"fox news @ night" with dreamy trace gallagher is next. i'm greg gutfeld, and i love you, america. >> trace: thank you, greg. good evening everyone welcome to america's late news, "fox news @ night." i'm trace gallagher in los angeles. breaking tonight: a second batch of unclassified documents were found by aids to joe biden from his time as vice president at a different location than previous mishandled documents. the white house is now scrambling to contain the story. the covid-19 state of emergency

has been extended by the biden administration, this despite the president telling "60 minutes" back in september that the pandemic was "over." and now new images, satellite images show china show crowds gathering at crematorium's though china's government insists covid has only killed a few dozen people. we begin with another round of travel chaos that could delay flights for another full day. it comes as a nationwide outage of a key warning system because the fda to ground all departing aircraft and in a very strange twist, the same warning system in canada also broke down today. charles watson is live with the breaking details in atlanta tonight. good evening. >> good evening. travel troubles caused by the system outage will likely continue through thursday. there are a lot of folks out there not able to make it on flights on wednesday and will not have to wait until sometime later today to get to where

they're going. meantime, in the latest update, federal aviation administration says "preliminary work has traced the outage to a damaged database file. at this time, there is no evidence of a cyber attack. the faa is working diligently to further pinpoint the causes of the issue." the system which updates pilots on issues that could affect their flights went out tuesday night, causing the faa to hold all departures. the nationwide ground stop was lifted shortly after 9:00 a.m. wednesday morning with the damage was already done as a cascade of disruptions left frustrated travelers to deal with more than 10,000 flight delays from coast-to-coast. >> there is just a lot of frustration, a lot of confusion. trying to figure out i should do. speak i thought because of the holidays, that was the main issue. really it is still happening and here we are, two weeks into 2023. >> meantime republicans in congress are pressing for answers as the white house looks

to transportation secretary pete buttigieg for clarity. >> how could a stable platform like this suddenly go down? were there no backups? >> my top priority right now now that this system is working again is about 9:00 this morning is to understand the root cause, understand how it could have led to this level of disruption, and understand how to make sure it does not happen again. >> the bottom line, u.s. travel association says this system is older needs to be updated. white house press secretary karine jean-pierre said that the faa is currently working with dlt to try to update the system and she says the white house welcomes the attention from congress to ensure the faa gets everything they need in the future so this issue doesn't happen again. >> trace: it's going to take a while. charles watson live for us at let lanna. thank you. let's talk about the system malfunction with aviation expert and former represented kyle bailey. great to have you on the show.

"the wall street journal" said "the government in general has the same problem industry has and that these systems get old and modernizing them is really painful both in terms of money and of time." it really is, because you talk to pilots and they say that the system is archaic and ineffective. >> that's 100% true. the government, it's very bureaucratic, lots of red tape. to build a new system or to get a new system, you're talking months to many years and then you have bidding and contracts. it's government bureaucracy is very slow and it's not like the private sector. this was spacex for a highly funded private company, things would be implemented much quicker but everything pretty much goes at a snail's pace when you're dealing with the government. >> trace: transportation secretary pete buttigieg has been highly criticized for handling some of these crisis

we've seen. he said this today. watch. >> we have to understand how this could've happened in the first place, why the usual redundancies that would stop it from being that disruptive did not stop it from being disrupted this time. and what the original source of the errors or the corrupted files would have been. >> trace: i guess, is there confidence among the airlines, among pilots that the federal government will get this right eventually? >> i don't think there's confidence. it's a matter of when is it going to happen again? without a new system or a modern system in place. will it be tomorrow, in a week, month, in a year? we don't know. we got pretty lucky we haven't had something like this with the complete national shutdown since around september 11. god only knows when it's going to happen again. >> trace: yeah, a couple weeks ago, had this happened when southwest melted down, that could have been chaos that lasted for weeks. i want to put the number of flights on the screen here, kyle. the number of flights today,

21,000 flights delayed. 10,143 flights canceled. more than 1300. that backlogs the airlines. we know that they only have so much equipment, only 500, 600 planes each so when you're talking about 20,000 flights and 11,000, or 12,000 are affected, it's going to take a while before this thing gets back on track. >> that's correct. it's a cascading effect. as you know if you getting in in a plane on los angeles, he might have come from dallas-fort worth or newark, new jersey. he might've been the third stop. yet they have to get this repositioned and picked this schedule back up. it doesn't happen quickly but we will see the aftereffects for 24 hours to 48 hours before things get back. >> trace: i have to ask, are you kind of baffled that canada's notam system will go down the very same day and hour and a half after hours goes back

online. the governor says -- the government says there is no evidence of a cyber attack that's highly unusual. >> i am baffled but in life, i've experienced things where you will have two or three things happen and you can't figure it out. it does make this a little bit worse, come a little more suspicious. if i was a cyber person trying to attack something i might go at something more vulnerable. that was my initial thought. probably wouldn't go over this. probably would go for something perhaps it would affect airplanes in the sky. one point in defense of the faa. the system, the notam did work, but millions of passengers might've been stranded or delayed. the system did stop and it did prevent catastrophe. so i mean, that would be one glimmer of light if there was anything in this whole unfortunate incident that happened. >> trace: fair point, kyle bailey. thank you for coming on. we appreciate your time.

meantime, other breaking news, second batch of classified documents associated with president biden has been found at a new location and the new discovery is raising a whole bunch of new questions. the administration insists it's being transparent but answers are in short supply. the white house correspondent kevin corke is live with the closer look. >> good evening. sources tell fox news that aids the president actually discovered another batch of classified documents from his time as vice president and we know it could be even more. the latest discovery comes after it was revealed on monday that aides found documents at our private office. for his part, the 46th president praised his lawyers, adding they did the right thing by immediately turning the documents over to the national archives. and then he claimed he was surprised to learn there were any government records that were

taken there to that office. adding that he didn't know what was in the documents either. but that of course made for a fairly awkward press briefing today. >> on these documents, how could anyone be that irresponsible? isn't that what this president says about mishandling classified documents consumer >> the president spoke to this personally. he believes classified documents and information should be taken seriously. he takes them seriously and he was the surprised to learn about any records. >> trace: peter doocy want to get on the job. meantime over on the hill, incensed republicans say it's high time for the attorney general merrick garland to do to mr. biden what he's already been doing to former president trump. >> that's exactly what merrick garland has done to donald trump and as you were saying a second ago, it can't be that we have two tiers of justice in that country. it can't be that there's one

rule for republicans in a different role for democrats. merrick garland's and we have to have a special prosecutor for trump. that means we've got to have one provided in. >> as you can well imagine, g.o.p. critics are questioning why the white house didn't disclose the discovery of the first batch, which as you don't happen before the midterm elections. but that wasn't known to the public until just this week. other questions had to come, trace. >> trace: like when did they find the second batch? >> and where? >> trace: and where did they find the second batch? kevin corke, good stuff as always. let's bring in the political panel. richard fowler, mike davis. thank you both. mike, i want you to listen to the house until chair mike turner and then i'll get your response on the backside. watch. >> it's very troubling that the search continues and yet the department of justice is standing down where they read donald trump's home. there's also questions we need to have answered about what's in these documents. why did he have them?

>> trace: what's in the documents? why did he have them and wise information being withheld? >> this is a much more troubling than president trump's documents because president trump come as a former president, had the constitutional and statutory right to take his presidential records and he left office, classified or not, that's why he gets secure office-based, federally funded staff, secret service protection. security clearances. that's not the case for former vice president. they are not allowed to take presidential records when they leave office especially classified records. you have to ask why did former vice president joe biden take these records and it wasn't just a mistake. he had them into different locations any move them at least twice. >> trace: right, that's it very good point. richard, do you think attorney general merrick garland should appoint a special counsel to look into the biden documents? >> i think we are going to have

to wait to see what happens but let's be very clear about what's happening as we speak. as we speak, one of the trump appointed u.s. attorneys in the city of chicago, he is reviewing this case to see if there was any legal wrongdoing done by the current president of the united states. with that being said, in the case of former president donald trump, there was a subpoena issued by a federal judge that believed that the president was engaging in some form of crime. this is not happening the case of joe biden. in the case of joe biden, these documents were found and they are now returned to the national archives where they belong. let's clarify one thing for the record. the president cannot take out classified documents just because he feels like it. >> trace: the president can declassify documents. a vice president cannot declassify. we haven't seen any evidence he did not declassify them and that's an important point. secondly, these documents were found two months ago, mike. two months ago and they were not

revealed before november 8, the midterm elections. they also were not revealed before they appointed a special prosecutor to go after the trump documents. we do not know when the two day's documents within disclosure of documents, when they were found or where they were found. these are all big, big points. >> yeah, this is absolutely a political cover-up by attorney general merrick garland and the biden justice department. like you said, they found these documents on november 2. six days before the midterm elections and attorney general merrick garland appointed a special counsel to go after trump on november 18. why didn't he mentioned that he had these documents, these stolen classified documents in biden's possession during that time? why did we wait two months for him to come out with this? this is clearly a political cover-up. >> trace: i want to read some of this. it says "like many americans i'm concerned about how some in the industry, he's talking about big tech, collect, share and exploit

our most personal data, deepen extremism and polarization in our country, tilt our economies playing field, violate the civil rights of women and minorities, and even put our children at risk." that is a big slam from the president against an industry that has very much leaned in his favor, richard, your last thoughts on this. >> look, i think what the president is saying there is we do have a problem when it comes to how social media platforms deal with the public. we know f for a fact that social media platforms because a higher suicide rate among teenagers. they cause eating disorders because of the information they sent folks. we also know that while tiktok is legal here in the united states, it's illegal in the country of china where the owners of that company is. we need to be having a conversation whether you're a democrat or republican about how we rein in the social media companies and ensure that our children aren't suffering from them. >> trace: . richard fowler, mike davis, gentlemen. thank you both. >> good to see you. take care.

>> trace: meantime the fox news at night common sense department is wondering why, if the world health organization says the new omicron variant just not have mutations know to make people sicker and why sections of the u.s. medical community agree, why has the biden administration renewed the covid public health emergency for the 12th time? i would swear i heard somebody say the pandemic was over. >> the pandemic is over. we still have a problem with covid and we are still doing a lot of work on it. but the pandemic is over. >> trace: that's where i heard it. it's funny because health and human services also told local and state health agencies to get ready for an end to the emergency. that was in august. what change? it's chilly not to increase in hospitalizations and deaths. those rates have been steady for a while now. it appears the emergency might be a bit of a power play. it allows the administration to

continue offering a litany of benefits like medicaid. maybe that's why enrollment in medicaid has exploded 83 million people. common sense is beginning to think emergency declarations are kind of like taxes. once they're in place, they have a habit of becoming permanent. a public health emergency remains in place here in the u.s. while china appears to be in the throes of a full-blown crisis. let's continue the covid conversation with fox news medical conservator dr. marty makary. dr. macario, it's always great to have you on. i just want your quick thoughts on the continuation, the declaration of the emergency, the public covid emergency for the 12th time. >> the worst thing you can do in public health esquire wolf more than necessary and it's getting ironic to have a state of emergency for an endemic low-grade virus at this point when you don't have one for heart disease and diabetes. the white house is going to find themselves in the big problem when you have a state of emergency designed for a rapidly

spreading epidemic declared when you don't have that situation. >> trace: yeah, i want to move on to china. i'm fascinated. we have the satellite images. i want to put up this "new york times" op-ed. he says as cases explode, china's low covid death toll convinces no one, going on to say china's murky statistics are fueling widespread public distrust. its narrow definition of covid death will very much underestimate the true death toll. the world health organization says. your thoughts. >> china has a "let it rip" strategy and there's a very high death toll because they have low rates of natural immunity. they did not use the time they had over the last two and half years wisely. and we know that they've been massively underreporting deaths but now we know exactly how. many doctors, and doctors i have spoken with in china say they only count a covid death if some of the has no other diagnosis. but by the very nature of being sick you develop other diagnoses. the concern of course is that a

new variant could emerge out of this dense population with rapid transmission. that's kind of the formula for a new variant. the biden administration has been working hard to try to give them our extra 100 million doses of the bivalent vaccine that the americans have said no to. they've done it quietly to save the pride of the chinese government ever right now there's a tremendous amount of animosity by the chinese people appropriately so towards the government over this general policy. >> trace: i'm wondering, as a doctor, what do you think americans should look for. what is the danger that we faced because of china? are we looking at may be doing something else to maybe stave this off? >> we should be. we should be considering was happening in china as a potential domestic threat to the united states because new variants, when they do emerge out of dense epidemics, they do go worldwide. they do go around the world. right now we have a unique situation where the epidemic is localized in one country.

that's where the variant will emerge if we are going to see a new one. we should be sending paxlovid over there and of the things that we can do to help the chinese people. on a humanitarian level but also to stem the risk of a new variant coming back to the u.s. >> trace: yeah, i see these pictures, the satellite images of these chinese funeral homes and crematorium's and they are crowded with people and it's telling a bunch of different stories -- telling a much different story than the chinese are telling us. great to have you on. thank you. embattled new york republican congressman george santos remains defiant event, refusing to resign after state local members of his own party called on him to do so. at ashley strohmier live with the latest in new york city. >> the freshman lawmaker is being pressed by four house republicans tumors lying among reports he misled voters on parts of his resume and biography. the g.o.p. chairman said he disgrace the house of representatives, he also for his

cleaning supplies at home depot. walsh is currently being held on a charge of lying to police. in new york, these thieves smashed up a jewelry case sunday and stole about $2 million in jewels all in about 40 seconds. the jewelry store owner says that these threaten to shoot her and her workers if they moved. no one got hurt but no word of any arrests so far. it just ours, idaho quadruple murder suspect bryan kohberger is back in court for a status hearing, this happy university of idaho students came back to school for the start of the spring semester. here's the senior correspondent, laura ingle. >> with an arrest made in winter break over, there is still sadness and shock on the campus of the university of idaho. now also some relief. >> before we left for winter break, it was scary, just knowing that they hadn't caught

him yet but i think being back now, i feel pretty safe on campus. >> 28-year-old bryan kohberger, accused of brutally murdering four university of idaho students will be back in a courtroom on thursday for his next hearing. as kohberger's public defender and her team continue to look at evidence of the crime scene. the mother of victim ethan chapin give an update in a personal message on social media wednesday reading in part "anything we, ethan had is now frozen with the defense. for us it involved two vehicles, belongings, and a set of golf clubs. we have met with prosecutors, handled media and police hopefully respectfully, managed, grieved, talked and continued to try to process our new normal. while much was learned about the probable cause affidavit including one xana kernodle ordered doordash, one famed attorney not connected to the cases he sees room to the

defense. >> the timeline shows these brutal killings took place sometime between 4:00 and 430. once we see with the doordash driver has to say, i think that will go a long way. >> two of the student to to campus this week include ethan chapin's triplet brother and sister, siblings who chose the university of idaho together. their mother says their job now is to be kids and start where they left off. trace. >> trace: laura, thank you. we have an update to a seattle crime story that we brought you a year ago and a warning that some disturbing video goes a long way. let's get right to seattle talk radio host jason rantz. always great to have you on. the video of a homeless person hitting a woman in the back of the head with a baseball bat. the sad thing is this kind of thing is not unusual in seattle. >> it's not unusual but what is especially disturbing here is this guy who's been charged with

first-degree assault has been in jail. judge orders him him to go through a competency restoration program. he was sent, supposed to go to hospital here in washington state that's run by the state so they can give him mental health treatment ahead of his trial. however, there are no beds available and you have about 850 suspect criminals who are currently in need of treatment before going to trial, and they are at the point where the state is saying we are going to have to just start saying no to treatment which in this case means this dude, this bad guy, this degenerate, might be back out on the streets. >> trace: the video is very hard to watch. meantime a lawsuit filed against social media companies are doing that social media companies developed, have caused kids to developmental health issues. here's the lawsuit. "defendants have exploited the vulnerable brains of youth, hooking tens of millions of students across the country into

positive feedback loops of excessive use and abuse." president biden an op-ed in "the wall street journal" wrote "millions of young people are struggling with bullying, violence, trauma and mental health. you must hold social media companies accountable for the experiment they are running on our children for profit." your thoughts on this. >> look, i think social media is unhealthy for kids and for adults but at the end of the day, this is a frivolous lawsuit looking to get these companies to fill a budget shortfall. i would argue that if all the districts that probably should not be moving forward with this kind of lawsuit, it is seattle public schools whose policies kept schools close to well after it was necessary due to covid which we know hurt kids. we know that they tell white kids that they are racist and sever from privilege that they have been earned. i think that might actually hurt their mental health. they tell black kids that cops are going around looking to

shoot them. and of course they tell students who maybe have some confusion about gender and gender identity, say oh, you should keep this secret from your parents. don't worry. we'll give you a completely new identity. something tells me that actually has a bigger impact on their mental health and may be hopping on tiktok or snapchat. sku and something tells me it's the people who live in glass houses kind of rule where maybe you should look inward. what about this proposal to protect referees and umpires, it says, this is a washington officials association told you "there is no data to prove the potential officials opt not to join because of fan behavior." but when speaking with people interested in officiating, fan behavior is a concern. don't we already have laws on the books to kind of protect this kind of thing? >> yes, we have assault laws that are on the books. if you go after a referendum let's say it's a misdemeanor assault, this would automatically upgrade that to a felony misdemeanor and i would

argue we don't need to expand protected classes. there is no data to suggest that this is an ongoing issue but is worthy of this kind of extra treatment. i would ask, why is assaulting a referee worth the felony punishment in not outside of law enforcement? why aren't talk show host of anchors getting extra coverage? there's already laws on the books for that. let's punish them with assault. if it's serious enough to be a felony, okay, let's go ahead and do it. there was a recent case in which under the current law, the guy gets hit with i believe it was secondary assault which is stronger than what would have been mandated under this particular bill. >> trace: jason rantz, good to see you. thank you. >> good to see you. >> trace: meantime the aftermath of a massive exposure caught on tape and the latest internet sensation, a bus full
