generation of segregation to the supreme court of the united states". those are the words of our supreme court justice. it took just one generation of segregation of the supreme court of the united states. as i told the folks at the time, she is smarter than you are. as doctor king said, give us the ballots we will place judges on the bench who will do justly. and we are. that is the promise of america where change is hard but necessary. progress is never easy.

but it is always possible. things do get better on our march toward a more perfect union. but this inflection point, we know there's a lot of work that has to continue and economic justice, civil rights, voting rights, and protecting our democracy. and i am remembering that our job is to redeem the soul of america. but. >> look, i get accused of being an optimist. i call that the irish of it. we are never on top, always stepped on but we are optimistic like doctor king was optimistic.

committees are now doing is making a risk assessment about what these documents are, how dangerous eric they were released. there's different levels of classification is classified, their secret, is top-secret for this classification levels correspond to how dangerous a leak of that information is. that is the first step. the answer to that question will determine and large part how the rest of the process goes. the other the department of justice is going to look at is the president or anyone implicated any purposeful hiding a purposeful moving of those documents? the intent is really critical the question of whether the department of justice could bring charges. >> you talk about intent its criminal intent or it is intent to keep these documents, not turn them over. do you have that in this case and do you have that former president trump's case? >> what we know about the present case does not indicate it sound like they found it, they turned it over, they talk to d.o.j. voluntarily there have been no subpoenas. there is no allegation on the case mr logout someone via

violent or like what they gave back. i think that is where the case really diverge between what we know so far about mar-a-lago. there's more information said the president himself or the agent taken things to wilmington purposefully did they give him back? i think will find ourselves much more in the situation. the reset department of justice would appoint a special counsel they want to make clear to the public they're going to apply the same set of rules to everybody. it appears some of the department of justice is doing that is what happen. >> there's a legal aspect then there's the political aspect in the public relations aspect of this but here's what president biden said when it was revealed about president trump's documents when he was on 60 minutes, take a listen. ask when you saw the photograph of the top-secret documents laid out on the floor at mar-a-lago, what did you think to yourself look at that image? >> how that could possibly happen. how anyone could be that

irresponsible. it's totally irresponsible. >> does it appear he's not guilty of that same thing or people in his office? >> i don't think we know that yet. this is five or 20 just classified documents i can find work to the cia there's a gap between just classified information top-secret especially compartment information but the things or talk about mar-a-lago things like nuclear secrets. right now we do not have any information anything president biden's possession or the possession of his aides at the penn center was more than just classified. that's a distinction among those who deal with this information among the national security apparatus. eric: there should not be classified information that is in it against the law to have it there? >> an absolute can be against the law should not have left any of the secured areas. they're very different handling rules for classified information then say top-secret information for top-secret information should never leave a secure compartmented facility for

classified information is had much more easily can be put in transferred around. the way these intelligence services treat the information it depends on what the information is. so far we think happened here? >> i can tell you every day our intelligence services produced thousands and thousands of pieces of information at the classified level but they produce a lesson or top-secret but you can imagine there is information that runs a washington, our national security apparatus that needs to go to a lot of people. so that documentation is not always handled well but here's a great example of how it's not for the real question is when someone finds out a mistake is made one of they do about it? so far there's no suggestion that what they have done the president's team has been criminal. there is that the recent got special counsel to look into it. eric: family some people say this helps president trump's case let me read you what michael goodwin says, trumps standoff with justice are classified documents putting it on a course for criminal charges. biden has come to trumps rescue

with this multi- documents -- make it nearly impossible for trump to be prosecuted if biden isn't. do you that are these two complete separate? >> for a practical perspective it does make the trumps special counsel job much harder. i think the appearance of how this looks the public a certain importance. at the end of the day the department of justice is going to make these decisions on the merits of each case. if a jury ever hears either of these cases are not going to learn about the other and ultimately come down to the guilt or innocence of a particular person at the department of justice brings charges. eric: all right alex little, alex great to see you thank you for your insight. arthel: eric, meanwhile president biden is marking doctor trayvon martin luther king's holiday weekend by delivering a sunday sermon on democracy at doctor king's ebenezer baptist church. mr. biden is a first sitting president to do so. charles watson is live in atlanta with more.

hey charles. >> hey good afternoon, arthel paid president biden just wrapped up his sermon at the ebenezer baptist church here in atlanta short time ago. as you mention, making a bit of history while he has adit been the first u.s. president to speak in front of that congregation during the church's regular sunday service. the president took the opportunity to reflect on the life and legacy of civil rights icon doctor trayvon martin luther king jr. on this mlk day weekend. and kings at 94th birthday by the president taking the time to praise the iconic efforts of king who was assassinated in memphis in 1968 after fueling the passage of the civil rights act of 1964 and the voting rights act of 1965 in front of the congregation king once lead it ebenezer baptist. president biden a plot of the progress that has been made in this country since the kings and push for civil and voting rights. the president also made it very clear that the work toward a

hey brian. >> hey eric, look, over the last week it appears this has moved from a missing persons case to a murder investigation. there has been no active search for anna walshe. for instance and have not been teams searching in the woods. there is not meant a public appeal by the police asking for any help. all eyes are now on ana's husband on her break the blood found the basement, damage knife with blood not reportedly a hatchet, hacksaw and blood found in a trash facility. at this point we are waiting for a forensic lab results before a possible murder charges filed. >> i would assume or believe there's going to be a charge coming soon. they really want to make sure they have everything.their eyes, cross their cheese for making sure charge comes. >> bryant walshe is in custody

case it may be brought against him which i believe will happen real soon. the government is obviously waiting for and taking their time waiting for the lab results now from the evidence that was found, the blood, the knife, the hatchet and the saw which is great. they do not have to be in a hurry. i do believe there will be a murder conviction probably and charges brought against him very soon. arthel: if honest dna is found on the hacksaw or the hatchet's or any of the bloodstains found in his rental home, would that be enough for homicide charge? >> absolutely. if those bloodstains come back and they go back to ana, not only that her phone was pained being at the residence. so where is she? the sad part is, for these children, where's mom? and now they've been taken away from the home and put somewhere

else. it is really strange, four days go by the father now has not even had any concern for the kids before they were taken away and before he was arrested for being a fraudster. arthel: implied to mention the children, the three sons who were reporting on this when he reports on a case like this it seems like we are callous and detached. we are not callous. this is a person and a family that is involved here. i just wanted to say that. now, tj, based on your experience are there any possible mistakes investigators should avoid making? >> i believe they're not going to get in a hurry. that's why they are taking that's our time with this and waiting for the dna results to come back. and then i believe they will compile all of the information they have what i just spoke about all the way back before he was even married the 2014 domestic violence. all of this in support of what they might have forthcoming with the dna results.

i believe they have had enough evidence to taken into custody and probably formally charged with murder. arthel: in that report you are talking about, revealing the police report revealing before they were even married bryant walshe threatened to kill ana walshe. and her friends. so, what if anything can be general at this information in court? >> they will use that to show what his anxiety was for his wife and for her disappearance now to be able to use that as substantial evidence in the efforts of other things that may come up with the dna results. her phone pain with her being at home and him lying to police and telling them he had gone other places when in fact he was at home depot vying for a $50 worth of cleaning supplies, who hundred buys a four and $50 with the cleaning supplies at one time? he was trying to clean up from

mistake he made. he's left a natural paper trail for law enforcement. twenty-four paper trail seems like some dna will be found. honest dna will likely be found you believe that. but what, if her body or remains are never found? >> they won't stop looking. somewhere along the line they will probably be more evidence come up. maybe after the trial or after he is formally charged. but i believe right now the dna results come back that confirms what law enforcement is looking for along with the other substantial evidence they have now, they will be able to formally charge him and move forward to prosecute him for murder. arthel: are there any other characteristics common traits displayed by bryant walshe that stand out to you, quickly? >> well, his actions. i know there has been questions

about him pleading insanity and so on and so forth. just the smirk on his face walking out, what is he thi thinking? obviously he's got no bearings about what is going on with his wife, much less his children. it remains to be seen when law enforcement brings the formal charges against him and does what they have to do. arthel: tj warren we have to leave it there thank you for being with us today. >> thank you and prayers for the children. arthel: of course, of course absolutely. so for now to the perceived southern border the influx of migrants comes continues. next gases that introduce articles of impeachment against homeland security secretary mayorkas over his handling of the immigration crisis. he is texas republican congressman pat valid who represents the fourth

congressional district in dallas-fort worth and is here now. welcome, why do you want mayor mayorkas bounce? >> think you have me on. mayorkas is engaged in a constant pattern that proves he is unworthy of public trust he's unfit for office but he is three articles of impeachment. one of the things i just read recently is mayorkas and his office is trying to have a blame game and say congress is at fault here. he is the one who violated his constitutional oath. according to the 2006 secure fence act the department of common security secretary which is his job, he is supposed to maintain operational control the southern border. he's clearly not done that. we can get into that in a second period he also willfully perjured himself in front of congress when he the board was secure, eric, and is caught on a hot mike singh's chaos and unsustainable for it lastly he undermined his on border patrol

agents by misleading the american people when he said they were whipping haitian migrants with e-mails now show he knew that never happened and yet he went along the false woman narrative anyway. eric: usually this involves high crimes and misdemeanors. what you just cited does that go under high crimes? is it not performing your duty, not enforcing the law, not as you talk about the secure fence act of 2006, what's a complete and secure fence? what's operational control the southern border probably does not include we never had a month and our history we had over 200,000 illegal border crossings. yet the last nine months in the rail have been over 200,000 from one to 60 countries represented by people across by viewing only recognizes 193 of them. we seized 28000 pounds of fentanyl which is enough to kill every american about 20 times over. and finally people cross the border illegally in the last two

years. i do not think that's operational control the southern border. eric: attack but the secure fence act depicted you explain what that is, an act, along long before president trump was less and called for building a wall to what have a secure fence and make sure it's all secure? >> well, what the 2006 secure fence act says is the department of homeland security director is tasked with maintaining operational control the southern border. and he hasn't violated that. also it was the immigration and nationality act that was last updated 2004 that prohibits catch and release which is what this administration has done for the last two years. he is in clear violation of the law, eric. also need to testify under a thin congress and using the border is secure then you're caught in a private moment saying it's unsustainable in chaos, i think he purged him himself. sue for you mention at the outset pointing fingers at congress. look, congress can do a lot more
