>> hannity: all right. new mexico prosecutors, they announced today that alec baldwin will be charged with two counts of involuntary manslaughter in the 2021 fatal film set shooting that killed a cinemaing tofer and injured another person. the first assistant director will plead no contest for negligent use of a deadly

weapon. now because baldwin's second charge includes a firearm enhancement, he could face a five-year mandatory sentence if he's found guilty. now baldwin's legal team responded in a statement, in part, quote, mr. baldwin had no reason to believe there was a live bullet in the gun or anywhere on the movie set. he relied on the professional with whom he worked, who assured him the gun did not have live rounds. we'll fight these charges and we'll win. while baldwin claimed he never pulled the trigger of the gun that claim was reportedly refuted by the f.b.i. now, look, i'm going to be very honest about this, i don't like alec baldwin. i don't know anybody that does. he's an awful person. everybody knows it. i've had my own personal fights with this idiot on twitter, on radio. we've shown you video of his violent, vicious temper tantrums especially with the media. we've played his hateful voice messages to his young daughter at the time.

excellent job covering and investigating this. there is no reason under any circumstance that a live round should be on an active movie set for any reason whatsoever and there are protocols in place to make sure that doesn't happen. as far as he saying he didn't fire weapon, we all know that in order to discharge a weapon, one in good working condition, you know, there are different mechanisms in place, one of which is the mechanism of the trick their has to be pressed. >> jamie: i know our friend judge interviewed the prosecutors. you worked with them. how strong would you assess the case that they have? how strong is this case? >> i don't think they have a strong case at all. this case belongs in civil court, where as the producer, if they feel like he was negligent he should pay money damages but it's completely different to say you've got proof beyond and to the exclusion of every reasonable doubt, the highest burden under the law in criminal court to say this goes from a tragic accident to a criminal

justice for the victims by doing an injustice against alec baldwin. i think this is an injustice. keep it in civil court where he has to pay money damages. >> hannity: what makes you think a judge will declare this interview with george stephanopoulos, his comments off limits to the jury? i'm not so sure the judge won't allow that? >> well, personally, there are a lot of factors at play here, and one of the main factors at play here is the beauty of him as -- duty of him as producer and an actor. you get behind the wheel of a vehicle you take responsibility for safety. he by his own admission multiple times said he was an experienced actor handling firearms. as an actor handling firearms and someone who knows exactly what to do and not do on a set he understood the protocol, realized the protocol was not in place and continued on anyway. that's, again, aside and

couldn't do my job without taking it, i was in the age group, there was a little -- these people in the military, they were not a high-risk population and it was forced upon them. they did not get the opportunity to make that decision for themselves. so i think that we'll find out that there are some significant side effects from this long term, and we won't know that for a while, and there has been somewhat of an effort to keep that covered up in my mind because there is a lot of money to be made in this to be honest with you. >> hannity: let me ask you this question. i had on radio and tv a guy by the name of dr. robert malone. dr. robert malone came up with the technology that allowed for the production of the mrna virus -- vaccine, rather. when i interviewed him he was very clear. he said this is not perfected science yet. and he created this. there wouldn't be the pfizer or moderna vaccines without this guy but he said, with that said, he thought it was a wise thing to do, to use for people with preexisting conditions,

co-morbidities and people 65 and older only. not everybody else. and he was brutalized by the media mob. the guy that created the technology that allowed it to even be made. my question is, why were people like him demonized? >> well, sean, everything you just said, they wouldn't be eligible to be in the military to begin with. on that original topic of people in the military being kicked out for refusing to take this vaccine, real irony is right in front of us. why was this person being demonized? because this was partisan and political from the absolute start. here's where we really need to focus on this story about more than 8,000 service members being kicked out of the military, now invited back in. you know, normally i expect politicians, and i don't mean this toward congressman jackson, he absolutely served his country honorably and i think he's doing a good job in d.c. but usually it's a politician that screws over our troops on the grounds. normally we expect that. it's the four-star generals and
