public and to the only thing they talk about are the first batch. >> they have promised to conduct their own investigation and have called for a visitor log for the presence of presidents. todd. >> late spring an kentucky congressman with over oversight committee. the oversight committee does have jurisdiction over the national archives. i know you have requested in all of this but have they responded to a request and what do you know about the documents that we might not? >> unfortunately, they have not responded here this is very disappointing because this is their role. anytime there is something like this, the national archives is supposed to break both the chairman and ranking member at the house oversight committee. when mar-a-lago was raided, we reached out to national archives requesting a briefing to know exactly what type of documents trump supposedly had in his possession and why they rated

mar-a-lago. all they did was referred to the justice department. here we have biden doing the same thing with multiple locations. we still have not heard anything from national archives. it is very disappointing. >> todd: focus on one of those location specifically wilmington and you call in the white house visitor logs. you wrote this to the white house chief of staff one, we have a list of individuals at the residence. the american people will never know who who had access to highly sensitive documents. the house oversight committee demand transparency whether individuals with foreign connections to the biden family gained access to president biden's residence and mishandled for years. who do you worry congressman comer is on the visitor's log? >> it could be anyone considering all the money of the biden family has received from adversaries around the world. your guess is as good as mine. we know hunter biden lived there several years. we know hunter biden has a

history of having problems with landlords with respect to who he lets in two on the premises of different properties that he was leasing. so, we've got a lot of concerns here. you go back to the way the fbi doj handled the mar-a-lago raid, they took security camera footage. they took all the videos. they know who was in and out of more local. we have no idea who was in and out of president biden's home. they didn't take security cameras. they never released the logs. they didn't read the residence. in fact after the general counsel was appointed, we still find out that president biden's personal attorneys are rummaging around essentially the crime scene trying to find information to turn over. so, this whole process has been handled poorly. it shows there's a two-tier system of justice in america, and we want to know exactly who

all had access to those classified documents at the biden home. >> carley: there are also questions whether president biden's lawyers had security clearance and if they should be the ones looking for these documents. what do you think about that? >> they do not have security clearance as far as we know, and they should not be looking at those documents. i said this yesterday, that is essentially a crime scene. once the special counsel is appointed, it became a crime scene. and yet, instead of the fbi reading the resident and going in there and treating that security breach the same as they treated the mar-a-lago security breach, they are letting president biden's personal attorneys go around and look for stuff. who knows if they are turning in what they find. just because president biden's lawyers only found a classified document, that doesn't mean anything to me. we have zero trust level with president biden's personal attorneys right now. they should be treated and handled in the same passion that mar-a-lago was handled, and it

is not pure of the american people see that. and i think the democrats in washington are in panic mode because they realize their scheme to try to convict donald trump for possession of classified documents just went down the commode because joe biden not only did the same thing, but he did worse and he was even president of the united states. he was only vice president. >> todd: donald trump's lawyers didn't have the same level of access and oversight over documents that mar-a-lago that may be joe biden's attorneys have had. obviously, you want to investigate this. how will congresses investigation of the president differ from the special counsel under merrick garland? >> the special counsel is only us to look at president biden's mishandling of classified documents. it is supposed to be a very narrow reach. but we are investigating is the biden influence peddling. the fact that they had classified documents, that adds

another layer to improper behavior on behalf of the biden family. now, this could have been unintentional. what i said when mar-a-lago was rated is our research indicates that every president accidentally takes documents with them when they leave the presidency. this shows we need to reform the way the national archives conducts business but with respect to trump, no other president or vice president was rated. so what biden has done with classified documents really isn't different than trump, bush, obama or any other president. it is just that donald trump was treated very differently. then, if you look and go a little deeper with respect to biden, no family, no presidential family in the history of america has been accused of more wrongdoing with respect to ethics violations and paddling like the biden family has. it is very concerning what they

have in very concerning what the justice cabinet is treating biden versus trump. this just adds to the long list of things that we are going to investigate with respect to the biden family. >> carley: there was a political drill goal that said the handling of the careless nae which he handled them more towards hillary clinton and former president trump, which is an interesting comparison. congressman, ultimately, how do you think this will end? even if a special counsel finds president biden did do something wrong, they can't indict a sitting president. so what ultimately ends up happening here? >> you know, i don't think they have thought that through. i think merrick garland says he appointed a special counsel to handle classified documents, he has no choice to do the same with biden. biden, again wasn't even president. biden has a document six years three times longer than

donald trump had documents. and this is just another example of a two-tier justice system. in my opinion, there shouldn't be any special councils. in my opinion merrick garland should step back and say, you know what, we probably overreacted with trump and we will ban most special councils and work with the house oversight committee to conform the way national archives does business in the future. that would be the best and let us continue our investigation in the biden family. the democrats investigated the trump family for numerous violations over the past six years. they really found nothing. this is the one and only investigation of the biden family. yet, the democrats cry foul every step of the way. this family needs to be investigated. we don't need special counsel in the way. again, i don't think there should be special counsel in either situation. i need to have a briefing with national archives, and i think

we can come together in a bipartisan way to fix this problem to where it doesn't happen in the future and reform the way the national archives does. it was purely political with doj and what fbi did to trump. >> todd: it has been reported about 20 documents out there that will come to light this week. congressman, do you think there are more documents out there that will come to light this week? >> unfortunately, i have no trust or confidence in biden's personal attorneys. joe biden said of the press conference a few days ago when peter doocy asked him, i have no knowledge. i believe he had no knowledge. that is even worse than having knowledge of it. who had access to biden? which we know primarily funded through china? who had access to the biden residence where hunter biden and i don't have time to go into the potential conflicts hunter biden would have had when he lived there two years. so we can come of this is something that is not going to go away.

i think there is a way this could be handled and save a lot of tax dollars. save a lot of drama, a lot of unnecessary legal and the national archives to sit down with congressional leaders and try to work this out. but right now, because the fbi didn't read the biden residence, we don't have any confidence in the low years are saying right now. >> carley: congressman, thank you for joining us. >> thank you for having us. >> carley: the crime story, diane walshe's mother spotted outside the family's home in massachusetts last week after son was charged with misleading the police and wife's disappearance and these photos saying one of her friends, heart-wrenching prediction about her whereabouts. >> i have to ask them to forgive me for asking this question, but do you believe anna is a life or do you believe she is dead? >> pamela and i know her

manhattan and snatches a woman cell phone right out of her own hands. the police say the 24-year-old attempted to give the phone back but the suspect pointed a gun at her. not good there. that man is still on the loose. >> todd: they just get more brazen than that. the l.a.p.d. planning for the thin blue line flag from its public lobbies after receiving, at this one single complaint. from an extremist group saying it has violent views. the founder of blue lives matter, joe imperatrice, what was your reaction when you heard this? >> todd, usually when people make a complaint, they don't like the cops in a given day. for at the police chief to take it down, it makes us think there is something wrong with that flag, which it is not pure than the police officers on the other side of this wall, you can hang it on your locker, vehicles appear there is nothing wrong with the flag.

a -- i can guarantee you that not only flowers but all different types of blue lines with the flags, stickers, cups then it is okay. we need to stand up for our cops and we should have left it there. >> todd: look at the lobby display, my gosh, if you are offended by that i don't know what you will be offended by it. here's the statement from l.a.p.d. chief, no pun intended, it is unfortunate extremist groups have hijacked the use of single-line flag to symbolize their undemocratic racist and bigoted you don't like views. what is your response to that? >> he should learn more depth what it means? especially that copy in the line of duty. it symbolizes the hard work that cops make every single day and continue to make. also, that blue line is only thing separating the darkness from the chaos. every once in a while, it would be nice for the executive police

department to just explain a little bit more because morale is in the gutter. we can't recruit people. why would people stay if the executives not standing up for them. >> todd: the group is fighting back, "we would display proudly and not let anyone distort the true meaning. and law enforcement stand in the gap between the lawless but you alluded to this, joseph. what does a move like this signaled the future recruits? this is going to destroy morale in light of defund the police. >> well we can jump to conclusions and the cubs will think what else is going to happen? from black to white to hispanic, asian, anything in between and i can tell you from my personal experience police officers off duty or proud no matter what to wear that blue line and honor the cops killed in the line of duty and honor the cops that go on the street every single day. if it was so divisive the police

officers who were the uniforms would not want nothing to do with that. instead, they embrace it and they want to show people how to serve and protect. >> todd: l.a.p.d. to a higher 200 retired officers to deal with 600 expected retirements next year and this next step is absolutely shocking, l.a.p.d.'s latest recruiting class had 22 recruits. that is not a typo, only 22 in a department that currently has 9,240. i don't know, joseph, do you think there is a connection between morale destroyers like what the chief did with the thin blue line and recruiting? >> think about it, this is happening all over the nation and not just l.a. policing is one of those dying breeds where cops are afraid to go out there and put their hands on somebody because there is somebody that committed a crime and afraid the next day they will be headlining in the paper. we have to change the narrative. we need the community come executives to stand behind the

cops and say, "if you do policing to the best of your ability and don't do anything criminal and generally want to help the public we will stand behind you. if you do cross that line, we will go after you because you need to be held to a higher standard." >> todd: defund the police was 2020 narrative but in 2023 over the course of the last couple of years the departments have seemed like a lady the numbers decreased in terms of recruiting. or any of these big cities getting the lessons that they need to change their approach? even though we don't defund the police, they still do things that destroy morale? are many waking up and realizing they will lose their departments if they don't act now? >> i don't agree, it is tearing into 2023 to hold onto retention behind the scenes to go out there and get police officers the equipment they need on a daily basis. i think there is much more behind it. the staff in new york city is doing an amazing job standing

♪ ♪ >> carley: we are learning border patrol agents account for 250,000 migrants at the southern border in december alone end. that is the highest month in history. >> todd: marianne rafferty joins us from los angeles with the details, marianne. >> good morning, carley and todd. 30 days cpc to clock more than 250,000 migrant encounters that averages out to more than 8,000 every day. the influx has been a steady stream of over 200,000 for nine straight months now. so far in 2023, migrants from 140 co1140 have crossed illegald accustomed to dealing with those overwhelming numbers. >> it is almost a norm, anything over 200,000 is the norm under this administration.

when i was in dhs we approached 70 a month, it was a full-blown crisis. >> todd, carley? >> todd: over the weekend new york city mayor eric adams all the chaos over the weekend and much, much different view than president biden. >> todd, he did. mayor eric adams begging for help since the first bus of migrants arrived from new york from texas. he paid a visit el paso meeting with migrants personally. so far, 5200 migrants sent to the big apple from texas peer of the large numbers are putting a strain on the sanctuary cities resources and he's demanding federal help. >> this is a national crisis. new york cannot take more, we can't. we are pointing the finger where it should be and that is the national government. this is a national problem. >> so judging by that response, it appears may be governor abbott showing other

cities what it's like to do with massive numbers of migrants might avert. adams wants to see the biden administration play a more proactive role in keeping the board are secure. >> carley: marianne rafferty, thank you so much. el paso u.s. marshal retired and deputy chief of el paso police department, robert, always great to see you. first the reaction to mayor adams visit to el paso. are you glad he came? >> oh, yeah, absolutely. i think it is a good thing. i wish he would have done that sooner. but the mayor of new york may be different at el paso right before president biden did it come with us to be cleaned up under orders of the of the white house border patrol. they rounded up all the migrants in el paso, the nice look. but mayor adams going down there actually got a dose of reality. and he is absolutely right. this was a border crisis that has turned into a national crisis.

i have been saying that many, many times. it is really unfortunate. when is it going to stop? this is a result of not having a plan to deal with the issues on the border. >> carley: what is it like in el paso right now, robert? are the numbers down from the record highs we saw a few weeks ago? >> yeah, absolutely appeared to be honest with you, the reason those numbers are down, i talked to some officials in el paso on a daily basis. after mayor declared an emergency with governor abbott sending the national guard out there and texas dps troopers out there, it actually stop the bleeding were slowed the bleeding down. the number went way down. that took the national guard having to install barbed wire there to get a control on the situation. so something needed to be done. if you want to call it drastic, so be it.

but something needed to be done. and since all of that, the numbers have gone down. speak to the situation is surprising to me because in arizona, they were using containers to secure the border. the biden administration made them move the containers but you see what is going on in el paso and the administration hasn't said anything about that. are you surprised by that? >> i am surprised, but it just tells me it is a different situation in el paso than what we saw in arizona. i believe those containers are on federal property. so i think we are seeing the difference in el paso. believe me if the federal government or the white house would step in and say you couldn't do that, they would avert that. >> carley: talking about the new numbers 250,000 migrant encounters in december alone, that is a record high across the border. the people coming from 140 different countries, what is your response to that?

>> you know, that just goes to show you that you have all these people from all these different countries wanting to come to the greatest country in the world basically. i don't blame them, but it is so overwhelming not only for the border but the cities that you saw where mayor adams in new york had to go down there and look at it first hand. so it is unfortunate. but the other thing not taken into consideration are the thought of ways. the migrants by surveillance system or vo border patrol agens coming into the united states not apprehended. and to be honest with you, those are my biggest concern. you will probably see more criminals within those groups. >> carley: let's talk about the biden administration's response so far. mayor adams calling on the administration to do more. do you think they will? >> i think it helps that

mayor adams went down to the border. what i would really like to see is all the mayors in new york see the being impacted by the crisis come down to el paso border. they need to band together come all the mayors need to band together and put pressure on the white house to come up with a plan and stop the bleeding. these cities just can't take anymore. >> carley: you know, love people would say mayor adams don't have clean hands when it comes to all of this either. because what he was doing the press conference in el paso, he said a lot of migrants are reading websites and see new york city streets will automatically get employment. he was alluding to the fact that is not true. but in many cases, robert, it is. the city is paying for hotel rooms for illegal immigrants and luxury hotel. it is also a sanctuary city. aren't those policies exactly driving migrants to make this dangerous journey in the first place? >> yeah, i agree with you.

this truth is spoken, we get closer and closer to his dream. >> todd: but that said, what would mlk think about the current state of our country? >> if mlk were here today, he would be praying. i don't believe that in america we pray and not many people do pray. that is not in a day met against prayer warriors but more of us to depend on god, not politics, not our money or our own strength but we must rely on god. martin luther king jr. said in many, many ways during his lifetime and his ministry when he matured to be a baptist preacher because as a college student, he started the religiousness of the world and governance of the world. but he settled on relying on god. i know that for sure. i've heard many of his sermons. >> carley: your uncle also said he dreamed of the day there was no black power or white

power but only god power in human power. some feel like we have taken a step backwards and that trend. a major emphasis on race right now but what do you think about that? >> truth must be taught every generation and nowadays things have been accelerated with technology. truth has to be told every generation. so that is the issue. many people are wakening up to the fact, especially young people on social media and all of that because we can see people instantly and know regardless of their skin color that we have so much in common. we will begin to respond to the truth that we are one human race. we have not necessarily gone backwards. we've had some hitches and things like that. it is important in this generation an decade to continue to see ourselves as one human race. and that we should work together to love, forgive, repent, have faith, hope, love.
