>> tucker: singing at al sharpton's group am we are out of time. [laughing]. that was too good. see you then. >> a special edition of "hannity." i am pete in for sean. on saturday we learned that even more obama's era classified documents were unearthed and discovered. this is the fourth finding. coming after the white house press secretary karine-jean pierre falsely claimed that the
6:01 pm
search was complete. nothing else to find. biden was at the scene of the crime this weekend. we don't know what he was doing or who he was meeting with. despite spending much of his presidency in delaware there it are no visitor logs at his home. they said his personal residence is personal. why was classified documents just lying around in a personal library? and a personal garage? why did the federal government allowed biden's partner lawyers to conduct the search a few months after raiding mar-a-lago and seizing documents at gun point. what prompted them to look for joe biden's classified documents in the first place?
6:02 pm
good question. with reaction the author of the "price of principle" alan dershowitz and gregg jarrett. professor, this is a personal residence but they believe he has prerogatives. what is their defense right now? >> well, i think the defense is going to be carelessness, sloppiness, no malev oinence. what about donald trump and hillary clinton? -- we will see a lot of comparisons. in the end we have 2 special prosecutors that were appointed. if you point one against someone running for president you need
6:03 pm
to appoint another one for someone else running for president. there will be no prosecution. probably the laws will be changed. we will see a new process where they will come to the house and remove everything the day the president leaves the white house. i think we will see that change. >> professor, you say it will be nothing followed by a change in the process and no repercussions for biden? >> i think there will be none except political. even the democrats are saying look how sloppy and irresponsible he is. i don't think we will see criminal prosecution either. if there was of a chance that donald trump would have been prosecuted what he did, that opportunity disappeared as the result of this tit for at that
6:04 pm
time politics. >> gregg jarrett, you had a great op-ed saying biden is a greater risk of criminal jeopardy. why do you believe that? >> with every new discover of classified documents at different locations. the case becomes stronger for criminal charges against joe biden. every time he and his defense team offer a defense, they only incriminate themselves. they are saying at biden's residence it was personal. the other defense is it's inadvertant. the lesser standard in play here
6:05 pm
is gross negligence or recklessness. inadvertent is the dictionary definition of carelessness. trump is admitting guilt. but where is the fbi in this? 73 days elapsed between the first discovery and the last one just over the weekend. where was the fbi? their first duty is to control a crime scene and seize and collect the evidence. their second duty is to seek out other venues. they have not done. that they allowed free will of biden's lawyers to go through documents and secure them and pick them out and hand them over. think about that? the duty of biden's lawyers is
6:06 pm
to protect their client. not to gather evidence for the government against their client. that's a monumental conflict of interest. merrick garland and christopher wray don't seem to give a damn. >> what about the documents of the president cannot be trusted? that was pushed by the republicans when there was talk about prosecuting trump. how can you say that a sitting president can be prosecution when the constitution seems to suggest that a sitting president can't be prosecuted. how would that happen? >> well, wait until he leaves office. the other part is trump had the unfettered authority to declassify. the vice-president doesn't have that. i know the "new york times" and cnn cited an obama executive
6:07 pm
order giving the authority to biden. that was null and void the moment obama signed it. a president cannot unilaterally modify or expand a constitutionally given power. joe biden didn't have the ability to declassify. that's why he is not asserting that defense. >> [overlapping talking]. >> is part of what i heard it's because he was joe biden and he was the vice-president. if i brought one piece of classified documents out of a classified area the law was iron clad. are you saying it's because of his position? >> well, that's what should be reviewed. every case.
6:08 pm
a person lost their jobs as a result of comparable conduct should be reviewed. you can't are one rule for a president and another rule for an army officer. it has to be the same rule. as to the issue of trump having declassified, did he actually declassify while he was president? now biden can declassify. that might contribute to transparency. why doesn't he declassify the ukrainian information so we know it didn't bear on his son. the president can declassify. i think he should consistent with national security. >> i agree it's a matter of evidence dispute as to whether trump declassified documents am good luck merrick garland trying to prove other. the president didn't have to
6:09 pm
tell anybody. he doesn't have to put it in writing or sign any documents. he doesn't have to notice any individuals or agencies. he can simply do it on its own. how can you disprove that trump declassified documents. you cannot. >> i agree. >> we have to leave it right there. tonight there is trouble in paradise. some of joe biden's biggest fans are disillusioned. time magazine said we elected biden to be greater than this. and "usa today" said this could be a political and legal liability. democrats and the media have serious buyers remorse right now.
6:10 pm
watch. >> i am glad there is a special prosecutor that will look at this. >> why? >> any time there is a deviance with security protocols that should be taken serious and investigated. >> it's embarrassing. it's embarrassing you would find a small number of documents. >> it's an embarrassment. no doubt about it. >> what is going on here? the stumbling and bumbling around for a month has been extraordinary into a couple of weeks. >> since november when they first started discovering these documents. >> the response from the president has been concerning for many people. democrats and republicans especially the comment about the garage and the corvette. >> these people don't like being concerned about joe biden. tongue during the election democrats tried to sell biden as an upstanding senior.
6:11 pm
in reality he is nothing more than a greed, low functioning career politicians with few principles or standards. joining us now kellyanne conway and buck sexson. what is the predicate for democrats turning? out rage over his actions or a desire to turn the page? >> it's a couple of things. it's out rage and all of them being on the record. last august into this january about the mar-a-lago raid. these are people who cannot answer a straight question about classified documents being where they should not be in joe biden's possession without mentioning the worst trump. trump is their answer for everything.
6:12 pm
we should resist that temptation. it's easy to compare the two. i think the facts are better for donald trump if you dig into it. the fbi went to mar-a-lago and said put a stronger lock. they did that. he had surveillance cameras and secret service. joe biden has his personal attorneys. he could claim attorney-client privilege. the media are turning on because they like accountability transparency. they were lied to last thursday twice by the press secretary 2 should say chief of staff put the twitter button-down and tell me what is going on. you are making me look foolish and making me lie to the public. they are keeping her in the dark about the facts here am we are
6:13 pm
not getting the information. it's not a matter of degree. they say just a few documents. it doesn't matter how many documents there was. it matters that you did it at all. the biden administration i call them the wrist flirks. they say he's not as bad as trump but they are turning on him. national security issues bother them. -- they never gave joe biden over the most disgraceful action where he disregarded the advice of his generals and turned it over to the taliban. $85 million of our equipment and this is a national security concern for many. they feel embarrassed that he
6:14 pm
did what they accused his opponent of doing. >> you know about a lot about classifications. he is writing the book right now. the timing of this. he is thinking about announcing for reelection. do you read anything into that? >> well, i think we need ton how this whole process began. who found these documents? were lawyers the ones. lawyers without clearances. you would think these are people close to joe biden they would disposed of these documents in some other way. they told the national archives. this guys into how journalists are the mainstream media, the democrats are feeling hung out to dry. there is no playbook here.
6:15 pm
joe biden whom barack obama said has an unbelievable ability to mess up anything. i am paraphrasing. joe biden has created a circumstance where all of his defenders look like buffoons what is more important to mainstream journalists is their ego. they look like clowns now. if there is a deep state operation going on here to push joe biden aside and make room for somebody else. all of his allies in the media look really dumb. that's a problem for them. there are pieces of in that are missing. in terms of the classification issue, there is not that hard. joe biden should not have had classified documents in his house. they made it a much bigger issue
6:16 pm
and now they have to focus on it sglong hard. >> both ever you quickly, how much does this damage joe biden? >> quite a bit -- it goes against that he knows how to handle classified documents. people without security clearances had access to that information. >> hunter. >> certainly hunter. they are investigatoring that. your question are they trying to push him aside? who they have? they can't turn it over to the vice-president. she can't speak and doesn't do much work. pete buttigieg? one of the socialists? tulsi gabbard on this network.
6:17 pm
who would they turn to? gavin newsom? that's also why the democrats are upset. they are stuck with this guy. they have been saying joe biden had a great mid-term. only because he was not allowed to campaign in the mid-terms. they stuck with him at the top of the ticket. >> i don't think it really matters in the long run. they will run a special counsel investigation and make this go away. i think joe biden is the democrat nominee. >> i hope so. the last part. >> yes. another basement campaign. can't wait. thank you very much. coming up ron johnson discusses his tense exchange with chuck tod. newt gingrich previews kevin mccarthy's big week.
