will:ing straight to a fox news alert. ten people are dead and at least ten hurt after a mass shooting near los angeles late last night. the suspect fled the scene and is still at large. pete: alexandria hoff is live in washington, d.c. with the latest. >> reporter: good morning. all we mow at this point is investigators believe the shooter is a man. we're expecting an update in a short time on the status of the search for him. the deadly incident happened around 10:30 local time in

monterey park just a couple miles east of los angeles, sharing the same county. thousands had been gathered for a lunar new year event. los angeles county sheriff's department confirming that ten victims have been pronounced dead at the scene, ten more injured with their conditions ranging from stable to critical. >> when officers a arrived on scene, they observed numerous individuals, patrons pouring out of the location. screaming. the suspect fled the scene and remains outstanding. anyone with information regarding this incident, we're asking them to call l.a. sheriff's homicide. >> reporter: when it comes to the location, authorities gave the address of a monterey park ballroom dance studio. the shooting happened inside of the busy club. monterey park is home to a large asian population. nothing more though has been provided in terms of a possible motive or suspect description. or we are expecting to hear more

many a press conference in about two hours. will, rachel, pete? rachel: thank you. will: to another fox news alert, six more items are found at president joe biden's home many wilmington, delaware. rachel: the documents discovered in an all-day search nearly two weeks after we first learned about classified material found at the penn biden center. pete: brooke broke the story last night on fox news digital, and she joins us now. >> reporter: good morning, even more classified documents found in president biden's wilmington, delaware, home during a nearly 13-hour fbi search. biden's personal attorney revealing in a statement that the doj took the possession of materials it deemed within the scope of its inquiry including six items with classification markings. bauer says those records date back to biden's time in the senate and as vice president, but he did not say exactly how many classified documents were

found. fbi agents began their search at i 9:45 on friday morning before wrapping up around 10:30 at might. white house officials and members of president biden's personal legal team were present for that search. now, at this point it is unclear if biden offered to allow the search or if the doj asked and he consented to it. his attorney confirming that agents looks thoroughly through working, living and storage spaces in the home. now, all after classified materials dating back to biden's time as vice president were first discovered at the penn biden center last fall. that happened are less than a week before the midterms, but that discovery was only made public last week. attorney general merrick garland assigned a u.s. attorney to conduct a review of the documents beginning in november, but in december biden's lawyers found more documents at his home in delaware. news broke of the discovery being found on january 9th before another document was found two days later. the discovery prompting garland to appoint a special counsel,

former u.s. attorney robert hur, to investigate the matter. and last weekend the white house announced even more classified documents were found while biden was at the wilmington property. as federal authorities continue to investigate the president's handling of hose classified -- those classified records, joe and hunter have made history, under investigation at the same time. will, rachel, pete. pete: wow, that's history. brooke, is it your sense this is like the final, final, final search? were they flagged that there might be more, why this additional 12 hours? >> reporter: i think it's unclear at this point. the fbi did conduct that search, the justice department was there, members of the fbi, the president's personal legal team the, the white house counsel's team as well. i mean, if they find more documents, i think that would come from a formal search, but at this point this is what we mow. will: brooke, thank you for that report. rachel: thank you, brooke. will: we're going to talk about it more throughout the morning, that that joe biden visited the crime scene in between searches

and during the investigation. rachel: and, will, he was also at the crime scene because, remember, they found out before the midterms, but they never told us. presumably, i assume that the bidens knew, and and they've spent time inside the crime scene during that time as well. pete: let's bring in someone who can give us some answers, "fox news sunday" anchor and chief legal correspondent shannon bream. let's start with that legal angle, shannon. good morning. joe biden's legal team was present for this latest search, but trump's legal team was not allowed on the premises as they rummaged lu mar-a-lago. can you help us with the rationalization as to why that might be the case? >> just a little bit of a clarification, this was negotiated in advance for the biden team. so this is the statement from his personal attorney. by agreement with doj, representatives of both the personal legal team and the white house counsel office were present. so they had already talked about in advance. difference will down in

mar-a-lago is the former president didn't know they were coming. his attorneys were on site quickly, they demanded to see the search warrant, but this was not negotiated in advance. now, biden's supporters and the white house, they're going to continue to say it's because we're cooperating, and we invited or offered them access to come over. obviously, the conversations that have been going on leading up to the raid on mar-a-lago had gone much more differently. but that that's where the perception problem comes in percent doj. the "wall street journal" said there had been conversations previously, should the fbi, should doj come help search the premises. both sides agreed, no, we're going to let the biden legal team handle it. there's also, this conversation in "the washington post" says the biden white house wanted to keep quiet, they were hoping it would be blown over, they would announce it after it was done and justice gave them the all clear. that begs a lot of questions about why they were able to keep this quiet, why he were able to

negotiate who would be there. it's going to make critics say it's not as transparent as he claimed it would be. will: no. and, shannon, it's hard to buy the rationale to describe the distinction from the doj because one of the arguments made during the mar-a-lago raid was various members of the trump administration had access to the documents and might have moved documents. and there was this video, supposedly, video surveillance of potential compromise to the documents which led, this is what we were told, to the raid. but i have a timeline from november to january with people including the president of the united states himself in the same location as these documents, so i have trouble understanding what was negotiated. was it that joe biden wouldn't go in the garage? was it joe biden wouldn't go into his personal library? it seems to me the exact same rationale for a raid was present here with joe biden. >> yeah. and our peter doocy a couple weeks ago said his question when

he got passed other at the white house was should the first lady and the president be going back to wilmington, is it not potentially a, quote, crime scene, and he was ripped for saying that that. but now we know there have been additional discover of documents so, again, it's that perception problem for the doj. this is a headache for the white house but also for her you can garland who's going -- merrick garland who's going to have to answer questions about why they were allowed to come and go. it's interesting, we don't know exactly what they got time, you guys have pointed out the wording of the statement is very interesting because it says they found six items consisting of documents with classification markings and surrounding material. so was that a box? was it an envelope somewhat exactly have they taken? every time the white house has said this is the wrapped up, we're cooperating, new stuff shows up, and there's this fight over artificial logs for who had access, who was in that house. although fox news is told that secret service is prepared to turn over information about

somewhat keeping track of visitors who have been will, but congress is going to have to ask for it. rachel: yeah. hunter biden definitely had access to that white house, and we know a really shadety figure. you think about the fbi going into mar-a-lago not just searching in the room with the document, but rifling through melania trump's stuff and barron trump. barron trump, hunter biden, i'm more concerned about hunter, by far. [laughter] so very interesting stuff. want to move to another topic because you are our network expert on the supreme court, and there's some really interesting news that has developed over the the last week, something that we've been trying to follow which is who is leaker of the draft for that the roe v. wade decision or the draft can opinion that ended up overturning roe v. wade. talk to me about that and some of the latest developments with that. >> yeah. of so the court decided to handle this internally. they've got a supreme court marshal who oversees things of

this nature, internal investigations and security, that that a kind of thing. she put out her report essentially saying this is what we did, this is who we investigated, and we don't have any answers. they said we couldn't by a preponderance of the evidence lead to any if one person. that's a very low standard, it's basically saying something is more likely than not. so the fact that they couldn't even get to that threshold suggests they do not have any hard leads. they say the thing's going to stay open, and hale purr -- they'll pursue any new leads. they did not say whether the justices themselves had been questioned. she followed up on friday saying, yes, they had all been questioned, no leads that led to either them or their spouses, so that was a dead end. but the justices did not sign sworn affidavits, and i think everybody else who was interviewed did, so now people are saying it's not pair that justices are -- fair that justices are being treated differently. everybody is unhappy because you

don't have an answer. will: is it plausible in your mind, shannon, do you buy that they gave a sincere effort to find the leaker and were incapable of finding evidence? >> i do think they gave it a sincere try. the trick is though critics will say why didn't you bring in the doj or fbi so that people are immediately giving statements to federal agents where it's a crime to lie and there might be a heightened sense of obligation to do it. but the court says everybody we interviewed was willing to do it, they signed sworn affidavits, people turned over call and text the information, that didn't take us anywhere. but we always go back to the clerks. they could be completely innocent, but it's a logical place to look. they leave in july. they serve terms from, essentially, july to july. so once they've left and the clerks who were there were gone by then, the court doesn't have jurisdiction to get them to come back or get additional records from them. so that leaves a lot of

questions about those former clerks that have going to have to now have a little bit of a cloud of question about whether any of them were involved. rachel: but, shannon, what about the justices themselves? tell me if i'm correct, they did not have to sign affidavits, and it is possible that it could have been one of the justices. and maybe that's why we don't know, because that could cause a lot -- maybe in chief justice roberts' view -- could cause some, i guess, lack of -- the. will: disrepute on the count? rachel: yeah, exactly. is that a possibility? and why aren't we looking at that? >> i mean, anything could be a possibility, and that's the problem. and this is a headache for the chief justice because he chose to do it way. in the report he said we have full confidence in the marshal, but the last thing he wants anybody if to do is speculate about a justice being involved. but because we're almost a year out and we still don't know, it's going to leave plenty of room for speculation.

and you're right, they didn't sign a the sworn statements, but we're told they were interviewed some of them multiple times, and the marshal did not through this were -- think there were my leads with them or hair spouses. -- their spouses. pete: "fox news sunday," what have you got? >> we've got democrat josh gottheimer and republican fitzpatrick. they say they've got a plan on the debt ceiling, and we're hosting aing a conversation between one of the top pro-choice and top pro-life advocates as we hit the 50-year mark of roe. they've agreed to sit down at the table together, and we'll talk about it. will: 2 p.m. eastern time right here on the fox news channel. pete: thanks, shannon. >> bye, guys. pete: now to a few additional headlines starting with this, the family of lisa marie presley arriving in memphis ahead of her funeral later this morning. her daughter and mother were seen arriving yesterday.

last week least a saw marie unexpectedly died after suffering from cardiac arrest at the age of 54. she will be laid to rest at the graceland mansion in the mediation -- meditation, excuse me, garden, next to her son benjamin who died in 2020. the memorial service is scheduled the begin at 10 a.m. eastern. the federal government has reportedly seized nearly $700 million from disgraced ftx founder sam bankman fraud. that according to court filings that reveal around $525 million was taken from the platform robinhood, another $170 million was recovered in cash from several bank accounts. the funds are set to be held as the government proceeds with fraud and money land orerring charges against bankman-fried. and alec baldwin's wyoming, hilaria -- wife -- is taking heat on social media after once again using a spanish accent

parents. a new bill dubbed the students first act would allocate nearly $7600, that amount a right there on your screen, in assistance to families who decide to move hair child to a private school or who want to educate them themselves. governor kim reynolds has supported the idea since taking office, and she joins us now. governor, thank you very much for being here. from what i understand, these are educational savings accounts that really any parent, any family can access. so the dollars follow the kids. they stay at a public school, the dollars stay there. if they go to an alternative, they follow hem. is that right? >> that's right. first of all, pete, thank you for the opportunity to be on this morning. pete: of course, thank you. >> it goes to the floor tomorrow many both the house and the senate. it is a bold plan that gets us to universal school choice by the third year. so starting next year, any student -- any incoming kindergartener and any student

in public school will be eligible for $7600 if they choose to go to an accredited private school, and then next year we'll phase in the kids that are currently in a private school over next two years. so it'll be based on need. so the first year will be those families at 300% of the federal poverty the level, the following year it'll go to 400%, and the next year it's universal and all kids, all families if they make that choice, that money will follow them to an accredited private school. pete: interesting. just real quick, how about home school? does it follow if you home school your kids? >> it doesn't right now, but that's something we can looked at in the future. we want to get the system established. we do that in three years, i think it took arizona eight to get there, so that continues to be on table. but we want to get this across the finish line. i'm all in. i'm i focused on that in the campaign. all of our candidates that ran in the primary election that made school choice a priority won. we had a red wave in iowa.

we don't talk about it often, but not only do we have a supermajority in the senate, but we increased the numbers in the house. i won by a significant margin. we flipped two statewides, and the parental choice was front and center. parents want school choice, students deserve it, and we're going to improve our educational system by putting students first and really funding students and not a system. pete: governor, i think this is fantastic. it's exactly where republicans should be, on the side of parents, on the side of choice. i'm sure your critics are coming a after you, the unions and others. they're going to say -- what's your response to them about why choice makes schools better for everybody? >> well, you know, at a time when equity is everything that we hear, it truly baffles me that those the that fight so hard for it are the same ones that are so strongly opposed to parental choice. and if i can't think of anything that's more equitable than

giving parents the choice in their child's education. i am all in on this. i've been working on for two years. iowans are in on this. it's the expectation. we're going to get it across finish line, or you know? it's going to make our educational system better overall, i truly believe that with all my heart. and it shouldn't be for just those families that have the resources and the income to make those decisions. pete: absolutely. >> every family, regardless of the money that they make, should have the opportunity to put their child in the best environment where they believe they can thrive and be everything that they can be whether it's faith-based or whether it's maybe a child that's been many trouble that needs more structure. that participant knows which is the best -- parent knows which is the best school. pete: absolutely. and it forces government schools to up their game to compete -- >> yes. pete: -- and make hem better in the process. >> it's a great thing. absolutely. pete: governor, keep us posted.

will: a fox news alert, ten people are dead, at least ten other hurt after a mass shooting took place in monterey park, california, last night. in the los angeles area. police say the suspect is still at large. the shooting taking place at a ballroom dance studio just before 10:30 p.m. local time. conditions of those injured range from stable to critical. police say the suspect is a

male, and no motive has been named at this time, but they're also investigating whether a second shooting at a different ballroom dance studio in the region is connected. an ms-13 gang member is arrested in maryland for the murder of an autistic 20-year-old woman. kayla hamilton was strangled to death in july, police only identified the suspect as an el salvadoran native and ms-13 gang member. he was arrested after investors matched his dna to that found at the crime scene. he's being held would want bail as he faces murder, robbery and rape charges. former house speaker nancy pelosi reportedly called police to perform an exorcism of her san francisco home after her husband paul was attacked last year. her daughter told new york times she thinks the attack weighed heavily on her soul. she even speculated her mom felt

rachel: i didn't even know that you said that. pete: aye seen that video so many times. anyway. rachel: back to our top story and it's a fox news alert, the doj is discovering even more classified items in president joe biden's wilmington home following a 1-hour search -- 12-hour search last week. pete: fox business host larry kudlow served under donald trump, and he joins us now. larry, thanks for being here. what do you make of this, another search with the lawyers in coordination, certainly contrast with the way donald trump was treated. >> yeah, it really did. thanks for having me. i'm many mourning over the giants -- i'm in mourning over the giants also, if that matters. [laughter] this is -- i know -- [laughter] don't smile, will. [laughter] so this is, i believe this is the fifth discovery, and i just want to say that from the

various reports i think it's a container of documents or -- can i'm sorry, it's six containers of documents. so we don't know all there is to know yet about this. i mean, i'm just looking at -- pete: that's a great point. it's different than six documents if it's six containers. rachel: or six items. pete: yeah, good point. >> that, that was the exact word, items. and so in these items, there are documents. and we'll have to sort that out. but i believe this is the fifth one, so the white house has been reporting to the press corps that hay found everything or there is -- they found everything or there is to find. this that's just not true. the idea that this is the an inadvertent mishandling is out the one doe -- window. i mean, it was nonsense to begin with. and what you have here is gross negligence when it comes to classified documents.

look, let me just walk this through. you retire from the white house whatever you do, so you're the vice president in this case, you could be the director of the nec, it doesn't matter. if you have any classified documents that you want to look at later on, let's say you're writing a book of memoirs or something like that, you have the security clearance, okay, that's fine. but, you know, you're carrying this stuff out in briefcases, and it goes to the national archives. that is the law. it doesn't go to office buildings, penn biden center, it doesn't go to home in wilmington, it doesn't go to any of those places. the first stop for all of it should be the martial archives -- national archives. and then if you have the security clearance and you want to go back and look at certain classified documents, etc., you do it at the archives where they'll have a skiff, or in other words if, a secure area,

or maybe conceivably some other secure area. but the routeing should go through the archives, and biden doesn't do -- didn't do that, and he knows he didn't do that. and what are those the documents doing in garages, in libraries, what are they doing in delaware, what are they doing in downtown washington? if nobody knows that. so gross negligence here and, unfortunately, the president on thursday or wednesday, i think it was, just keeps saying i don't regret anything. and he said there's no "there" there. well, i think if he wants to have any law-abiding responses here, he should think about regrets, and he should think about no "there are" will. he's made a big mistake, so he's got to be investigated for that mistake. the other point i want to make is quite unlike donald trump, biden's personal lawyers have been deeply involved in this. the fbi comes in with trump, you know, the mar-a-lago invasion, which was an incredible thing

for an ex-president. the fbi, i guess, finally has gone to the wilmington house, finally, took 'em long enough to go there. it was all done, you know, pre-preparatory, everybody was fine. i can see that because biden is the president. but still there were personal if lawyers there and white house counsel type lawyers are there. so there's so much we don't know. there's so much here that, you know, smacks of political interference. but you know what i mean? inadvertent, it's a great phrase, inadvertent mishandling? nonsense. that's now -- this is all over the place, and they're going to have to look elsewhere too. my guess is they're going to have to look at the beach house. i don't know if they have any other automobiles or corvettes or whatever that need to be looked in, but it all has to be looked in. rachel: yeah. we need to know what's in the documents as well, why were they there. you you know there's so many seedy connections between the

biden family, ukraine, china, russia. we don't know why these papers were taken out and what they're about, but joe biden told us before he was elected that he had nothing to do with hunter's business, and we now know that's not true. >> yeah. i mean, very important what you just said, i think, because we don't know the contents of these documents. now, we, frankly, may never know. i mean, this is a very tricky matter. are they, for example, going to sewnwall -- stonewall the house investigations by jim comer, right? well, we have a special counsel now and, you know, we'll talk to you, but we can't really tell you very much because we have our own internal processes. who were these personal lawyers? what kind of security clearance did he was of? we don't know that. -- did they have? for that matter, who were these
