zone in the woods. police say they were clearing out the encampment when one of the protestors opened fire hitting one of the troopers. officers returned fire shooting and killing that protestor. >> the group was there protesting the construction of a new police training facility. officials say opponents of that project have repeatedly turned to violence. >> over the last several months, law enforcement and portions of our community have experienced growing criminal behavior and terroristic acts committed by individuals and groups for the building of the new atlanta public training safety center. they have attempted to disguise their activities as being protests against the building of this facility. the law enforcement can't stand by while serious criminal acts are being committed that jeopardize the safety of the citizens we're sworn to protect. >> dana: we go to jonathan serrie in atlanta. >> bill: social media posts calling for violence have been

banned. protestors continue to question official accounts of what led to the death of one of the demonstrators. investigators say 26-year-old man died in gunfire exchange with police officers who were removing protestors camping on an 85 acre site slated for construction of a public safety training center for the city of atlanta. >> an individual, without warning, shot a georgia state patrol trooper. other law enforcement personnel returned fire and evacuated the trooper to a safe area. >> suffering a wound the trooper went emergency surgery and in stable condition. seven protestors, all from out of state, have been charged with domestic terrorism and criminal trespass. three additional demonstrators who cooperated peacefully were allowed to leave the site without arrest. governor brian kemp issued a statement saying as we have always done the state respects

peaceful protests. as i have also always said, acts of violence intimidation, destruction and terrorism will not be tolerated in georgia. some of the groups and individuals trying to block the public safety training center say they're concerned about the project's impact on the environment while others oppose the increased presence of law enforcement they say it would bring to the area. >> i do think the world is at a turning point where people recognize that cops are not there to help them. >> but supporters say the center will improve training for law enforcement and other first responders which they say ultimately makes the community safer. dana and bill, back to you. >> dana: jonathan serrie in atlanta. >> bill: another shooting. evansville, indiana. a gunman opened fire at a wal-mart. police quick to respond. they chased the suspect throughout the store exchanging gunfire and then eventually

killing him. >> we have been trained that if there is an active threat we go in, we don't pause or try to figure out what's going on. we go where the shots are being fired. >> no word on the victim's condition and shooter's identify. we'll bring you details as we get them today. >> mr. baldwin had a duty at the base level to never hold a gun and point it at a person while pulling the trigger. he also had a duty as an actor and producer on that set, to have the bullets checked or to check them himself to make sure they weren't live. and he had a duty to make sure that the set was a safe set and we know from multiple accounts it was not a safe set. >> dana: the district attorney explaining her decision to charge alec baldwin. it was a movie set shooting that

killed halyna hutchins. both are vowing to fight the charges. >> the special prosecutors wrote in the decision to charge baldwin it showed a pattern of criminal disregard for safety on the "rust" film and there is no room in new mexico for film sets that do not take new mexico's commitment to gun safety and public safety seriously. here is the new mexico d.a. and special prosecutor. >> we believe baldwin as a producer knows everything that goes on in the set. so there was a lot of problems. there was a lot of -- a couple accidental discharges. there was a lot of safety concerns that were brought to the attention of management and he did nothing about it. >> that special prosecutor also telling fox news that baldwin did pull the trigger on the gun he fired. a claim he strongly denies. the new mexico d.a. says baldwin faces up to 6 1/2 years in prison if he is convicted by a

jury. baldwin's attorney responded writing in part, quote, this decision distorts halyna hutchins' death and represents a terrible miscarriage of justice. mr. baldwin had no reason to believe there was a live bullet in the gun or anywhere on the movie set and are he lied on the professionals whom he worked that assured him the gun did not have live rounds. the armorer faces the same prison time. her attorney telling fox news hannah is and has been very emotional and sad about this tragic accident but she did not commit involuntary manslaughter. hutch-in's family -- baldwin agreed to turn over his cell phones but records were missing. not clear if that was intentional. >> dana: we'll have much more on this case at the top of the hour next hour with criminal defense

day. now as you watch, these migrants going back into mexico under title 42 expulsions lets he go to the drone a quarter mile away. you can see a group of 25 of mostly columbians and venezuelans, i was talking to them. what you have here, bill, is utterly a revolving door. many come, half go back. all day long non-stop. that's why it has been a fire hose of activity. let me show you video we shot just a few hours ago before dawn. this large group is about 70, 71 migrants from cuba, columbia, dominican republic. i talked to them and asked them if they feared the cartel and asking them how much they paid. some paying, $1 thousand, $2 thousand to cross the river. it is a snapshot of why these agents are so exhausted after two years of this every single day. and the human smuggling you mentioned absolutely on the

rise. let's take a look at this video overnight that our fox cameras captured embedded with the texas dps and the span of six hours we saw the dps stop three different smuggling operations. one driver was from houston, another from mexico. apprehended and charged with human smuggling. more than a dozen migrants were recovered. that's why agents are saying now at this point if indeed secretary mayokas were impeached well, the border patrol council union vice president says maybe that would help things. here is what he had to say. take a listen. >> if at the very least puts a bigger spotlight on what's happening and get some of the resources here and maybe gets border patrol agents out of the asylum business and putting us back in the field we're all for it. what will be the result of it in the end? >> the result they hope for, bill, is a change in policies to stop the mass release, catch and release policies and also to get

>> dana: get this. the supreme court still doesn't know who leaked a draft opinion overturning abortion rights. the court released a report yesterday eight months into the probe saying investigators held 126 interviews with 97 employees. they also reviewed court issued laptops and cell phones. "politico" published a draft opinion last may. protests across the country and concerns about security for justices. one man was arrested outside justice kavanaugh's home and charged with attempted murder. >> bill: the mystery continues. f.b.i. offering a $25,000 reward for any information about a series of attacks on

enforcement. these positions are political appointments. if you want to be a successful commissioner and chief you have to have the frank reagan approach. you have the respect of the rank and file while still being able to maneuver in these political positions. ortiz behind the scenes, he will go to bat for his agents on the ground but publicly he won't do anything to support them. so he was in a tough spot. i know ortiz. he has talked about the problems he has had with this administration. at the end of the day, mayokas and biden are his bosses. he would do what they said. he was fighting for his agents behind the scenes. what his rank and file wanted to see this public gesture saying, if you go after my people you go after me and i'll walk off this job before i let you prosecute four of my agents on the ground. he didn't do that publicly. >> dana: let's read some of the emails he sent just released. call for number one.

he said there are great efforts occurring and we aren't highlighting any of them. every day we're providing lifesaving efforts to migrants under the bridge. agents are being assaulted and we aren't saying a word. haitians are escaping and trying to overrun drivers and we stay quiet. agents and staff are working 14 hour days in difficult conditions, nothing said. we have to change the narrative or these stories will be the only stories. he is right. that has been the case. >> expect more documents and comments to come out of ortiz office. he realizes he has the political will with everybody talking about the border and biden visiting the border and i think he is tired of being beat up about this issue. i think there will be more leaks about what is going on at the border. people should ask themselves where does fox news get information? someone with inside of the administration that is saying the border is a crisis. i think that's what we're seeing

re-election bid. white house aides say the classified document scandal will have no impact on his decision and the announcement won't come until after the state of the union address february 7th. let's bring in axios political correspondent. josh, it makes sense to not announce until after the state of the union? >> it does. when you are president you want to focus on governing and the economy. you don't want to be in politics mode right away. especially since the republican field of possible 2024 presidential candidates is taking its time to develop. we have president trump in the mix. no one really else is getting in right now. so there is no rush for biden to get into politics mode. especially with the whole scandal involving these classified documents. i think it would be smart politically for the white house to take their time and wait for any kind of political re-election campaign.

if you look at the average of polls by real clear politics, biden's job approval rating is about two points lower than where trump's was before the 2020 presidential election. so the notion that biden is in strong political shape. that has hurt his political standing. but i think the bet from the white house at the same time is that they think republicans are going to overreach and they think that they can paint the republicans in an extreme corner and they are hoping that this scandal will blow away with the passage of time. >> dana: so we have the state of the union coming up. his re-election announcement coming at some point after the state of the union. in the meantime you have republicans thinking about it and exploring the opportunity. nikki haley with bret baier last night. >> when you look at a run for president you first look at does the current situation push for new leadership? the second question is am i that person that could be that new leader? yes, we need to go in a new

direction. can i be that leader? yeah? >> do i think i could be that leader? yes. we'll work through things and figure it out. i never lost a race. i won't lose now but stay tuned. >> dana: we're staying tuned. what are you watching as she comes on the scene? >> it sounds like she is running from the interview she gave with bret baier. we'll wait and see. she is someone who as she said never lost a race. she won her first campaign in south carolina coming from behind as an underdog. she would start out as an underdog if she gets into the presidential campaign. she is someone who -- she is an optimist and someone focusing on the governing record in south carolina for two terms as governor. the mood of the republican party lately has been confrontational. they like trump because he is a

>> dana: five inmates are on the run after escaping from a missouri detention center. surveillance cameras caught them breaking out and now an intense manhunt is underway. authorities say three of those who busted loose are known sex offenders. senior correspondent casey stiegel is live in dallas with the latest. >> the u.s. marshal service joined the investigation encouraging people to call 911 with information and not to approach the suspects. they are dangerous. this all happened tuesday night in farmington, missouri. 75 miles southwest of st. louis. they gained access to the roof through the plumbing and ventilation system and able to

turn. what is your assessment of that request? >> thanks for having me today. appreciate it. i'm here because of the association, an ngo allowed me to come over and look at ukraine. when we developed the systems to defeat the soviet army years ago the bradley fighting vehicle system was part of that. we'll give them to ukraine. with paladin -- motorized paladin 155 system was part of that. the abrams tank was part of that. designed to fight in combined arms warfare together. fool irk not to give them the abrams tank. it is capable of beating any russian tank out there today in the field. so give them the entire capability to defeat the russian

army here in ukraine plus give them the combined arms training and what i would do is add on top of that give them the a-ten wart hog air to ground anti-arm or system. train them in combined arms warfare. have president biden call putin our job is to help ukraine defeat the russian army in ukraine, not march on moscow. when that's done our job is complete. he hasn't done that. years ago when we developed the systems we called it the assault breaker program to have all the systems fight in combination. you don't fight infantry without armor. the bradley and abrams are hand in glove. they should go together. the senior leadership in the military know that. austin and milley know that and advise the president and give it to them and let them lead the fight. >> bill: it seems like a matter of time. it has been an argument and debate and eventually granted.

the pentagon is operating that the abrams tanks operate on jet fuel that make it more difficult. the latest contribution is not insignificant. eight air defense systems. 60 bradley infantry fighting vehicles. 90 striker apc. mine resistant vehicles aened on and on it goes. it is a lot. you have been there for a week and spend another week there. what is your evaluation of where the war is today? what have you learned? >> i think what i've learned is this. i've been able to talk to a lot of people and seen places. sur real. you go where the war hasn't affected anybody and this morning we're in the spear point of the russian invasion and talking to people there and military as well. if i had to look at it this way a simple answer. the ukrainian military is on a trajectory and winning the fight

in the field. the russian army is flat. they have lost their best systems and units. their best units are mauled. i think the ukrainians have an ability now to win this fight in spring. i do believe there will be a culmination period. that period is the springtime. both will try to win the fight. this fight won't go on for 5 or 10 years. it should be decided as long as we support ukraine to the best of our ability i think they can bring the fight to a culmination. to me it's defined as ejecting the russian army from the field in ukraine and regaining all their territory. we're in a proxy war. we're part of this fight whether we like it or not. whether we talk about it or not. nato, the united states is part of this war. we should admit it. not with u.s. forces on the ground but proxy and equipment and go for the endgame. >> bill: general kellogg live in ukraine. thanks for your observation today. >> thanks, bill.
