the

question for dominic was from a nonfox reporter in mexico city so they are interested in this. so i want to see what else is in there we need to figure out what these documents are so we go out to the u.s. attorney appointed by donald trump in chicago at which time he i imagine will go through it and tell us what was there. and then get an explanation. if there is an excellent nation i think the president will say go through the other stuff, one of the classified information? this is not his only office. he has been out of office four years, what other information do you have and what else do you to tell us and to clarify we hear he has locked a number of classified will donald trump set i have paperwork. donald trump was negotiating on the other side, i don't think was smart for donald trump to take it to mar-a-lago. i don't think it was smart to leave it there and not just hand over every thing right away especially because you know he's not into reading it anyway except for a few momentum's. and the way he was locked in mar-a-lago and there was secret service there. there was no secret service at the penn building washington. so i just think there is a lot

of questions. is so far i'm intrigued other people are interested. >> harris: as a widget called the penn biden center. >> brian: what i call it? >> harris: don't leave out the biden part. is a private office of his. i don't know if we necessarily knew what he knew or didn't know. or he may not remember, it has been some time it's paperwork. that is not up solution. >> emily: do you know it's interesting, martha, to harris' point back in august he was asked about the mar-a-lago raid and interestingly biden sort of in an interesting way defended it a little bit he said well it depends on the document. it depends how secure that's it direct quote. i think there may be a specialized area classify documents and he says i read it up i lock it up i give it to the military so he was essentially implying for more words he himself was a traveling bolt. anywhere he went so too could these documents and it depended on the situation or the vault itself the vessel at the end whether it was okay, was that in

a way premonition? did he might remember or did he think there was probably a chance that there would be likely given his long tenure in washington and his pensions for forgetting that there might be a classified document in his weight? >> martha: this is the problem look at sandy berger, general petraeus, donald trump, look at joe biden now, they all i would imagine no it is and everybody does this kind of thing. either this is an indictable offense and it breaks the law, or it doesn't. we need to live in a country where people understand what the law is. and when you are leaving your office it is very clear, sir, ma'am, let's go through every single one of these boxes because you do not want to break the law and be caught with these things in your private office ever. but the problem is you know it's always qualified. it wasn't important, it's a small amount, either it's legal or it's illegal.

the other thing i don't like about the story so far is that people are saying well this is going to take the political winds away from the former president because now this president also has this to be concerned about. no. two wrongs do not make a right. that would suggest if they both did it somehow it doesn't matter. you know? maybe i'm being overly purist here, but i was raised to think rules are rules. and here is hillary clinton and nancy pelosi saying that just watch. >> no one is above the law. and the rule of law is a democracy -- [applause] has to be standard. >> no person is above the law. not even the president of the united states. not even a former president of the united states. >> martha: she went on to say former vice president. >> brian: will he get prosecuted? >> martha: they have to treat them equally. >> harris: will they two oh raid on the biden residence?

>> carley: i think these sound bites are interesting to hear and the biggest one aside from hillary clinton and nancy pelosi we just heard was joe biden himself on "60 minutes." so horrified by the fact that former president trump had these classify documents. gives a republican so much material to work with. how you biden supporters saying exactly what we were talking about well he handed documents over right away. there trump but it's hard to take the moral high ground on this issue when both presidents had documents in their possession that they shouldn't have had. i think james comer has a really reasonable take on this whole thing. he said that president biden probably didn't do anything wrong here. arthur, to exactly what you were saying, most presidents have classify documents in their possession but only one president had an fbi raid over this whole thing. that is really the big issue here. lastly the penn biden center is an affiliate with the university of pennsylvania.

according to "the new york post" that the school put biden's name on it and it raked in millions of anonymous donations from china. >> emily: from china. >> brian: two months to find a set. >> martha: that's whole thing is this cup from the former president for a reason? and if they are, then there is a lot to answer for. >> carley: and also, brian, what you said. these documents were found on november 2nd. before the midterm elections and we are only learning about it now. >> harris: and turned in the next day on the third. >> emily: when you bring in the china thread and classified in general, national security is just like debt it's bipartisan, it doesn't care what party you had. this should not be a partisan issue at all it should be an american security issue which means everyone should care about it including every person in the media. coming up when president biden took office he was no fan of the border wall. apparently he doesn't mind building barriers and put one up around his beach house in

this administration doesn't actually care. they had to have a sanitized view of el paso, they botched statistics by the way our president did with president obrador of mexico when he try to talk about fentanyl, he is not accurately brief, he was in a manufactured bubble for quite some time which includes a wall and rubber what he called trump's wall, he called it the physical embodiment of trumps inability to develop effective immigration policy and yet when he went down to el paso he used the first image he used to tout that visit was a wall. so why is he making that cinsynonymthat as we see the wat el paso so you can look into juarez easily and see why there is an absolute lack of any barrier. that's why everyone down there by the way into juarez in el paso it's a line, not a border it's a line. >> harris: that's what we say in arizona and we have a structure. because the fentanyl is flowing

also supported jailing employers who hire illegal immigrants and said sanctuary cities should not be allowed to violate federal law. he said a fence was needed to stop drugs coming in from corrupt mexico. so, 17 years ago president biden and former president trump at the same in this issue. imagine that. flash forward to today, he is in mexico talking to lopez over obr with a good chance of stemming the flow of drugs, we had a great guest former d.a. special operations director who used to lead operations targeting mexican drug cartels and he said you could fix this issue, secure the border, must push mexico to shut down the chemical weapon production labs and start demanding extradition of kingpins back to the united states like el chapo's son. they don't care about president mexico their biggest fear is present in the united states united states. >> harris: declare them as terrorist as president abbott wants.

the biden administration was reportedly trying to cook up some new rules on gas stoves. that plane got put out pretty quickly. >> good writing. >> harris: the consumer product safety commission backtracked after outrage of reports they wanted to ban the gas stove and cooktops over pollution concerns. they now say they are just going to add to regulations on new products after one republican lawmaker called amount. keep in mind, how many people this would affect, tens of millions of people across america using natural gas stoves which are in about 40% of american homes. martha, they are not saying you can't keep the one in your ho house. >> martha: that's good. of muskoka stomach minnesota had a controversy around freedom, there were let go after showing students a painting of the prophet mohammed considered to be a masterpiece this was an art history class keep in mind. "the new york times" reports she warned prospective students about the image in the syllabus, later said they could contact her about any concerns, none did. she also warned students again on the day the painting was going to be shown giving anyone who might be offended by such imagery and opportunity to leave the classroom. despite her multiple cautious warnings, a senior in the class later complained to administrators about the adjunct professors use of the imagery and the university did not welcome her back. now the muslim public affairs council is coming to her defense. they are demanding university reversed their decision in a statement reading in part even if it is the case that many muslims feel uncomfortable with depictions such depictions, dr. petter was trying to emphasize a key principle of

religious inerrancy. they are not monolithic in nature but internally diverse and that the professor should be thanking her role in educating students muslim and non-muslim alike and for doing so in a critically emphatic manner. so you know this is an interesting story. we are member charlie abdo and another individual before that happened who was assaulted by terrorists for depicting mohammed because in some parts of the muslim faith and a depiction of mohammed is considered to be a form of blasphemy, emily. what you thing about this? >> emily: i think the saddest part was the comments from the university which said that essentially the capacity to offend, or the fact that an offense had happened outweighed academic freedom. everything to me in our country stands for the utmost freedom and liberty and this is frankly

horrifying to me and advocating for just that, and i think an interesting op-ed put forth an argument which was the saddest part as well is that how quickly administrators and those in charge, the bosses just want to wash their hands of any type of controversy or any type of issue instead of getting down and working alongside all of us in the thick of it meaning it's easier for the bosses to fire the person, get rid of them, we don't want controversy whatsoever instead of getting in there and saying no, no, no, in this country its religious liberty. in this institution is academic liberty that's what we stand for. unfortunately they were feckless and stood for nothing. >> martha: brian this is a world are class focusing on religion. >> brian: this world. >> martha: this world and i thought was very telling one of the student said hamlin teaches us it doesn't matter the intent, the impact is what matters. whatever the impact might be on me is more important than what the teacher is trying to teach the students. >> brian: one student

complaint and that's enough to get her fired, and adjunct professor fired at the school over in minnesota. the organization sticks up for them and dr. mark berkson says listen, there is nothing wrong with showing this picture. put her back in place. i will say this. i am so over people being offended, the muslim community, where a quran is placed or a picture is shown but they don't say a word about the people being tortured on a daily basis, their organs or art harvested to be given to other chinese people while the saudi arabian princes meeting with the heads of china not talk about the thousands of muslims tortured, you're worried about showing an accurate picture of a 14th century religious leader as opposed to people living now being tortured, i mean there is a huge problem with this. >> martha: great point, where our student protests? that's the kind of thing that use to ignite students into protest, harris. >> harris: you know, i have some new questions about what

this image means to that faith. i think there was an opportunity missed by the university. i think what they could have done was, look, they know at least one student may have something to say. perhaps. perhaps not, that's why the opportunity was put out there if you have a problem come for a. but maybe it should have been more than that. maybe the university could have backed that teacher and said you know what? we want to make it clear to the entire community here. their voices are welcome. maybe we can learn coming from them. we are not going to quash whatever it was, but what we are is going to open up a forum to hear their point of view to educate everybody. i do think she stood alone, this professor. in the headwinds. may be needed some backing up she was going to make this choice, but at the same time i don't think you kill something people generally dumb i genuinely don't understand and it's art because if we start to do that we will kill a whole bunch. right? there's a whole bunch an art
