top secret documents were in president biden's possession. oversight chairman james comer pushing to get the visitor log particularly for biden's home in delaware. where aides found classified materials not once but twice so far. special counsel robert hur on the job, we're told, after the investigation steeped in america's national security was hidden from the public. why? how could this surface november 2nd and get handed to the archives on november 3rd, and nothing ever leaked about the nation's leading politician and his team? we all know washington, d.c. leaks like a sieve. it's hard to believe. >> just shows the hypocrisy and why the american public doesn't trust their government. >> step one in stopping this behavior is exposing it and getting the truth to the american people. >> for those who think well the

a quick look now at the latest developments from jacque heinrich at the white house. >> we asked about this on friday when they were going to release the visitor logs of the president's wilmington home and deflected and drew a comparison to the donald trump administration and now we know why. we are learning they actually don't keep any records of who comes and goes from the home where potentially unsecured classified material was found. >> again, i am telling you we did something that the last administration got rid of, instituting the white house logs. did you ask the last administration why they got rid of the white house logs? >> republicans are sounding off boxing in democrats who posed the same questions about the document found add mar-a-lago. adam schiff admitting national security could be jeopardized here. >> i don't think we can exclude the possibility without knowing more of the facts. we have asked for an assessment in the intelligence community of

the mar-a-lago documents. >> republicans are also pointing out a big gap in democrat claims that this is apples and oranges to the mar-a-lago raid. >> they never released visitor logs, they didn't raid the residence. in fact, after the general counsel was appointed we still find out that president biden's personal attorneys are still rummaging around essentially what would be a crime scene trying to find information to turn over. so this whole process has been handled poorly. >> the discovery of more documents came more than a day after the white house claimed they were being transparent. two days after they told us the search for more documents was complete. the president's attorneys have tried to explain the gap between when they discovered something and when they tell us about it by saying it is a balancing act between the needs of public transparency and protecting an ongoing investigation, harris. >> harris: but we don't know who actually lifted up the garage

door to see some of the documents that were in an unsecured location or who moved the files from one location to the office and then from the office someplace else at penn biden center. we know a bunch of attorneys did it on the back end and they are worried about national security? wow. >> attorneys that the -- the president's attorneys. >> harris: good point. jacque heinrich, thank you for the latest. let's bring in republican senator ron johnson of the great state of wisconsin who sits on the foreign relations and homeland security committees and the top republican on the subcommittee on investigations. look, i want to get into the row that you had with a member of the liberal media in a moment and get to your top line shots where we are now with president biden and secret documents that keep popping up. >> it is one more example of the

multiple tier system of justice and the unequal application of the law. justice department didn't deal with biden like they did with former president trump. there is a much larger story here. senator grassley and i issued our report and showed millions of dollars of foreign financial entanglements. those never adequately explained. we don't know whether attorney weiss has the resources. we have a whistleblower that says he doesn't have the resources to investigate hunter biden and why we called for a special counsel. we need the capability of looking into financial transactions between hunter and joe biden. big guy. an investigator has the capability. congress doesn't. certainly not in terms of our subpoena authority. we simply don't have access to those records. we don't get access to those records because what ends up

happening is the f.b.i. always claims there is an active investigation. we can't hand over those records. the american public never understands the truth. there is a much larger story here of f.b.i. corruption, complicity and the corruption and complicity of the mainstream media as well that cover up for democrats and the bidens. they ought to be investigating this themselves. they ought to be howling about this but they are going to cover for the bidens one more time. >> harris: not all of them. some are seeing the ramifications with this in terms of public trust. you said it best. we now, through you and congress, we aren't allowed to see what was in the document but i asked this question again and i am serious about it. those document and jonathan turley legal expert said were moved at least two times. getting them in and out of the biden center, the university of penn biden center. we don't know how many times the garage door went up with the

corvette and papers in it. the president said they were in there with the corvette. somebody had a lot more access than you'll ever get. >> it's real possibility. of course, president biden having been in washington for decades understands how classified documents should be handled. we wrote to his counsel and we got a brief email saying the present administrations understands the federal records laws. they might understand them but they are ignoring them as president biden has as well. no, to me this -- this is obvious that president biden has certainly broken the rules. he should have known better. incredibly hypocritical. you heard his interview with cbs talking about how he simply can't understand how somebody could be so irresponsible talking about president trump. what does he think about himself? but again there will be double standards applied to this and as

we talk about this -- i'm not down playing the seriousness of his mishandling of classified information, we just aren't getting the information in terms of the financial transactions, how that might have impacted his policies toward china. more than $50 million donated by anonymous chinese to the university of pennsylvania where he had the penn biden center and then 160 members of that faculty wrote to merrick garland to cancel the china initiative in which he did. that was the department of justice program to uncover and investigate chinese theft of intellectual property. how is president biden's compromise impacting our national security? that's the larger story here. >> harris: republicans are digging for answers as you were just talking about, senator, on hunter biden's business dealings and the president's connections to them as you laid out. a new wrinkle with those classified documents laying around the president's office,

home, garage. senator, this exchange over the investigation into hunter biden is getting a lot of attention. let's watch. >> senator grassley and i -- about -- >> potential. >> about $30,000. target individuals. >> you are targeting hunter biden. >> this is pretty obvious to anybody watching you don't invite me on to interview me but to argue with me. it needs to be more unbiased. there is misinformation on both sides but the censorship is primarily from the left. >> harris: todd just hemes insults upon those who called for investigations. the point is not there are proven crimes but the need to have a special counsel look into these offenses including some of the -- some of those that involved emails referencing the president. what were you trying to say

about 30,000 because that particular point was when he really leaned in. >> you couldn't understand it because he was talking over me. he argues with me not interviews me. hunter biden, we have records that show about $30,000 were paid to prostitutes. probably individuals associated with the eastern europey an sex trafficking ring. $30,000. the same time period in the midst of that five-month period over two months joe biden committed to wire hunter biden $1 hundred thousand. was the president of the united states at that point in time the former vice president financing hunter biden's illegal activity with prostitutes? where is the #metoo movement in terms of the outrage of the son of the president cavorting with people that could be coerced into the sex trafficking business? again it's just one of the

crimes. we know the f.b.i. is investigating hunter biden for potential tax evasion. other potential serious crimes. they've been investigating since 2018. what's amazing if you look at the timeline, the f.b.i. starts investigating him in 2018, april of 2019, hunter biden gets off the board of burisma and turns over his computer to a computer repair shop and later that month joe biden announces for president. are those things connected? then we know later in 2019 the f.b.i. takes possession of that computer. on the way out the door they look at the owner and say people don't talk about these things. don't get in trouble. the f.b.i. over the next nine months laid the ground work to sabotage the hunter biden's computer as being russian misinformation campaign knowing full well it was authentic and genuine. there is a much larger story of

corruption between federal law enforcement, mainstream media, biden family and other democrats as well. there is a much larger story here. >> harris: the disinformation about the laptop, that whole, you know, shadow campaign that was going on involved the f.b.i., we've learned, with reports of intervention with social media particularly the old twitter before elon musk bought it. real quickly, vulnerability is the word that comes to mind when you talk about hunter biden and prostitutes and money. you said this to chuck todd and made it clear, i thought. it is not about hunter biden, it is the fact the hunter biden go into the garage where the corvette was? were he and his dad in such a way that things were crossing lines? is that a vulnerability that our president now would have? senator johnson, love to have you back. thank you so very much. >> have a good day. >> harris: the war on police is real and it is getting worse.

is struggling with people being bused into the city from the border from texas. that number, of course, is a fraction of how many illegal immigrants that state actually sees. in just a few hours or a day. mayor adams had this to say. >> this is a national crisis. our cities are being undermined and we don't deserve this. migrants don't deserve this. and the people who live in the cities don't deserve this. we expect more from our national leaders to address this issue in a real way. >> harris: the numbers continue to bog will the mind. cbp sources telling fox news a record [ing 250,000 people were encountered. a quarter million this comes after nine straight months of encounters exceeding 200,000.

charlie hurt, washington times opinion editor, richard fowler both huge contributors. i'll start with you, charlie. mayor adams when he was running, i remember he said illegals would be able to vote. this is sanctuary territory up here in new york. what happened? >> it is extraordinary. he is right about one thing. the people of new york city don't deserve this. they also don't deserve to be lied to by politicians like mayor adams going back and embracing all the ideas around sanctuary cities. this is what you get when you have politicians who embrace sanctuary cities and don't believe in enforcing very basic immigration laws that are passed by congress. all of this -- more than anyone is joe biden's fault single handedly his fault for undoing all of the things his predecessor put in place that stopped the immediate problem at

the border. he did it for political purposes. he did it as a political weapon and it is backfiring to the point that even fellow democrats who have embraced sanctuary cities for a long time are now coming to grips with the idea this is a really bad situation. >> harris: what you said is so important, richard. i want to know if you caught that. charlie called it an immediate problem at the border that biden undid but flipping the switch on trump policies. no one thought whatever trump had place, nobody has negotiated a better way forward yet. presidents and congresss have tried but they haven't. what we have in place is basically a stopgap, stem the flow and biden flipped the switch on that. >> i do think you're right in the fact we have a stopgap measure. this is not a biden border crisis, this is an american outdated immigration problem that every president -- >> harris: both can be true.

go ahead. >> this is an american problem that's created because we have a lack of -- we have outdated laws that need to be reformed. what eric adams is asking is something simple, for congress, for the president and both sides of pennsylvania avenue to get to work and create real immigration laws. the ones we have in this country to charlie's point you can enforce them sure but they were years before i was born, right? that's what is problematic here. if we want to have a conversation about fixing america's broken immigration system we have to knowledge oaf en in the trump era were illegal border crossings. >> harris: this is the most in the history of the country. >> one crossing or a quarter million crossings, a crossing is a crossing. >> harris: no, no, no. under obama the dhs secretary said there was a number north of 900 a day that would be okay. but that now we're in this

is. when the president of the united states transition team tells you what will happen, which reportedly happened when trump's team left. they told the biden team, this is what happens if you don't leave these things in place. talk to chad wolf, talk to tom homan and some of the people in charge and they will tell you this was foreseen what we have right now. this is not a shock or surprise. two things can be true, as i said. we have a history of bad, we have a current of much, much worse under one president. >> it is worth pointing out that our immigration laws are passed by congress. we cannot have an administration passing executive order after executive order fixing a problem without congress. >> the executive branch is refusing to enforce the laws. >> the congress needs to pass a law written. >> they have laws. there are laws on the books. >> congress is not passing immigration law this millennial. >> harris: richard, read title

i can tell you that those documents did not just float around. they aren't like the confidential documents or even the classical secret document. these are the high oft level of security that our country designates documents. they don't just lie around. aides don't just utilize and push these papers around. in order to have them in your possession outside of where you are authorized to view them would take a concerted effort. >> harris: i don't know if you heard my previous guest we were having quite a heated discussion. charlie hurt said the president stole these when he was vice president. that they actually were under the classification as such that you couldn't just walk out with them and they belonged to president obama. what is your take on that? >> he is accurate. a crime has occurred and the standard is not that you intended to harm the country or not that you intended something nefarious with relation to our national security.

it is easy enough to prove you intended the action which allowed for the document to be confiscated. that's a standard. i was a participant in criminal investigation. they don't get the same benefit this president is getting. >> harris: one of my co-hosts on "outnumbered" has called it strict liability in some of the criminal cases she has worked on and that's what this is or something akin to it. it doesn't matter what your feelings are. the fact is you did this thing. >> that's right. the next level is where you really get into intent. was there a use of these or intended use of these to protect themselves? did it have anything to do with ukraine and the bidens' alleged financial dealings? who knows? the mere possession is a violation of federal criminal gnat all.

>> dana: you might mention ukraine and china and iran. in the first batch of documents found at the penn biden center some had top secret markings but some were foreign intelligence documents of some sorts that had the three countries as topics or issues in them. i want to get to this. fox news contributor and constitutional law attorney jonathan turley said biden used his lawyers to find the documents not the f.b.i. the president has a host of people who regularly handle classified materials. why use the lawyers? the answer appears the same as it was in the clinton's emails. control using private counsel allows biden to raise attorney/client privilege. the lawyers aren't acting on behalf of the public interest but for the president's personal interest. brett. >> i would add in addition to what jonathan points out.

shooting, whether it's justified or unjustified you know what they almost all have in common? somebody failing to comply with the instructions of a police officer. i tell my own kids all the time. i would encourage every parent out there to tell their kids this exact thing, too. comply with police. if you didn't do anything wrong, there is a constitutional system in place. you will be taken care of. what we can't solve is an act of violence that ends in someone's life ending. far too often when we have right now police interactions with potential criminals, with individuals in this country, they turn violent because there is no respect for the police. that is why these overall numbers of deaths are continuing to soar and why police are still under such danger. you know this. when you create this situation. police see all these numbers. when they fear for their lives, it creates more tension, it creates more difficulty for every police stop and makes

violent outcomes more likely on both sides. it has to stop. it stops with the support of our law enforcement. >> harris: it creates absences. that's what we're seeing now. municipalities cannot live without law enforcement officers. we knew that. now their absences, they have left the programs that kept those communities safe. can you get them back? i pray for the ones who are dying. we have an uptick in new york city of suicide among cops. it is tough. our rhetoric has got to change. let's get to this. four more schools in northern virginia now admitting that they also withheld national merit award notifications from students in the name of equity. which brings the total to at least six high schools in the state. you know that affected college and so on. in november parents accused officials at thomas jefferson high school of holding back notifications until after the college application cycle to even the playing field, they

said, and avoid hurting anybody's feelings who didn't get a merit. parents say some notifications didn't come at all. the attorney general announced an investigation after a request from governor youngkin. he said the schools have a man huge focus on equal outcomes for students at all costs. >> these awards are incredibly important for letting kids know how they stand up and stack up with everybody else across the country. northern virginia schools in gain rail are obsessed with the fact they don't have the cosmetic diversity they wanted even though they have a tremendous amount of diversity. they have massive amounts of asian students enrolled. it is directly connected to what we've seen happening in new york cities. test scores are dominated by asian students and hurting the
