biden's delaware homes. >> my lawyers reviewed other places where documents and my -- from my time as vice president were stored and they finished the review last night. they discovered a small number of documents with classified markings in storage areas and file cabinets in my home -- in my -- in my personal library. the department of justice was immediately notified. and the lawyers arranged for the department of justice to take possession of the document. >> attorney general merrick garland has tapped robert herr a former u.s. attorney in maryland who served as a senior justice department official in the trump administration to lead this probe. now, let's look at the timeline, guys. it all started november 4th. the first time classified material was discovered. national archives contacted doj to report classified documents biden center office here in the nation's capital. documents had been secured in the national archives. now, on november 9th. the fbi begins to investigate.

on november 1st. garland assigns john lausch. just before christmas a second batch of classified documents discovered. informed lausch additional documents found at biden's private home in wilmington. on january 5th. lausch briefed garland and advised that a special counsel was warranted. just yesterday, a third -- for the third time classified materials discovered. biden's counsel called lausch and said this additional document was identified. under questioning from our own peter doocy, president biden admitted some of this classified material was discovered in a garage at his house, which the president insist was locked next to his corvette which our viewers of course remember from this campaign ad. >> there is going to be a limit in transparency, public, non-legal transparency what can be shared. >> i disagree, ed. there has not been a limit of transparency. >> statements on wednesday. -- >> -- there has not been a limit of transparency. that, i will disagree with you

on that. >> what's notable is garland ordered this new special counsel just days after appoint ago separate special counsel to investigate former president trump's handling of classified material. guys? >> brian: lieu as, i get the sense that the probe ♪ ending along with the discovery. thanks so much. >> might take a while. >> brian: yeah, i think it might take a while. how about this? just keep in mind, there is a third discovery in there you have got the garage. we don't know what the documents are, just classified. then you have got a third discovery of at least one other classified document and it could be where -- i did not know this, but they build a scif in every president or vice president's house unless you are donald trump they refused to build in mar-a-lago. maybe they would have built n trump tower but not there anymore. bottom line it should not be there and you have a situation where their lawyer gets to lead. attorney general who calls the national archives who called the attorney general who maybe gets the fbi.

irresponsible for donald trump to do. this meanwhile he is doing the same thing. donald trump says. >> pete: classic. >> ainsley: donald trump classified his items which he is allowed to do as as president and joe biden is not as vice president. he is caught with this classified information from his vice presidency and he was not supposed to have that gregg jarrett, who is a fox news legal analyst, talked about these documents a few minutes ago on "fox & friends." >> president biden is more at criminal risk here because trump had the ability to declassify documents, unfettered authority. can do it on his own. he doesn't have to tell anybody. it's a crime to remove and store classified documents and put them in an unauthorized location. and i'm sorry, but the corvette defense doesn't cut it. you know, it has to be in what's known as a scif, as you know. a secure location approved by the government for classified docs. it's concerning to me not one, bnot two but three locations.

that suggests knowledge and intent on the part of biden. >> brian: again, we know classified documents. we don't know what level and they actually are we might never know. we know the topics were u.k., ukraine and china on the last batch. keep in mind, we have no idea. we know he had mechanics coming in and out thereof working on his corvette. we also know that there is no records of who has been visiting him at his delaware place. obviously when he is out of office we have no idea. now that he is president he has been there 60 times. he is going there this weekend again. there's no sign-in sheet. >> pete: most transparent administration in history is what they want to declare yet, we have no idea who visiting him at the very house where the documents were where he spends all of his time. >> brian: one thing noteworthy other outlets seem just as exercised as maybe you are out there about what's going on and what's being held back because they clearly keep reading the same statement over and over again and, yet, there is stuff they easily could answer

outgiving up anything that would hurt joe biden's case. but they just keep saying joe biden takes it seriously when his action's say a totally different story. a locked closet in an office and then you have a guy who leaves boxes of paperwork in a garage and they keep saying he takes it seriously. which makes you wonder are they just trying to make it seem that everyone thinks he just didn't know it was there. the intent was not there. you have got to wonder why now? is there someone on the left that doesn't want to run for president is that why it's suddenly exposed? >> ainsley: maybe, we don't know. >> pete: that's a great question. >> ainsley: migrant situation is affecting texas and arizona and also florida. we reported last week that the coast guard is saying 300 migrants were fleeing cuba and other countries and they landed at the dry -- national park last week and forced it to close because there were so many that landed there. 45 also made landfall in key west. florida was saying, you know, what do we do? how do we handle this? and they reached out to the

government and they -- you know, they were talking about this situation. we had some of the agents on our show. well, it turns out ron desantis decided to deploy the national guard to help with the migrant surge, just a few hours later. joe biden blasts him and says it's a political stunt and on karine jean-pierre did the same thing. listen. >> we have seen governor desantis do political stunts. that is how he perceives to fix the -- this issue from florida, all right. and he takes -- you know, we're talking about people who are coming from -- from countries who are doing with, um, political sphr strife who are dg with issues where they're trying to find asylum answered treats them like pawns. and so we have called that out over and over again and we will continue to do that. and he is not dealing with the problem. he's actually creating a problem. and so that's what i have to say to that we have talked about governor desantis and the,

again, the mockery that he is making of a process that the president is trying to fix. >> brian: by trying to fix parachuting them in at 2:00 in the morning and dropping them in cities without even telling mayors. putting them in sponsor homes we know nothing about. this use people as pawns. not one person gets on a bus or plane without signing a sheet including the ones that went over to martha's vineyard. ron desantis obviously was going to apologize for using those illegal immigrants as pawns, right? is that what he did? >> pete: i think that's the soundbite. >> ainsley: coast guard is the one that asked him. have the emails to prove it. >> brian: he was responding to a federal organization. >> ainsley: that's right. >> pete: coast guard calls the governor and says. >> ainsley: we need your help. >> pete: if it was a different governor they may not have gotten that help. ron desantis says coast guard calls we're willing to help with the florida national guard. here's what he said. >> we were seeing the coast guard had brought in like 300 people that they had onboarded and put them in the florida keys. well, they didn't have the

ability to take care of those folks. there is vessels left everywhere on people's property and all of this. we declared a state of emergency. we provided coast guard, the assistance that they've asked for. we are going to clear the vessels free of charge for those residents because it wasn't their fault. maybe we will send the bill to biden, we'll see. [laughter] [applause] >> the reality is the coast guard is stretched so thin. what the coast guard has told us is we are not going to get additional resources from the federal government like this is what we have. so we're basically filling gaps that the federal government should be filling and would be filling if they wanted to do it. i would just tell the white house not only has the coast guard asked us to help, but we have no choice but to help because of your neglect and incompetence. [applause] >> ainsley: so the coast guard requested twin engine fdc, aircraft to patrol the shoreline in florida. you heard him say the state of florida is going to pay the residents.

this is what residents down in texas are fuming about. because the migrants walk into their yard. they damage their fences. they cut holes in their fences. so ron desantis is saying i'm going to pay the florida residents if these migrants pull up their backyard in a boat on the water to pay -- i'll pay to remove those boats so the residents aren't stuck with that bill, then he said i'm going to send the bill to joe biden perhaps. >> brian: same thing about governor abbott. every time he tries to get ahold of the border and puts kids on bus because overwhelmed. again, the press secretary totally unprepared. if you get briefed and said there was a request from the coast guard to get florida's help, you don't make that statement. there is a laziness she goes about with where she is a pure politician. she is also not even armed. >> way jen psaki was with the facts. >> pete: also double down on the myth that this is not a problem at the border, flight if they admit that the coast guard called and they are admitting they created this migration problem. illegality problem. >> ainsley: it's the same answer. political stunt. this is a political stunt.

>> brian: by the russians and by the ukrainians, former secretary of state condoleezza rice calling for urgency in sending money and weapons to ukraine saying time is not on their side. this is navy secretary warns the weapon makers much ramp up production to replenish our stocks. here to react is general jack keane retired four star general fox news senior strategic analyst. first off the urgency that condoleezza rice sees. why do you think she is saying that? i think she rises full well in '23 the ukrainians have the opportunity to drive the russians completely off their territory and that opportunity will close. that won't be there two, three years from now. russia wants, brian, a protracted war. they want to cripple ukraine's economy and well on their way to do it. destroy their physical infrastructure and then weaken the political resolve of the united states and the west to support the war. they are playing for a long game and they think if they hold on to territory, eventually, ukraine will stalemate, that

will get negotiations and as a result of those negotiations, russia will have a good place to restart the war. they're not giving up here. the only way this thing ends favorably for the west and for the ukrainian people certainly is to drive them off the territory. drive the russians out. and that's what this is about. this that is what rice is talking about. the strategic implications of that are pretty significant. and russia turns this around and eventually scores a win because they protract a stalemate i mean there's no doubt they will continue their aggression mum dove have a will be next and on nato and strategic implications with china and iran are obvious. they will be emboldened by. this so we have an opportunity to stop an aggressor cold here and we should the give the ukrainians everything they need. they need tanks. they need long range missiles. they need advanced drones. they need more air defense, obviously stop deliberating. >> brian: eventually give them

of their stocks. they have got understand it works for them, too. war games, simulated war against china over taiwan. we actually, according to this study, we win this war game but it's with japan's help. tell us about this, general. >> well, first of all, there has been a number of war games done over the last 10 years, most all of them classified. but the results have been widely reported. and we normally lose in that conflict. there's a number of different scenarios they ran which i think made the war game very interesting. one is taiwan stands alone. defeated in a couple of weeks by china. china retakes the island. the united states to prevail in supporting taiwan, japan has to be in the war and japan has to give up their bases for the united states to use because many of the basis throughout the region are destroyed by the chinese. the results are horrific though. even though the united states

june. june 26th. joining me now with more is former federal prosecutor francey hakes. good morning to you, francey. >> good morning, ainsley. >> ainsley: why do we have to wait six months just for that preliminary hearing? >> well, it's really interesting delay, ainsley. and i think what it means is the defense is well aware that the prosecution has the goods. as they know that if they were to go to a probable cause hearing tomorrow, the judge would bind kohberger over for trial. i think their strategy is to delay this as long as possible to let it fade from the news. i don't think it will. i think that's their intent to let it fade from the news so that they can quietly in the background do their own investigation and gather their own team of experts. really by the time they get to trial it's too late to attack the evidence. that's why they are going to try to do it at the preliminary hearing. >> ainsley: did they request this -- did they say to the judge we would love six more months or does the judge make that determination? >> well, it was an agreement between the parties. so both parties would have

agreed and for the prosecutor, that gives them lots of time to continue the investigation. i think what most people don't know is that when kohberger was arrested, the investigation didn't stop it. just started a new phase because now what the prosecution wants and what the investigators are trying to find out is that all-important motive. why did he do it? and they are going back and interviewing everyone he has ever known, everything he has ever written, every class he's ever taken, every person he has ever interacted with to try to get that answer so they can give it to a jury eventually. >> ainsley: i also want to ask you about this case in oklahoma this 4-year-old little girl her name is athena brownfield she disappeared in oklahoma. her caretaker alicia adams she is 31 years old. she and her boyfriend or her spouse, another person they were supposed to be watching these two sisters and she is charged with child neglect. the 5-year-old sister was found wandering around, a postal worker found that child on tuesday 5:00 p.m.

authorities are saying her sister that's still missing might have disappeared on friday. so what does this tell you? what do you think happened? >> well, the more days that have passed since someone saw her last, the grimmer, i'm afraid, it is for little athena. this is a terrible case. and i fear for her safety. what i want to know is where are her parents? i know her grandmother has been interviewed. the father apparently said he hadn't seen the child in a year and a half. how do you not see your children in a year and a half? i don't understand what was happening with these caretakers? what does that mean? were they babysitters? was this a day care? the whole situation just absolutely stinks. and i'm very worried for athena. i'm especially worried to see law enforcement looking through things like lakes and bodies of water. that's never a good sign. >> ainsley: so sad. francey, thank you so much for coming on. >> thanks, ainsley. >> ainsley: you're welcome. let's check in with our senior meteorologist janice dean for forecast. >> janice: deadly day yesterday

of severe storms. one of the worst severe weather outbreaks in the month of january we have ever seen. look at that over 200 reports of severe storms. 68 reports of tornadoes. we had three tornado emergencies yesterday in alabama. and the destruction that is happening right now as the sun comes up is just devastating. that system is moving eastward off the coast and we have the potential for some nasty weather in the northeast with this coastal low, rain along the coast. some gusty winds and snow and ice in interior sections. so just beware of that and of course of the west. we have been talking about the incredible amounts of rain. over 40 inches of rain along coastal california and 10 feet of snow over the mountains. another few days of more of the same. the good news is as we look ahead to tuesday, wednesday, and thursday of next week, better weather in store. but it has just been incredible last few weeks for california. there is san francisco. one of the hardest hit areas, tuesday, wednesday, thursday,
