pancakes like it was nobody's business. she was hungry for everything here. >> dana: you guys will need the sustenance. >> i will have to own that one. >> dana: the three of you are bright lights and look forward to seeing your new show starting monday at 1:00 on fox business. have a great weekend. >> thank you. >> dana: fox news alert top of the hour. three big stories topping the news. we're less than an hour away from finding out whether alec baldwin or any of the three possible co-defendants will be charged in the fatal shooting on the set of his movie rust in new mexico. the secret service now says it is ready to provide the names of people who visited president biden's home in wilmington, delaware if asked by congress after saying there were no visitor logs. the biden administration failing to reach its goal for -- after draining 220 million barrels last year to bring down gas prices. we have more on all those stories throughout the hour.

first our top story del rio once again the hot spot in the migrant crisis. customs and border protection says in less than a week agents in del rio have encountered nearly 7,000 migrants from 79 different countries spotted and lost track of more than 3,000 known gotaways. arrested 13 criminal aliens including three felony sex offenders. blocked 74 cases of smuggling. all that in just six days. now people who live there are just at their wit's end. >> we've seen and hear about increase of criminal behavior at the border. the issue we run into it has increased so much and see how the local law enforcement officers hands are tied because of the resources being exhausted. so it is like the community is already gave up. >> dana: welcome to a new hour of "america's newsroom," good morning. i'm dana perino. >> bill: i'm bill hemmer. good morning. investigators in california

still trying to piece together who is behind a cold blooded murder. the killing of six members of a family including a 16-year-old mother and her 10-month-old baby. police say the execution style murders were likely the result of drug violence. >> i do believe that the cartel is involved. i do believe there is high ranking gang structure involved in this. the reason i believe that is this is not your norm. when you have a 16-year-old young mother killed right alongside her 10-month-old son, shot in the head, these cartels and the drug violence and gang violence is taking the lives of innocent young people. >> dana: we'll talk to the sheriff in a moment. looking forward to that. let's go to griff jenkins in maverick county, texas. folks are saying they no longer feel safe. >> good morning. that's right. this community is feeling very insecure because of this crisis.

it has been going on for now over two years. but we're outside of eagle pass on highway 244 where tragedy struck. you can see how busy this highway is behind me but just behind me is where a migrant just before dawn was running across the road and was hit. we can show you some video we shot exclusively in the early morning hours when i first arrived on the scene. the migrant officials say they found documents on him that indicate he was a 17-year-old from guatemala. no picture i.d. so an investigation is underway. texas dps is in the lead and being conducted with the border patrol officials. but it is just a snapshot of just the tragedy that happens when cartels are smuggling people across. this was an individual not wanting to give himself up and claim asylum. it was an individual trying to hide in the dark and make it to the interior. obviously sadly he will now be

among the statistics. more than a dozen migrant deaths in this del rio sector already. now speaking of juveniles, let me show you some brand-new footage from texas dps, a high-speed pursuit with two jove nile smugglers both out of del rio, three migrants bailing in this incident. now the texas troopers were able to pursue the two juveniles and bring them into custody. it is a clear picture showing the dangers. this is why the officials say do not take your life into the hands of the cartels and try and make this. whether it is the river or obviously a busy highway as we saw here firsthand, this is a dangerous and treacherous journey for migrants to try to make. a sad morning here outside of eagle pass, dana.

>> dana: thank you for your reporting. we want to go to the violent attack in central california where a family of six was murdered execution style including a 16-year-old mother and baby boy. the killers shooting everyone in the head. joining us now is the sheriff. wonderful to have you. admire you for how you are very clear eyed about the problem and you are trying to explain to people what you are seeing there. what is the latest in this case as you have it? >> well, we do have a lot of intelligence and information coming in that hopefully we're able to bring these suspects into justice. some of which we have. i'm not able to share. we do know quite a bit. the newest part that we have is from our surviving witnesses. our survivors of this horrific massacre. we also have people in the community reaching out to us with some intelligence information. those things are positive for us

but what has -- what this has done is put our community in this small migrant farm community in a state of shock and a state of fear. however, they all know this existed. we heard some media reports in other places saying that maybe the cartel is exactly not involved in this and this is just an act of violence. i'm here to tell you that's not true. what we're experiencing is high level gang structure violence who are married to the cartel. the cartel brings the drugs into our area and the gangs distribute them. they are partners. this slaughter of a family, an entire family. this wasn't just the killing of rival gang member or a fellow gang member. this was a slaughter massacre of an entire family. they were targeted and this was a message being sent. >> bill: age 72, age 52, age 49, age 19, age 16, and age ten

months. you said none of it was by accident. can you tell us more about that? >> well, let me explain from my years of experience and many law enforcement we're working with. when they see these stories they shake their head. they are experiencing the same type of thing. when we have a 16-year-old young mother and a 10-month-old child, infant who we know from forensics these suspects stood over the top of them and fired rounds into each of their heads. this is an intentional slaughter and massacre. no one was supposed to be left alive. they went through this house methodically very slowly. they made sure that they were going to kill everyone in that home. when you slaughter, when you shoot a 16-year-old mother in the head and a 10-month-old child in the head, that's a very clear message to everyone that

this was a cartel-style shooting, execution, and these types of things with our unsecure open border, with our soft on crime approach here in california, this is the result of some of that failed policy. >> dana: sheriff, thank you so much for joining us this morning. we'll stay in touch with you and certainly watch your progress there. you are a very clear voice on these issues and we need more of it. thank you so much. >> bill: want to show our viewers what he was talking about with the cartels. the drugs come from china, produced there, put together in southern ports of entry. these locations in texas are really something we've been watching for some time. here is the location, two of them in arizona, one of them being yuma, where we talked with the sheriff last hour. and these are the locations in southern california. one on the left is tijuana. we got from the drug enforcement agency what the u.s. government is saying now with regard to

cartels and gangs and how they infiltrate all of america. five different groups listed here. they are all across the country. just about every city you can imagine. now with regard to the incident here in california, we're looking right around this area where the sheriff is describing this in fresno. it is only, well, you could say only -- you could say it's too much from the border, 350 miles to get up to the town of gosh en, california. if you are watching at home, sorry, stand by here. check out this map. when we received this this morning, dana, i was floored by it. whether it's boston in the northeast or palm beach in the southeast or seattle in the northwest it covers our entire country. this is a problem we need to address it. we haven't done it effectively. when we start is anybody's guess starting on that border and the ports of entry we showed there. back to that story in goshen as we get more details what happened. >> dana: that is shocking.

three virginia counties that delayed notifying some students of their national merit commendation status. fairfax county superintendent michelle reid continued public meetings with parents yesterday. she is saying she understands why parents are angry but dana, for an issue that was initially said to be unique and a product of human error, there seems to be a different message now. >> it was not unique to virginia. this just happens to be we're in the middle of this conversation right now. >> virginia governor glen young quinn is taking action with new legislation to require schools to notify students and parents immediately of awards or scholarship opportunities moving forward. but for some families, it is already too late. >> what i didn't know, martha, was that fall my son had gotten this national merit commended student award. they kept it a secret from me

and he is now a sophomore in college. i'm paying out of state tuition. >> the school districts are promising changes. prince william county school superintendent told fox business last night the district will now designate a person to let students know about their national merit status. these changes come as the state attorney general's investigation is ongoing and wants to know whether discrimination is at the root of this. >> dana: seems like he is right to ask it. thank you. >> bill: we have breaking news out of washington. watch the story on the debt limit. you heard about the headlines and how we'll manage it and how the white house works with a new republican house majority. janet yellen treasury secretary sent a letter to members of congress saying that the debt limit period -- the extraordinary debt limit measures will be enacted starting today. and that they will continue through monday, june 5th.

>> dana: the department of energy announcing a roadblock in just the first month of the biden administration's plan to restore the strategic petroleum reserve. the white house set a deadline to repurchase 3 million barrels in february but the energy department says the biden team is failing to meet its own goals. how could that be? >> turns out the biden administration is coming up short meeting its goals refilling the critical supply to help shield americans from international supply crisis. biden's own energy department says that. after the president withdrew 220 million barrels last year leaving the reserve at a 39-year low you might remember this commitment he made in october.

listen. >> president biden: today i am announcing a plan to refill the strategic petroleum oil reserve in the years ahead at a profit for taxpayers. united states government will purchase oil to refill the strategic petroleum reserve when prices fall to $70 a barrel. >> today that price is still a long way off with wti trading at $79 per barrel. the department of energy says this. doe will only select bids when they're at a price that's a good deal for taxpayers. the department had set a goal of purchasing 3 million barrels in february but already back to those high prices. following the review of the initial sub submission doe won't make any award selections for february. this week the president is blaming republicans. listen. >> president biden: house republicans introduced another

bill under strategic petroleum reserve blocking action that would help lower gasoline prices and help consumers. >> speaker mccarthy insists the legislation fixes the president's own mistakes. >> we also got a bipartisan vote to stop that strategic petroleum reserve for selling our oil that is supposed to be there for a time of emergency off to china and others, 113 democrats joined with us. >> new data from the energy information administration shows another.8 million barrels were withdrawn. the emergency process now is complete. >> dana: thank you. >> religious beliefs line and all of a side the nhl will bass off. the national hockey league today nights -- that is insulting. if the nhl is serious about

this. they say they are. we'll see. >> bill: this went on for some time. a commentator blasting a player after skipping the team's pride night citing his religious faith. it didn't go over well. hello to you. he is saying look, it is against what i believe in and some of these commentators said go back to russia and one even suggested maybe you could join the battle for ukraine. >> that's so over the top. as an islanders fan i hate the flyers for the old-fashioned reasons, not a fan of anything going on in philly. in terms of this event the person i'm mad at is the nhl. nobody asked for this. this player is not saying i don't tolerate gay people. they don't have a right to exist. he is saying i don't want to participate in what feels like a symbolic shallow corporate

the key word is formal. the white house may not keep a log, the secret service does have some sort of database which is no surprise. this is the president of the united states. the service keeps a list of people who have regular access to the wilmington home. if there is a dinner party or some other function there is a guest list. those closest to the president are considered arm's length to the president and vetted more thoroughly than someone at a distance. how long those names stay on the secret service list depends on factors including the person, background check and the proximity to the president. some names stay on for 30 days, others are on for years. the secret service not commenting further but did release this statement to us from chief of communications, while the secret service does generate law enforcement and criminal justice information records for various individuals who may come into contact with secret service projected sites we can't comment further. when biden left the vice

presidentsy he received secret service protection for six months. ? july of 2017 he was on his own. it's possible the documents are there until he received secret service protection again in march 2020 when he became a presidential candidate and a secret service protectee. any secret service information wouldn't come overnight. they are no longer part of the department of treasury. you can imagine the general counsel of homeland security would get involved. sources say the secret service has a listing of people who came to wilmington and will provide it to congress when officially asked. at this point we're told congress has not made that official ask just yet. that could change any minute. >> dana: i can imagine that's coming. david spunt. thank you. >> president biden satisfied with the current sop of handling

classified materials here and turning them over to national archives? >> i'll refer you to the white house counsel's office. the people would be aible to answer that question about classified information. >> from this point out are you not going to be taking questions about the classified documents? >> i've been very clear we'll be prudent here. >> bill: more stonewalling from the white house there during yesterday' briefing. not a lot of answers given there. she referred the questions to d.o.j. and the white house counsel more than 20 times. david spunt reported on that a moment ago. what have we learned and where are we going? great conversation, karl rove and andy mccarthy join me. you both wrote a piece. you said biden and the justice department's grossly negligent mishandling of classified documents reads 4 1/2 pages and you conclude by saying what a mess. what's the point you are trying to make, andy?

>> well, they knowingly -- this is both the biden people and the justice department together apparently before the additional searches after the first batch of documents was found, before the additional searches were done, thought was given to having the f.b.i. accompany biden's private aides to do the additional searches. that absolutely had to be done at that point because even thief i think it's reasonable for the justice department not to have proceeded by getting a search warrant, they had a grounds for one. highly likely they would find more documents. so you have to at that point for the purposes of preserving evidence and for national security have the f.b.i. collect the documents. i think it's grossly negligent on their part obviously so, not to have done that, which is ironic to say the least because the crime that's under investigation is whether classified documents were handled with gross negligence. it seems that was done not only

by biden people but by the justice department. >> bill: the wilmington home primarily. back in washington on capitol hill you have the penn biden center. i was not aware of this before. apparently it's around the corner from our bureau. were you aware of it? with regard to foreign donations what questions would you have there? >> well, my ears pricked up when i heard this from the university of pennsylvania which is the sponsoring organization for the penn biden center. the penn biden center never solicited or received any gifts from any chinese or other foreign entity. funds to support the center came from university funds. now, this dodges the question. the question is not did the penn biden center solicit money from child yeah. of the 54.6 million that came from chinese individuals or entities between 2014 and 2019, was any of that money used to

support the penn biden center from university funds? the reason i'm suspicious about this is go to the penn biden center website and down towards the bottom of the landing page you will see a photograph of president biden, former vice president biden, at the formal dedication of the center in february of 2018. standing next to him formally dedicating it with giant pairs of scissors are the president of the university and the chairman of the board of trustees. what happens when president biden comes into office? appointed to be the ambassador to germany and canada respectively. a center that has no real purpose except to support him and give opportunities for university of pennsylvania students to come to washington and come into contact with him. it provides him a salary of nearly a million dollars as professor who never teaches a class and where did the money come from in it's not enough to say he didn't solicit it.

the question is did you use the chinese monies in any way, shape or form to support him and what documents are there at the university of pennsylvania and what kind of people were involved in that decision making? at least two of them, the chairman of the board of trustees and the university president who played a big role in allowing the center to be created have been rewarded with really plum ambassadorships. >> bill: you both raise very interesting points. i don't know how you get answers to what you are saying. i think republicans in the house will certainly have hearings. they did campaign on it during the mid-terms. perhaps that's where we get a little more of what you are talking about today. andy, thank you. >> may i make one quick point? i think andy put his finger on it. somebody needs to go after the department of justice. why did you not have the f.b.i. conduct these searches? why did you allow people connected with biden who have no national security clearances to conduct the searches? it's a key point. the d.o.j. ought to be asked

>> dana: a couple of close calls in recent days at jfk airport. video shows a jetblue plane running into a parked aircraft on the tarmac yesterday. no injuries reported thankfully. but the incident comes less than a week after a near miss was reported on a nearby runway when a delta plane nearly collided with an american airlines plane during take-off.

how do the incidents happen? let's bring in a former faa official. a week after the disas tress computer problems at faa. >> it hasn't been a great week for aviation considering with southwest and all the cancellations that went on. you have a couple of issues. the air side part of an airport, runways, taxi ways and gates is the most dangerous area of an airport. you have so many vehicles moving around. aircraft moving around and here where you had the jetblue aircraft normally you have two wing walkers kind of watching so when they are backing the aircraft out nothing touches. i'm not sure what happened. maybe somebody wasn't paying attention, maybe the tug took a sharp turn when he wasn't supposed to. it doesn't happen very often but unfortunately these aircraft aren't made for bumper cars. any time they come in contact

with anything you need to pull them back in and go through a pretty serious safety check to make sure nothing has been damaged. >> dana: we were bound to have some problems or growing pains out of covid after so much air travel had been abated during that time. now there is more air travel than ever and people want to vacation and work and family to see. are we experiencing -- expected to experience some more of these hiccups until things settle in? >> you know, i don't think so, dana. you have these systems set up that have been working very well for a long time and -- but at the end of the day you still have humans operating aircraft and you are going to have errors. with the aircraft that stumbled onto the runway. there are so many technologies, so many warning signs out there to prevent that from happening and yet when a pilot loses kind of spatial orientation understanding where they really

death of another. in new mexico it is minimally charged as a fourth degree felony. it could be higher depending on the circumstances. with the fourth degree felony you look at up to 18 months in jail. >> bill: could you get probation under that and no do any jail time if you were to play out that scenario? >> yeah, bill, i doubt -- if all three of these folks are charged with negligent homicide. you can have more than one person causing a crime just so your viewers know that. it is not just one person. there could be several people that cause the crime and why the all three should be charged with that crime. i doubt that you will get probation. now, with the other charge that dana mentioned, the negligent use of a deadly weapon, that is categorized as a misdemeanor, if that charge comes up that's something that will likely yield probation. but not with the negligent

homicide. i think there would have to be some jail time. >> bill: he told stephanopoulos in the interview on arcs bc i've been told by people in the know and inside the state that it is highly unlikely i would be charged with anything criminally. that's from baldwin. it doesn't mean he is exonerated. the arm orer was anna gutierrez reed. she was saying she wasn't called inside the church at the time. would that allow her to escape culpability? >> bill, good point about what baldwin told stephanopoulos. look, he is the captain of the ship, right? he will be charged because he is the producer of the rust production as well. so remember you had a day or two prior to that with some people walk out on the set. you also had 1 or 2 occasions in which there wasn't inadvertent discharge of ammunition on set and why baldwin will be charged
