search was complete. nothing else to find. biden was at the scene of the crime this weekend. we don't know what he was doing or who he was meeting with. despite spending much of his presidency in delaware there it are no visitor logs at his home. they said his personal residence is personal. why was classified documents just lying around in a personal library? and a personal garage? why did the federal government allowed biden's partner lawyers to conduct the search a few months after raiding mar-a-lago and seizing documents at gun point. what prompted them to look for joe biden's classified documents in the first place?

time politics. >> gregg jarrett, you had a great op-ed saying biden is a greater risk of criminal jeopardy. why do you believe that? >> with every new discover of classified documents at different locations. the case becomes stronger for criminal charges against joe biden. every time he and his defense team offer a defense, they only incriminate themselves. they are saying at biden's residence it was personal. the other defense is it's inadvertant. the lesser standard in play here

is gross negligence or recklessness. inadvertent is the dictionary definition of carelessness. trump is admitting guilt. but where is the fbi in this? 73 days elapsed between the first discovery and the last one just over the weekend. where was the fbi? their first duty is to control a crime scene and seize and collect the evidence. their second duty is to seek out other venues. they have not done. that they allowed free will of biden's lawyers to go through documents and secure them and pick them out and hand them over. think about that? the duty of biden's lawyers is

to protect their client. not to gather evidence for the government against their client. that's a monumental conflict of interest. merrick garland and christopher wray don't seem to give a damn. >> what about the documents of the president cannot be trusted? that was pushed by the republicans when there was talk about prosecuting trump. how can you say that a sitting president can be prosecution when the constitution seems to suggest that a sitting president can't be prosecuted. how would that happen? >> well, wait until he leaves office. the other part is trump had the unfettered authority to declassify. the vice-president doesn't have that. i know the "new york times" and cnn cited an obama executive

order giving the authority to biden. that was null and void the moment obama signed it. a president cannot unilaterally modify or expand a constitutionally given power. joe biden didn't have the ability to declassify. that's why he is not asserting that defense. >> [overlapping talking]. >> is part of what i heard it's because he was joe biden and he was the vice-president. if i brought one piece of classified documents out of a classified area the law was iron clad. are you saying it's because of his position? >> well, that's what should be reviewed. every case.

a person lost their jobs as a result of comparable conduct should be reviewed. you can't are one rule for a president and another rule for an army officer. it has to be the same rule. as to the issue of trump having declassified, did he actually declassify while he was president? now biden can declassify. that might contribute to transparency. why doesn't he declassify the ukrainian information so we know it didn't bear on his son. the president can declassify. i think he should consistent with national security. >> i agree it's a matter of evidence dispute as to whether trump declassified documents am good luck merrick garland trying to prove other. the president didn't have to

we should resist that temptation. it's easy to compare the two. i think the facts are better for donald trump if you dig into it. the fbi went to mar-a-lago and said put a stronger lock. they did that. he had surveillance cameras and secret service. joe biden has his personal attorneys. he could claim attorney-client privilege. the media are turning on because they like accountability transparency. they were lied to last thursday twice by the press secretary 2 should say chief of staff put the twitter button-down and tell me what is going on. you are making me look foolish and making me lie to the public. they are keeping her in the dark about the facts here am we are

not getting the information. it's not a matter of degree. they say just a few documents. it doesn't matter how many documents there was. it matters that you did it at all. the biden administration i call them the wrist flirks. they say he's not as bad as trump but they are turning on him. national security issues bother them. -- they never gave joe biden over the most disgraceful action where he disregarded the advice of his generals and turned it over to the taliban. $85 million of our equipment and this is a national security concern for many. they feel embarrassed that he
