families crossing the border to buy eggs and not just eggs but filling up on gas and basically seeing what groceries they can get on the other side. it is a shame to have to go to another country to buy essential items such as eggs. and fill your tank with gas. many other items. >> todd: do you know with fellow small business owners are selling or using what i will call contraband eggs? >> you know, i've heard of taco shops that may have family members on the other side of the border bringing eggs over for them. they are struggling. they are struggling, dealing not only with eggs but every item has soared through the roof. so they are finding ways to save and a $300 fine with potentially

$500,000 worth of savings, they have to weigh the risk. i believe the fine can get up to $10,000 but i think that is if you are dealing with larger amounts. >> carley: a lot of eggs. you are absolutely right in federal law brought eggs and poultry across the board border which is why the fine can be so high. moving from eggs to inflation if you are a small business owner, how is this impacting your business? what is going on right now? >> it's been difficult. we see the customers on a daily basis. it is telling us how difficult it is. they note that we are not the culprits. they understand it is nationwide, but it is a struggle. it is a struggle in american families in a struggle across the board. frankly, i don't see it ending anytime soon. i'm being told by vendors that prices will continue to rise all across the board, especially on items such as poultry and wheat,

bread, corn, obviously fresh tortillas. that is a big issue. so, it is across the board. i don't see an end in sight. i've been in business working since i was 11 years old. my dad had a grocery store and taught me at a young age. so i'm pretty experienced at a young age to see that there is definitely no end in sight. if anything, i think it is only getting worse. so to bring this back to eggs for a moment and i know we are having a little fun with this but anthony the last time i went to the store no joke, for . that is for figures if you include the decimal point here that will go higher into 2023? >> so eggs typically are the cheapest in january and february. obviously with easter coming around in april, we will see

march /april is typically the highest. so i don't think this is, you know, short term. >> carley: that is so true. >> after easter mike and see the parts of coming down but the other issue is people can't store them, they can't save them. it is harder. you can freeze them for a little bit, but it's not ideal. >> carley: anthony, i wonder why you broke quickly before i let you go, why are eggs cheaper in mexico? >> you know, obviously minimum wage is a lot cheaper and employees make $10 a week. so obviously, some of the big issues here, over $16 in california. and so you deal with high fuel cost and high labor prices and maybe not having employees speak with some of the vendors here they say, you know, we don't have employees to get these eggs packed.

♪ ♪ >> carley: alec baldwin facing criminal charges for the shooting death of cinematographer halyna hutchins on the "rust" movie said. the d.a. set to charge him with two counts of involuntary manslaughter. >> todd: brooke singman with the details, but. >> that is right, carley and todd. if charge, six and a half years behind bars. new mexico district attorney said this in her decision, "after a thorough review of the evidence in the state of mexico, we determine there is sufficient evidence to file criminal charges against alec baldwin and other members of the "rust" film crew. in my watch, no one is above the law and everyone deserves justice." baldwin pointed his popgun against halyna hutchins and striking her in the chest and raising another crew member and the shoulder.

according to the affidavit, leslie told by crewmembers the revolver was not loaded. baldwin repeatedly claimed he did not pull the trigger. listen. >> it was not in the script for the trigger to be pulled. >> i didn't pull the trigger. >> you never pulled the trigger. >> no, no, no, i would never pull the trigger. that is the training i had. i feel that someone is responsible for what happened, and i can't say who it is, but i know it's not me. >> the dimmick baldwin directly contradicted forensic analysis. the prosecutor say he is completely responsible for hutchins tragic death. >> we definitely believe he pulled the trigger. the fbi lab report confirms that, so definitely the trigger was pulled. >> mr. baldwin had a duty at the base level to never hold a gun and pull at a person well winning a trigger.

but he headed duty as an actor on the set to check himself to make sure they were not live. >> the professional armor tells fox news there is no reason they should ever have happened. >> there is no reason under any circumstance that should be on the movie set whatsoever. there was protocols in place to make sure that it doesn't happen. as far as saying he didn't fire the weapon, we all know that in order to discharge a weapon, one in working condition, there are different mechanisms in place and the mechanism of the trigger. >> blaming the crew member who allegedly assured him the gun was not loaded. they say "a decision for halyna hutchins tragic death with a terrible miscarriage of justice" he had no reason to believe that there was anything anywhere on the movie set. she relied on professionals to

assure that the gun did not have live rounds. alec baldwin and the films set to be formally charged with two counts of involuntary manslaughter each by the end of march. guys. >> todd: broke, "the five" judge puro said he did not pull the trigger he's his own enemy. >> the height of arrogance and he did himself did no favor alec baldwin by saying i'm not responsible. this is not my fault or whoever's fault it is. look, you took a gun, a loaded gun and you pointed it, you pulled the trigger and a woman died, mother of a child died. and it creates an inconsistent statement that he will take a plea and try to get out of this as clean and quickly as he can. but understand he's facing six and a half years. not just 18 months for involuntary manslaughter, but there is a gun charge attached to that peer of the jury has the option of going for either or

both. if they do, he faces six and a half years. he's got a lot on the line here. these are prosecutors who are not focused on any of that pier they are focused on the evidence. they know they have the evidence. they know they have the goods and they can convict him here they are ready to do so. we will see. if he wants a plea, he should play. >> todd: the defense attorney, thank you for being here and let's jump off of the point of judge jen needs comments come at the inconsistent statement point. alec baldwin do you think have said specifically in tv interviews too much? speak with the one thing defense attorneys will tell you, we don't want our clients talking to the media or any kind of news whether media or law enforcement while the case is being reviewed by a d.a.'s office. and alec baldwin did that. it would have been better had he not at this point. you can't undo the damage. he already spoken, his words are out there and preferably, it

would be better if he hadn't said some of the things he said including saying he never pulled that trigger because someone must have pulled that trigger maybe it was done accidentally and he doesn't realize he pulled it, but we know that the gun would not have shot without someone actually pulling the trigger. >> todd: let's go back to the beginning. a lot of legal experts surprised when they decided to charge alec baldwin. are you surprised? >> i was surprised and i wasn't expecting this and i don't expect alec baldwin to be charged. i was expecting others including the armor and assistant director to be charged because at the end of the day, ultimately, it was their job, it was their responsibility to make sure this gun was pulled. it is the armor's job to maintain all the weapons, to make sure they are not loaded appeared to make sure there is no live ammunition on the set

and the assistant director before he handed the gun to alec baldwin, he told them it was a cold gun. so one with thought he would have checked and he should have checked it. so yes, they were two individuals that should have checked it. why would alec baldwin have thought these two individuals, not just one, but two individuals had not done their job? he is the actor. it does not his job to check the gun. what reason did he have not to rely on the word of his assistant director or the professional who was in charge of all of these guns and the safety and security on the set? >> todd: the prosecution will obviously say, open will well, it is because of the executive producer hat he was wa higher burden or standard of care i should say to the indivil but that is what this case will be about. focusing on the standard of proof for the charge of involuntary manslaughter as it

does relate to new mexico law, it is more than negligence. that is kind of the standard throughout the 50 states. how strong do you think the prosecution's case is? >> i don't think it's that strong. obviously, i stated what i think should happen in this case. i think this is a case that should state in civil courts and be dealt with there. i don't think this amounts to criminal liability. again, my position and he's not the only producer there but there is others in both. of course, he's being filed on because he was wearing the executive producer hat. well, then there is another of other individuals they could file alone. in reality the reason he's being filed on, he was the last person who could have possibly prevented this tragedy by checking that gun and he pulled the trigger. and, he's being made an example out of here they are making a decision to the industry to get their act together and to ensure

something like this will never ever happen again. so, speaking about the law and the charges involved, you've got involuntary manslaughter. there is two different theories to establish involuntary manslaughter in new mexico. they both require criminal negligence. the first one which involves the unlawful act that doesn't amount to a felony has a lower standard of criminal negligence on the lower level. but the second one, the second way of establishing involuntary manslaughter is that the manslaughter was committed in the commission of a lawful act. >> todd: right. that is where the questions will come in. >> you know that is where the case will be. >> todd: i think it will get settled and they will plea but we will see. lara, really great points come appreciate it.

business owners like you. greg you are a busy guy and you have a bunch of restaurants and construction companies and those two industries i think of inflation and interest rates but how have things been going? >> inflation is through the roof and we certainly see that in the cost of diesel fuel and that hits hard with her filling up a dump truck or a bulldozer or filling up a tour bus coming out of nashville to play on the weekend. so that certainly hits hard. then interest rates, you look at interest rates for equipment within the up everyday operatios with the business boom that sounds fake to me. each one of those business owners, most of them will need a credit line and that credit line is not going to be cheap and that will be money out of the pockets every single day. small business it is tough to begin with but a challenging time to be starting a business

and what these people will be facing and it's really going to be difficult. i certainly hope a lot of them survived but it is going to be very, very difficult and they have to work much harder than they already have two. >> carley: john, really quickly, to greg's point, reporting that small business confidence slipped to six month low in december even went tweeting about a business boom. what are the future and are you hopeful for it? >> that is just because of me personally. i'm not someone who's going to lay down and quick and timescale order. that is what we are going to do and that's how we operate, and we hope this business during the pandemic and we will survive the stupid gas prices and ridiculously high inflation and we will overcome because we are americans. >> carley: amen to that. you make this country go around. we thank you for what you do.
