the history of prosecution of these cases requires that the prosecutor showed with strong evidence a willful and intentional, a deliberate attempt to keep classified documents. under the espionage act makes it different from other cases we have reviewed, they return them on government request for it if you ask me too read the tea leaves right now, given that high standard of the prosecutor's place on themselves, so people that don't make accidents or mistake or they don't know or aides pack things and they are unaware of it, then got a high bar to prove beyond a reasonable doubt. let's have smoking gun evidence they knew his classified information and that they purposefully and deliberately withheld it upon the government request, a lot of this is going to go away but i think is too high a bar for what we know right now but of course politically is damaging to the president. >> any just heard hillary vaugh was interviewing congressman johnson who implied these documents could have been

planted, is that where your investigative nose lead you? >> no it does not at all. again we have to wait for the entire investigation goes out for of course it's always a possibility. we have to stop time at the weatherization of legal issues where there is nothing to suggest but in fact it was biden's lawyers that turned them over bro that's going to be the saving grace for the biden administration. that once they found these documents they immediately without having been requested or asked, turned them over. why would they be turning over information without explanation? by the wavy things these things were planted. so for the record from what we know there's nothing to suggest that. skyview mention president biden's lawyers handling this, given the political current in which we exist and the fact there is an existing case against president trump for withholding documents, he says he did not do it intentionally but the special counsel's looking into that as well. but given that, does it seem all that at all president biden's

attorneys are handling these documents other than say some regular staffer? or does it make sense because of everything i outlined at the top of the question? >> i do not know arthel but that is an interesting question. how did this whole thing start? didn't aid find something i think this would be imprudent action, if i were an attorney represent somebody and say let the attorneys go and from this point forward so they can identify everything. make sure they are going to be having conversations with national archives and the fbi pretty with legal counsel involved in that. we just do not know the answer to that now. but, we have to find out and i'm sure these investigation certainly exists first point they're going to go to in congress that they get any oversight responsibility over this is going to find out how did this whole thing happened the first place? arthel i just have to say it certainly worthy of a congressional inquiry but this is not the first time nor will i suspect to be the last time on a federal level, a state level or a local level where people take

with them on wittingly or unknowingly are not even out the law is, documents for this is a kind of things it needs to be cleaned up here. this is obviously very dangerous situation. but, what best practices versus a violation of criminal law beyond a reasonable doubt the 12 jurors are two completely different spaces. >> so then, how does the biden case compared to the trump case? or are they two completely different cases? >> the argument i think is going to be the trump case are different. it is very, very important points. on a number of occasions and when i talk to you before about a government agency asking for the documents back, they were asking for the documents back. they got varying responses but eventually got 15 boxes of documents based on a grand jury subpoena the lawyer signed certification indicating all the documents had been returned. the federal government alleges in a search warrant they knew and fact that was not true.

additional requests were made to try to get those documents backward that's a triggering thing under the statue of the espionage act but a request of the government to return them. and really unwittingly in my mind into me a foul ball or bad play was the lawyers admitting he knew he had the documents. but believe their personal records and he had a right to retain them. to the extent that information is going to be admissible in a court of law, that is exactly the intentional, willful and deliberate things if true they are going to say we asked for them back. we're trying to play nice. then they did not turn them back and we found out they didn't turn them back again think of a quantity here, 11000 plus documents, they then make an argument he was entitled the former president trump to actually possess those documents for that's what they're going to say it shows willfulness and deliberate violation withholding classified or keeping classified documents. the fact they never return them when requested. arthel: appreciate your

the investigation to president trump of the documents found at mar-a-lago continue. so what can we expect? as a washington executor deputy. they say they're being transparent they say the documents were inadvertently misplaced the drink and everything they can to abide by the law. but man are republicans slamming. what happens on monday? >> i think it's going to telford merrick garland has backed himself into a corner here. he has had no choice but to appoint a special counsel. obviously that was the right move considering he appointed as special counsel to investigate former president donald trump. but really there's a lot to come out of this investigation. we do not know how many more docs are out there. that biden took with him from his vice presidency would we have no idea where they might be stored. somewhere in his garage, summer and is affiliated think tank. we really don't know who had access to them. one of the most disturbing parts of the story is at the documents that were held in his garage

specifically, were available to who knows how many people. we don't one of them was hunter biden who was under investigation for tax fraud. and for his other foreign business dealings. the question is whether hunter biden actually assess those classified documents and then use them to peddle his father's influence. eric: hunter biden he has said that was his residence at one point. you expect him to be asked and others to be asked by congressional hearings looking into all this? >> absolutely proven congressional republicans and already made investigation into hunter biden. one of their top priorities but i've always said that investigation should remain focused on how it affects the president. obviously the president and whether he was involved in his son's business dealings is the important aspect of that investigation. and if this investigation ends up revealing up biden's mishandling of classified documents aided his son in some sort of way, that is a very

methane leaked from gas stoves. the white house said the president does not support that idea. but, states like new york and california, they are planning a band of their own. lawmakers say put a huge street or it would put a huge strain on american families and busi businesses. >> this is going to be a huge burden for lower and middle class folks for this 187 million people in the country that have these gas stoves in their homes. it's 40% of the population. people can't afford to go in convert what they have and put new electric stove in. it's expensive for hard-working people. >> is bringing karen harper. she's president ceo of the american gas association. so, should gas stoves be banned across the board? or should they continue to be used like in restaurants for example? >> arthel, thank you for having me. and you're set up there as noted 187 million americans use

natural gas at home. it is because it's popular, it's affordable. and it is reliable. that's really important. 76% of all restaurants use natural gas. rather it one at a 7 million americans as more people than voted in the last presidential election. so we have to think about the scale. no, we should not be banning natural gas stoves. many studies have shown there is no linkage including one released just last month it said to stop the electric stove or the gas stoves that matters it matters what you cook and how you cook. survival was short reaction to the study it was published in the international journal of environmental research and public health. again, showing almost 13% of asthma in children is due to methane that leaks from us gas stoves for even when they are turned off. >> well, arthel, its environmental advocacy organization whose agenda is to

eliminate natural gas rates no surprise to be issuing reports advocating and putting out basal science. this report was based on cherry picked data and reports they chose to ignore, the study from the institute for the study of asthma and allergies in children which concluded there was no linkage. they did not look at studies that made the exact opposite conclusion. so it is irresponsible, it is reckless and they themselves yesterday had to walk the study back and say indeed, this study does not prove there is any linkage. the government had to walk it back, and people should take notice of this lack of transparency. arthel: so karen, if you believe there is no direct correlation with childhood asthma and methane gas it's leaked from stoves, our gas stoves completely safe? is there anything we should be concerned about? or are there any sort of adapters that may have to be

developed to take care of whatever existing gas leaks might exist? >> sure. we have to realize there's lots of things in our home that are producing indoor air quality concerns. insulation, all these other things your indoor fireplace. but we should be doing is being very transparent with our consumers of what there is stoves are regulate for carbon monoxide there are standards. we always work with the consumer product safety commission on any concern. nothing is changed if you're at home have a gas stove or if you have an electric stove, use your hood if you have one. proper ventilation is the best thing to do for any appliance in the home. >> newark, california, washington these states are taking steps to limit the use of gas stoves or other gas appliances that's a the new buildings moving forward this is an effort they say 2d carbonized all buildings. now in new york specifically they are moving to get rid of all buildings.

is this a step in the right direction? i get it the presidency of the american gas association. so i understand you would not want to do away completely with gas appliances. but is there a way to seriously make sure we are safe in our homes as well as not just knock out whatever businesses can be hurt by this? >> look if the goal is to reduce emissions we are all in. with natural gas in our delivery system we have proven in a similar study we reduced earlier this year you get to net zero by 2050 if that's her goal. you can get there faster and more affordably with our systems. so we are all in on getting a lower environmental footprint. we reduced by 70% already we are continuing to work on the next 30%. so banning natural gas will chase away industries that rely on it. so aunt jessica, the industries that need a lot of natural gas are going to move somewhere else.

the city just south of atlanta. this is where the national weather service confirms a powerful ef-3 tornado touchdown. really shredded through this town earlier this week. cleanup efforts are underway. but as you walk around this town, a lot of the debris that was left behind is still hanging around for it like these large trees here behind me. a couple of them completely uprooted and then toppled over onto this home where they are resting. next door you can see this home took on significant amount of damage as well bring the top portion of that addict detached from the home and now sitting on the ground. you can see this suv also sustaining quite a bit of damage for the windows and blown out too. there are lots of scrapes and scratches on the exterior of the scar. but as we have surveyed griffin, georgia today and got a look at what folks are doing, it appears
