republicans to launch several investigations into the matter. among the burning questions, why did the president's lawyers conduct the search instead of the feds and why are there no visitor logs at the president's home in delaware? shouldn't the secret service keep track of who is coming and going? >> bill: all fair questions. the white house and secret service say there are no such records. republicans are not taking that for an answer. >> mr. comer's investigation will look at that and like to get the logs of who had access to the biden family residence. why did they keep this from us? maybe the most important question we've asked for over a week is why did they keep it from the american people when they knew about it before the election? >> we wonder if the secret service had records. he still had secret service protection and you would assume that the secret service would vet people that would be allowed on the premises of the dwelling for the president of the united states. >> dana: karl rove in moments

with reaction. first let's go to the white house where peter doocy is standing by. hi, peter. >> just from a practical standpoint the secret service can't keep records or logs if they aren't there. so we have a new way to look at this issue of asking for visitor logs. i found a photo on my phone this morning taken april 2019, the day biden announced his run. there is a secret service guard shack on the right and parking lots for the police cars but no agents. they left shortly after he left the vice president's office. v.p.s don't get secret service protection for life. this is an area now that's very well populated with big s.u.v.s and police checkpoint. in this photo there were documents beyond the gate somewhere but no, visitors weren't being screened for several years. still, republicans say they think there must be something.

>> if the secret service did see and clear people who went in and out of the garage and guest house, people who mowed the lawn. reality is we'll be able to reassemble in time perhaps how many perhaps hundreds of people could have looked at those documents. >> the lack of concern that republicans have about mar-a-lago and records found there has the white house counsel saying house republicans have no credibility. their demands should be met with s skepticism and politicizing this issue and that they don't care about the underlying classified material. top democrats say they don't know what's going to happen. >> as we get to know the facts better in the months ahead we'll better understand what if any risk there was to national security. of course i respect the importance of proper handling of classified documents and i think at this point we're going to

have to wait to hear what the special counsel concludes. >> so even the president's closest democratic counselors know the probe may not go the president's way. >> dana: they are a close pair. thank you. >> bill: we listed a few questions, karl rove has a few of his own as well. good morning. why don't you begin now before we get to our list. good morning. >> i thought congressman jordan of the judiciary committee said why didn't they tell us this in november? that's an important question. i have an even more important one. how did the documents get there in the first place? who took them out of the obama/biden white house? was it vice president biden, one of his staff? how did those documents get to the penn biden center and his home. second question is did he draw upon those documents when he

wrote his white house memoir as his time as vice president of the united states. we know that these documents include ukraine, china, russia, united kingdom. maybe somebody ought to take a look at his memoir and see what he says about those subjects. to me it's more important than why didn't you tell us in november. we know the answer. they didn't tell us in november because they didn't want it to blow up in their face in the final days of the mid-term election. i'm more concerned who was it that took those document out of the white house and took them to the penn biden center? is there a connection between the penn biden center and the chinese money the university of pennsylvania received, tens of millions of dollars? who or what are the sources of the chinese dollars? university of pennsylvania says they're anonymous. institutions or companies with ties to the communist party. why did the president say his lawyers told him he couldn't look at the documents now. he is the ultimate

classification guy. the highest security clearance of anybody in the country. why did the president say i can't comment on this because the lawyers have told me not to look at the documents? >> dana: let's look at the timeline. as you mentioned november 2nd is the first time they find the documents. they don't tell anybody until much later. on january 9th we have this news story that comes out and january 11th they find more documents and 14th more documents. i would ask questions to you that is to the disclosure to the american people and how the white house is operating. at what point did the communications director and the white house press secretary know about these documents? were they told? if they weren't told, why not? >> who made the decision not to reveal the november december. i suspect it was ron klain talking to the president saying we better not reveal this until after the election. >> bill: another question we were talking about. is there an obligation on behalf

of a sitting president to keep a personal log, visitors log at his private residence whether it's a beach house or in this case a home of wilmington, delaware? do you know that answer and have past presidents done that? >> i don't know the answer definitively. talking to people with knowledge, think about this. we had president biden had a home in wilmington and rehobeth beach. president bush had his ranch in crawford. his father had the walker's point estate. i'm not certain clinton had a house in arkansas that he kept. but the question here is two-fold. one is what is the practice of the secret service? my sense was that there was a log of all the visitors to the ranch in crawford because every one of those people who came to the ranch had to go through a

background check. it seems normal just as they had to keep a background check and log of visitors to camp david or the white house, the personal quarters, overnight guests, there are logs of those people. i can't imagine there wasn't a log for crawford. but whether there was or wasn't the question is did the secret service change its practice for president biden and do something different when he became president with regard to his home in wilmington and his beach house in rehobeth than they did for previous questions? is there something different they did for him? >> bill: obama has had a home in chicago. he didn't go there a lot in eight years but always owned that home. i still think he lives there now. >> dana: the other thing is with the timeline we just showed everybody, it is about the last five months or so, or three months. presumably these documents are taken when they are leaving in those chaotic days leaving the

white house in january of 2017. so he is the former vice president. so between january of 2017 and then him becoming president, think of all the campaign people in and out of the wilmington home. that was campaign headquarters for all intents and purposes. during all of that time there would probably be no records i would imagine, karl. >> take a look at the penn biden center. they don't have records there. think about all of the people who now serve in the administration. the secretary of state was the head of the office at one point. another member of the president's inner circle was a senior person there and so who else saw these documents? you said one thing, though, that i want to respond to. this administration response saying you know what, it was so chaotic, we don't know how it happened. so chaotic please. every departure by a president and vice president is chaotic.

chaos is not a reason to say you failed to meet your obligation. presidential record act says nobody can take documents out of the white house at the end of the term. president, vice president or staff member. so this idea well, it was chaotic. you were violating the law when you did that. there are no criminal penalties for a president under the presidential records act or the staff but mishandling classified documents is a problem. the idea that you have to excuse us because we had the normal pressures that every president and vice president has when they come to the end of the term is baloney and i thought it was insulting to the american people to say special carve out for us because we were chaotic. >> dana: they were supposed to be the not chaotic, that's what they ran on. >> bill: great discussion. "new york post" we look to them for clever and accurate items like this one. playing biden seek.

it is pretty good. you will hear a lot of comparisons how biden conducted himself and how trump did. some democrats silent on the issue. let's begin with the former house speaker. >> our concern is always to protect and defend and protecting and defending means we do not frivolously treat the documents. >> the judge looked at this and said yeah, there is evidence. enough evidence to warrant a search warrant to retrieve those documents that are of high national security classification. these are the nation's secrets. >> you have many, many republicans giving up on democracy. >> bill: that was all from august. there were updates since then. the whole comparison between biden and trump we'll get into it next hour and we'll frame it for you from professor jonathan turley. >> dana: everyone is talking about the differences. what about the similarities?

also let's go to florida. unfortunately we have this story here. eight people were shot and several others hurt after an argument escalated to a gun fight yesterday. it happened during a martin luther king, junior day celebration. phil keating in fort pierce with more. >> there were about 1,000 people at the park yesterday celebrating the holiday. there was a classic car show and all of the trash and debris that was littered everywhere has been cleaned up as people were scrambling to get out of the way of the gunfire. the eight people shot and wounded are still getting treatment and recovering. certainly from a martin luther king, junior holiday celebration they'll never forget. at the park in fort pierce, florida, a celebration and classic car show when according to police two groups of people got into an altercation and one of the people involved pulled out a gun and started shooting. eight people wounded, one critically. all rushed to a nearby hospital

for treatment. as of now none of the victims died. that's good news. police have not arrested anyone, although they believe there may be more than one suspect. for those that were here it was certainly a traumatic experience. >> there is nothing you can tell a 6-year-old about her mom getting shot in front of her. not a word to use for that. >> again no arrests yet have been made and as one of the officers on the scene here last night said the sad irony here is this violence erupted on a day celebrating a man who preached for social change and social justice through non-violence measures. dana. >> dana: very sad story. >> bill: new footage of the shooting that led to the arrest of a well-known basketball player university of alabama. this is disturbing stuff here. a clip of that. it runs about nine seconds.

>> bill: so the moment gunfire breaks out near the campus of the university of alabama on sunday killing a 23-year-old woman. this video you can hear it.

it is disturbing. [gunshots] >> oh my god! >> bill: they say there were 11 shots. sounds like more than that. darius miles and a 20-year-old michael davis are being charged for her murder. police allege miles fired at a car that harris was riding in near the campus early sunday morning. the victim's mother says the suspect killed her because she would not talk to him. more on this clearly coming up out of alabama. all right. dana. >> dana: law and order set to take another hit in the nation's capitol. d.c. counsel overriding the mayor's veto of a crime bill that softens penalties for violent crimes. former d.c. homicide detectives is on deck. mark meredith live with details on how it would go down. >> good morning. leaders here in the nation's

capital are locked in a debate over how best to address rising crime. they want fairness in the justice system but others argue it will help criminals stay on the streets. city council members are set to approve the measure. in 2025 people charged with misdemeanors get a jury trial and let people already behind bars for a variety of reasons more easily apply for early release. d.c.'s reelected democratic mayor is against the reforms and vetoed the proposal saying the changes send the wrong message. the new attorney general said he supports this. reforms to the criminal code passed before women and black residents enjoyed rights are needed. the "washington post" editorial board is among those against these changes. they write maximum sentences are

seldom pursued under the status quo but limiting them so drastically will deprive prosecutors of needed discretion. if the city council moves the measure forward today it is not a done deal. congress oversees the district. lawmakers have 60 days to decide what's next. how bad crime is in d.c. today january 17th, we have already had ten homicides in the district this year. >> dana: i think five of them were children. >> yes. >> dana: thank you, mark meredith. >> bill: let's bring in former d.c. homicide detective ted williams. you know the city well. you lived there. is the mayor -- she is holding the line for now. do you see her holding it forever? >> i don't see her unfortunately holding it forever. you know, bill and dana, there is a question. why are we not looking out for the rights of law-abiding citizens? it seems we're looking out for

the rights of criminals. and when you look at this reform, i believe in the district of columbia some reform is necessary. but under these circumstances here, where you eliminate maximum minimum sentences for crooks, i mean, you know, i believe if you do the crime, you should be able to do the time. i think it's unfortunate that the city council is going to try and probably override the mayor's veto here. this certainly stretches the criminal justice system. it makes it very difficult, guys, for police officers to do their job because by the time they lock some of these people up, they will be back out on the street unfortunately. >> dana: one of the things the bill calls for would be allowing anyone who is given a ticket or charged with a miss demeanor, it

would allow them to get a jury trial. imagine how that would clog up the system, ted. >> dana, the system is already clogged up. the unfortunate thing is when you say misdemeanors. most of those you can have a jury trial, dana, you can't get folk in d.c. to come to sit on juries for felonies now. now will you get every misdemeanor to have a jury trial? it makes no sense whatsoever. >> bill: in addition they want to have -- eliminate most mandatory minimum sentences and reduce mandatory maximum penalties. in addition to the jury trial for a misdemeanor. well -- we'll see where it goes. the president talking about retraining cops in america. watch. >> president biden: we have to

retrain cops as to why should you always shoot with deadly force? the fact is if you need to use your weapon you don't have to do that. look, to call a fresh approach to recruit and how we recruit and hire, train and retain law enforcement. >> bill: the speech yesterday. here are the facts. 331 officers shot in the line of duty in 2022. 64 cops were killed in 2022. we need retraining, ted? >> you know, it's sad that we seem to put everything in a box for retraining. what we have to look out for out here are law enforcement officers. as you said, 331 police officers shot, 64 of those officers died last year. i mean, retraining is not the answer. what we need to do is to try to find a way to bring the

community along to help law enforcement. law enforcement officers are leading, good men and women are leaving these police departments if droves in droves and citizens are many left vulnerable tatty criminal element. we have to find a way to help citizens. i'm sick and tired of retraining police officers. yeah, there are some bad cops, get rid of them. but we have a lot of good cops out here and we need to help those. mr. president, i'm asking you not only for retraining but try to help the good law-abiding citizens in this country to establish a rapport with law enforcement where they can get rid of some of these crooks on the street. >> dana: ted williams fired up this morning, as you should be. great to have you. >> bill: thank you, ted.

at least 13 high schools across three counties have now admitted to it. there might be more. let's bring in virginia attorney general. good to have you here. when this first happened and a mother found out about it just because her husband happened to see the letter on the student's desk at home, you all were told this was just a one-off aberrations. doesn't appear to be the case. >> no, you are correct, dana. we were told initially it was at one school. one administrative error. we find it is multiple schools. over a dozen in one low kalt. in fairfax from public report. they hired an equity consultant and paid them $450,000 for nine months of work. one of their directives was equal outcomes no matter what, even if it means treating some students purposely uniquely. so we're trying to determine

what that means. well north of 70% of the national merit commendation letters were going to students that were asian-americans. f fairfax is a magnet school that you have to apply to attend. they decided to go to an equity admissions standard. not quite sure what it looks like. we know this. we saw close to a 20-point drop in asian american enrollment at thomas jefferson high school in just one year. we have a lot of parents saying our kids are being discriminated against. as one mom said my daughter has done everything right since the first grade. she has studied so hard. now she is realizing she may not go to the school of her dreams because of who she is because she is korean american. that goes against everything we believe in this country and that's why we have this investigation to determine whether or not our state virginia human rights act, anti-discrimination statute whether they're discriminating against asian american kids.

we've seen it happen nationally in college admissions. the only state sanctioned form of bigotry in america is anti-asian bigotry. >> dana: the new structural racism is what makes asian american achievement resentment and exposes the false narrative about a racist america where minorities can't succeed. this disdain for asian-americans is amplified by a resentment of moms and dads who believe they should be a say in their kids' educations. so you are doing this investigation there in virginia. the supreme court is also weighing college-based affirmative action admissions. project ahead a little bit for me. maybe next year at this time. do you think things will have

fundamentally changed? >> well, i know there is a huge level of outrage of what is happening in northern virginia particularly. we have a large immigrant population. i'm a child of an immigrant and know that education is the doorway to the american dream. it is tragic at a national level what is happening. and several supreme court cases. asian american students are treated the way jewish american students were treated in the 1920s and 10930s. they would cap how many jewish american students would be enrolled there. that's happening at a national level and we want to make sure it is not happening in virginia. you hear the word equity all the time. equity without excellence is emptiness. it doesn't really help the student at all. it actually i think divides us. so listen, we believe in the quality of opportunity.

migrants from honduras and cuba. there were five unaccompanied children in this group. there was a woman, you can see in the video, that brought her puppy. unclear exactly what will happen to that dog. now let me take you and show you more texas dps video. they say in del rio sector the smuggling is on the increase. most drivers are from out of town. many of the smugglers are armed. this one in kinney county driving a u haul bails, the van crashes at high speed. eight migrants were recovered there. another texas dps video out of neighboring uvalde county. the trucks towing a hauler. 15 migrants recovered and the driver was houston being charged with human smuggling. the mayor of uvalde says it is time for a bipartisan solution. listen here. >> there has to be a solution and neither party wants to sit at the table and do it.

colorado in less than a month. we're live in denver. alicia, what's going on? >> this is just crazy. inglewood is a suburb south of the city of denver. they did testing in restrooms and public places in the public library and found methamphetamine contamination at a level that exceeds safety thresholds for the state. inglewood officials said the test results we received today are troubling and we immediately began working to remediate affected spaces with the goal of reopening the library as soon as possible. >> we've seen an increase in drug use, or heard about it from patrons who might be smelling something in the air when they are in our restroom. we've seen a change in who comes into our library and the clientele around the area. it has started to escalate. >> library shut down and work began on not just the cleanup

but security also. >> we'll have to look at a multi-pronged approach. i don't know of a perfect solution that 100% prevents this. i think increased security, more staff awareness, as well as training for folks in and around the area. >> the whole reason inglewood decided to test for meth was news that the city of boulder's main library tested positive for similar contamination last month. they say certified contractors removed seating along with public computers and laptop. public restrooms are sealed in an airtight environment while extensive cleaning is underway. the library is open now. no open public restrooms. a couple of things. the denver public library is saying it won't do this testing. also the american library association has said so far they believe this is a colorado problem. the big question, dana, as you know is how many of those public
